Abstract

Perbuatan hukum misalnya jual beli bukanlah suatu perbuatan hukum yang sudah final pada saat terjadi suatu "akad" atau ''perjanjian" dianggap kesepakatan awal sesuai dengan asas konsesualisme menurut hukum perdata barat, akan tetapi dalam hukum Islam, akad atau perjanjian akan menjadikan syarat penyerahan atau "levering" sebagai suatu patokan telah selesainya perbuatan hukum jual-beli. Dalam hukum bisnis Islam bisa saja "penyerahan barang yang dibeli" sudah dilakukan pada saat akad ditutup atau ditanda tangani. Akan tetapi masing-masing pihak baik pembeli atau penjual tetap mempunyai opsi (pilihan) untuk membatalkan atau melangsungkan perbuatan hukum jual beli.

Abstract

The aim of this research is to examine how multicultural education is incorporated into PAI learning in vocational schools. This research was conducted at SMKN 4 Cilegon City. The research method uses a qualitative approach. The first data collection method was interviews with school principals, PAI subject teachers and students. The second is documentation and observation. Data analysis techniques include data collection, data reduction, and drawing conclusions. The results of the author's research show that multicultural education in PAI learning: 1) Applying knowledge that upholds the principles of love, openness and respect for each other 2) Recognizing religious tolerance among all members of society in the context of multicultural education in school life.

Abstract

The COVID-19 pandemic has changed the education paradigm around the world, including in Indonesia. The focus of this journal is to investigate post-pandemic Islamic religious education learning policies in Madrasah Ibtidaiyah and Primary Schools. This study aims to analyse the strategies and policies adopted by these educational institutions in facing the challenges of distance learning and the implementation of health protocols. The research methods used were case studies and in-depth interviews with key stakeholders such as school principals, teachers, parents and students themselves. Data was analysed using a qualitative approach to describe the changes in learning strategies, the role of technology in teaching Islam, and the challenges and opportunities faced in the adaptation process. The results show variations in the implementation of learning policies, depending on technological infrastructure, availability of human resources and parental support. Nonetheless, Islamic religious education remains a top priority with an emphasis on religious and moral values amid the global health crisis. The implications of this study are the need for improved technological infrastructure, more intensive teacher training in online learning and the important role of families in supporting religious education at home.

Abstract

This study aims to analyse the dogmas received by wives in Bali and Banten regarding their obligation to provide for their families. It also explores the shifting roles in the fulfilment of these obligations. Employing a qualitative research method with an empirical juridical approach, also known as a sociological approach, data were collected through observations, interviews, document analysis, and literature reviews. The data collected were analysed using Interpretative Phenomenological Analysis (IPA). The findings reveal differences in the dogmas received by wives in Bali and Banten. Women in Bali perceive the responsibility of earning a living as a shared duty between husbands and wives. In contrast, women in Banten view it as an absolute obligation of the husband; if the wife works, her role is merely to support the husband in meeting the family’s needs. The role shift in providing for the family occurs due to various factors, including economic needs, the wife’s skills being more relevant, the husband’s illness, prolonged absence without notice, death, and old age. Women in both Bali and Banten often assume the role of breadwinners for several reasons, such as the higher availability of job opportunities for women, economic challenges, higher educational attainment of wives, greater demand for women in the labor market, pre-marriage employment contracts, and inherited customs. This study offers insights into the interplay between traditional dogmas, economic realities, and shifting gender roles in Muslim families, contributing to discussions of gender dynamics and economic adaptation in Indonesia

Abstract

This research aims to describe the communication models and teaching methods used by the ustaz in delivering religious material in majelis taklim. This research uses a qualitative approach with a descriptive method, with data obtained from interviews, observations, and literature review, namely The method of da'wah such as hikmah emphasizes wisdom in delivering messages, adjusting the delivery method to the context and characteristics of the message recipients, while mujadalah involves constructive discussions and dialogues to clarify and strengthen arguments, often in the context of debates and disagreements. This was used long before mau'idhah hasanah became the main focus of this method, delivering teachings with a gentle and wise approach, and tailored to the characteristics of the audience. And mau’idhah hasanah has been used since the time of the Prophethood, initially to convey teachings to the community and the early spread of Islam. after Prophet Muhammad (PBUH) was appointed as a messenger, and it was used and developed during the Mecca and Medina periods.

