Abstract

ABSTRAKPutusan Mahkamah Agung Nomor 175 PK/TUN/2016 telah membuka ruang kewenangan peninjauan kembali permohonan fiktif positif. Alasan dikabulkannya peninjauan kembali untuk perbaikan kualitas pelayanan publik. Kualitas pelayanan publik merupakan asas-asas umum pemerintahan yang baik dalam Undang-Undang Administrasi Pemerintahan. Rumusan masalah yang akan diuraikan dalam tulisan ini adalah bagaimanakah penerapan asas-asas umum pemerintahan yang baik terhadap upaya peninjauan kembali permohonan fiktif positif ditinjau dari Undang-Undang Administrasi Pemerintahan. Tulisan ini menggunakan metode penelitian yuridis normatif, dengan pendekatan teoritis konseptual serta pendekatan perundang-undangan dan putusan pengadilan. Hasil analisis terhadap Putusan Mahkamah Agung Nomor 175 PK/TUN/2016, pengadilan judex facti menunjukkan bahwa pengadilan tidak mempertimbangkan asas pelayanan yang baik dalam Undang-Undang Administrasi Pemerintahan dan Undang-Undang Pelayanan Publik untuk memeriksa permohonan fiktif positif. Asas pelayanan yang baik yaitu memberikan pelayanan yang tepat waktu, prosedur dan biaya yang jelas, sesuai dengan standar pelayanan. Asas pelayanan yang baik merupakan perluasan dari Undang-Undang Administrasi Pemerintahan dan Undang-Undang Pelayanan Publik. Kesimpulan dari penelitian ini adalah bahwa perluasan penggunaan asas-asas umum pemerintahan yang baik pada Undang-Undang Pelayanan Publik telah melengkapi asas-asas umum pemerintahan yang baik pada Undang-Undang Administrasi Pemerintahan khususnya asas pelayanan yang baik. Pertimbangan hukum majelis hakim peninjauan kembali terkait kualitas pelayanan publik yang baik, harus memenuhi standar pelayanan. Kata kunci: asas-asas umum pemerintahan yang baik; fiktif positif; pelayanan publik. ABSTRACT Supreme Court Decision Number 175 PK/TUN/2016 has opened up space for extraordinary appeals on positive ctitious requests. The reason for being granted extraordinary appeal is to improve the quality of public services. The quality of public services is the general principles of good governance in the Government Administration Law. The formulation of the problem that will be described in this paper is how to apply the general principles of good governance to the extraordinary appeal of positive ctitious petitions in terms of the Government Administration Law. This paper uses a normative juridical research method, with a conceptual theoretical approach as well as a statutory approach and court decisions. The results of the analysis of the Supreme Court Decision Number 175 PK/TUN/2016, the judex facti court showed that the court did not consider the principles of good service in the Government Administration Law and the Public Service Law to examine ctitious positive applications. The principle of good service is to provide services that are on time, clear procedures and costs, in accordance with service standards. The principle of good service is an extension of the Government Administration Law and the Public Services Law. The conclusion of the study is that the expansion of the use of general principles of good governance in the Public Service Law has complemented the general principles of good governance in the Government Administration Law, especially the principle of good service. Legal considerations of the panel of judges on extraordinary appeal related to the quality of good public services must meet service standards. Keywords: general principles of good governance; fictive positive; public service.

Abstract

Several research problems that need to be answered are as follows. First, can the granting of victims' restitution rights based on Article 7A paragraph 1 (one) of Law Number 31 of 2014 be carried out by the aims and objectives of the legal principle of "fair legal protection" as regulated in Article 28D paragraph (1) of the 1945 Constitution? Second, is it necessary to reconstruct the arrangement for granting restitution rights in Article 7A paragraph (1) of Law Number 31 of 2014 so that the legal principle of "fair legal protection" as referred to in Article 28D paragraph (1) of the 1945 Constitution can be realized in the Indonesian welfare law state? The research method used is the juridical-normative research method. The conclusions that can be put forward are as follows. First, the granting of restitution rights to victims of criminal acts based on Article 7A paragraph 1 (one) of Law Number 31 of 2014 cannot be carried out by the principle of "fair legal protection" in Article 28D paragraph (1) of the 1945 Constitution because of the legal vacuum regarding the perpetrators. Able to pay restitution. Second, the granting of restitution rights to victims must involve the state when there is a legal vacuum so that the principle of "fair legal protection" based on Article 28D paragraph (1) of the 1945 Constitution can be realized in the Indonesian criminal justice system and the Indonesian welfare law state.

