Abstract

Default is non-fulfillment of an obligation or obligation carried out by parties who are mutually binding. In the case of a cooperation agreement, it is often one of the parties that does not carry out the achievements as agreed. Default is carried out through several stages, namely a warning or subpoena which if there is no response then it can go to the court stage. In the case raised in the Supreme Court Decision Number 1386K/PDT/2020, that the Abdurrab Foundation committed an act of default in an agreement with PT Karya Metropolitan Utama because the Foundation did not fulfill its achievements and broke a promise. The research method used in this study uses normative juridical methods using secondary data. Then the results of the study stated that the judge's decision in granting part of the plaintiff's lawsuit was in accordance with the law and there was no deviation in deciding a case.

Abstract

The mechanism of fund reimbursement in cases of transfer errors is crucial in maintaining customer trust and satisfaction in banking services. This study aims to investigate and propose optimal steps to enhance the effectiveness of fund reimbursement mechanisms. The research methodology involves literature analysis and case studies to understand key challenges and best practices in the banking industry. Findings indicate that transfer errors can occur due to various factors, including human error, system glitches, or fraudulent activities. To optimize fund reimbursement mechanisms, a holistic approach is required, encompassing improvements in internal processes, enhanced transparency, and communication with customers, as well as the implementation of advanced technologies such as anomaly detection and automated verification. The implications of this research underscore the importance for banks to continuously improve their systems and procedures in handling transfer errors, thereby enhancing customer trust and maintaining corporate reputation. This study provides practical guidance for banks in addressing challenges related to transfer errors and ensuring swift and accurate fund reimbursements to customers.

Abstract

This article provides an overview of the implementation of an employment agreement or employment contract in the business world that often causes interpretation. This research is based on normative legal research with qualitative research methods. The results of this study describe the causes of default in an agreement which as a result can harm the parties who bind themselves in an agreement. Settlement of default can basically be reached through several legal remedies such as sending a subpoena, negotiations to the lawsuit in the trial. As the decision of the panel of judges in a civil case between PT. Sukses Bintang Indonesia and PT. Ratu Intan Mining has resolved the dispute between the parties in accordance with the provisions of applicable regulations.

Abstract

In this era and age, doctors and patients are mostly bound by transactional relationship which generally written down under a therapeutic contract. The contract acts as mutual agreement between both the practitioner and patient that ensures the medical procedure will be performed professionally and highlights responsibilities of the practitioner towards patient. It becomes problematic when medical professionals performs beyond their responsibilities of what has been written under the contract which would cause of what should have been a legal procedure to become an unlawful act. Most common people wouldn’t understand and comprehend what is actually written under the contract so it becomes difficult to determine whether the medical procedure is legal or not.

Abstract

Perkawinan masuk ke dalam kategori peristiwa hukum dan suatu jalan bagi manusia untuk meneruskan keturunannya. Ikatan dua subjek hukum tersebut terjalin dapat berdampak luas pada harta kekayaan dan anak yang lahir dalam Perkawinan tersebut. Salah satunya merupakan hak waris bagi anak yang menjadi bagian keturunan antara suami dan istri tersebut. Perkawinan menurunkan harta kekayaannya kepada ahli waris khususnya kepada anak, namun terdapat beberapa kasus terdapat perceraian yang menyebabkan akibat hukum terhadap ahli warisnya terkait harta kekayaan. Selain perceraian yang berdampak terhadap harta kekayaan pada ahli warisnya adalah meninggalnya orang tua sang anak, sehingga menyebabkan anak menjadi yatim piatu. Anak yang menjadi yatim piatu mendapatkan asuhan dari wali yang ditunjuk oleh orang tua anak sebelum ia meninggal ataupun dari pihak keluarga ayah atau ibunya yang ingin menjadi wali bagi anak tersebut. Metode yang digunakan pada penelitian ini ialah yuridis normatif dengan mengkaji peraturan perundang-undangan. Pendekatan yang dilakukan ialah dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil pembahasan pada penelitian ini ialah seorang anak yang ditinggal wafat oleh kedua orang tuanya akan tetap mendapatkan asuhan dari wali apabila ia belum mencapai umur 18 tahun. Bagi wali yang ingin mendapatkan hak asuh anak dapat meminta penetapan kepada Pengadilan Agama atau Pengadilan Negeri setempat.

