Abstract

The position of the rights and obligations of everyone in court is the same, but as a special relationship in the criminal justice system, children must receive different treatment, considering that children are an inseparable part of human survival and the sustainability of the nation and state. Law no. 11 of 2012 concerning the juvenile justice system emerged as a form of intention to create child-friendly courts, even looking further at the most basic substance of this rule, namely promoting the principles of restorative justice with a view to finding a settlement of cases without having to go through a trial. However, in practice there are still child cases that continue to take legal action through the courts. These problems will then be discussed, looking at the policies and realities as well as benchmarks about what kind of cases can be resolved in every process of resolving child cases in court.  Currently with  Law Number 11 of 2012 on the Criminal Justice System of Children (SPPA) which has sought diversion and restorative justice in terms of handling child conflict with the law.  From the results of this study concluded that the policy formulation the concept of diversion and restorative justice pursuant to Law Number 11 of 2012 on the Criminal Justice System of Children (SPPA) and its implementation rules have been set regarding policy concept of diversion and restorative Justice with the aim that children who commit act the criminal is no longer confronted in the judicial process but through an alternative solution.

Abstract

Corruption crimes committed by civil servants or state apparatus are thoroughly correlated to the abuse of authority and state losses. The authority given to organize and carry out burdens and errands for the assistance of the public is misused by enriching oneself or personal groups. However, there is an alteration in the mistakes made by civil servants or state apparatus which can cause losses to the public, specifically in the field of civic administration, in this case the gaining of goods and facilities. This error is referred to as an administrative error. This study discusses the differences in legal responsibility for state losses in acts of corruption with state losses in state administration law and regarding the return of state losses by goods and services procurement officials to be able to remove punishment. The difference between state losses in acts of corruption is intentional losses to enrich oneself or a group, while state losses in state administrative law are carried out without any element of intentional committing a crime. Returning state losses within a period of 10 (ten) days for administrative errors committed by bureaucrats for the obtaining of goods and facilities can remove the punishment that was originally classified as a illegal turn of corruption because this was done as part of an unintentional mistake and not to augment oneself or a particular assembly.

Abstract

Perkembangan teknologi dari era tradisonal ke era milenial saat ini mengubah cara manusia dalam melakukan komunikasi. Media social merupakan salah satu contohnya, media sosial sudah satu kesatuan dari kehidupan untuk memperoleh, membagikan dan menyebarluaskan informasi. Berkembangnya media sosial maka masalah keamanan informasi dan privasi juga menjadi hal yang penting saat ini. Media sosial merupakan satu sumber terbongkarnya informasi rahasia sudah menjadi hal yang umum saat ini. Sehingga banyak data mengenai privasi seseorang yang telah tersebar di dunia maya. Data privasi yang tersebar bisa disebabkan oleh kelalaian maupun penyedia layanan. Keamanan sistem informasi merupakan aset yang harus dilindungi keamanannya. Keamanan secara umum diartikan sebagai “quality or state of being secure to be free from danger”. Kejahatan terkait data pribadi, misalnya hacking dan penipuan, semakin meningkat di Indonesia, mengancam hak privasi yang dijamin konstitusi. Untuk mengatasi hal ini, Pemerintah merespons dengan mengeluarkan Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi yang mengatur prinsip, jenis data, hak subjek data, dan larangan penggunaan data pribadi, mencerminkan perhatian terhadap privasi di sektor kesehatan. Metode penelitian dilakukan adalah menggunakan metode normatif. Penelitian ini dilakukan dengan cara mencari dan serta memahami literatur atau yang berhubungan keamanan informasi pada media social dan penelitian pustaka. Enam poin utama yang harus dipertimbangkan saat menggunakan system aplikasionline terkait privasi data yaitu keamanan dan data perlindungan, kesadaran pengguna, pengaturan kontrol, manajemen risiko, transparansi, dan etika. Perlu dibangun kepercayaan ke dalam rancangan layanan Internet, baik melalui kegiatan rancang bangun pengelolaan suatu sistem yang lebih mengedepankan user priority. Memungkinkan, user diberikan pilihan mekanisme kontrol terhadap perlu tidaknya dalam mengungkapkan informasi pribadi dan penggunaannya.

Abstract

Peran dan tanggung jawab Polisi sebagai penegak hukum tentunya sangat diandalkan, dan tentunya sangat diharapkan implementasinya demi keadilan dan kemanfataan bagi masyarakat. Dalam prakteknya tentu Kepolisian mempunyai berbagai sistem dan standar operasional dalam menjalankan tugasnya, mulai dari sistem keamanan, sistem penyidikan, maupun sistem dalam menangani keluhan dan kritikan dari masyarakat. Melihat pentingnya peran Kepolisian, maka tentunya bukan hanya Indonesia yang memiliki “penegak hukum”, Negara lain pun tentunya memiliki Polisi mereka sendiri. Dalam tulisan kali ini, Amerika dan Kanada menjadi contoh Negara yang juga mempunyai “Penegak Hukum”. Perbandingan ini tentunya bukan untuk mencari Negara mana yang lebih baik dalam sistem dan penanganan masalahnya, namun untuk melihat dan mempelajari cara kerja dari sistem mereka. Mengambil hal yang positif dan mengesampingkan yang tidak perlu. Bagaimana kemudian Polisi Indonesia dapat berkembang semakin maju dengan belajar dari Negara-negara tetangga.

