Abstract

Dalam era globalisasi teknologi informasi, perkembangan pesat dalam teknologi internet telah mengubah lanskap sosial, ekonomi, dan politik. Namun, bersamaan dengan kemajuan ini, kejahatan siber semakin mengintensif dan memerlukan kerangka hukum yang komprehensif. Penelitian ini menggunakan pendekatan kualitatif dengan fokus pada analisis hukum normatif dan studi kepustakaan. Data diperoleh melalui wawancara dan pengamatan terhadap perilaku serta pendekatan peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa Indonesia perlu segera membentuk Rancangan Undang-Undang Ketahanan dan Keamanan Siber (KKS) yang komprehensif untuk mengatasi ancaman kejahatan siber yang semakin kompleks. RUU KKS harus dirancang secara transparan melibatkan berbagai pihak, mencakup ketentuan sanksi tegas terhadap pelanggaran kedaulatan digital, dan memperkuat kerangka hukum dalam menghadapi perkembangan teknologi yang terus berlanjut.

Abstract

In the perspective of civil law, this contract plays an important role as it contains the elements of an agreement regulated by the Indonesian Civil Code (KUHPerdata). An analysis of banking contracts is necessary to ensure compliance with applicable laws, avoid potential disputes, and protect the rights of debtors. The rights and obligations of customers in banking contracts may vary depending on the type of product or service agreed upon. The research problem formulated in this study is how the principles of civil law regulate banking contracts and how the rights and obligations of debtors are applied in banking contracts at PANIN BANK. The research method used is normative with a regulatory approach. The results of the study show that in banking law, several principles are recognized, namely the principle of trust, the principle of prudence, the principle of confidentiality, and the principle of knowing your customer. The principle of trust is regulated in Article 29 paragraph (4) of Law No. 10 of 1998 concerning Amendments to Law No. 7 of 1992 on Banking, which states that for the benefit of debtors, banks are obliged to provide information regarding potential risks of loss related to customer transactions conducted through the bank. To gain confidence in its debtors, PANIN BANK conducts a financing assessment. The criteria for financing assessment at PANIN BANK are carried out by analyzing the 5C principles (Collateral, Character, Capital, Capacity, Condition).

Abstract

Financial sector reform in Indonesia through Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (UU P2SK) is a strategic step by the government to improve public welfare by strengthening financial inclusion, economic stability, and stricter supervision of the financial sector. This study uses a type of normative legal research, namely legal research that focuses on norms or rules in applicable laws and regulations. The approaches used are the statute approach and the conceptual approach. This regulation aims to strengthen the role of the Financial Services Authority (OJK) in maintaining the stability of the financial system and creating a more inclusive and transparent financial climate. A case study in Aceh Province highlights the positive impact of the P2SK Law, but factors such as infrastructure and financial literacy influence its implementation. One of the main focuses of the P2SK Law is stricter regulation of financial institutions, including the rapidly growing fintech sector, in order to protect consumers and prevent practices that are detrimental to society. Through the P2SK Law, it is hoped that the financial sector can have a positive impact on the economy, especially in terms of empowering MSMEs and creating new jobs. In addition, this regulation also focuses on environmental sustainability by strengthening the green finance sector, which encourages financing for environmentally friendly projects such as renewable energy and waste management. However, a major challenge in implementing the P2SK Law is the low level of financial literacy in Indonesia which hinders the achievement of optimal financial inclusion. Therefore, it is important for the government to strengthen financial education programs at all levels of society. In this context, the success of financial sector reform is highly dependent on the synergy between the central and regional governments, as well as public support in understanding and accessing available financial services. In addition, the P2SK Law is expected to create a more transparent, accountable, and sustainable financial system, so that it can improve people's welfare evenly. With comprehensive regulatory strengthening and proper implementation, it is hoped that the Indonesian financial sector can support inclusive and sustainable economic growth for all levels of society.

Abstract

This study aims to analyze the legal protection of domestic workers (PRT) within the framework of constitutional and statutory law, identify the factors contributing to weak supervision over the fulfillment of domestic workers' rights in the household sector, and formulate an effective supervision model within the administrative context of East Jakarta. Employing a normative-empirical legal method with statutory, conceptual, and sociological approaches, this research integrates primary data obtained through interviews and Focus Group Discussions (FGDs) involving government institutions and civil society organizations. The findings reveal that constitutional protection for domestic workers is guaranteed under Article 27(2) and Article 28D(2) of the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945). Nevertheless, implementation remains weak due to the absence of legal recognition of households as workplaces within the national labor law framework. The ineffectiveness of supervision in fulfilling domestic workers' rights is attributed to four key factors: limited scope of supervision, restricted jurisdiction and authority of local government agencies at the administrative city level, institutional fragmentation among state bodies, and a formalistic bureaucratic culture. As a solution, this study proposes an effective supervision model grounded in the principles of legal inclusivity, institutional collaboration, and community participation. The model consists of five main components: (1) neighborhood-based registration (RT/RW) to ensure that domestic employment relationships are officially recorded and monitored by the state; (2) strengthening the role of Domestic Worker Placement Agencies (LPPRT) as legal entities responsible for training and grievance mechanisms; (3) integration of cross-agency complaint systems through proactive technology-based coordination; (4) public education and empowerment of domestic worker communities to enhance legal awareness; and (5) establishment of complaint centers at the sub-district (kecamatan) level. This study concludes that labor law reform should aim to recognize domestic work as a legitimate form of employment, decentralize supervisory authority, and develop a living legal system rooted in the values of social justice.