Abstract

Auction is a method of offering goods by verbally mentioning the price from the highest to the lowest. This writing aims to find out the material law that should be stipulated in this case and to find out the basis for the judge's considerations in deciding case Number 2893 K/Pdt/2021. This research approach is a normative juridical approach by discussing the doctrine or legal principles contained in statutory regulations. The results of this study are that the court can cancel the cancellation of auction for the execution of the Mortgage. Cancellations can only be canceled before the auction is held, this is by the provisions in Article 24 of the Minister of Finance Regulation No.106/PMK.06/2013 which states that the auction can be canceled by a court decision before the auction is held. Cancellations of auctions submitted after the auction has occurred cannot be carried out, this is in accordance with the provisions in Article 3 of Minister of Finance Regulation No.106/PMK.06/2013 which reads that auctions that have been carried out in accordance with applicable regulations cannot be cancelled.

Abstract

In essence, Indonesia is a state based on law as stated in the Constitution of the Republic of Indonesia Article 1 paragraph 3, so that every community activity is regulated by using law as a tool to carry out order, justice, security and development. One form of guarantee provided by law in its products is the legal relationship between legal subjects and other legal subjects in the economic field which cannot be separated from everyday human activities with the existence of arrangements regarding agreements. One that relates to agreements is online-based arisan which is based on written or oral agreements, thus providing protection to legal subjects to avoid unwanted things such as not having good faith in carrying out online arisan activities, especially those that can be a default form. Therefore the researcher uses a type of normative research method with a statutory approach. The results of this study are that the legal consequences arising from non-payment of online arisan funds can cause losses and are included in the category of default in the agreement so that they are required to compensate for losses and the conclusion in this study is that repayment can be carried out by means of litigation and non-litigation.

Abstract

Notary staff has a very important role in assisting the performance of a notary in providing deed-making services. Apart from being able to help the performance of a notary in carrying out his position, he must also be able to be an instrumental witness in making and formalizing notarial deeds as long as they meet the requirements stipulated in Article 40. Law on the Office of Notaries, namely witnesses who are at least 18 years old who are categorized as legal subjects who are capable of carrying out legal actions, understand the language used in the deed, can put signatures and initials, because the notary employee acts as an instrumental witness in the formalization of the deed, already entered into the realm of law which has legal consequences, so that if a notarial deed in the future occurs a problem or case, the notary employee automatically becomes involved in the problem or case. Witnesses in notary deed cases must also receive legal protection and their safety must be guaranteed in the event of a case or lawsuit in court against a deed where the status of being a witness. Even though the actions of a notary employee as an instrumental witness in the formalization of a notarial deed are included in the field of notarialism, the Law on the Position of a Notary does not provide legal protection for witnesses in the formalization of a notary deed, especially for notary employees. In the absence of provisions in the Notary Office Law regarding protection for notary employees who become instrumentair witnesses in the formalization of deeds, legal protection for notary employees who act as witnesses can only be found in provisions outside the notary office regulations.

Abstract

Artikel ini bertujuan memberikan gambaran yang cukup komprehensif tentang kontroversi seputar SEMA No. 2 Tahun 2023 di Indonesia terkait dengan perkawinan beda agama. Hasil Penelitian ini menunjukan adanya keragaman agama di Indonesia, peraturan perundang-undangan yang berlaku, kewenangan hakim, dan pentingnya keadilan serta kepastian hukum merupakan pertimbangan yang sangat relevan. Kontroversi seputar SEMA ini memang sangat kompleks dan mencerminkan ketegangan antara aspek agama, hukum, dan kebebasan hakim. Isu ini memang sangat sensitif dan memerlukan pembahasan mendalam serta pertimbangan yang cermat oleh berbagai pihak, termasuk legislator, pengadilan, dan masyarakat luas. Sebagai solusi, perdebatan ini harus diarahkan menuju solusi yang dapat menghormati hak-hak individu, memperkuat kebhinekaan Indonesia, serta memastikan perlindungan hukum dan administratif yang memadai bagi perkawinan antar-umat berbeda agama.

Abstract

This research was conducted with the aim of knowing how to regulate the concept of unlawful acts and how the similarities and differences in default with unlawful acts. Using normative juridical research methods, it is concluded: 1. Unlawful acts (Onrechtmatigedaad) are a provision regulated in Article 1365 of the Civil Code that occurs a lot in society. Based on Article 1365 of the Civil Code, there are a number of elements, namely: 1. The existence of an act; 2. The act is against the law; 3. There is a mistake on the part of the perpetrator; 4. There is a loss to the victim; and 5. There is a causal relationship between actions and losses. 2. Legal acts have developed through jurisprudence both in the Netherlands and in Indonesia, which expands the meaning of legal acts not only violating the law, but also violating the decency and decency that live and prevail in society.
