Abstract

Putusan Mahkamah Agung Nomor 2868 K/Pdt/2018 diberitahukan kepada Para Pemohon Kasasi pada tanggal 8 Februari 2018. Menyatakan budel warisan dari Para Penggugat, Tergugat II SUT dan EST yang belum dibagi. Menyatakan tidak berkekuatan hukum Penetapan Eksekusi Lelang Nomor Penetapan Eksekusi Nomor 09/Eks/2010/253/Pdt.G/2007, tanggal 3 Maret 2010. Menolak gugatan untuk selebihnya; dan menghukum Tergugat I, II, III dan Tergugat IV untuk membayar biaya perkara yang timbul sebesar Rp1.832.000,00 (satu juta delapan ratus tiga puluh dua ribu rupiah). Berdasarkan latar belakang penelitian tersebut akan dianalisa perbuatan melawan hukum, perlindungan hukum, pertimbangan serta putusan hakim terhadap pelelangan harta warisan yang diletakkan sita eksekusi dalam putusan nomor 2868 K/ Pdt/2018. Penelitian ini dilakukan dengan menggunakan metode penelitian hukum yuridis normatif. Data penelitian menggunakan data sekunder. Data dikumpulkan dengan menggunakan cara studi kepustakaan. Analisis data dilakukan dengan metode analisis kualitatif. Perbuatan melawan hukum sebagaimana yang diatur dalam Pasal 1365 KUHPerdata telah dilanggar dalam putusan nomor 2868 K/Pdt/2018 oleh Tergugat I, II, III dan IV melakukan perbuatan melawan hukum, sehingga terhadap Penetapan Eksekusi No.09/Eks/2010/253/Pdt.G/2007 pada tanggal 3 Maret 2010 menimbulkan kerugian kepada keempat anaknya. Peraturan Menteri Keuangan Nomor 106/PMK.6/2013 memberikan perlindungan hukum kepada para pihak terhadap pelelangan harta warisan yang diletakkan sita lelang. Belum terjadinya peralihan harta warisan kepada seluruh ahli waris. berdasarkan keputusan Mahkamah Agung Nomor 553 K/Sip/1966 ahliwaris memilik hak sanggah untuk harta yang diperkarakan tidak disita dan dilelang. Dalam amar condemnatoir harus didahului amar declator yang menyatakan penggugat dan tergugat adalah ahli waris, dan obyek terperkara adalah harta warisan pewaris serta penguasaan tergugat atasnya tanpa hak. Berdasarkan penelitian diatas, saran peneliti bahwa Eksekutif bersama legislatif diharapkan membuat peraturan yang lebih spesifik, kemudian pihak Kantor Pelayanan Kekayaan Negara dan Lelang seharusnya lebih memahami peraturan lelang lebih dalam lagi, lalu para pihak yang objeknya disengketakan harus sudah tahu asal-usulnya terlebih dahulu.

Abstract

This research explores the role of Land Banks in handling and developing abandoned land in Indonesia. Through a qualitative approach using interviews and secondary data analysis, this research identified several key findings related to inventory, procurement, distribution and utilization of abandoned land. The research results show that although the Land Bank has made great efforts to manage abandoned land more efficiently and effectively, there are still a number of challenges that need to be overcome, such as a lack of accurate data, resistance from land owners, and lack of access to resources and technology. To overcome these challenges, the research recommends improving inter-agency coordination, participatory approaches in land acquisition, development of comprehensive mentoring programs, ongoing education and training for communities, as well as policy support that supports access to microcredit and marketing facilities. By implementing these recommendations, it is hoped that the Land Bank can function more effectively in supporting sustainable development and improving the welfare of society in Indonesia..

Abstract

Sale and purchase agreements are one form of agreement that often occurs in society. An agreement will be valid if it has fulfilled the conditions stipulated in Article 1320 of the Civil Code. The sale and purchase binding deed is a preliminary agreement that binds the parties to the sale and purchase and has the right and obligation to fulfill the performance as agreed upon in the sale and purchase agreement. The research method used is normative juridical research. The nature of this research is descriptive analytical. The source of legal material used is secondary data with primary legal materials, secondary legal materials and tertiary legal materials. The research technique used is library research with a case approach to this research. The results of this study indicate that defaults caused by heirs who are reluctant to pay land and building tax and seller's tax from the late seller / heir in the deed of binding of sale and purchase even though the buyer has carried out his performance so as to obtain legal protection, he filed a lawsuit with the court in accordance with preventive legal protection.

