Abstract

There are still products in the process of issuing halal certificates, even though numerous goods circulating in society promise halalness until 2024. Consequently, comprehensive provisions are required to cover goods and services. This follows the regulations explicitly regulated in Law Number 6 of 2023, Law Number 33 of 2014, and Article 4 of Law Number 8 of 1999 about consumer protection. This writing employs normative juridical legal and field research methods to observe and collect data from real-world societal situations to obtain the necessary facts. The study's findings show that the halal certification program has been effectively implemented in Indonesia's national legal framework, as outlined in Law Number 6 of 2023, Law Number 33 of 2014 concerning Halal Guarantee Products, and Law Number 8 of 1999 concerning Consumer Protection. The government's efforts to enhance the halal certification program are demonstrated by the self-declare program and halal certification assistance in socialization and data collection for halal certification registration, facilitating business actors to obtain halal certificates that enhance consumer comfort.

Abstract

Abstract

The article in front of the reader is the result of research related to the role of the State and the Indonesian Islamic State Crisis Center or abbreviated as the NII Crisis Center in efforts to overcome religious extremism and terrorism in Indonesia. Through religious moderation is also a good way in efforts to overcome religious radicalism and terrorism in Indonesia. The diversity of ethnicity, race, religion and culture is a characteristic of the heterogeneous Indonesian nation. This diversity is an integrating force to bind society in the framework of the united ummatan. However, lately the problem of radicalism and extremism in Indonesia is still rampant and even almost difficult to contain if not supported by a support system in efforts to overcome it, both in government circles or elements of society. As in the incident in the Garut area of West Java, there has been an oath of allegiance to dozens of children carried out by the radical NII group. Even after being investigated, there were as many as 59 teenagers who had been exposed to the radical ideology of the NII. The issue of religious extremist movements in Indonesia has begun to emerge again, such as the recruitment process of the Indonesian Islamic State (NII) organization carried out through religious studies under the pretext of religion, so that the role of the state and Islamic mass organizations is greatly needed. The method used in this article is to use the rule theory related to the role of the state and the NII Crisis Center in efforts to overcome radicalism, extremism, and terrorism in Indonesia

Abstract

This study aims to evaluate the legal effectiveness of diversion mechanisms within Indonesia’s juvenile justice system, particularly in relation to the state’s commitment to restorative justice principles. Although a comprehensive legal framework is in place—namely Law No. 11 of 2012 and Supreme Court Regulation (PERMA) No. 4 of 2014 (Peraturan Mahkamah Agung)—the implementation of diversion remains limited, with only 14.1% of juvenile cases resolved through this mechanism. This gap reveals a significant disconnect between legal norms and practical enforcement. The study employs a normative-qualitative legal research method, utilizing document analysis of statutory regulations and institutional reports from the Ministry of Law and Human Rights, the Indonesian Child Protection Commission (KPAI), the Directorate General of Corrections, as well as secondary sources including academic literature, media coverage, and official documentation. Thematic analysis was applied to identify structural, cultural, and institutional barriers in the implementation of diversion. The findings highlight three major issues: (1) regional disparities in the application of diversion, especially between urban centers and disadvantaged (3T) areas; (2) structural obstacles, including a shortage of trained personnel, lack of proper mediation facilities, and weak interagency coordination; and (3) the persistence of a retributive and legalistic legal culture among both law enforcement officials and the general public, which impedes the acceptance of restorative approaches. This study makes a significant contribution to the discourse on juvenile justice reform by emphasizing the need for systemic support and cross-sectoral collaboration to ensure the effective realization of diversion. Policy implications include the strengthening of training programs, infrastructure development, and public legal education. The originality of this research lies in its integrative evaluative framework, which combines legal, institutional, and socio-cultural analysis, offering a comprehensive assessment of the effectiveness of diversion in Indonesia.

Abstract

The issue of "application fatigue" among government agencies has led to a reluctance among user to download or engage with existing applications. The intent behind these applications is to digitalize government functions, particularly in enhancing public services. This article explores the application of cost-benefit analysis (CBA) regarding the development of smart city policies in Indonesia. Historically, smart city initiatives have often translated into the creation of new applications by both central and regional government entities. This study employs normative legal research, utilizing both a statutory and cost-benefit analysis approach to investigate smart city implementation. The findings that the current conditions for smart city development in Indonesia are regressing, primarily due to lack of central government regulations that serve as guidelines for these initiatives. The involvement of stakeholders is examined based on their authority and interests, which significantly influence the implementation of the single smart city platform. Furthermore, the cost-benefit analysis demonstrates the importance of establishing and implementing this single smart city platform as a means to enhance decision-making efficiency within government agencies. It is hoped that this article will serve as a recommendation for policymakers to conduct through analysis prior to program development to ensure feasibility and effectiveness.