Abstract

The phenomenon of rampant acts of child prostitution causes children to lose their rights in relation to their protection, prostitution that makes children as victims is certainly an act that violates the law and decency, when children have to get education and study but instead get bad treatment and consequently hindered to live his life. In its development, prostitution which was originally a conventional crime became an unconventional crime where children can be victims or traded online through Facebook and Instagram in carrying out transactions or agreements through pimps or brokers. The impact of prostitution on children is that the child will be depressed, depressed and have a lot of daydreaming and not concentrating on learning while related to health can damage the reproduction of girls and cause infectious diseases such as AIDS/HIV. In addition, the factor of the occurrence of prostitution is due to economic factors where it is difficult to meet the necessities of life so that it justifies all means, and prevention can be done by increasing the family's understanding of the importance of child protection through an understanding of human rights, developing knowledge about the impact of prostitution on children and being consistent. to protect and supervise and guide children so as not to fall into the trap and also the need for the role and concern of the community to actively participate and be consistent and care about the government's efforts to provide guidance and supervision so that the practice of prostitution by minors does not occur again

Abstract

Penelitian ini bertujuan untuk mengkaji dan menganalisis perubahan hak menjadi konsepizin dalam UU No. 1 Tahun 2014. Metode yang digunakan dalam penelitian ini adalahyuridis normatif yang menganalisis peraturan perundang-undangan yang dikonsepsikansebagai aturan-aturan yang telah diterima sebagai aturan yang sah karena dikeluarkanoleh lembaga yang berwenang. Berdasarkan hasil penelitian bahwa prinsip hak dalammengelola wilayah pesisir dan pulau-pulau kecil, menempatkan HP-3 sebagai hakkebendaan. Ketentuan hak sebagai hak kebendaan dan izin adalah sama, artinya semuahak itu memerlukan izin, sehingga pengaturan tentang IP-3 dan HP-3 hakikatnya sama,hanya pembalikan kata saja, yang terpenting adalah substansi bentuk perizinan tersebut.Konsep IP-3 tidak mewajibkan masyarakat hukum adat dalam pemanfaatan sumber dayapesisir dan pulau-pulau kecil untuk memiliki IP-3. Akan tetapi, IP-3 yang diatur dalamperubahan UU No. 27 Tahun 2009 masih memberikan peluang besar dan menfasilitasipemilik modal untuk menguasai pesisir laut dan pulau-pulau kecil. Keberadaanmasyarakat wilayah pesisir dan pulau-pulau kecil masih menjadi pihak yang lemah ataskeberadaan korporasi tersebut.Kata kunci: Perubahan Ketentuan Hak, Pengelolaan Pesisir, UU No. 1 Tahun 2014

Abstract

Pelaporan dana kampanye merupakan perintah yang diatur dalam UU No.7 Tahun 2017. Dana kampanye bersumber dari partai politik, calon anggota DPRD Kabupaten/Kota, termasuk pula dari sumbangan yang sah berdasarkan hukum. Pelaporan sumbangan dana kampanye yang didapatkan dari pihak lain tidak ada pengaturannya. Pemilu tahun 2014 dan tahun 2019 telah ada peraturan KPU yang mengaturnya. Khusus untuk pemilu tahun 2024 belum dibentuk aturan pelaksananya. Ketiadaan pengaturannya, membuat tindakan tersebut tidak konsinten terhadap pemilu sebelumnya dan akan melahirkan potensi pelanggaran pemilu. Mitra kegiatan pengabdian kepada masyarakat ini adalah Bawaslu Kota Bekasi. Peserta kegiatan pengabdian diperhadapkan permasalahan apakah perlu pelaporan sumbangan dana kampanye dari pihak lain dan bagaimana dasar hukumnya. Kegiatan pengabdian ini menawarkan solusi bahwa KPU seharusnya tetap membuat peraturan pelaksana terkait pelaporan sumbangan dana kampanye yang didapatkan dari pihak lain. Adapun argumentasinya adalah konvensi ketatanegaraan pemilu tahun 2014 dan tahun 2019 yang mengatur ketentuan tersebut dan konsekuensi pasal 334 ayat 2 UU No.7 Tahun 2017.

Abstract

The Understanding in the prevention of DomesticViolence can not only be done in the community in general, butalso for inmates/convicts who are serving sentences inCorrectional Institutions. Legal counseling in the form ofempowering inmates is intended so that when they are free andreunited with their families and communities, they can play asignificant role in preventing domestic violence. In counselingin the form of empowering inmates, the participants, in this casethe inmates/inmates who previously did not fully know aboutdomestic violence, understood it more and more so that it isexpected to be a provision in welcoming a new life when theyreunite with their families. This activity was carried out using anonline method via zoom where the participants, namelyinmates/prisoners were in the Pondok Bambu Rutan while thespeakers were lecturers from Bhayangkara University who wereon campus.

Abstract

Reporting on campaign funds is an order regulated inLaw No. 7 of 2017. Campaign funds come from political parties,candidates for Regency/Municipal Regional People'sRepresentative Assembly members, including contributions thatare legal under the law. There is no regulation for reportingcampaign fund contributions obtained from other parties. The2014 and 2019 elections have KPU regulations governing them.Specifically for the 2024 elections, implementing regulationshave not yet been formed. In the absence of regulation, this actionis not consistent with the previous election and will give rise tothe potential for election violations. The partner of this serviceactivity is bekasi election monitoring body. Participants inservice activity were faced with the problem of whether it wasnecessary to report campaign funds contributions from otherparties and what the legal basis was. This service activity offersa solution that the KPU should still make implementingregulations regarding reporting of campaign fund donationsobtained from other parties. The argument is that the electionsconstitutional conventions for the 2014 and 2019 electionsregulate these provisions and the consequences of Article 334paragraph 2 of Law No. 7 of 2017.