Abstract

Abstract: Sigama Village, Ujung Gading, still applies severe customary sanctions to those who practice same-marriage marriages, even though the marriage is legally valid and not prohibited. Sanctions such as large fines, social exclusion, revocation of inheritance rights, and prohibitions on participating in customary activities are still enforced because the community believes that same-marriage marriages bring shame, disaster, and disrupt kinship order. This situation creates tension between custom and positive law, while also showing the difference between general Batak customary rules and specific customary practices in the village. Therefore, this issue is important to study to see the extent to which these customary prohibitions and sanctions are still relevant in today's community life. Using a normative juridical method that examines documents related to the research problem. The results of the study show that the Batak Angkola customary marriage in Paluta still prohibits same-marriage marriages because they are considered to violate customary order, even though state law does not prohibit it. As a result, tension arises between custom and positive law, especially regarding social status and inheritance rights. Perpetrators of same-marriage marriages often receive customary sanctions such as fines and ostracism. This situation demonstrates that society is still striving to maintain traditions amidst modern social change. Keywords: marriage, customary law, legal consequences Abstrak: Desa Sigama Ujung Gading masih menerapkan sanksi adat yang berat terhadap pelaku perkawinan semarga, meskipun secara hukum negara perkawinan tersebut sah dan tidak dilarang. Sanksi seperti denda besar, pengucilan sosial, pencabutan hak waris, hingga larangan mengikuti kegiatan adat tetap diberlakukan karena masyarakat meyakini bahwa perkawinan semarga membawa aib, musibah, dan mengganggu tatanan kekerabatan. Situasi ini menimbulkan ketegangan antara adat dan hukum positif, sekaligus menunjukkan adanya perbedaan antara aturan adat Batak secara umum dengan praktik adat khusus di desa tersebut. Oleh karena itu, persoalan ini penting dikaji untuk melihat sejauh mana larangan dan sanksi adat tersebut masih relevan dalam kehidupan masyarakat saat ini. Dengan metode yuridis normatif yang mana meneaalha dokumen-dokuman yang berkaitan dengan masalah penelitian. Hasil penelitian menunjukkan bahwa Perkawinan adat Batak Angkola di Paluta tetap melarang perkawinan semarga karena dianggap melanggar tatanan adat, meskipun hukum negara tidak melarangnya. Akibatnya muncul ketegangan antara adat dan hukum positif, terutama terkait status sosial dan hak waris. Pelaku perkawinan semarga sering menerima sanksi adat seperti denda dan pengucilan. Abstract

Decision number 413/Pdt.G/2024/PN Mdn discusses the legal process for filing a lawsuit based on Article 271Rv. This case involved several parties, with the plaintiff filing to withdraw the lawsuit before the defendant gave an answer. The court stated that the action was in accordance with applicable legal provisions. The process of withdrawing the lawsuit in this case occurred before the lawsuit was read, at which point the judge stated that the withdrawal was not contrary to the law. The judge decided to grant the revocation and ordered the removal of the lawsuit from the register. In the context of Indonesian law, Article 271Rv is the main reference in handling the revocation of the lawsuit. This article allows the plaintiff to withdraw his lawsuit on condition that the withdrawal is carried out before there is a response from the defendant

Abstract

This study aims to examine the problems of resolving customary land disputes through customary law in Lumban Ruhap Village, Habinsaran District, Toba Regency, North Sumatra Province. The customary land disputes that occur create legal uncertainty regarding the status and ownership of land for the local customary community. The problem formulation in this study includes the causes of customary land disputes, the resolution process through customary law mechanisms, and the obstacles encountered in that process. The research method used is empirical juridical-legal research with a descriptive-analytical nature. The approaches used include sociological approaches and legislative approaches. Data were obtained through field interviews and literature studies, then analyzed qualitatively and descriptively. The results of the study indicate that customary land disputes are caused by unclear legal status and land ownership, unclear boundaries between customary land and private land, population growth, and increasing public awareness of the economic value of land. Dispute resolution is carried out through customary deliberations led by natua-tua ni huta involving the disputing parties and the local community. However, the settlement process often faces obstacles, including the parties’ absence, a lack of good-faith efforts to reconcile, limited witnesses and evidence, and unclear boundaries and land ownership.
