Abstract

Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan kasus, serta pendekatan konseptual yang didukung dengan data sekunder berupa dokumen hukum, literatur, dan yurisprudensi terkait. Selain itu, penelitian ini juga dilengkapi dengan pendekatan empiris melalui wawancara dengan hakim, advokat, dan pihak-pihak yang memiliki pengalaman langsung dalam perkara perceraian dan pembagian harta gono-gini. Analisis dilakukan dengan menelaah norma hukum positif, putusan pengadilan, serta teori-teori hukum progresif, keadilan, dan hukum responsif. Hasil penelitian menunjukkan bahwa dalam Putusan Nomor 132 K/AG/2019. Mahkamah Agung mempertimbangkan beberapa faktor penting, yakni keberadaan perjanjian perkawinan, kontribusi masing-masing pihak terhadap perolehan harta, bukti kepemilikan yang sah, serta perlindungan terhadap hak-hak pihak yang lebih lemah. Putusan ini memberikan kepastian hukum bahwa jika tidak ada perjanjian pisah harta, maka harta bersama dibagi secara adil sesuai prinsip kesetaraan, sementara harta bawaan dan warisan tetap menjadi hak pribadi. Dampak putusan ini tidak hanya memperkuat yurisprudensi dalam pembagian harta gono-gini, tetapi juga mendorong kesadaran hukum masyarakat mengenai pentingnya perjanjian perkawinan untuk menghindari sengketa di kemudian hari. Abstract

The rapid expansion of digital financial services has reshaped the global discourse on financial inclusion, yet more than a billion adults, a large share of them in Muslim-majority countries, remain excluded from formal financial systems, partly because conventional products conflict with Shariah principles. Islamic fintech has emerged as a strategic instrument that merges religious compliance with digital innovation to close this gap. This article synthesizes recent literature (2023-2026) on the relationship between Islamic fintech and financial inclusion within the digital economy, drawing on peer-reviewed studies indexed through Google Scholar and Consensus databases. Using a qualitative narrative-review method structured around identification, screening, eligibility, and synthesis stages, the study maps the instruments, drivers, and barriers shaping Islamic fintech adoption, including digital sharia banking, peer-to-peer sharia financing, digital zakat and waqf platforms, and blockchain-based instruments. The findings show that regulatory harmonization, Shariah governance, digital literacy, and public trust are decisive determinants of inclusion outcomes, while unresolved fiqh muamalah issues and infrastructural gaps in rural regions remain persistent obstacles. The article contributes an integrative framework linking maqāṣid al-Sharīʿah with digital financial inclusion indicators and offers policy implications for regulators, Islamic financial institutions, and fintech developers seeking equitable digital economic participation.

Abstract

This paper critically analyzes Indonesia's legal and ethical framework for privacy and data security amid rapid digital transformation, using a juridical-normative approach and case studies to evaluate the effectiveness of Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) in addressing contemporary challenges. The research addresses a significant paradox where Indonesia's accelerating digital economic growth and high internet penetration contrast sharply with escalating cyber threats reported by the National Cyber and Encryption Agency (BSSN) and increasing large-scale data breach incidents causing public concern. The central research question examines: To what extent is the PDP Law effective in protecting citizens' privacy and data security in Indonesia's digital transformation era, and what are the key legal, technical, and ethical challenges that hinder its optimal implementation? The analysis examines key PDP Law provisions, comparing them with the EU's General Data Protection Regulation (GDPR) as a global benchmark, while presenting case studies of major data breaches at Tokopedia (2020), BPJS Kesehatan (2021), and the General Elections Commission (2023) to illustrate gaps between regulatory frameworks and practical implementation. The discussion extends to complex ethical dilemmas including state digital surveillance and AI-driven personal data analysis threatening citizens' privacy rights. Findings reveal that while the PDP Law establishes a strong legal foundation and represents a significant milestone, its effectiveness remains limited by weak enforcement, institutional cybersecurity vulnerabilities, and unresolved ethical issues, leading to strategic recommendations for government, organizations, and the public to collectively build a comprehensive, adaptive, and sustainable national data protection ecosystem for future digital challenges.
