Abstract

This research was motivated by two decisions of the Aceh Syar'iyah Court, namely decision Number 75/Pdt.G/2019/MS. Aceh in determining the child's sustenance after divorce, distinguished by the amount that must be given by civil servant and non-civil servant fathers. However, these two decisions are different from the provisions of the Compilation of Islamic Law (KHI), in which the Compilation of Islamic Law (KHI) does not mention the number of child support provisions. This is the focus of this research, in which two research questions were administered to answer the research inquiries First; what is the judge's consideration in determining the obligation of a civil servant and a non-civil servant father? Second; how does the Islamic law determine the obligations of a civil servant and non-civil servant father to children after a divorce from the study of the 2019 Aceh Syar'iyah Court judge’s decision? This is a library research investigating cases on strategies used by judges in solving various cases. The study reveals that the judge’s considerations in determining the level of child maintenance rights are differed between the judge’s decision Number 75/Pdt.G/2019/MS.Aceh and decision Number 70/Pdt.G/2019/MS.Aceh. The study suggests that the judge has different ways of determining the legal decision. The civil servant fathers are entitled to comply by article 8 PP No. 10 of 1983 jo. PP No. 45 of 1990, while the non-civil fathers are referred to the recommendation of the Compilation of Islamic Law (KHI), which is seen from the ability of the father. This is found to have been in compliance with the Islamic law. Therefore, according to the author, the difference in determining the level of income for children after divorce is relevant to Imam Syafi'i's opinion that income has a certain size. The rich father should pay two mud, middle-class fathers pay one and a half mud and the low-income fathers pay one mud.

Abstract

The purpose of this study is to describe these two opinions and the points of their study of the final legal status of investment activities using zakat funds. As a type of library research, this research uses the literature data which concluded two perspectives of ulama that allow and reject investment by using funds from zakat. Results reveal considerations of the view that permits the investment of zakat funds is to take hadith values from Zaid bin Aslam, namely the practice of Rasulullah SAW and Caliph Umar Bin Khattab who made use of the zakat wealth before it was delivered to his mustahik. This opinion also paid attention to the ijtihad or law policy of the caliph Umar bin Khattab who sought the property of orphans, stopped paying zakat for muallaf, and replaced fa'i for the soldiers by giving monthly salaries from Baitul Maal. Opinions that do not allow the investment of zakat funds stand on a hadith from Aisha RA, "Whoever practices a charity that my orders are not given to him, he is rejected". Investing zakat’s assets is considered to inhibit the ownership of zakat by mustahik individually. Whereas zakat has been linked to mustahik ownership rights. Investing zakat funds is considered to have no references and it is feared that this will eliminate the spirit of worship compulsory and potentially zakat changes to be business-oriented.

Abstract

Aceh is a region that applies Islamic law to all lines of government, including worship and mu'amalah. The Qanun on Sharia Financial Institutions (LKS) has been in effect since January 2019 and includes Sharia Financial Institutions. As of January 2022, there are still many cooperatives in Aceh that have not converted to sharia principles. Considering this situation, this study aims to examine the existence of the Sharia Supervisory Board (DPS) by analyzing its role and influence on sharia cooperatives in Aceh. This study employed a qualitative method, utilizing Islamic economics theory. Data were collected by means of interviews, questionnaires, and document studies. Interviews and questionnaires were carried out with respondents from the Aceh Sharia Council, the Aceh Cooperatives and SMEs Office, and the Cooperative Supervisory Board. Qanun, journal articles, and other documents relevant to the discussion were analyzed. The findings indicate that cooperatives in Aceh consist of Savings and Loans Cooperatives, Savings and Loans Units, Sharia Savings and Loans and Financing Cooperatives, and Sharia Savings and Loans and Financing Units. The number of DPS in Aceh as of 2023 is 214. The DPS has played a role in accelerating the conversion of sharia cooperatives by making several efforts while also facing various challenges and obstacles. From an Islamic economics perspective, the existence of the DPS also has an influence on increasing the conversion of sharia cooperatives in Aceh. However, the number of sharia cooperatives is still very low, only 6% of the total number of cooperatives operating in Aceh. Nevertheless, DPS still has an economic impact on the development of the sharia economy, which is an implementation of the Qanun LKS.

