Abstract

Diskusi Poligami yang selalu menarik untuk dibahas oleh pemerhati perempuan yang merasa prihatin kepada para wanita yang diperlakukan tidak manusiawi dalam tanda kutip, maupun oleh para laki-laki yang merasa bahwa perlakuan poligami sebenarnya prilaku keadailan yang dibolehka oleh Islam dalam rangka mengakomodir para wanita yang ingin mempunyai pasangan tapi belum ada pasangannya. Toleransi Islam atas poligami sering kali disalah gunakan oleh para laki-laki dengan mengatas namakan sunnah rasul, yang difahami hukumnya sunnah, bahkan tidak sedikit prilaku laki-laki baik yang shaleh hubungan dengan Tuhan tapi hobi mengancam dan menakut nakuti istrinya dengan menambah daya (poligami) apabila seorang istri tersebut tidak mengikuti kehendaknya, karena kelelahan atau ada masalah yang lain yang belum bisa melayani suaminya. Dari fenomena yang terjadi di masyarakat inilah penulis ingin menegaskan kembali hukum poligami dengan menyuguhkan ayat-ayat poligami dan beberapa hadis yang terakait dengan poliagami dalam perspektif ushul fiqh yang akan ditinjau adalah ayat poligami yang meliputi shigat amar dan implikasi hukumnya dan ta’arud al adillah dalam ayat poligami yang berkaitan dengan syarat adil bagi pelaku poligami terhadap istri-istrinya.

Abstract

"Tuhan” pada umumnya dipakai untuk merujuk kepada suatu zat abadi dan supranatural. Bagi rumpun agama samawi, kata Tuhan sendiri biasanya mengacu pada Allah, yang diyakini sebagai zat yang Maha sempurna, pemilik langit dan bumi yang disembah manusia. Dalam bahasa Arab kata ini sepadan dengan kata rabb. Menurut Ibnu Atsir, Tuhan dan tuan secara bahasa diartikan pemilik, penguasa, pengatur, pembina, pengurus dan pemberi nikmat. Kata Allah saja dalam dalam Al-Qur’an disebut 2697 kali, sedangkan kata Rabb (Rabb, Rabbi, Rabbuna, rabbukum dan Rabbuhu) sebanayak 839 kali,sedangkan kata Ilah (Ilahun, Ilahi, Ilahuna Ilahukum Alihatun, Alihati, Alihihatuna Alihatukum) ada 147 kali. Belum lagi semacam kata Wahid, Ahad,  atau kalimat yang menafi kan ada sekutu baginyna baik dalam perbuatan atau wewenang menetapkan hukum atau kewajaran beribadah kepada selain-Nya atau penjelasan lain yang semuanya mengarah penjelasan tentang tauhid. Tuhan dan fi trah adalah dua kata yang tidak bisa dipisahkan karena  fi trah itu  adalah  asal kejadian, kembali ke asal, bahkan dikatakan juga artinya Tuhan, manusia itu pada dasarnya memang ada unsur Tuhan maka di mana pun dia berada ia tidak akan bisa lepas dengan Allah.

Abstract

This study aims to determine the legal provisions of boycotting Israeli products in the perspective of Ijtihad Nahdhatul Ulama and Muhammadiyah. The method used is a descriptive-analytical method with a qualitative approach. The source of this research data comes from litelature studies. Data analysis is carried out through the process of inventory, classification, and data analysis. The results of this study are: 1) the boycott law of Israeli products in the concept of ijtihad NU is mandatory if it is believed and known that profits from the sale of such products by Israel are used to help launch attacks against Palestinians. However, if it is not believed and it is not known for certain that the profits obtained from the sale of these products are to help fight the Palestinians, then buying Israeli products is not obligatory but makhruh because in a war situation that allows the use of profits for war; 2) In the concept of Muhammadiyah ijtihad, boycotting Israeli products becomes fardhu 'ain for Palestinians and fardhu kifayah for Muslims in other countries. Likewise, the law of boycotting products from branch companies and parties that clearly support Israel is mandatory, while boycotting products from local shops and hawkers is discouraged because it results in greater madharat. So that compliance with the MUI Fatwa related to boycotting Israeli products must be adjusted to the situation and conditions.

