Abstract

The protection and welfare of children in the criminal justice system is the main focus of efforts to find alternative solutions that do not involve children in formal legal processes, such as imprisonment, which can have a negative impact on their development. Law No. 11/2012 on Juvenile Criminal Justice System (SPPA Law) implements the concept of restorative justice through a diversion system. This study aims to understand the regulation of diversion under the SPPA Law and how it is implemented in the Batam District Court in handling children involved in legal problems. The research method used is empirical juridical. The implementation of diversion in Batam District Court aims to achieve restorative justice which emphasizes on recovery, providing opportunities, and children's awareness of their mistakes. The goal is to ensure children's growth and development rights are guaranteed by law. Although the implementation of diversion in Batam District Court is in accordance with the provisions of the SPPA Law, there are obstacles that make it less effective. From 2019 to 2022, 18 cases were eligible for diversion, but only 4 cases were successfully resolved using this method, while 14 other cases failed due to various obstacles and constraints accompanying its implementation.

Abstract

Despite global adoption, Indonesia's criminal justice system lags in utilizing body-worn cameras (BWCs), hindered by the absence of a regulatory framework. This disparity complicates efforts to curb police misconduct, ensure accountability, and protect individual rights. The study underscores the urgency of promoting transparency and rebuilding public trust in law enforcement. It identifies a disconnect between the conceptual need for BWCs and the lack of normative support in Indonesia. Key challenges include oversimplified data classification, inadequate mechanisms for handling biometric data, and a lenient police code of ethics on evidence management. These issues pose significant challenges to the BWCs’ effectiveness, undermining their potential to enhance accountability. By addressing these issues, BWCs can realize their full potential in contributing to a more accountable and  ethical data protection standards.

Abstract

Hate speech and terrorism are two forms of crime that are similar in their discriminatory nature. The efforts to address these crimes are of significant importance, as they starkly contrast with the values that Indonesia holds dear and present serious threats to its multicultural society. This study aims to explore the correlation between hate speech and terrorism and to explain how this correlation may assist in the development of a legal framework that better addresses both issues. The research employed a normative legal approach to analyze the existing positive laws regarding hate speech and terrorism, aiming to identify correlations between the two. This normative legal research utilized a combined statutory approach, employing primary law sources as secondary data. The analysis revealed normative issues within the Indonesian legal framework that restrict the criminalization of offenses that fall between the legal definitions of hate speech and terrorism. These issues need to be addressed as an important step in Indonesia’s legal development to realize a safe society for all Indonesians.

Abstract

Penelitian ini mengkaji kebijakan sanksi pidana pembunuhan dalam KUHP Indonesia dan hukum Islam, dengan fokus pada pembaharuan hukum pidana nasional. Tujuannya adalah untuk mengidentifikasi perbandingan kebijakan sanksi antara pidana dan hukum Islam, serta memahami mengenai sistem sanksi pidana pembunuhan dalam hukum Islam dapat berkontribusi pada pembaharuan hukum nasional. Penelitian ini menggunakan metode yuridis normatif, menganalisis data primer berupa KUHP dan peraturan perundang-undangan, serta data sekunder berupa jurnal dan pendapat para ahli. Hasil penelitian menunjukkan adanya perbedaan dan kesamaan dalam kebijakan sanksi, KUHP mengancam pidana penjara hingga hukuman mati sedangkan hukum Islam menerapkan qishas dan diyat sebagai sanksi utama. Penelitian ini ini menyoroti potensi pembaharuan hukum pidana nasional dengan mengintegrasikan prinsip-prinsip hukum Islam.

Abstract

Kemajuan teknologi menuntun manusia untuk terus berkembang dalam mengunakan terknologi tersebut. Perjalanan kemajuan teknologi kini semakin memberikan pergantian regulasi dalam kebutuhan masasyarakat yang dapat di lakukan secara daring. Pendaftaran dan pengaitan data pribadi untuk sinkronasi data kini semakin banyak dan di perlukan. Seiring perkembangannya oknum yang tidak bertangung jawab juga semakin berkembang dan menyalahgunakan data pribadi seseorang untuk kepentingan pribadi. Karenanya untuk menekan tindak pidana pencurian data pribadi ini di butuhkan pengaturan yang dapat menjadi titik penekan adanya kasus pencurian data pribadi. Artikel ini menggunakan metode penelitian hukum normatif dan menggunakan pendekatan Statute Approach dan menggunakan dua sumber hukum yaitu primer dan sekunder. Dalam pelaksanaannya, pemerintah atau yang memegang kekuasaan dirasa mampu menilai kebijaksanaan yang dewasa ini berlaku dlingkungan asosiasi. Pandangan evaluasi ini dirasa mampu untuk ditingkatkan dengan membentuk sebuah pengaturan hukum yang berbentuk Undang-Undang sehingga dapat menjadi penjamin terlindunginya masyarakat. Lembaga Independen Negara yang diberikan kekuasaan untuk membentuk Undang-Undang dapat berperan dan bertugas untuk segera menggandeng pemerintah untuk bersama-sama membentuk dan mengesahkan Undang-Undang Pelindungan Data Pribadi.

