Abstract

Tujuan penelitian ini adalah untuk melihat bagaimana transformasi perilaku konsumen berbelanja di pasar modern dan pasar online. Penelitian ini dilakukan dengan menggunakan metode penelitian kualitatif dengan pendekatan penelitian menggunakan field research (penelitian lapangan). Informan dalam penelitian ini adalah mahasiswa UIN Imam Bonjol Padang sebanyak 30 orang. Pemilihan informan menggunakan purposive sampling. Teknik pengumpulan data berupa wawancara dan dokumentasi dan teknik analisis data yang digunakan adalah reduksi data, penyajian data, dam penarikan kesimpulan. Hasil penelitian ini menunjukkan Transformasi perilaku konsumen muslim berbelanja di pasar online dan pasar modern. 1)Konsumen muslim berbelanja di pasar modern dan pasar online pada tahap pengenalan masalah tidak mengalami perubahan yang signifikan. 2)Transformasi perilaku konsumen muslim saat mencari informasi diperoleh secara lebih detail melalui internet seperti; media sosial, web browser, konten digital, youtube, maupun platform belanja online. 3)Transformasi perilaku konsumen muslim saat melakukan evaluasi alternatif terdapat pada kesadaran atas aturanaturan syari’ah dengan mempertimbangkan kehalalan produk, rasional dengan mempertimbangkan mashlahah dan nilai guna, dan tidak bolehnya perilaku idzraf dan tabzir. 4)Transformasi perilaku konsumen muslim saat melakukan keputusan pembelian terdapat pada saat melakukan pembayaran pada pasar modern dengan menggunkan dompet digital. 5)Transformasi perilaku konsumen muslim pada tahap pasca pembelian terdapat pada kemudahan konsumen melakukan review.

Abstract

In the hierarchy, Haqiqah has a higher position than Majaz, because Haqiqah is the principal while Majaz is the branch. Therefore, Majaz cannot be used as a basis for determining a law unless there is difficulty in using the Haqiqah, and in this case, instructions (qarinah) are needed that direct the use of Majaz. In the linguistic context, the word “an-nikâh” in Arabic has a hakiki meaning and a Majazi meaning. According to Imam Nawawi, linguistically, “nikâh” means joining. Sometimes, the word “nikâh” is used to refer to “marriage contract”, and sometimes it is also used to refer to “intercourse”. This research is a qualitative method that uses library research, in this study the data used is secondary data sourced from books and OJS-based scientific articles that are relevant to this discussion. Based on the discussion that the author has analyzed, it can be concluded that the explanation of the concept of marriage in Islam, especially those related to the word “nikah”, can be understood through the Haqiqah and Majaz approaches. According to ushul scholars and Arabic linguists, the Haqiqah of the word “nikah” is actually “watha”. However, according to the fuqaha, including the four madhhabs, the true Haqiqah of “nikah” is “akad”, although in its Majaz usage it refers to “watha”.

Abstract

This study aims to analyze how social media usage affects marital discord, focusing on the case of Decision Number 0064/Pdt.G/2021/PA.Adl at the Andoolo Religious Court. The research employs a normative juridical approach and qualitative methods, with primary data sourced from the court decision and supporting references from Islamic legal literature and related journals. The findings reveal that improper use of social media, such as excessive communication with third parties, can undermine trust and harmony within a household. Based on Article 39 Paragraph (2) of Law Number 1 of 1974, Article 19 letter (f) of Government Regulation Number 9 of 1975, and Article 116 letter (f) of the Compilation of Islamic Law (KHI), the Religious Court granted the divorce suit in this instance, citing continuous disputes with no hope of reconciliation. The judges also considered the Islamic principle that preventing harm takes precedence over pursuing benefit. This study emphasizes the value of digital literacy as a safeguard against family disputes brought on by social media use.

Abstract

This study aims to analyze the legal considerations of the Panel of Judges in granting the application for child origin at the Talu Religious Court in Determination Number 355/Pdt.P/2021/PA.Talu, and how these considerations are viewed from the maqashid sharia perspective. The research method used is normative juridical with a qualitative approach, where data is obtained through literature study and analyzed descriptively. The results showed that the Panel of Judges decided to accept/grant the petition after considering the evidence submitted, including testimonies and supporting documents regarding the applicants' siri marriage and household conditions. The decision was in accordance with maqashid sharia, which emphasizes the importance of preserving offspring (hifz al-nasl) and eliminating harms, especially in relation to obtaining legal documents to guarantee children's civil rights, such as nasab and inheritance rights.

Abstract

This research aims to analyze the role of the Sharia Supervisory Board (DPS) in sharia compliance at sharia fintech institutions in Indonesia and identify the problems that occur. This research uses a library study method with a secondary data analysis approach from various sources such as articles, journals and previous research. The research results show that DPS has a significant role in ensuring sharia compliance through periodic supervision, implementation of DSN-MUI fatwas, and product and service development. However, various challenges were found such as weak special supervision mechanisms for sharia fintech and non-compliance with sharia principles in several institutions such as Investree, Dana Syariah, Peer to Peer Lending Syariah. This research recommends increasing DPS capacity, strengthening regulations, and better collaboration between DPS and relevant authorities to minimize sharia violations in the fintech sector. Thus, this research contributes to strengthening the sharia supervision system and supports the sustainable growth of sharia fintech.