Abstract

This paper aims to analyse the concept of indigenous peoples in Indonesia and examines whether the concept is appropriate with an international legal framework. Analysing the concept is essential to legitimising indigenous rights under the international law regime. The discourse on indigenous in Indonesia emerged after the government rejected an international treaty on indigenous rights and was reluctant to adopt the UNDRIP into their national law. The government opposes this by arguing that the concept of indigenous peoples under the international legal framework is inappropriate for the Indonesian context. Consequently, indigenous peoples in Indonesia do not benefit from international norms that have recognised and protected their rights globally. This paper found that the concept of indigenous peoples in Indonesia has similarities and is appropriate to the international instrument (ILO169 and UNDRIP). Thus, ratifying the ILO treaty or adopting the UNDRIP into national law will benefit the indigenous in protecting their fundamental rights, including their collective rights to traditional lands under international norms.

Abstract

Abstract This article aims to examine the perspective of Islamic economic law on the destruction of illegally imported foodstuffs. This research uses an empirical juridical approach, where the main data is obtained from interviews and observations in the field, as well as studies of legal doctrine, and analyses of statutory norms.  In addition, the author also uses secondary data sourced from various sources related to this research. The results of the study show that: first, the practice of destroying illegally imported groceries is carried out on groceries that have met the criteria for destruction, including groceries in rotten, expired, and unfit for use conditions. Second, the legal basis for destruction is Minister of Finance Regulation Number 240/PMK.06/2012 concerning Procedures for the Management of State Property Originating from Ex-Customs and Excise Assets. Third, in terms of Islamic law, the destruction of illegal imported groceries at Banda Aceh Customs is in accordance with sharia economic law.

Abstract

Land buying and selling transactions are closely related to people's lives which are a benchmark for whether or not the public understands land buying and selling transactions as regulated in Islamic law and Indonesian positive law. Disobedience in carrying out land sale and purchase transactions can lead to disputes which result in disputes in the future in society. Land buying and selling transactions that occur in the Darussalam sub-district community are the object of research conducted to see how the process of buying and selling land occurs whether there is an application of syuf`ah rights according to the provisions in fiqh muamalah and Islamic law. In this study, the main focus of the research is how the practice of buying and selling land in Darussalam sub-district, how is the existence of the application of syuf`ah rights that occur in society and how is the juridical analysis of syuf`ah rights in buying and selling land. The method used in this study is the method qualitative and sociological juridical with the type of field research (field research) and library research (library research). Research data were analyzed by means of descriptive analysis. Based on the analysis, it shows that land buying and selling transactions are in accordance with the applicable land sale provisions, in practice the community enforces syuf`ah activities in the process and becomes a necessity in land buying and selling transaction activities, but there are still those who do not carry them out due to a lack of understanding of syuf'ah rights . In this study, it was found that not all local people know the mention of syuf`ah rights in their daily lives, mention of syuf`ah rights in general is often referred to as "neighboring rights". The implementation of neighbor rights is still being used and continues to grow in society.Keywords: Islamic Law, Fiqh Muamalah, Syuf`ah Rights, Land Management, Land Purchase Transactions

