Abstract

Distribution of shared assets can lead to new conflicts if one party saves his assets in a bank account. Meanwhile, Law Number 10 of 1999 concerning Banking instructs banking business operators to keep their customers' and savings data confidential. This article is doctrinal legal research with the statutory approach and the conceptual approach. The results of this study indicate that bank secrecy is an instrument of legal protection against customers from various unauthorized parties. However, in the case of joint assets, bank secrets cannot be enforced as Constitutional Court Decision Number 64 / PUU-X / 2012 because the husband or wife of the customer is also the owner of the assets held in the bank.Pembagian harta bersama dapat menimbulkan konflik baru jika salah satu pihak menyimpan hartanya di rekening bank. Sementara, Undang-Undang Nomor 10 Tahun 1999 tentang Perbankan memerintahkan pelaku usaha perbankan merahasiakan data nasabah dan simpanannya. Artikel ini bertujuan untuk mendeskripsikan dinamika regulasi rahasia bank terkait harta bersama. Artikel ini merupakan penelitian hukum doktrinal dengan pendekatan peraturan perundang-undangan dan pendekatan konsep. Hasil kajian ini menunjukkan bahwa rahasia bank merupakan instrumen pelindungan hukum terhadap nasabah dari berbagai pihak yang tidak berkepentingan. Namun, dalam kasus harta bersama, rahasia bank tidak dapat diberlakukan sebagaimana Putusan Mahkamah Konstitusi Nomor 64/PUU-X/2012. Sebab suami atau istri nasabah juga merupakan pemilik dari harta yang disimpan di bank.Kata Kunci : harta bersama; rahasia bank; maqashid shariah.

Abstract

There are still relatively few people with disabilities who complete their education up to the university level in Indonesia. In contrast, Singapore and the United States are known for their high levels of innovation, especially in promoting equality in education. Three countries—Indonesia, Singapore, and the United States—share a common commitment to realizing the protection of disability rights. This research employs normative legal research methods, utilizing both statutory and comparative approaches. The findings of this study reveal that Singapore's universities have the highest percentage of disability-friendly institutions, with approximately 60% of colleges maintaining specialized Disability Services units. In the United States, only 4.7% of colleges offer Disability Services, while in Indonesia, the figure stands at 1.48%. Substantial, structural, and cultural challenges persist in all three countries when it comes to fulfilling the right to education, particularly concerning funding policies. Each nation needs to cultivate a culture of anti-discrimination in disability education. Notably, Indonesia has yet to implement an inclusive curriculum in higher education. This paper holds significant importance in the context of improving educational services for individuals with disabilities, ultimately contributing to the realization of equality in the education system.

Abstract

The rapid advancement of technology is a double-edged sword. While it provides easy access to information, it also opens the door to unrestricted access, including personal data. Governments worldwide are leveraging technology to enhance their connection with citizens and deliver top-tier public services. In this vein, the Provincial Government of DKI Jakarta as an Indonesian local government, launched a SuperApps called JAKI in 2019 as a dynamic platform for two-way communication between DKI Jakarta residents and local authorities. This research employs empirical juridical methods, incorporating statutory and conceptual approaches. Drawing from primary sources, including DKI Jakarta Regional Secretariat Decree Number 99 of 2022 concerning the Citizen Relations Management application and interviews with the Smart City Developer Service Unit, the study demonstrates that JAKI ensures robust data security. The app complies with ISO 2700, an international standard that regulates information security management systems and fulfils the three core components: confidentiality, integrity and availability. Furthermore, in alignment with Al Farabi's concept of information security accountability, the emphasis is placed on collaborative social responsibility between data owners and collectors, represented by DKI Jakarta Provincial Government. This cooperation is both fair and beneficial, adhering to the fundamental principles of political philosophy and ethics.

