Abstract

Scholars from many fields have written about happiness and how to achieve it. But this is still an exciting topic, because happiness is one of the most important things people need. This article aimed to examine the significant of happiness for every Muslim in the light of al-Ghazali’s thought through his book al-Chemy of Happiness. The article employs the qualitative approach by using the content analysis method to explore the ideas of al-Ghazali on happiness, its element and its significance for Muslims' lives. The result shows that Ghazali's thoughts on happiness enlighten the Muslims to step on to live happily and be full of salvation. More than that, it becomes one of the psycho-spiritual methods that Muslim and global communities can utilize to live better in the world and hereafter.

Abstract

Giving to a person either in the form of compulsory alms (zakat) or ordinary alms already has a designated recipient or musthiq. This research elaborates on the law of almsgiving to thieves, adulterers and the rich. The research used is a review of literature through the takhrij al-hadith method both in terms of the quality of sanad and matan. The result of his research is that almsgiving to thieves, adulterers and the rich can be viewed from the side of maslahat, the highlighted object is the recipient not the one who gives alms. In this case almsgiving becomes a will away from forbidden deeds according to the rules of fiqh li al-wasail hukmu al-maqasid (the law of intermediary depends on its purpose). Almsgiving can be a testament and the media prevents the sipencuri from stealing, prevents the adulterer from committing adultery and gives motivation to the sikaya to immediately issue his zakat or alms.

Abstract

Penelitian ini bertujuan untuk menganalisis praktik roasting dalam perspektif hukum Islam melalui studi hadis Nabi SAW dan evaluasi aplikasinya di era kontemporer, yaitu dengan cara memahami pandangan Islam tentang roasting, batasan humor dan penghinaan dalam hadis, serta penerapan prinsip syariah dalam konteks modern. Menggunakan metode kualitatif dan analisis teks, penelitian ini memanfaatkan hadis-hadis relevan serta pandangan ulama klasik dan kontemporer. Analisis kasus berkaitan dengan kasus roasting juga dilakukan untuk melihat penerapan prinsip-prinsip syariah. Penelitian ini mengisi kekosongan literatur mengenai roasting dalam Islam dengan memberikan analisis mendalam dan perspektif baru tentang humor yang diperbolehkan dan penghinaan yang dilarang. Hasilnya menunjukkan bahwa Islam membolehkan humor selama ia tidak mengandung unsur penghinaan atau merendahkan martabat orang lain. Hadis-hadis yang dikaji menunjukkan adanya batasan jelas antara humor yang sehat dan yang berpotensi merusak hubungan sosial. Selain itu, penelitian ini mendapatkan bahwa masih ada praktik roasting saat ini yang melanggar batasan-batasan syariah, dan sering kali berujung pada penghinaan.

Abstract

This study investigates the Tabot Festival in Bengkulu Indonesia focusing on its cultural, religious and sosioeconomic impacts, with the aim of demonstrating how local traditions can both preserve cultural heritage and empower the community economically. The study involves examining the festival's transition from a Shiite religious ceremony commemorating Imam Husein bin Ali’s martyrdom, to a broader cultural celebration that attracts significant tourism. Employing a qualitative ethnographic method, data were analyzed through extensive literature reviews. The findings reveal that the festival retains its deep cultural and religious roots, reflecting humanitarian and Islamic values such as courage, sacrifice and justice through its rituals and processions. Despite its evolution into a lively cultural event, the festival continues to uphold significant Islamic traditions and symbols. Economically, the Tabot Festival provides substantial benefits to the local economy, boosting sectors such as hospitality, restaurants and transportation. It also creates a multiplier effect by stimulating the creative economy and generating temporary employment opportunities for vendors, artisans and service providers. The local community's active participation further strengthens social cohesion and economic welfare.

Abstract

The article addresses the various challenges that waqf (Islamic endowment) law faces in Indonesia. It specifically investigates how the application of Qawā'id Fiqhiyyah (principles of Islamic jurisprudence) can enhance waqf law considering obstacles such as public ignorance about waqf, inadequate legal frameworks, and the necessity for effective management strategies to improve the productivity of waqf assets. The aim of this research is to analyze how Qawā’id Fiqhiyyah can provide foundational support to enhance Waqf law, proposing viable solutions to existing issues. The novelty of this research lies in its integrative approach, which combines traditional Islamic legal principles with the contemporary challenges of waqf management. By focusing on Qawā'id Fiqhiyyah, the study proposes a framework that not only addresses legal and administrative issues but also highlights the cultural and social dimensions of waqf in Indonesia, an area that has not been extensively explored in existing literature. . The results of the research suggest that the application of Qawā'id Fiqhiyyah can provide practical solutions to the identified challenges in waqf law. The study outlines several strategies, including enhancing public education about waqf, improving legal frameworks, and fostering collaboration among various stakeholders such as government bodies, religious organizations, and the community. These strategies aim to create a more effective and sustainable waqf system in Indonesia, ultimately leading to increased productivity and a greater social impact of waqf assets

Abstract

This article examines Ibn Taymiyya's vision of governance, spotlighting the concepts of public interest (mas{lahah) and prosperity (falâh) within the Islamic law (sharî’a) framework. The increasing importance of Islamic governance in contemporary political discussions, particularly in Muslim-majority societies striving to harmonize tradition with modernity, underscores the relevance of this inquiry. The primary aim is to synthesize existing scholarship on Ibn Taymiyya's contributions to statecraft and its ethical dimensions, elucidating how his principles can guide contemporary governance. The literature reveals a diverse yet fragmented landscape, encompassing historical analysis, theological discourse, and socio-political critiques, reflecting a burgeoning interest in the intersection of Islamic jurisprudence and governance models. This study employs qualitative analysis of both primary texts and contemporary interpretations, creating a nuanced overview of Ibn Taymiyya's political thought. The results indicate that he champions a governance model that prioritizes community welfare, grounded in ethical accountability and justice. His vision emphasizes the alignment of state policies with principles of justice and public interest, asserting that adherence to Islamic values is essential for achieving prosperity. In conclusion, this study contends that Ibn Taymiyya’s insights are relevant and crucial for modern statecraft, providing a robust framework for embedding ethical considerations into governance.