Abstract

Although embezzlement of inheritance property often occurs in Indonesia, Islamic law does not regulate sanctions for embezzlement of inheritance rights, including the Compilation of Islamic Law as the basis for Islamic inheritance law. This study examines the sanctions for embezzlement of inheritance property in Islamic law and how they are applied in Indonesia; it adopts the normative juridical method with statutory, conceptual, and case approaches. The study findings show that in classical fiqh, there are no sanctions for embezzlement of inherited property. However, based on qiyas and mashlahat mursalah, sanctions against embezzlement of inheritance property in Islamic law are in the form of moral sanctions (gibah) and takzir, whose levels are left to the imam and mujtahid. In Indonesia, a case of embezzlement of inheritance property is included in a criminal case. The sanction for this is imprisonment for a maximum of 4 years or a maximum fine of 900 rupiah as laid down in Article 372 of the Criminal Code. The author argues that the criminal sanction based on qiyas is a takzir sanction set by the government. This study offers an integrative normative framework between classical inheritance fiqh and contemporary positive law and provides a clear legal understanding for the protection of inheritance rights.

Abstract

Artikel ini mengkaji transformasi organisasi pesantren dari era kolonial hingga era globalisasi dengan pendekatan kualitatif deskriptif melalui studi pustaka. Fokus utama terletak pada sejarah lahirnya pesantren, konsep awal sebagai lembaga pendidikan Islam, peran strategisnya dalam pendidikan dan organisasi sosial, serta eksistensinya di tengah arus globalisasi. Hasil kajian menunjukkan bahwa pesantren mampu beradaptasi dengan perkembangan zaman tanpa kehilangan identitas tradisionalnya. Organisasi seperti Nahdlatul Ulama dan Muhammadiyah menjadi contoh bagaimana pesantren berperan dalam membentuk sistem pendidikan Islam nasional yang moderat dan berdaya saing. Pesantren terbukti sebagai institusi pendidikan yang holistik, yang tidak hanya mengajarkan ilmu agama tetapi juga membina karakter, kepemimpinan, dan keterampilan hidup. Dengan demikian, pesantren memiliki kontribusi besar sebagai agen transformasi sosial dan spiritual dalam pembangunan peradaban Islam di Indonesia.

Abstract

The era of disruption is marked by rapid technological developments that change various aspects of life, including how to obtain information and knowledge. Generation Z, as a generation that grew up in a digital environment, has extensive access to various digital media that can be used to deepen their understanding of the Islamic religion. This article explores multiple digital platforms that provide educational content about Islam. Through literature studies and case analysis with a qualitative approach, this article highlights the benefits and challenges of using digital media in religious education. Data was collected from various literature sources and interviews with Generation Z, namely the Informatics Engineering Study Program students at Serang Raya University. The research results show that Generation Z prefers to use digital media to increase and improve their religious knowledge rather than conventional media because it is more effective, efficient, and accessible anytime, anywhere, according to Generation Z's preferences and learning styles. However, challenges such as the validity of the information and interference from irrelevant content are also identified. This article concludes that with the right strategy, good digital literacy, and continued guidance from teachers, educators, and religious leaders, digital media has great potential to become an effective tool in facilitating Generation Z's understanding and interest in Islamic teachings and can help them practice religious teachings better.

Abstract

In Islamic law, there are two views on marital rape: one rejects it because marriage is considered a lifelong consent to sexual relations. At the same time, the other recognizes the possibility of marital rape within a marriage. Unlike UU-PKDRT, marital rape receives strict penalties. This study aims to identify and analyze the legal sanctions for marital rape in UU-PKDRT and Islamic criminal law, compare the sanctions of both laws, and explain the concept of takzir for marital rape. The research method is juridical-normative, using qualitative data and three frameworks: credo theory, legal change, and takzir. The study results show that UU-PKDRT, which includes marital rape, does not contradict Islamic law and therefore should be obeyed by Ulil Amri. The legal sanctions are relevant and in accordance with takzir; sexual relations are a mutual right of husband and wife, and forced sexual relations in marriage are not considered rape but violence that can be sanctioned by takzir; marital rape is not considered rape in Islam because marriage negates fornication; Marital rape in UU-PKDRT is viewed as rape, but in Islamic law, it is only violence that can be sanctioned by takzir after reconciliation efforts. The new theory from this research states that marital rape is violence, not rape.