Abstract

The public’s freedom to access information is increasingly guaranteed by law. However, when accessing copies of court decisions, the court must still protect the personal rights of all parties involved. The application of secure technology, supported by regulatory protection, is essential to prevent privacy-related data breaches and maintain public trust in the judiciary. In this context, the Personal Data Protection Law application should be expanded to include guidelines for accessing court decision copies. This research analyzes the importance of maintaining the parties’ confidentiality when accessing copies of court decisions and the need for legal certainty regarding sanctions for disseminating personal data in these decisions. This study uses normative juridical methods with statutory and conceptual approaches. The study results indicate that this is appropriate if court decisions are accessed for the benefit of the litigating parties. However, certain aspects, particularly personal data, must remain confidential when accessed by the general public. It is also explained in the Qur’an that, in general, privacy within the home is highly protected and respected. AbstrakKebebasan masyarakat untuk mengakses informasi semakin dijamin oleh undang- undang, namun dalam hal mengakses salinan putusan suatu perkara yang telah diputuskan, pengadilan harus tetap melindungi hak-hak pribadi masing-masing pihak yang terlibat dalam perkara tersebut. Penerapan teknologi yang aman dan didukung dengan perlindungan regulasi diperlukan untuk mencegah pelanggaran data terkait privasi dan menjaga kepercayaan publik terhadap lembaga peradilan. Dalam hal ini, penerapan Undang-Undang Perlindungan Data Pribadi perlu diperluas hingga mencakup pedoman dalam mengakses salinan putusan pengadilan. Penelitian ini bertujuan untuk menganalisis pentingnya menjaga kerahasiaan para pihak dalam mengakses salinan putusan pengadilan, serta pentingnya kepastian hukum terkait sanksi atas penyebarluasan data pribadi para pihak dalam putusan pengadilan. Penelitian ini menggunakan metode yuridis normatif, dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa jika putusan tersebut diakses untuk kepentingan para pihak yang berperkara, maka hal ini sesuai dengan ketentuan. Namun demikian, ada hal-hal yang harus dirahasiakan terkait data pribadi para pihak apabila putusan tersebut diakses oleh publik. Dalam Al-Qur’an dijelaskan bahwa secara umum, privasi di dalam rumah sangat dilindungi dan dihormati.

Abstract

Within the pesantren tradition, kitab kuning serves as a foundational and authoritative reference for Islamic scholarship. This study focuses on the regular recitation of kitab kuning texts—Tafsīr al-Munīr by Imam al-Nawawī and Iḥyā’ ʿUlūm al-Dīn by Imam al-Ghazālī, as conducted by K.H. Ahmad Hasan, the head of Pesantren As-Sa‘īdiyyah 2 Bahrul Ulum Tambak Beras, Jombang. Employing a field-based, qualitative research approach, this study applies the lens of digital da'wah to examine how traditional pedagogical practices are being transformed through modern technology. This study's findings indicate that since 2014, the pesantren has initiated the digital broadcasting of kitab kuning recitations via YouTube. Despite limitations in audiovisual quality, which often affect sound clarity, the integration of digital media has substantially widened the reach and accessibility of these religious teachings. This transformation yields three significant impacts: (1) spatial boundaries are reduced through the enabling power of information technology; (2) audience participation is no longer limited by physical space; and (3) the availability of recitation content transcends time, allowing asynchronous access for learners. These developments mark an important step toward preserving classical Islamic scholarship while adapting to contemporary modes of knowledge transmission.

Abstract

The issue of "application fatigue" among government agencies has led to a reluctance among user to download or engage with existing applications. The intent behind these applications is to digitalize government functions, particularly in enhancing public services. This article explores the application of cost-benefit analysis (CBA) regarding the development of smart city policies in Indonesia. Historically, smart city initiatives have often translated into the creation of new applications by both central and regional government entities. This study employs normative legal research, utilizing both a statutory and cost-benefit analysis approach to investigate smart city implementation. The findings that the current conditions for smart city development in Indonesia are regressing, primarily due to lack of central government regulations that serve as guidelines for these initiatives. The involvement of stakeholders is examined based on their authority and interests, which significantly influence the implementation of the single smart city platform. Furthermore, the cost-benefit analysis demonstrates the importance of establishing and implementing this single smart city platform as a means to enhance decision-making efficiency within government agencies. It is hoped that this article will serve as a recommendation for policymakers to conduct through analysis prior to program development to ensure feasibility and effectiveness.

