Abstract

Kepariwisataan merupakan salah bagian dari hak asasi manusia, begitu juga dengan hak perlindungan hukum yang dimiliki oleh wisatawan dalam penyelenggaraan kepariwisataan karena tidak jarang terjadi peristiwa yang merugikan wisatawan sabagai implikasi penggunaan barang/jasa usaha pariwisata. Berdasarkan fenomena tersebut, penelitian bertujuan untuk mengetahui pengaturan perlindungan hukum wisatawan dalam hukum positif di Indonesia dan tanggungjawab pengelola usaha pariwisata terhadap wisatawan jika terjadi kecelakaan dalam berwisata. Penelitian ini disusun dengan menggunakan metode penelitian normatif dengan pendekatan The Statue Approch yaitu penelusuran melalui peraturan perundang – undagan yaitu UU Kepariwisataan dan UU Perlindungan Konsumen. Berdasarkan hasil penelitian, UU Kepariwisataan hanya memberikan pengaturan terhadap perlindungan hak – hak wisatawan, namun tidak mengatur pertanggungjawaban bagi pengusaha pariwisata apabila menyebabkan kerugian bagi wisatawan. Pengaturan mengenai pertanggungjawaban terhadap wisatawan diatur dalam UU Perlindungan konsumen dan tidak menutup kemungkinan terdapat pertanggungjawaban pidana apabila terbukti adanya kesalahan yang dilakukan dalam pengelolaan usaha pariwisata. Tourism is part of human rights, as well as legal protection rights owned by tourists in the implementation of tourism because it is not uncommon for events that are detrimental to tourists, such as the implied use of tourism business goods/services. Based on this phenomenon, this study aims to determine the legal protection arrangements for tourists in positive law in Indonesia and the responsibilities of tourism businesses towards tourists in the event of an accident while traveling. This research was compiled using normative research methods with the Statue Approach, tracing through statutory regulations, the Tourism Law and the Consumer Protection Law. Based on the research results, the Tourism Law only provides arrangements for the protection of tourist’s rights but does not regulate accountability to tourism entrepreneurs if they cause harm to tourists. Arrangements regarding responsibility for tourists are regulated in the Consumer Protection Act and cannot rule out criminal responsibility if it is proven that an error has occurred in the management of the tourism business.

Abstract

Abstract This article aims to analyze the categorization of the food plating art as art in the context of copyright protection and the protection of photography and video works upon the food presentation. This article uses normative research method with conceptual, statutory and comparative approaches. The results show that the food plating art cannot be categorized as a work of art that is protected under copyright because the elements of copyright protection that are interrelated to each other have not been fully fulfilled, such as the fixation requirement which is not successfully fulfilled. The food plating art is impermanent because it is easily destroyed and will not exist after being eaten (perishable in nature) because the art is meant to be eaten. Thus, the element of “should be embodied in real form” are very difficult to fulfill. The food plating art cannot yet be considered copyrighted art. However, derivatives of the food plating art in the form of photographic and cinematographic works on the food plating art can be copyrighted as works of Food Art Photography and Food Art Cinematography. Therefore, the creator has exclusive rights in the form of moral rights and economic rights, while the copyright holder can enjoy exclusive rights in the form of economic rights over the photographic and cinematographic works. Keywords: Food plating art, Copyright, Derivative Work, Technology Abstrak Tulisan ini bertujuan untuk menganalisis pengkategorian seni menghidangkan makanan sebagai seni dalam konteks perlindungan Hak Cipta serta perlindungannya terhadap karya fotografi dan video terhadap keberadaan hidangan makanan. Tulisan ini menggunakan metode penelitian normatif dengan pendekatan konseptual, perundang-undangan dan perbandingan. Hasil penelitian menunjukkan bahwa seni menghidangkan makanan tidak dapat dikategoritisasikan sebagai karya seni yang dilindungi Hak Cipta karena belum terpenuhinya secara utuh unsur-unsur perlindungan hak cipta yang saling berkaitan satu sama lain, seperti syarat fixation yang tidak terpenuhi. Karya seni menghidangkan makanan sifatnya memang tidak permanen karena mudah dihancurkan dan akan tidak eksis setelah dimakan, karena sifat seni penyajiannya memang untuk dimakan. Dengan demikian, unsur diwujudkan dalam bentuk nyata sangat sulit dipenuhi. Seni menghidangkan makanan belum dapat dianggap sebagai seni yang dilindungi hak cipta. Namun demikian, turunan dari seni menghidangkan makanan tersebut dalam wujud karya fotografi dan sinematografi atas seni menghidangkan makanan dapat dilindungi hak cipta sebagai karya Food Art Photography dan Food art cinematography, sehingga penciptanya memiliki hak ekslusif berupa hak moral dan hak ekonomi, sedangkan pemegang hak cipta dapat menikmati hak eksklusif berupa hak ekonomi atas karya fotografi dan sinematografi tersebut. Abstract

