Abstract

Access of Indigenous children to education remains a problem when there is discrimination in learning, treatment, and the use of the language and culture in schools. This impacts on the achievement of education for all. Discriminatory fulfilment of the right to education for Indigenous children is not only experienced by developing countries, but in fact indigenous children in developed countries experienced the same thing. The Ainu tribe children in Japan still experiences discrimination in the world of education, but in contrast to the Anak Dalam tribe in Indonesia, the Indonesian Government has sought to obtain their rights. The role of the government in fulfilling the right to education is very important as the entity responsible for upholding human rights. The government's role in inclusive education raises the issue of the rights of indigenous children in the fields of culture and education to a more real significant and realistic.

Abstract

The annexation of Crimea and the emergence of armed conflict between Russia and Ukraine has risen a question of the form of armed conflict itself. Despite Russia disputing any proof of aiding rebel forces, there are several clear indications of Russia’s influence over the separatist groups. Overall control plays an important role in determining the shape of the conflict, whether it has turned into an International Armed Conflict or remained a Non-International Armed Conflict. This Overall Control is encompassed in many international law, each with its unique definitions and thresholds, causing tensions in-between. It must be defined clearly which test should be applied in the dispute for the non-International Armed Conflict to turn into an International Armed Conflict. The overall control test is more likely to be met and reliable, providing superior protection under Humanitarian Law. The clear indication of planning and coordination done by Russia towards the separatist group’s military actions has then fulfilled the test of overall control that was ruled by the International Criminal Court of the Former Yugoslavia.

Abstract

Program Pengabdian kepada Masyarakat (PkM) ini bertujuan meningaktkan kesadaran mastyarakat Desa Ciambar, Kabupaten Sukabumi, tentang pengelolaan sampah melalui edukasi dan implementasi sistem bank sampah. Kegiatan ini dirancang untuk mendukung pemilahan dan pemanfaatan sampah organik serta anorganik secara efektif. Sampah organik diolah menjadi pupuk untuk mendukung sektor pertanian, sednagkan sampah anorganik didaur ulang menjadi produk bernilai ekonomi. Selain meningkatkan kesadaran lingkungan, program ini diharapkan mampu memberdayakan ekonomi warga dan mendukung pengembangan Desa Ciambar sebagai destinasi wisata yang bersih dann ramah lingkungan. Program ini melibatkan 14 peserta dari berbagai kelompok masyarakat yang secara aktif berpartisiasi dalam pelatihan dan diskusi interaktif. Evaluasi menggunakan kuisioner menunjukkan tingkat kepuasan yang tinggi terhadap materi pelatihan, performa fasilitator, dan fasilitas yang digunakan. Hasil program ini memperlihatkan dampak positif terhadap pengetahuan dan kesadaran masyarakat Desa Ciambar. Dengan penerapan bank sampah yang efektif, desa ini dapat menjadi model pengelolaan sampah berbasis masyarakat yang mendukung linkungan bersih dan pembangunan ekonomi berkelanjutan

Abstract

Protecting cultural heritage during non-international armed conflicts remains a significant challenge for the enforcement of International Humanitarian Law, especially given the rising instances of intentional or accidental destruction of cultural sites in recent decades. This study aims to explores the role of national legal mechanisms and analyzes the legal consequences of cultural heritage preservation, emphasizing its economic aspects. This research applies normative legal methods to analyze a range of international instruments, including the 1954 Hague Convention, the 1999 Second Protocol, and UN Security Council Resolution 2347 (2017), along with soft law sources such as Customary IHL and the 2024 Joint Declaration. The study's results indicate that applying international rules to the Indonesian national legal framework, particularly regarding the prohibition on exporting cultural heritage objects, can serve as a crucial preventive measure. However, at the national level, the Regulation still needs to be strengthened through more technical operational mechanisms, inter-agency cooperation, and the participation of individuals and indigenous peoples, based on international provisions that the world community has accepted.

Abstract

Latihan tempur Angkatan Bersenjata sangat diperlukan untuk membangun militer yang kuat, namun jika dilakukan secara kontinyu dalam waktu lama akan menimbulkan kerusakan lingkungan alam. Karenanya latihan tempur harus ramah lingkungan dan memperhatikan alat serta cara berperang baik pada saat maupun setelah pelaksanaan latihan. Penelitian normatif ini menganalisis elemen materiil dan psikologis berupa aturan nasional dan kebijakan yang berkaitan dengan latihan tempur TNI. Hasil penelitian menunjukkan bahwa elemen hukum kebiasaan humaniter internasional telah diinternalisasikan dalam aturan internal TNI, namun masih memerlukan aturan pelaksanaan pada tingkat taktis-operasional.

Abstract

The non-international armed conflict (NIAC) between the Sudan Armed Forces (SAF) and the Rapid Support Forces (RSF) is currently one of the world’s largest humanitarian crisis. Allegations of support from the United Arab Emirates (UAE) to the RSF raise legal issues concerning the violation of the principle of third-state neutrality under international humanitarian law. This research applies the theories of international humanitarian law, neutrality, and state responsibility to analyze whether the alleged support provided by the UAE in Sudan’s internal conflict has breached international obligations and may influence the transformation of the conflict’s status into an international armed conflict (IAC). The findings show that the UAE’s involvement can be categorized as an internationally wrongful act, potentially triggering state responsibility. This study recommends strengthening international monitoring mechanisms to uphold and ensure the application of third-state neutrality in non-international armed conflicts.

Abstract

Introduction: National economic growth requires a responsive and efficient legal system, particularly in the field of business and investment. The Draft Bill on Civil Procedure Law is expected to provide legal certainty and accelerate the resolution of business and investment disputes.Purposes of The Devotion: This article aims to provide understanding of fast-track civil procedure for business and investment through public dialogue.Method of The Devotion: The method applied was lecture and interactive discussion, using an empirical approach based on stakeholder participation in public dialogue.Results Main Findings of the Devotion: The community service activity revealed that participants gained broader knowledge of business dispute resolution through both litigation and non-litigation, fast-track proceedings in civil procedure law, and academic aspects of the Draft Bill. The enthusiasm of the participants highlighted the urgent demand for a faster and more efficient civil procedure system. These findings emphasize the importance of reforming civil procedural law to foster a favorable investment climate and ensure legal protection for business actors.

Abstract

The 1949 Geneva Conventions set out clear obligations for participating states to uphold the humanitarian norms contained therein. In Indonesia, the two regions of Aceh and Papua have experienced violent conflict with significant escalation, raising the question of whether these situations can be legally classified as non-international armed conflicts under international humanitarian law. The purpose of this study is to examine this issue by focusing on how treason cases have been tried in Indonesian courts, as judicial reasoning provides an important perspective for assessing the threshold of violence. This study uses normative legal methods, reviewing relevant statutory provisions, legal principles, and court decisions. The research findings indicate that, from a humanitarian law perspective, the acts of violence in Aceh and Papua have not reached the legal threshold required to be categorized as non-international armed conflicts. Instead, the handling of treason crimes still relies on national legal instruments, particularly Article 7 paragraph (2) of the Indonesian National Armed Forces Law, which frames such acts as military operations other than war. In conclusion, although these conflicts exhibit significant social and political tensions, they remain outside the scope of humanitarian law, highlighting the reliance on criminal law and military law in addressing treason.
