Abstract

Penelitian ini dilakukan dengan tujuan memahami pengaturan pelaksanaan AYDA oleh LPD sebagai upaya mengatasi kredit macet dan menganalisis kedudukan hukum LPD dalam pelaksanaan AYDA terhadap agunan berupa hak tanggungan. Guna mencapai tujuan penelitian tersebut, penelitian ini dilakukan dengan metode penelitianhukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Berdasarkan analisis yang dilakukan didapatkan kesimpulan bahwa ketentuan tentang pelaksanaan AYDA yang dilakukan oleh LPD diatur melalui Pasal 17 Pergub Bali No. 44/2017. Berdasarkan ketentuan tersebut LPD dapat melakukan AYDA untuk menyelesaiakn peroalan kredit macet. Namum LPD memiliki kewajiban untuk melakukan penyelesaian terhadap agunan tersebut dalam jangka waktu 6 (enam) bulan, jika melebihi jangka waktu tersebut LPD tidak bisa melakukan penyelesaian terhadap agunan yang diambil alih maka LPD berkewajiban menanggung segala biaya yang timbul terhadap agunan tersebut. Ketentuan lain tentang kebijakan dan prosedur pelaksanaan AYDA oleh LPD ditaur lebih lanjut melalui Paruman Desa dan kemudian disetujui oleh Panureska. Kewenangan dan kedudukan hukum LPD dalam melakukan AYDA didasari atas ketentuan Pasal 17 ayat 1 Pergub Bali No. 44/2017. Namun, agar LPD tetap bisa memperoleh legitimasi dan perlindungan hukum atas pelaksanaan AYDA ang dilakukannya terhadap objek Hak Tanggungan bilamana terjadi sengketa, maka penyusunan kebijakan dan prosedur pelaksanaan AYDA yang berkaitan dengan hak tanggungan haruslah mempertimbangkan prinsip-prinsip dan ketentuan hukum positif yang berlaku. ABSTRACT This research was conducted to understand the arrangements for implementing AYDA by LPDs as an effort to overcome bad credit and analyze the legal position of LPDs in implementing AYDA regarding collateral in the form of mortgage rights. To achieve the research objectives, this research was carried out using a normative legal research method with a statute approach and conceptual approach. Based on the analysis, it was concluded that the provisions regarding the implementation of AYDA carried out by the LPD are regulated through Article 17 of Bali Gubernatorial Regulation No. 44/2017. Based on these provisions, LPD can carry out AYDA to resolve bad credit problems. However, the LPD has an obligation to settle the collateral within a period of 6 (six) months, if beyond this period the LPD cannot settle the repossessed collateral, the LPD is obliged to bear all costs arising from the collateral. Other provisions regarding policies and procedures for implementing AYDA by the LPD are further regulated through Paruman Desa and then approved by Panureksa. The authority and legal position of the LPD in carrying out AYDA is based on the provisions of Article 17 paragraph 1 of Bali Gubernatorial Regulation No. 44/2017. However, so that the LPD can still obtain legitimacy and legal protection for the implementation of AYDA carried out on Mortgage Rights objects in the event of a dispute, the preparation of policies and procedures for implementing AYDA relating to mortgage rights must take into account the applicable positive legal principles and provisions.

Abstract

Tujuan penelitian ini adalah untuk bahan bacaan yang dimana nantinya penulis harapkan dapat mempermudah dalam memahami konflik norma yang terjadi, menjadi tambahan wawasan dan tujuan pembelajaran lainnya. Adapun tujuan khusus dari penulisan jurnal ini ialah untuk mengkaji efektivitas Putusan MK No. 40/PUU-X/2012 dan perizinan praktik tukang gigi pasca keputusan tersebut diberlakukan. Artikel ini disusun dengan menggunakan Jenis penelitian jurnal ini menggunakan metode normatif, yang berfokus pada analisis bahan hukum peraturan perundang-undangan dan putusan Mahkamah Konstitusi terkait legalitas praktik dokter gigi. Penulis mengumpulkan bahan sekunder melalui internet berupa buku elektronik atau e-book, situs terpercaya, terbitan berkala, dan peraturan perundang-undangan. Selanjutnya, jurnal ini bersifat deskriptif dalam ruang lingkup materi yang penulis bawakan. Hasil dari analisis ini, yaitu memperlihatkan bagaimana pentingnya peran Hukum serta kekuatan didalamnya untuk menyelesaikan konflik norma yang ditinjau dari perspektif hukum yang berlaku di Indonesia didasari dengan kajian yuridis dan hukum yang berkaitan. Keberadaan tukang gigi mendapat sorotan dimana jika berdasarkan UUD 1945 diperbolehkan keberadaannya namun berdasarkan UU Praktik Kedokteran keberadaan tukang gigi dianggap ilegal. Hal ini dapat ditelusuri kemudian dipelajari lebih lanjut sehingga menghasilkan Putusan MK No. 40/PUU-X/2012. Dengan adanya putusan, diharapkan keberadaan praktik tukang gigi tidak melebihi kewenangan yang dimiliki. The purpose of this research is to provide academic reading that the author hopes it will help the reader to understanding of the occurring norm conflict, serve as additional insight, and other learning objectives. The specific purpose of this journal writing is to examine the effectiveness of the Constitutional Court Decision No. 40/PUU-X/2012 and the licensing of dental technician practices after the decision was enacted. This article is compiled using a normative strategy with a literature study methodology. The author collects secondary materials through the internet in the form of e-books, trusted websites, periodicals, and legislation. Furthermore, the data analysis is descriptive in the scope of the material presented by the author. The results of this analysis show the importance of the role of Law and its power to resolve norm conflicts viewed from the perspective of the applicable law in Indonesia based on legal and jurisprudential studies. The existence of dental technicians is highlighted, where based on the 1945 Constitution their existence is allowed, but based on the Law on Medical Practice, the existence of dental technicians is considered illegal. This can be traced and studied further, resulting in the Constitutional Court Decision No. 40/PUU-X/2012. With this decision, it is expected that the existence of dental technician practices will not exceed their authority.

