Abstract

The unlimited use of Information Technology (IT) has made cybercrime accessible to everyone. Technology can be very useful for daily needs, but on the other hand it can also be used irresponsibly by certain parties such as the distribution of pornographic content. The purpose of this article is to find out the regulations regarding pornography in Indonesia, to analyze the spreaders of pornographic content based on Indonesian positive law and to analyze the penalties for spreading pornographic content based on positive law in Indonesia. This research uses ‘doctrinal legal research’. Sources of legal information use primary legal materials (regulations and relevant documents) for further qualitative analysis. The approach used is ‘statutory and conceptual’ to help solve the problem in this research. The results showed that law enforcement officials such as the police and prosecutors prefer to use Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions and Law Number 44 of 2008 concerning Pornography to ensnare perpetrators. spreading pornographic content on the Internet which is considered more obvious and appropriate to be used as a legal basis to ensnare  spreaders of pornographic content on the internet. Perpetrators can be sentenced to punishment is imprisonment and/or a fine as regulated in the law.

Abstract

Legal protection for whistleblowers constitutes a crucial element in efforts to combat corruption. This study aims to analyze the effectiveness of the legal frameworks in Indonesia, the Philippines, and Australia in providing protection for whistleblowers. A normative legal research method and a comparative approach were employed. The study examined key regulations and complementary legal instruments in each country. The findings reveal that Australia has the most comprehensive and structured legal framework for whistleblower protection. Indonesia possesses an adequate normative foundation but lacks a consistent and integrated system. The Philippines, meanwhile, does not yet have explicit legal provisions safeguarding whistleblowers. These findings highlight that all three countries continue to face various challenges in ensuring adequate legal protection. The study recommends strengthening regulatory systems and enhancing institutional support to ensure that the courage of whistleblowers does not lead to vulnerability, but rather becomes an integral part of the social control mechanism in law enforcement. Perlindungan hukum terhadap whistleblower menjadi bagian penting dalam upaya pemberantasan tindak pidana korupsi. Penelitian ini bertujuan untuk menganalisis efektivitas kerangka hukum di Indonesia, Filipina, dan Australia dalam memberikan perlindungan terhadap whistleblower. Penelitian ini menggunakan metode penelitian hukum normatif dan pendekatan komparatif. Kajian dilakukan terhadap regulasi utama dan perangkat hukum pelengkap yang berlaku di masing-masing negara. Hasil penelitian menunjukkan bahwa Australia memiliki sistem perlindungan paling menyeluruh dan terstruktur dalam peraturan perundang-undangannya. Indonesia telah memiliki dasar normatif yang cukup, tetapi belum membentuk sistem yang konsisten dan terintegrasi. Filipina belum memiliki pengaturan hukum yang secara eksplisit melindungi whistleblower. Temuan ini menegaskan bahwa ketiga negara masih menghadapi berbagai hambatan dalam memastikan perlindungan hukum yang memadai. Penelitian ini merekomendasikan penguatan sistem regulasi dan dukungan kelembagaan yang lebih responsif, agar keberanian pelapor tidak berujung pada kerentanan, melainkan menjadi bagian penting dari mekanisme kontrol sosial dalam penegakan hukum.

Abstract

Penelitian ini membandingkan kebijakan hukum dalam penyelesaian tindak pidana anak di Indonesia dan Amerika Serikat, terutama terkait penerapan konsep Restorative Justice. Di Indonesia, Restorative Justice diperkenalkan melalui Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA), dengan penerapan terbatas pada mediasi dan melibatkan lembaga negara. Sebaliknya, Amerika Serikat melibatkan fasilitator swasta dan berbagai program restorative justice. Metode penelitian yang digunakan adalah yuridis normatif melalui analisis peraturan perundang-undangan dan dokumen terkait. Hasil penelitian menunjukkan perkembangan signifikan dalam kebijakan hukum Indonesia, tetapi perbedaan praktik dengan Amerika Serikat, terutama dalam melibatkan aktor dan proses penyelesaian. Kesimpulan penelitian ini menekankan perbedaan dalam penerapan Restorative Justice antara kedua negara, meskipun tujuan mengurangi jumlah narapidana tetap menjadi fokus utama. Ini memberikan wawasan terperinci tentang kemajuan dan perbedaan praktik penanganan tindak pidana anak di Indonesia dan Amerika Serikat.

Abstract

To date, Indonesia is still grappling with waste management issues, which is a significant obstacle to realizing Sustainable Development Goals (SDG) 11. One of the ways to deal with this issue is through the development of the waste-to-energy (WtE) system, which can be utilized to transform waste into precious energy resources. However, this system must also be supported with robust legal compliance to ensure that its development is not solely focused on generating profits through energy production but also meets its noble purpose of improving sustainability as conceptualized within SDG 11. This study utilizes the normative legal research method, along with a statutory approach. Analysis of this study finds that the current Indonesian legal framework is insufficient in providing a robust mechanism of compliance to ensure that the waste-to-energy system can contribute to the broader waste-management issues and their ramifications, specifically due to the lack of recognition of the unique intricacies of the development of WtE systems, along with the lack of normative implementation of SDG 11. The paper proposes a model of normative construction to cover these issues as a way of ensuring growth and environmental sustainability in Indonesia, particularly regarding waste management.