Abstract

Negara yang besar lahir dari pemerintahan yang cerdas, terutama dalam memecahkan masalah dan rintangan yang selalu datang menghampiri. Begitu juga yang terjadi saat ini, kemunculan virus Covid-19 menjadi serangan nyata yang bukan hanya dirasakan oleh satu atau dua wilayah, namun di seluruh dunia. Hal ini acapkali membuat para pemimpin bergerak cepat dan sigap dalam mengambil tindakan. Indonesia yang juga merasakan dampak masive dari pandemi ini telah melakukan berbagai upaya, baik penanganan maupun pencegahan. Polri yang merupakan garda terdepan soal keamanan dalam negara langsung diterjunkan untuk menertibkan dan mengamankan setiap wilayah yang menjadi zona merah penyebaran virus Covid-19. Penerapan PSBB serta protokol kesehatan di setiap daerah di terapkan dengan melibatkan Polri. Hal ini ternyata mendorong Polri untuk membuat gebrakan atau kebijakan baru yang efektif dalam rangka menjaga situasi dan ketertiban di masa pandemi ini.

Abstract

Introduction: The realization of Parliament's desire to support asset seizure efforts, currently there is a discourse to regulate the seizure of assets resulting from criminal offenses in a separate law. The proposal to form a law on the expropriation of assets resulting from criminal acts is seen in the agreement to include a draft law on the expropriation of assets resulting from criminal acts in the National Legislation 2009-2014.Purposes of the Research: The purpose of this study is to explain the paradigm that the importance of the establishment of asset seizure laws in money laundering.Methods of the Research: The research method used is normative legal research with a statute legal approach and a conceptual approach.Results of the Research: The urgency of establishing a special asset seizure law for money laundering is an inadequate mechanism. Adequate mechanisms in asset seizure efforts are expected to use the mechanisms contained in the UNCAC so that asset seizure in Indonesia will run effectively.

Abstract

Introduction: The concept of deradicalization itself has been running for the first time since 2005 but there is no guide or patent concept for this program. The effect given through the deradicalization program must be recognized is not optimal, but this does not necessarily make deradicalization a failed innovation, keep in mind that the existence of the deradicalization program is an answer to the handling of terrorism that is considered hard and intimidative (hard approach), while the more subtle ways of dialogue and religious approach (soft approach) is considered also able to neutralize the values of terrorism in someone who is already radical.Purposes of the Research:  The real purpose of de-radicalization in general is to prevent repeated terror incidents by former prisoners, because the National Police itself has the task of being able to detect and prevent acts of violence that insurgents. Methods of the Research: The research method used is normative legal research with a statute legal approach and a conceptual approachResults of the Research: The deradicalization Program is not a program that can be assessed directly as a failed program, deradicalization must be remembered as a reflection of the bad and hard handling (hard approach) so that the form of humanism and respect for human rights can actually be reflected by the existence of deradicalization, with the existence of deradicalization also illustrates that the perpetrators of terror or ex-prisoners have hope to return to normal life, also indicates that the government pays attention to those who commit this crime.

Abstract

This paper discusses the strategic plan of the Indonesian National Police. The purpose of this study is to evaluate the implementation of the National Police grand strategy towards 2025, especially Phase I or known as trust building in the implementation period of 2005-2010 and the second phase of Partnership Building for 5 years 2010-2015, This is done because towards Strive for Excellence in 2016-2025 in building the ability of public trust and public trust to go to the current stage of excellence is difficult to realize because trust building cannot be stable because it depends on legal events involving cases of police members and services of police members in the community.

Abstract

Radicalism and terrorism have created a national security crisis, especially in the current digital era. The era of digitalization has given birth to rapid changes and has had massive effects in various sectors, including the movement of new forms of terrorism. Terrorist groups have changed movement patterns by utilizing the internet, from spreading ideology, recruiting, funding, exchanging information and terror threats. The Internet enables rapid, low-risk, and inexpensive dissemination of information to diverse constituencies. Therefore, appropriate measures are needed to prevent terrorism. However, the implementation of digitalization-based terrorism prevention is currently unable to be realized effectively. If we look at it, since the September 11 2001 terrorist attack on the World Trade Center (WTC), terrorism has become an issue that has been widely discussed in all parts of the world. Almost all countries agree to fight terrorism, because terrorism is contrary to humanitarianism and has caused economic, political and psychological losses.  This research analyzes the government's role in eradicating terrorism in the era of digitalization. It is hoped that this research can contribute to scientific development related to handling terrorism in Indonesia. The aim of the study is to describe the causal factors and formulate steps taken by the government to overcome radicalism and terrorism in Indonesia.

Abstract

Transformasi digital kini menjadi fokus utama dalam merespons ancaman siber yang kian rumit di era modern. Penelitian ini menggunakan pendekatan kualitatif dengan memanfaatkan data sekunder untuk menganalisis serta mengeksplorasi tata kelola transformasi digital dan strategi dalam membangun ketahanan siber. Hasil penelitian ini menunjukkan bahwa tata kelola transformasi digital yang diterapkan oleh Badan Intelijen Negara (BIN) berperan dalam meningkatkan ketahanan siber nasional. Untuk menghadapi serangan siber yang terus berkembang, diperlukan penyesuaian struktural agar organisasi intelijen lebih responsif dan adaptif. Strategi ketahanan siber BIN meliputi penerapan kerangka kerja keamanan siber, peningkatan kapasitas sumber daya manusia, serta pengembangan kebijakan yang mendukung. Melalui Peraturan Presiden Nomor 73 Tahun 2017, BIN telah merestrukturisasi organisasi dengan fokus pada keamanan siber guna memperkuat pertahanan nasional. Selain itu, kolaborasi antara sektor publik dan masyarakat dalam meningkatkan kesadaran serta literasi digital menjadi elemen penting dalam menjaga keamanan siber negara. Dengan demikian, reformasi tata kelola intelijen dan adaptasi strategi ketahanan siber menjadi kunci utama dalam menghadapi ancaman digital.