Abstract

Penelitian ini bertujuan untuk meneliti keabsahan sertifikat ganda berdasarkan Undang-Undang Pokok Agraria (UUPA) No. 5 Tahun 1960 serta bentuk perlindungannya. Penelitian hukum normatif umumnya menggunakan data sekunder, termasuk dokumen hukum primer, dokumen hukum tersier, dan literatur hukum. Dalam proses analisis data hukum tersebut, penelitian normatif mempertimbangkan beragam penafsiran yang biasanya muncul dalam disiplin ilmu hukum. Selanjutnya Adapun pendekatan yang digunakan dalam penelitian ini adalah pendekatan secara perundang-undangan (Statute Approach). Hasil penelitian juga menunjukkan bahwa untuk menentukan keabsahan dari sertifikat ganda hak atas tanah, diperlukan pemenuhan beberapa tahapan prosedur sesuai dengan peraturan perundang-undangan yang berlaku. Hal ini penting untuk mendapatkan pengakuan yuridis atas bukti kepemilikan tanah yang ada, sehingga pemilik hak atas tanah dapat memperoleh perlindungan hukum yang sesuai. Dengan kata lain, penelitian ini menyoroti pentingnya memahami prosedur hukum yang berlaku untuk menentukan keabsahan sertifikat ganda dan upaya perlindungannya, serta menekankan perlunya pematuhan terhadap aturan yang berlaku dalam rangka memastikan hak kepemilikan tanah yang sah dan mendapatkan perlindungan hukum yang sesuai. Hasil penelitian menunjukkan bahwa sengketa terkait sertifikat ganda sering kali disebabkan oleh kesalahan administratif yang terjadi dalam proses pendataan atau pendaftaran tanah oleh Badan Pertanahan Nasional. Kesalahan ini mengakibatkan terbitnya sertifikat tanah yang tumpang tindih atau ganda. Penelitian adalah instrumen kunci dalam kemajuan ilmu pengetahuan dan teknologi. Penulisan dilakukan dengan menerapkan metode penelitian normatif, yang mencakup pengolahan dan evaluasi data yang bergantung pada jenis data yang digunakan. This research aims to examine the validity of dual certificates based on the Basic Agrarian Law (UUPA) no. 5 of 1960 and its forms of protection. Normative legal research generally uses secondary data, including primary legal documents, tertiary legal documents, and legal literature. In the process of analyzing legal data, normative research considers various interpretations that usually arise in the legal discipline. Furthermore, the approach used in this research is a statutory approach. The research results also show that to determine the validity of a double certificate of land rights, it is necessary to fulfill several procedural stages in accordance with applicable laws and regulations. This is important to obtain juridical recognition of existing evidence of land ownership, so that owners of land rights can obtain appropriate legal protection. In other words, this research highlights the importance of understanding the legal procedures that apply to determine the validity of multiple certificates and their protection efforts, and emphasizes the need to comply with applicable regulations in order to ensure legal land ownership rights and obtain appropriate legal protection. The research results show that disputes related to double certificates are often caused by administrative errors that occur in the data collection or land registration process by the National Land Agency. This error resulted in the issuance of overlapping or duplicate land certificates. Research is a key instrument in scientific and technological progress. Writing is carried out by applying normative research methods, which include processing and evaluating data depending on the type of data used.