Abstract

This project is one of the programs of the Real Work Lecture of Islamic University Students. Fatmawati Sukarno State University (UINFAS) Bengkulu Group 97 in Lubuk Sahung Village. The program. This program is designed to commemorate Islamic holidays, besides that this program is also expected to increase the religious value of the community in Lubuk Sahung Village. Religious values to the community in Lubuk Sahung Village, and also strengthen the relationship between the community. Among the community. Methods methods used included an initial survey to identify how the culture and habits of the community in Lubuk Sahung village, the preparation of an activity plan, and the participation of the local community. participation of the local community. The expected result is the creation of close friendship that is able to increase the value of togetherness and also community's awareness of the Islamic New Year's holiday, which coincides on the 1st of Muharram.

Abstract

This article examines the mechanisms of inheritance resolution in cases of different religions in several regions of Indonesia, namely North Sumatera, Central Java, Bengkulu, and East Java, focusing on integrating customary law, religious law, and state law in inheritance distribution. This research employs a descriptive qualitative approach with a case study method, where data is gathered through interviews, observations, and literature reviews on the practice of inheritance among families with different religions. The findings reveal that family deliberation remains the primary principle in resolving inheritance disputes despite the religious differences among heirs. Social and cultural values such as kinship, mutual assistance, and interfaith tolerance play a significant role in the inheritance process, with each region having its own ways of accommodating religious differences within families. The legal pluralism approach, which combines customary law, religious law, and state law, forms the foundation for developing a fair and inclusive national inheritance law. This article suggests strengthening the principle of deliberation, creating an adaptive legal unification, and formulating inclusive regulations for interfaith inheritance rights to create a harmonious and just inheritance system that aligns with the spirit of Indonesia's cultural diversity. AbstrakArtikel ini mengkaji mekanisme penyelesaian waris beda agama di beberapa wilayah di Indonesia, yaitu Sumatera Utara, Jawa Tengah, Bengkulu, dan Jawa Timur, dengan fokus pada integrasi hukum adat, agama, dan negara dalam pembagian warisan. Penelitian ini menggunakan pendekatan kualitatif deskriptif dengan metode studi kasus, di mana data diperoleh melalui wawancara, observasi, dan kajian literatur mengenai praktik waris beda agama dalam masyarakat. Hasil penelitian menunjukkan bahwa meskipun terdapat perbedaan agama di antara ahli waris, musyawarah keluarga menjadi prinsip utama dalam penyelesaian sengketa waris. Nilai sosial dan budaya seperti kekeluargaan, gotong royong, dan toleransi antaragama berperan penting dalam proses pembagian warisan, dengan setiap daerah memiliki cara-cara tersendiri dalam mengakomodasi perbedaan agama dalam keluarga. Pendekatan pluralisme hukum yang memadukan hukum adat, agama, dan negara menjadi landasan dalam pengembangan hukum waris nasional yang adil dan inklusif. Artikel ini menyarankan penguatan prinsip musyawarah, unifikasi hukum yang adaptif, serta penyusunan aturan inklusif untuk hak waris lintas agama, guna menciptakan sistem kewarisan yang harmonis dan adil sesuai dengan semangat keragaman budaya Indonesia.

Abstract

The community in Bukit Peninjauan I, Sukaraja District, faces challenges related to low participation in religious activities, limited financial literacy, and inadequate child education programs. This community service program, conducted under the mosque-based framework, aims to enhance the quality of life through a series of religious, educational, and social initiatives. The activities include Islamic New Year and National Children's Day celebrations, regular mosque cleaning, health and financial literacy campaigns, and educational outreach. The participatory approach involved collaboration with local residents, religious leaders, and educators. Data collection methods included observation, interviews, and documentation, analyzed through qualitative techniques. The findings indicate increased community engagement, improved financial literacy, and heightened environmental awareness. The program's success underscores the potential of mosque-based initiatives in driving holistic community development and addressing rural challenges. This study concludes that mosque-centered programs effectively foster community resilience and social cohesion in rural settings.