Abstract

This research aims to analyze Istihsan qiyas Khafi al-Bazdawi as indicated in contemporary fatwas in Indonesia. What is the concept of Istihsan qiyas khafi al-Bazdawi, and how is it relevant to contemporary fatwas in Indonesia? The research method used is descriptive analysis with a literature study approach sourced from journals, websites, books by al-Bazdawi and his lecturers. The results of the research show that Istihsan qiyas khafi al-Bazdawi is a process of intifa' (taking benefits) on a legal object by using qiyas/illat (legal reasons) khafi (hidden) by removing qiyas/illat jali (real reasons in law), and Istihsan Khafi al-Bazdawi's qiyas are considered relevant to a number of contemporary fatwas of the Indonesian Ulema Council (MUI), including: 1) the prosperity of cash waqf Sukuk, 2) the ease of Sukuk Mudharabah, Murabahah, Musyarakah, 3) the ease of Sweb when fasting, 4) the ease of Vaccine injection while fasting

Abstract

An analysis of marriage validation (itsbat nikah) decisions by religious courts concerning the appointment of wali muhakkam for female converts (muallaf) in Muslim minority regions reveals that the process involves complex legal, social, and cultural considerations. These rulings not only focus on the formal legality of the marriage but also take into account the long-term implications for children born of the union and the alignment with the prevailing national legal system. This study aims to describe and analyze judges’ considerations regarding legal facts in the marriage of female converts using wali muhakkam, to explore the legal construction applied by judges in legitimizing the use of wali muhakkam, and to examine the arguments formulated by judges in validating such marriages. This research is categorized as a library study employing a normative juridical method with a statutory approach. Data sources are derived from established legal theories and documented judicial practices. The findings indicate that judges formulate legal arguments based on both Islamic legal principles and national law to validate the marriage of female converts conducted with a wali muhakkam. These rulings reflect the harmonization of religious values and state law, thereby ensuring justice, welfare, and legal certainty for all involved parties.

Abstract

The stratification of al-maqashid al-khamsah (preserving religion, soul, reason, offspring and property) and its application in al-dharuriyah, al-hajiyah, al-tahsiniyah and al-mukammilat is a study that elaborates the implementation of the objectives of sharia in order to bring benefit and reject the glory of human life. The research method used is library research which is presented in descriptive form from literature that discusses al-maqashid al-khamsah then analyzed. The findings of this study are; The importance of al-maqashid al-khamsah maqashid al-khamsah is the purpose of shari'a to preserve (maintain) the five elements that must exist for the realization of the benefit (al-maslahat) of religion and the world. If this does not exist, it will cause damage (al-mafsadat) and even loss of life and life. There are differences in the opinion of scholars in placing the order of al-maqashid al-khamsah but what is popularly used is the opinion of al-Ghazali, namely hifzh al-din, hifzh al-nafs, hifzh al-'aql, hifzh nasl and hifzh mal. The main objective of sharia is to protect man from harm in five things maqashid al-khamsah safeguarding religion, soul, reason, offspring and property grouped into four strata namely primary needs (al-dharuriyat), secondary (al-hajiyat), complementary (al-tahsiniyat), and perfecter or complement (al-mukammilat)

Abstract

Kajian ini mengangkat tema ta’arudh al-adillah yang terdapat di dalam permasalahan hukum keluarga. Dalam hal ini, ulama Syafi’iyyah dan Hanafiyyah memiliki metode yang berbeda dalam menyelesaikan ta’arudh al-adillah. Tujuan penelitian adalah mengetahui bentuk perbedaan metode ulama Syafi’iyyah dan Hanafiyyah dalam menyelesaikan ta’arudh al-adillah pada permasalahan hukum keluarga. Penelitian ini menggunakan sumber data sekunder seperti buku-buku dan karya ilmiyah yang relevan dengan pembahasan ini.  Data yang terkumpul dianalisis dengan metode analisis deduktif. Hasil utama kajian ini adalah bahwa ulama Syafi’iyyah dan Hanafiyyah berbeda pendapat dalam menerapkan urutan metode penyelesaian  ta’arudh al-adillah,  perbedaan dalam menerapkan urutan metode ini terkadang menghasilkan hukum yang berbeda dan terkadang menghasilkan hukum yang sama. Namun urutan metode yang digunakan oleh ulama Syafi’iyyah lebih kuat dibanding urutan metode ulama Hanafiyyah dalam menyelesaikan ta’arudh al-adillah. Hal ini terlihat di dalam penyelesaian ta’arudh al-adillah pada permasalahan hukum keluarga.

Abstract

This article aims to describe the impact of legal dualism within the Ottoman Empire. After Constantinople was taken over, Sultan Muhammad Al-Fatih instituted a significant policy, including issuing laws and regulations for the benefit of society; then, there was also a dualism system within the Ottoman Empire, which was visible during the reign of Sultan Sulaiman I. During this time, foreign nationals were mainly recruited, and foreign traders began to gain impunity at the peak of power. This then prompted several questions, such as were the sultans free to create the laws they wanted, or was Islamic law still binding on them? Was Sultan's law an innovation from the Ottoman Empire or a legacy from the preceding dynasty in the form of Capitulation? To address those issues, the authors conducted a comparative historical analysis of various types of literature. We used a descriptive qualitative approach to Qānūn's position, which served as a springboard for foreign intervention in an Empire that was strong but weak in political policies which occasionally strayed outside the corridor of Islamic Sharia which had become customary and national culture. The tolerance separated from the corridors of Islam derailed during the crisis. This became a springboard for legal dualism in a state body with integrity in various dimensions.Keywords: Sultan's Law, Sharia, Judiciary,  Ottoman