Abstract

This study aims to examine the legality of the security duties carried out by Pecalang within Indonesia's national security system. As a state based on law, Indonesia recognizes and respects the traditional rights of customary law communities, including those in Bali. Pecalang, a traditional security task force in Balinese customary villages, plays a crucial role in maintaining order and security. The research method employed is normative legal research with a documentary approach to relevant legal products. The analysis focuses on the legal basis of Pecalang's authority, their position within the national security system, and the regulations governing their role. The findings indicate that Pecalang have a solid legal foundation based on Regional Regulation No. 4 of 2019 concerning Customary Villages, which regulates their role in maintaining order within the Customary Village. Additionally, Pecalang are recognized in Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia as part of self-initiated security, whose role is to support the police in maintaining security. Pecalang perform their duties based on awig-awig (customary regulations) created by the customary village, providing a legal basis for them to carry out security and order functions according to customary law. However, challenges include negative public perceptions and actions that exceed their official authority. Therefore, there is a need for increased socialization and education for the community regarding the role of Pecalang, as well as an increase in the number of Pecalang within the community.

Abstract

Studi berikut dibuat dengan tujuan yakni mengkaji Akibat Hukum Praktik Poaching Terhadap E-Sport Di Indonesia. Maksud dari akibat hukum tersebut adalah hak dan kewajiban apa yang timbul ketika terjadinya praktik poaching. Hal ini diimplementasikan dengan metode hukum normatif, melalui pendekatan perundang-undangan. Bahan hukum yang digunakan yaitu bahan hukum primer dan bahan hukum sekunder yang diperoleh menggunakan studi kepustakaan. Kajian studi menunjukkan yakni belum ada peraturan khusus tentang e-sport di Indonesia akan tetapi dasar hukum yang dipakai adalah Pada Pasal 1 angka 2 Undang-Undang Nomor 11 tahun 2022 tentang Keolahragaan, dengan tidak adanya hukum yang mengatur secara spesifik maka maraknya praktik poaching yang ada dalam e-sport Indonesia yang mengakibatkan banyaknya kerugian bagi pihak yang terlibat. Akibat hukum yang dialami tidak lain adalah sanksi terhadap atlet yang terlibat dalam poaching dan membayar ganti rugi kepada pihak yang merasakan dampak dari poaching tersebut. Adapun peraturan lainnya yang mengatur seperti Peraturan Pengurus Besar Esport Indonesia Nomor 034/PB-ESI/B/VI/2021 tentang Penyelenggara kegiatan Olahraga Elektronik di Indonesia.

Abstract

This research have intenions to show and understand the legal principles of engagement in agreements when entering into agreements. know about the implementation of the principles of engagement, especially the principle of consensualism in realizing an engagement. The writing of this article applied through the normative legal research method where the author employs a legislative approach and a system of legal concept. The study results indicate that when making an agreement, several principles serve as the foundation of legal proceedings, guiding decisions and actions within the judicial system, as a legal basis this principle can provide an overview of the contract. Numerous guiding principles are available for reference and implementation in various contexts and situations. The principles of association include the principle of freedom of contract, the principle of good faith, the principle of pacta sunt servada, and the principle of consensualism. In implementing consensualism in a contract such as an online buying and selling agreement. Buying and selling online from the point of view of contract law in Indonesia uses Paragraph (1) of Article 18 of the Electronic Information and Transactions Law. There is also a lease agreement where the parties make an agreement. The legal basis for renting a house is explained in Government Regulation no. 44 of 1994, which guarantees legal protection for home owners or tenants. The regulation also explains that a rental agreement can be said to be valid if there is approval or permission from the owner of the dwelling. In accordance with the basic law of renting a house, there are 3 (three) clauses in the house rental agreement

Abstract

This research is entitled "Community Based Tourism in Welcoming the New Normal Tourism Village in Bali Province". This research was motivated by the economic crisis that occurred in Bali Province, due to the outbreak of the corona virus. For the Province of Bali, tourism is the leading sector of the Balinese economy because the majority of Balinese people depend on the tourism industry directly or indirectly. The outbreak of the corona virus throughout the world has caused countries in the world to implement various policies to limit the space for their people, which have implications for the decline in tourism activities in Bali. Bali has 116 Tourism Villages which are now excellent tourist destinations amid the Covid- 19 pandemic. Tourist villages offer natural beauty more ideally visited in the midst of the Covid-19 pandemic compared to other tourist destinations. However, it turns out that until now the local government of the province of Bali has not had a norm in the formation of a tourist village, which implies difficulties in developing a Tourism Village, so it is necessary to construct norms that specifically regulate tourism villages by implementing the concept of community based tourism that promotes community participation. The formulation of the problem in this study, namely; 1. What is the authority of the Regional Government in developing the Tourism Village in Bali Province? 2. How is the development of a tourism village based on the concept of community based tourism in welcoming the new normal of Bali tourism? In this study, it is known that the local government of the province of Bali has the authority to construct tourism village norms as a guideline for organizing tourist villages in Bali Province. The provincial government of Bali is expected to form a Regional Regulation as a guideline for regencies / cities in developing tourist villages so that they can realize the tourism implementation objectives contained in article 4 of Law no. 10 of 2009 concerning Tourism.