Abstract

Pengembang perumahan (developer) adalah badan hukum atau perusahaan yang berkerja mengembangkan suatu kawasan pemukiman menjadi perumahan yang layak huni dan memiliki nilai ekonomis sehingga dapat dijual kepada masyarakat. CV Embun salju adalah salah satu perusahaan pengembang (developer) yang berinvestasi dan membangun rumah di Gampong Lampeudaya, Kecamatan Darussalam. CV. Embun Salju membuat perjanjian muḍārabah dengan Ibu Fatimah Syam dan Ibu Nurrahmi sebagai pemilik tanah. Adapun tujuan penulis adalah untuk mengetahui sistem bagi hasil yang dilakukan oleh CV. Embun Salju dan bagaimana tinjauan hukum Islam terhadap sistem bagi hasil tersebut. Untuk menjawab pertanyaan tersebut, penulis menggunakan jenis penelitian kualitatif deskriptif dengan menggunakan pendekatan empiris, dimana data yang diperoleh bersumber dari wawancara, observasi dan catatan lapangan yang disusun penulis di lokasi penelitian yang tidak dituangkan dalam bentuk angka-angka. Dari hasil penelitian dapat diketahui sistem bagi hasil muḍārabah pada pembangunan perumahan di Kecamatan Darussalam antara pemilik tanah dan developer CV Embun Salju adalah 33 berbanding 67. Pemilik tanah mendapatkan 33% dari hasil pembangunan sedangkan developer 67% dengan ketentuan yang telah disepakati bersama. Hukum Islam membolehkan sistem bagi hasil seperti ini agar kedua pihak dapat mengambil manfaat dari pembangunan ini. Para ulama telah sepakat, sistem muḍārabah ini dibolehkan. Dasar hukum dari sistem muḍārabah ini adalah Al-Qur’an surat An-Nisa ayat 29 dan Hadis riwayat Ibnu Majah dari Shuhaib

Abstract

This study discusses the way in determining ‘illat through the munasabah method proposed by Imam al-Ghazali in the perspective of Islamic law. The study focuses on two main problems: the identification of ‘illat through munasabah and the legal formulation to utilize hikmat to obtain ‘illat according to al-Ghazali. This normative legal research used a legal history approach as an analytical tool to examine the Islamic scholars’ thoughts on concepts, theories and ways of doing istinbath. The study concluded that according to al-Ghazali there are three kinds of munasabah in determining ‘illat, consisting of munasib mu’atstsir, munasab mula’im, and munasib gharib. In munasib mu’atstsir, there is no issue found in seeking ‘illat because the ‘illat is understood directly from the nash or ijma’. Therefore, munasabah is no longer needed in the determining ‘illat. Here, the munasabah method focuses on munasib mula’im and munasib gharib in identifying ‘illat. Munasib mula’im seeks for the genus ‘illat, an ‘illat drawn from every event that has been predetermined by the nash, by examining the same hikmah in each of the events. Such hikmah is then used as the genus ‘illat which will later be applied as qiyas for other events that have been legally stipulated by the nash. On the other hand, munasib gharib seeks for the species ‘illat, an ‘illat obtained from an event that has been predetermined by the nash, with no comparison found in other events. ‘Illat determined from munasib gharib is also hikmah, having no concrete nature. In the perspective of legal history, this method of seeking ‘illat is inseparable from kalam and philosophy as was the development of the Islamic sciences at the time. As such, this had also affected al-Ghazali’s mastery in Islamic law as well as in other Islamic disciplines.

Abstract

Abstract The distribution of subsidized LPG is part of the government’s policy to ensure access to basic energy needs for low-income communities. However, in practice, several irregularities persist, including off-target distribution, prices exceeding the official Retail Price Ceiling (HET), and weak oversight mechanisms at the base distribution level. This study aims to examine the supervision system in the distribution of 3-kg subsidized LPG cylinders in Kuala Batee District, Southwest Aceh Regency, and to assess the extent to which current distribution practices align with the principles of Maqashid Syariah. This research employs a qualitative method with a descriptive-analytical approach. Data were collected through field observation, in-depth interviews with LPG outlet owners, five subsidy recipients from the local community, one relevant village official, and a review of policy and regulatory documents. The findings were analyzed within the framework of Maqashid Syariah, focusing on the principles of hifz al-mal (protection of wealth) and hifz al-nafs (protection of life). The results indicate that the existing supervision of LPG distribution remains ineffective. Key issues include the misidentification of eligible recipients, inconsistent pricing beyond regulatory limits, and the absence of a robust verification system. From the perspective of Maqashid Syariah, such shortcomings not only undermine social justice but also hinder the realization of public welfare. Therefore, improvements are needed in the form of data-driven distribution systems, collaborative oversight, and public education to ensure that LPG subsidies are distributed fairly and in accordance with Islamic ethical values.