After the formation of the Bali Provincial Regional Regulation Number 4 of 2019, there were regulations regarding the mechanism for selecting Traditional Village Heads, which had never previously been regulated in previous regional regulations. This article aims to examine and analyze the Arrangements for the Election of Traditional Village Villages by Deliberation and Consensus After the Establishment of Bali Province Regional Regulation Number 4 of 2019. This article uses normative legal research methods as a type of research, which is studied through a statutory approach, analysis of legal concepts, and also history. The results of the study show that the Arrangements for the Election of Traditional Bandesas After the Establishment of Bali Provincial Regulation Number 4 of 2019, which were carried out through a deliberation and consensus mechanism, resulted in legal uncertainty in the regulation of the election of Traditional Bandesas, because there were no strict sanctions or strict provisions prohibiting the election mechanism for Traditional Bandesas. not through consensus deliberation. Pasca terbentuknya Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019, terdapat pengaturan mengenai mekanisme pemilihan Bandesa Adat, yang sebelumnya tidak pernah diatur dalam perda sebelumnya. Artikel ini bertujuan untuk mengkaji dan menganalisis Pengaturan Pemilihan Bandesa Adat Secara Musyawarah Mufakat Pasca Terbentuknya Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019. Artikel ini memakai metode penelitian hukum normative sebagai jenis penelitian, yang dikaji melalui pendekatan perundang-undangan, analisis konsep hukum, dan juga sejarah. Hasil studi menunjukkan bahwa Pengaturan Pemilihan Bandesa Adat Pasca Terbentuknya Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019 yang dimana dilakukan melalui mekanisme musyawarah mufakat, mengakitbatkan ketidakpastian hukum dalam pengaturan pemilihan Bandesa Adat, oleh karena tidak terdapat sanksi tegas ataupun ketentuan tegas yang melarang mekanisme pemilihan Bandesa Adat tidak melalui musyawarah mufakat.

Abstract

This study aims to examine the legality of the security duties carried out by Pecalang within Indonesia's national security system. As a state based on law, Indonesia recognizes and respects the traditional rights of customary law communities, including those in Bali. Pecalang, a traditional security task force in Balinese customary villages, plays a crucial role in maintaining order and security. The research method employed is normative legal research with a documentary approach to relevant legal products. The analysis focuses on the legal basis of Pecalang's authority, their position within the national security system, and the regulations governing their role. The findings indicate that Pecalang have a solid legal foundation based on Regional Regulation No. 4 of 2019 concerning Customary Villages, which regulates their role in maintaining order within the Customary Village. Additionally, Pecalang are recognized in Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia as part of self-initiated security, whose role is to support the police in maintaining security. Pecalang perform their duties based on awig-awig (customary regulations) created by the customary village, providing a legal basis for them to carry out security and order functions according to customary law. However, challenges include negative public perceptions and actions that exceed their official authority. Therefore, there is a need for increased socialization and education for the community regarding the role of Pecalang, as well as an increase in the number of Pecalang within the community.

Abstract

Studi berikut dibuat dengan tujuan yakni mengkaji Akibat Hukum Praktik Poaching Terhadap E-Sport Di Indonesia. Maksud dari akibat hukum tersebut adalah hak dan kewajiban apa yang timbul ketika terjadinya praktik poaching. Hal ini diimplementasikan dengan metode hukum normatif, melalui pendekatan perundang-undangan. Bahan hukum yang digunakan yaitu bahan hukum primer dan bahan hukum sekunder yang diperoleh menggunakan studi kepustakaan. Kajian studi menunjukkan yakni belum ada peraturan khusus tentang e-sport di Indonesia akan tetapi dasar hukum yang dipakai adalah Pada Pasal 1 angka 2 Undang-Undang Nomor 11 tahun 2022 tentang Keolahragaan, dengan tidak adanya hukum yang mengatur secara spesifik maka maraknya praktik poaching yang ada dalam e-sport Indonesia yang mengakibatkan banyaknya kerugian bagi pihak yang terlibat. Akibat hukum yang dialami tidak lain adalah sanksi terhadap atlet yang terlibat dalam poaching dan membayar ganti rugi kepada pihak yang merasakan dampak dari poaching tersebut. Adapun peraturan lainnya yang mengatur seperti Peraturan Pengurus Besar Esport Indonesia Nomor 034/PB-ESI/B/VI/2021 tentang Penyelenggara kegiatan Olahraga Elektronik di Indonesia.

Abstract

This research have intenions to show and understand the legal principles of engagement in agreements when entering into agreements. know about the implementation of the principles of engagement, especially the principle of consensualism in realizing an engagement. The writing of this article applied through the normative legal research method where the author employs a legislative approach and a system of legal concept. The study results indicate that when making an agreement, several principles serve as the foundation of legal proceedings, guiding decisions and actions within the judicial system, as a legal basis this principle can provide an overview of the contract. Numerous guiding principles are available for reference and implementation in various contexts and situations. The principles of association include the principle of freedom of contract, the principle of good faith, the principle of pacta sunt servada, and the principle of consensualism. In implementing consensualism in a contract such as an online buying and selling agreement. Buying and selling online from the point of view of contract law in Indonesia uses Paragraph (1) of Article 18 of the Electronic Information and Transactions Law. There is also a lease agreement where the parties make an agreement. The legal basis for renting a house is explained in Government Regulation no. 44 of 1994, which guarantees legal protection for home owners or tenants. The regulation also explains that a rental agreement can be said to be valid if there is approval or permission from the owner of the dwelling. In accordance with the basic law of renting a house, there are 3 (three) clauses in the house rental agreement