Abstract

Implementasi budaya 5S di MI Darul Muttaqin Sadang melalui kegiatan piket pagi tenaga pendidik telah berhasil menjadi sarana untuk membentuk karakter generasi muda. Budaya 5S yang mencakup Senyum, Salam, Sapa, Sopan, dan Santun diterapkan dalam rutinitas harian memberikan pengajaran langsung untuk mengembangkan sikap positif di lingkungan sekolah. Melalui pengabdian ini, peserta didik diajarkan untuk saling menghormati dan berinteraksi dengan baik. Metode ABCD (Asset Based Community Development) digunakan dalam kegiatan ini memanfaatkan potensi yang ada di lingkungan sekolah untuk mendukung pembentukan karakter. Hasil kegiatan menunjukkan adanya perubahan positif pada sikap peserta didik yang menjadi lebih ramah, disiplin, dan berempati. Secara keseluruhan, kegiatan ini meningkatkan keterampilan sosial peserta didik dan menciptakan suasana sekolah yang lebih harmonis dan positif. Keberhasilan implementasi budaya 5S ini diharapkan dapat menjadi contoh bagi institusi pendidikan lain untuk membangun generasi yang berkarakter kuat, bertanggung jawab, dan mampu berkontribusi bagi masyarakat.

Abstract

Kinerja guru dapat ditingkatkan jika ada kesesuaian antara pekerjaan dengan keahliannya, begitu pula penempatan guru pada bidang tugasnya. Kinerja guru merupakan keberhasilan guru untuk melaksanakan kegiatan belajar mengajar yang bermutu. Tujuan penelitan ini adalah untuk mengeksplorasi pengaruh kepemimpinan autentik terhadap kinerja guru beserta faktor-faktor lain. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi literatur. Hasil penelitian mengungkapkan bahwa gaya kepemimpinan autentik berpengaruh terhadap kinerja guru. Makin kuat pengaruh kepemimpinan autentik kepala sekolah maka kinerja yang dihasilkan oleh guru makin tinggi.  Oleh karena itu untuk meningkatkan kinerja para guru diharapkan adanya peningkatan indikator-indikator dari kepala sekolah.

Abstract

The dynamics of mixed-marriage families between Muslims and non-Muslims in South Korea illustrate how Islamic legal principles are negotiated within a multicultural and minority context. This study examines how Indonesian–Korean families practice and reinterpret Islamic law by integrating Social Construction Theory and the maqāṣid al-sharī‘ah framework. This research employs a socio-juridical qualitative design supported by demographic statistics on Indonesian migrants and intermarriages from Korean government sources. Primary data were obtained through in-depth interviews and semi-structured questionnaires with ten purposively selected Indonesian Muslim–Korean couples, while some other data were gathered from the Korean Muslim Federation (KMF) and the Indonesian Muslim Student Association (IMUSKA), both playing a central role in community support and religious education. Data were analysed in three stages: reduction, data display, and conclusion-drawing, to obtain a thematic interpretation that integrates social and legal dimensions. The findings reveal diverse strategies among Muslim spouses in balancing religious obligations with tolerance toward non-Muslim partners and families. Some maintain strict adherence to Islamic prohibitions, while others accommodate local cultural practices such as communal dining or social gatherings involving alcohol, interpreting these as expressions of respect and family harmony rather than religious neglect. These negotiations demonstrate that tolerance within mixed-marriage families is an active, socially constructed process shaped by daily interaction, cultural adaptation, and pragmatic decision-making. From the maqāṣid al-sharī‘ah perspective, such practices can be understood as preserving core objectives of Islamic law—ḥifẓ al-dīn (protection of faith), ḥifẓ al-nasl (family and lineage), and ḥifẓ al-ijtima‘ (social harmony). This research contributes to broader discussions on Islamic law, interfaith relations, and the lived experiences of Muslim minorities, highlighting how Islamic legal principles operate dynamically within non-Muslim communities.