Abstract

Abstrak Fenomena childfree yang semakin marak terjadi hingga kini masih memancing pro dan kontra. Beberapa Ulama Nusantara menentangnya dengan keras namun justru Dar al-Ifta’ Mesir –sebagai lembaga fatwa yang sering menjadi rujukan internasional– memperbolehkannya. Maka penelitian ini bertujuan untuk meninjau argumen dan pandangan yang diberikan; seperti bagaimana proses pembolehan tersebut dijelaskan dalam fatwa yang dikeluarkan, kemudian juga disertai analisis penulis untuk mengetahui nilai-nilai Maqashid Syariah yang terkandung di dalamnya. Jenis penelitian ini merupakan penelitian kepustakaan yang bersifat deskriptif kualitatif. Hasil dari penelitian ini adalah, pembolehan perkawinan childfree berlaku hanya untuk personal dan atas kesepakatan suami-istri berdua yang berlandaskan kemaslahatan bersama. Pembolehan tersebut diqiyaskan dengan pembolehan ‘azl. Meski demikian, memiliki anak tetaplah menjadi anjuran utama berdasarkan banyaknya dalil yang mendukung. Adapun nilai Maqashid Syariah yang terkandung di dalam fatwa ialah adanya aspek al-kulliiyyat al-khamsah yang ditelisik dari faktor/alasan yang mendasari keputusan untuk childfree tersebut, yaitu: hifz an-nafs, an-nasl, dan al-mal. Sedangkan tanggapan dari penulis bahwa pembolehan childfree tersebut cukup dimaknai sebagai rukhsah bagi yang memiliki uzur syar’i, bukan dijadikan dalih/pembenaran dengan alasan pribadi. Sehingga pasangan yang tidak memiliki alasan dharuriy tidak diperbolehkan untuk childfree. Kata Kunci: Childfree, Maqashid Syariah, Dar al-Ifta’ Mesir

Abstract

This research was conducted by students of KKN MBKM Group 1 Batch IV 2025, Fatmawati Sukarno Bengkulu State Islamic University with a focus on integrated assistance to elderly teenagers for a prosperous society. The aim is to determine the effectiveness of integrated assistance for elderly teenagers in improving community welfare in RT 19 Karang Indah, Sumur Dewa Village, Bengkulu City. This research method uses a participatory and collaborative approach between teenagers and the elderly in carrying out mentoring activities. The research results show that integrated assistance to elderly teenagers can improve community welfare by increasing the active participation of teenagers and elderly people in social and economic activities. This research also shows that cooperation between teenagers and the elderly can strengthen intergenerational relationships and increase public awareness about the importance of shared prosperity

Abstract

The problem of joint property disputes after divorce in the jurisdiction of the Bengkulu Religious high courts, in the period 2010 to 2015 all decisions are always made up of half of the property of the ex-wife and the other half of the property of the ex-husband, regardless of who is more dominant in working to produce the property. This is based on article 97 of the Islamic Law Compilation. According to the authors the decisions did not fulfill a sense of justice, with regard to wives who participated in working for a living. The judges of the first level Religion Court in Bengkulu did not consider the role of the wife working for a living; which incidentally is the husband's obligation. How does the Maqāsid asy-Syarī'ah review the Bengkulu judges' consideration of joint property in the case of a wife participating in earning a living in the jurisdiction of the Bengkulu’s Religious high courts? and What are the implications of the judge's decision in the jurisdiction of the Bengkulu’s Religious high courts regarding joint property in the case of the wife participating in earning a living in the context of Islamic family law reform in Indonesia? The conclusions of this research are: Judges' considerations on decisions regarding joint assets in the case of wives participating in earning a living in the jurisdiction of the Bengkulu Religious high courts were not in accordance with Maqāsid asy-Syarī'ah, because the judge did not consider the position of his ex-wife who continued to work for a living besides running obligation to take care of the household. The judge's decision regarding joint property in the case of his wife helped earn a living in the jurisdiction of the Bengkulu Religious high courts in the context of reforming the Islamic Family Law in Indonesia, the judge must be progressive. The ex-wife who helped make a living should get a share of the joint property that is greater than the ex-husband. The ex-wife's portion was formulated peacefully and deliberately between the parties.

Abstract

This paper specifically discusses about religious differences as one of the barriers in inheritance. A Muslim does not inherit an infidel (kâfir), and conversely they also do not inherit a Muslim. Can a Muslim child inherit his infidel parents? In order to analyze this problem the author uses maqāsid syarī'ah review, where the law is determined for the benefit. This research concludes that it is permissible for a Muslim child to inherit his infidel parents, which is included in hifz al-dīn (maintaining religion) at the darūriyat level. This is because when a Muslim child is prohibited from inheriting his infidel parents, it is feared that his faith will waver, due to property problems. In the case of hifz al-māl, the hājiyat position, if a Muslim is prohibited from inheriting non-Muslim property, it means that any property that should be used for the benefit of the ummah will be lost.