Abstract

This research is entitled "Community Based Tourism in Welcoming the New Normal Tourism Village in Bali Province". This research was motivated by the economic crisis that occurred in Bali Province, due to the outbreak of the corona virus. For the Province of Bali, tourism is the leading sector of the Balinese economy because the majority of Balinese people depend on the tourism industry directly or indirectly. The outbreak of the corona virus throughout the world has caused countries in the world to implement various policies to limit the space for their people, which have implications for the decline in tourism activities in Bali. Bali has 116 Tourism Villages which are now excellent tourist destinations amid the Covid- 19 pandemic. Tourist villages offer natural beauty more ideally visited in the midst of the Covid-19 pandemic compared to other tourist destinations. However, it turns out that until now the local government of the province of Bali has not had a norm in the formation of a tourist village, which implies difficulties in developing a Tourism Village, so it is necessary to construct norms that specifically regulate tourism villages by implementing the concept of community based tourism that promotes community participation. The formulation of the problem in this study, namely; 1. What is the authority of the Regional Government in developing the Tourism Village in Bali Province? 2. How is the development of a tourism village based on the concept of community based tourism in welcoming the new normal of Bali tourism? In this study, it is known that the local government of the province of Bali has the authority to construct tourism village norms as a guideline for organizing tourist villages in Bali Province. The provincial government of Bali is expected to form a Regional Regulation as a guideline for regencies / cities in developing tourist villages so that they can realize the tourism implementation objectives contained in article 4 of Law no. 10 of 2009 concerning Tourism.

Abstract

Penelitian ini bertujuan untuk menyelidiki permasalahan terkait fenomena childfree di Indonesia serta dampak hukumnya berdasarkan hukum adat Bali. Dalam menganalisis permasalahan tersebut, digunakan metode penelitian hukum normatif. Hasil kajian menunjukkan bahwa fenomena childfree yang tengah menjadi perbincangan di Indonesia merupakan keputusan individu untuk tidak memiliki anak, dengan berbagai faktor yang melatarbelakanginya. Keputusan ini berbeda dari kebiasaan mayoritas masyarakat, khususnya di Bali, yang sangat mengutamakan keberadaan anak dalam keluarga. Dalam konteks hukum adat Bali, keputusan tersebut berdampak pada tidak adanya penerus yang dapat melanjutkan swadharma (tanggung jawab) dan swadikara (hak) suatu keluarga, baik dari aspek sekala (realitas) maupun niskala (kepercayaan). Kata Kunci: Childfree, Hukum Adat Bali, Swaharma, Swadikara   ABSTRACT   This study aims to investigate the problems related to the childfree phenomenon in Indonesia and its legal impact based on Balinese customary law. In analyzing the problem, the normative legal research method is used. The results of the study indicate that the childfree phenomenon that is currently being discussed in Indonesia is an individual decision not to have children, with various underlying factors. This decision is different from the habits of the majority of people, especially in Bali, who prioritize the existence of children in the family. In the context of Balinese customary law, this decision has an impact on the absence of successors who can continue the swadharma (responsibility) and swadikara (rights) of a family, both from the aspects of sekala (reality) and niskala (belief).   Keywords: Childfree, Balinese Customary Law, Swadharma, Swadikara

Abstract

Studi ini memiliki tujuan untuk menganalisis ciri-ciri dan memahami kejelasan hukum serta jaminan hukum bagi kontrak pintar dalam aktivitas perdagangan mata uang kripto di Indonesia. Studi ini menerapkan metode penelitian normatif melalui kajian pustaka dan penelaahan regulasi dengan memanfaatkan pendekatan peraturan perundang-undangan dalam penyusunannya serta menggunakan pendekatan konseptual. Hasil dari penelitian ini menunjukan bahwa smart contrack merupakan program digital yang menjadi evolusi blockchain yang memudahkan dalam proses transaksi cryptocurrency melalui mekanisme self-executed immutable clause. Smart contrack dapat dikatakan sah sebagai kontrak elektronik dan memiliki kepastian hukum apabila memenuhi syarat sah kontrak menurut Pasal 1313, 1320, dan 1338 KUHPerdata serta tidak bertentangan dengan peraturan perundang-undangan yang berlaku saat ini, termasuk Peraturan Pemerintah No.71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik (PSTE). Perlindungan hukum terhadap smart contract di Indonesia masih bersifat umum dan belum memiliki aturan khusus, sehingga perlindungan lebih lanjut bergantung pada penerapan prinsip hukum kontrak elektronik dan ketentuan yang sesuai atau relevan. Dengan demikian penelitian ini menegaskan bahwa pentingnya pengembangan regulasi khusus untuk menjamin kepastian hukum dan perlindungan hukum smart contrack dalam transaksi cryptocurensy di Indonesia.