Abstract

Konsep golden visa bertujuan menarik investor asing untuk menanamkan modalnya di Indonesia. Regulasi golden visa diatur dalam Permenkumham Nomor 22 Tahun 2023 dan Peraturan Menteri Keuangan Nomor 82 Tahun 2023. Kedua regulasi tersebut mengatur substansi izin tinggal bagi orang  asing untuk lebih disederhanakan perizinan dan persyaratan nilai investasinya. Ide ini muncul dari kebutuhan perbaikan perekonomian pasca Covid-19. Penelitian ini menggunakan metode penelitian yuridis normatif, dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini ditemukan bahwa Permenkumham Nomor 22 Tahun 2023 mengatur izin tinggal paling lama 2 tahun hingga izin tinggal paling lama 10 tahun. Sementara PMK Nomor 82 Tahun 2023 mengatur tarif nominal izin tinggal investor asing. Kebijakan izin tinggal pemodal asing diatur dengan batas nilai investasi kepemilikan saham yang tergolong masing rendah. Kebijakan tersebut juga memberi kelonggaran bagi korporasi asing yang akan membuka cabangnya di Indonesia. Besarnya modal yang dimiliki oleh investor asing akan bersaing dengan pemodal lokal. Perlindungan terhadap pelaku usaha lokal akan terdegradasi dengan pelonggaran norma. Sehingga pengaturan diatas tidak memenuhi asas kemanfaatan dalam perspektif hukum administrasi negara. Asas kemanfaatan menekankan upaya pemenuhan hak kepentingan individu yang satu dengan kepentingan individu yang lain, kepentingan individu dengan masyarakat, bahkan kepentingan generasi mendatang, hingga kepentingan ekosistemnya. Bukan hanya perlindungan bagi pemodal asing, juga harus melindungi pengusaha lokal hingga masyarakat Indonesia hingga generasi yang akan datang.

Abstract

Penelitian ini membahas putusan Mahkamah Agung Nomor:813 K/Pid/2023 terkait penegakan hukum pidana pembunuhan berencana yang dilakukan oleh Ferdy Sambo. Putusan tersebut mengubah hukuman bagi terpidana yang sebelumnya pidana mati menjadi pidana seumur hidup. Pengurangan pidana tersebut perlu dikaji menggunakan paradigma kontruktivisme. Paradigma kontruktivisme akan mengkaji bekerjanya hukum dalam masyarakat yang dipengaruhi oleh pengalaman masyarakat baik itu pengalaman sosial, agama, budaya, termasuk pula aliran ideologi. Putusan MA memberikan pertimbangan hukum terkait alasan yang meringankan bagi terpidana. Hal ini yang menjadi perbedaan dengan putusan pengadilan dibawahnya. Dalam perspektif konstruktivisme, hal tersebut kurang tepat. Perlu dikemukakan faktor-faktor pengalaman masyarakat dalam menjatuhkan putusan bagi terpidana. Apalagi terdapat perbedaan pendapat (dissenting opinion) oleh hakim dalam mengadili Putusan kasasi MA Nomor: 813 K/Pid/2023. Perbedaan pendapat didasari pertimbangan hukum bahwa alasan pembelaan diri karena terpaksa, harga diri maupun kehormatan terpidana tidak perlu dipertimbangkan. Kemudian dugaan tindakan asusila yang belum dilakukan klarifikasi kebenarannya oleh terpidana kepada korban. Realitas pengalaman kurang digali dalam putusan tersebut, baik faktor sosial maupun faktor lingkungan terpidana.

Abstract

The decision of the Honorary Council of the Constitutional Court stated that the Constitutional Court judges who examined case Number 90/PUU-XXI/2023 were proven to have violated the right to refuse. The right to refuse is part of the independent and impartial principle of the Constitutional Court. There has been a conflict of interest between the norms being tested and the Constitutional Court judges. Conflicts of interest are constitutional and moral violations. What are the juridical consequences of Constitutional Court Decision Number 90/PUU-XXI/2023 which violates the constitution and morals from the perspective of natural law philosophy? This research uses a normative juridical research method with a conceptual approach, a statutory approachs and a case approach. The results of the discussion have found that in the MKMK decision that the judge consciously and deliberately ignored constitutional principles regarding the right to refuse in Law Number 48 of 2009 concerning Judicial Power. Overruling the right to refuse is tantamount to overruling constitutional principles. Judges place constitutional values in practice as semantic values. Apart from that, there was a moral violation which was assessed by the lack of awareness not to review case Number 90/PUU-XXI/2023 due to a conflict of interest. Awareness comes from conscience and is closely related to integrity, independence and impartiality. The integrity of judges as enforcers and guardians of the constitution is at stake. Moral and legal principles in the constitution are two things that go hand in hand in natural law philosophy.