Abstract

One the negative usages of digital technology is the sharing of inappropriate photo to someone online. However, as social media users are often the target of doxing, young persons who commit this offense can also be considered victims, leaving them vulnerable to bullying, especially in their own environment, such as school. Using normative legal research method and statutory approach, this research analyzes the potentials of school transfer as a post-criminal proceedings method for juveniles who commit sexual offense in the form of inappropriate photo-sharing, to first get them to an environment safe enough for them to be educated on their mistakes in another school, which is important for their growth. This study identifies normative gaps within the Juvenile Justice, Pornography, and Education Laws that hinder the reintegration of juveniles involved in online sexual offenses, proposing school transfer as a mitigative strategy against bullying and harassment. It emphasizes the need for further research to address implementation challenges, underscoring the importance of a holistic restorative justice approach.

Abstract

The enforcement of digital conduct provisions is currently gaining more relevance. Indonesia and Thailand, as two countries with diverse socio-cultural and religious backgrounds, continue to struggle with ensuring that online conduct was within safe boundaries. However, ongoing efforts to regulate this situation raised numerous questions regarding the balance between freedom of expression and societal sensitivities, particularly in relation to how 'harm' was defined by individuals and the legal system. A normative legal study was conducted to analyze the relevant primary law sources from both countries and examined how ‘harm’ is defined by the Indonesian and Thailand legal system. The results showed that there was a significant disconnect between Indonesia and Thailand's diverse societies and how the legal system tried to balance competing interests. Legal provisions and enforcement also showed a strong focus on socio-cultural preservation that may inadvertently limit digital discourse.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi dan menganalisis kesenjangan antara regulasi dan implementasi hukum dalam memberikan perlindungan terhadap korban kekerasan seksual di lingkungan pondok pesantren. Fenomena kekerasan seksual di pesantren menunjukkan adanya ketidaksesuaian antara norma hukum yang berlaku dengan praktik di lapangan. Meskipun telah tersedia sejumlah regulasi seperti Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual dan Peraturan Menteri Agama Nomor 73 Tahun 2022, pelaksanaannya masih menghadapi banyak kendala. Penelitian ini menggunakan pendekatan yuridis-normatif dan teori legal positivism sebagai dasar analisis. Temuan utama menunjukkan lemahnya pengawasan eksternal, tidak adanya mekanisme pengaduan yang aman, dominasi struktur hierarkis, serta rendahnya literasi hukum sebagai faktor penghambat perlindungan korban. Penelitian ini menawarkan rekomendasi berupa penguatan Standar Operasional Prosedur berbasis korban, pembentukan pengawasan independen, dan pelatihan bagi aparat hukum dan pengelola pesantren. Implikasi dari hasil penelitian ini diharapkan dapat mendorong reformasi kebijakan dan penguatan sistem hukum dalam lembaga pendidikan keagamaan.

Abstract

A notary is an official who is authorized to make an authentic deed that has legal force when used as evidence in a contract conference. The purpose of this study is to analyze the forgery of signatures on authentic deeds that are used as evidence in a civil trial. The research method used is normative juridical. The results of the study show that there are cases of forgery of authentic deeds that are used as evidence in a civil trial, while the judge in the civil trial only seeks formal truth, not checking the authenticity of the authentic deed data. If there is forgery of an authentic deed, it can go to criminal court. Therefore, in order for the civil trialto run efficiently, the judge in the civil trial should not only seek formal truth, but also material truth by using the judge's belief. Based on the coherence theory, the judge in the civil trial is still given the opportunity to find the law through the interpretation of statutory regulations. Then based on the theory of evidence, judges in civil trials can also use their beliefs which are referred to as material truth.

Abstract

Parking is an activity regulated by the government as a source of local revenue to support infrastructure development. The management of parking revenue in Batam City refers to Law Number 28 of 2009 on Local Taxes and Levies and Local Regulation of Batam City Number 1 of 2024. The problem of this research is the effectiveness of the government's role in managing parking revenue in Batam City, especially in the aspects of facilities, community participation, and culture of legal compliance. This research aims to analyze the role of government in managing parking revenue in Batam City. The method used is empirical juridical research involving in-depth interviews with the Local Revenue Agency, Transportation Agency, as well as parking attendants in Batam City with statutory approach, conceptual approach and sociological approach. The results show that the government has a strategic role in ensuring that parking revenue is optimally distributed, both for the welfare of parking attendants and the development of city infrastructure. In addition to effective regulations, the main challenges in optimizing the parking system in Batam City lie in improving facilities, public participation, and strengthening the culture of compliance with parking regulations. Therefore, synergy between government policies, especially related to technology and public education, is needed to create a parking system that is more transparent, efficient, and contributes maximally to local revenue.
