Abstract

 Abstract: The form and function of political party in various countries are different from one each in accordance with the system of politics which is applied in the country was. One of the functions of party politics is educate in education politics to the public, will be but the fact that occur at the time of this study politics are carried out by party politics are conducted only on past campaigns ahead of the election, namely the education of voters in terms of elections and the vision of the mission of the parties, regard this indicates that the education politics are conducted directed tho choose the party. In Islam party called Hizbu wich aims for is to help a muslim as an individual in carrying out is obligations to God, amar ma?ruf and forbis the evil, and to realize the leadership for the people of Islam in the entire word. From here seen clearly that, in education must exist an educator who always give instructions, guiding steer, encourage and educate humans to the goodness. And even an educator has the obligation to amar ma?ruf and forbidding evil, which became the principial importance of the main points of religion.Keywords: political education; party; politics.

Abstract

Navigating the intersection of religious doctrines and legislative frameworks poses a significant challenge in the abortion discourse, particularly in Indonesia. This study investigates the legitimacy of abortion through the dual perspectives of Islamic jurisprudence and positive law within Indonesia’s intricate socio-cultural and religious milieu, where Islamic principles deeply influence legal interpretations and societal views. The study aims to dissect the complex legal and religious debates surrounding abortion in Indonesia, offering a thorough analysis of its legitimacy under both Islamic jurisprudence and state law. Current literature reveals a fragmented legal landscape marked by diverse interpretations and applications of Islamic principles and state laws, resulting in inconsistent legal outcomes. Adopting a qualitative methodology, this research utilizes doctrinal analysis of primary and secondary legal sources, statutory laws, judicial decisions, and Islamic legal texts. Findings highlight a stark dichotomy between strict prohibitions in traditional Islamic jurisprudence and more lenient, context-specific interpretations by contemporary scholars. The Indonesian legal system, heavily influenced by Islamic values, nonetheless displays flexibility in cases involving maternal health risks or severe fetal anomalies. Ultimately, this study advocates for a nuanced, context-sensitive legal framework that harmonizes Islamic jurisprudence with positive law. It proposes a balanced approach that respects religious values while addressing modern societal needs and medical realities, aiming to ensure legal clarity and safeguard women’s rights in Indonesia.

Abstract

This article examines the mechanisms of inheritance resolution in cases of different religions in several regions of Indonesia, namely North Sumatera, Central Java, Bengkulu, and East Java, focusing on integrating customary law, religious law, and state law in inheritance distribution. This research employs a descriptive qualitative approach with a case study method, where data is gathered through interviews, observations, and literature reviews on the practice of inheritance among families with different religions. The findings reveal that family deliberation remains the primary principle in resolving inheritance disputes despite the religious differences among heirs. Social and cultural values such as kinship, mutual assistance, and interfaith tolerance play a significant role in the inheritance process, with each region having its own ways of accommodating religious differences within families. The legal pluralism approach, which combines customary law, religious law, and state law, forms the foundation for developing a fair and inclusive national inheritance law. This article suggests strengthening the principle of deliberation, creating an adaptive legal unification, and formulating inclusive regulations for interfaith inheritance rights to create a harmonious and just inheritance system that aligns with the spirit of Indonesia's cultural diversity. AbstrakArtikel ini mengkaji mekanisme penyelesaian waris beda agama di beberapa wilayah di Indonesia, yaitu Sumatera Utara, Jawa Tengah, Bengkulu, dan Jawa Timur, dengan fokus pada integrasi hukum adat, agama, dan negara dalam pembagian warisan. Penelitian ini menggunakan pendekatan kualitatif deskriptif dengan metode studi kasus, di mana data diperoleh melalui wawancara, observasi, dan kajian literatur mengenai praktik waris beda agama dalam masyarakat. Hasil penelitian menunjukkan bahwa meskipun terdapat perbedaan agama di antara ahli waris, musyawarah keluarga menjadi prinsip utama dalam penyelesaian sengketa waris. Nilai sosial dan budaya seperti kekeluargaan, gotong royong, dan toleransi antaragama berperan penting dalam proses pembagian warisan, dengan setiap daerah memiliki cara-cara tersendiri dalam mengakomodasi perbedaan agama dalam keluarga. Pendekatan pluralisme hukum yang memadukan hukum adat, agama, dan negara menjadi landasan dalam pengembangan hukum waris nasional yang adil dan inklusif. Artikel ini menyarankan penguatan prinsip musyawarah, unifikasi hukum yang adaptif, serta penyusunan aturan inklusif untuk hak waris lintas agama, guna menciptakan sistem kewarisan yang harmonis dan adil sesuai dengan semangat keragaman budaya Indonesia.