Abstract

Navigating the intersection of religious doctrines and legislative frameworks poses a significant challenge in the abortion discourse, particularly in Indonesia. This study investigates the legitimacy of abortion through the dual perspectives of Islamic jurisprudence and positive law within Indonesia’s intricate socio-cultural and religious milieu, where Islamic principles deeply influence legal interpretations and societal views. The study aims to dissect the complex legal and religious debates surrounding abortion in Indonesia, offering a thorough analysis of its legitimacy under both Islamic jurisprudence and state law. Current literature reveals a fragmented legal landscape marked by diverse interpretations and applications of Islamic principles and state laws, resulting in inconsistent legal outcomes. Adopting a qualitative methodology, this research utilizes doctrinal analysis of primary and secondary legal sources, statutory laws, judicial decisions, and Islamic legal texts. Findings highlight a stark dichotomy between strict prohibitions in traditional Islamic jurisprudence and more lenient, context-specific interpretations by contemporary scholars. The Indonesian legal system, heavily influenced by Islamic values, nonetheless displays flexibility in cases involving maternal health risks or severe fetal anomalies. Ultimately, this study advocates for a nuanced, context-sensitive legal framework that harmonizes Islamic jurisprudence with positive law. It proposes a balanced approach that respects religious values while addressing modern societal needs and medical realities, aiming to ensure legal clarity and safeguard women’s rights in Indonesia.

Abstract

The study of Qawā’id Fiqhiyyah or Islamic legal maxims, plays a crucial role in contemporary legal analysis and application within Indonesian Islamic jurisprudence. This research explores the brief historical evolution and modern utilization of these legal maxims, emphasizing their significance in shaping legal outcomes in Indonesia's dynamic socio-religious landscape. The study aims to shed light on how Qawā’id Fiqhiyyah has been adapted and integrated into the Indonesian legal system, providing a framework for resolving complex legal issues in a manner consistent with Islamic principles. This research examines the evolution of Qawā’id Fiqhiyyah (Islamic legal maxims), exploring their foundational roots in classical Islamic jurisprudence and analyzing their adaptation and relevance in contemporary Indonesian legal and societal contexts. It highlights how these maxims have provided a bridge between traditional Islamic law and the modern legal challenges faced by a diverse Muslim population. The research method employed includes a qualitative analysis of legal texts and case studies, offering a comprehensive overview of the practical application of these maxims. The results reveal that Qawā’id Fiqhiyyah has been instrumental in providing clarity and consistency in legal reasoning, contributing to a more coherent and adaptable legal system. Abstract

Notwithstanding the fact that Indonesia has the world’s largest Muslim population, zakat collection through formal institutions is substantially below expectations. In light of this shortfall, this study investigates the interplay between religiosity and social capital on individual preferences for zakat payments and the proportion allocated to official zakat agencies, with the overarching aim of contextualizing the fiqh zakat framework in contemporary Indonesia. Drawing upon the data from a nationwide survey of 794 respondents, the empirical analysis employs Linear Probability Model (LPM) and Poisson Pseudo Maximum Likelihood (PPML) regression techniques to examine the determinants of zakat payment behaviour. Findings reveal that social capital significantly increases both the likelihood of choosing zakat institutions and the portion of zakat paid through them. In contrast, religiosity shows a weaker direct effect on institutional zakat payment. Taken together, these results highlight the pivotal role of social networks and trust in enhancing institutional zakat collection. Therefore, the study advocates for a strategic reform of fiqh zakat practices that integrate social capital strategies to reinforce religiosity and improve zakat compliance through formal channels.

Abstract

An agreement is an act by which one or more people bind themselves to one or more people in implementing a cooperation agreement for securing vital objects between the Bengkulu Police and Bank Bengkulu, whether the agreement is valid as per Article 1320 of the Civil Code and has been implemented by both parties, the obstacles faced in implementing the cooperation agreement, and the resolution of the dispute if a breach of contract occurs. In the cooperation agreement for securing vital objects between the Bengkulu Police and Bank Bengkulu, it has been implemented by both parties in accordance with the contents of the agreement containing the rights and obligations of the parties, as well as the fulfillment of the valid conditions of the agreement, both subjective and objective conditions, in accordance with Article 1320 of the Civil Code. The obstacles faced in implementing the cooperation agreement are from the underutilization of security facilities such as CCTV, external obstacles, namely the large number of customers at the beginning of the month which causes the security personnel to be overwhelmed. In the agreement, if one party causes a breach of contract due to the agreement, it can be resolved in a non-litigation manner, namely mediation and deliberation, but if it is unsuccessful, the court will take the form of.
