Abstract

In Indonesia, the crime rate still reaches 1.01% in 2020, but crime still exists and is a state concern. The purpose of this study is aimed to analyze the offer of maqâshid al-syarî`ah as a solution in overcoming crime in Indonesia. This study is qualitative research in nature with a literature review approach. The object analyzed is Article 29 of UUD 1945 which is analyzed with the concept of maqâshid al-syarî`ah in the study of Islamic law. The results of this study describe that the maqâshid al-syarî`ahconcept can be a solution to overcome crime in Indonesia as its concept regulates various things including God's purposes (qashdu al-syâri') and mukallâf goals (qashdu al-mukallâf) as well as the perspective of constitutional law in the crime in Indonesia. The state regulates matters contained in the state of the fundamental norm, namely the constitution contained in Article 29 of UUD 1945. This article uses a religious approach as a basic rule to regulate the life of the Indonesian legal community so that they live a good life and do not commit the crimes contained in the UUD 1945. Internalization of maqâshid al-syarî`ah in constitutional law is an alternative to protecting citizens from various crimes. Di Indonesia, angka kejahatan masih mencapai 1.01% pada tahun 2020,  artinya kejahatan masih ada dan menjadi perhatian negara. Tujuan penelitian ini adalah menganalisis tawaran  maqâshid al-syarî`ah sebagai solusi dalam mengatasi kejahatan di Indonesia. Penelitian ini merupakan penelitian kualitatif dengan pendekatan kajian pustaka. Objek yang dianalisis adalah  pasal 29 UUD 1945 yang dianalisis dengan konsep maqâshid al-syarî`ah dalam kajian hukum Islam. Hasil penelitian ini menguraikan bahwa konsep maqâshid al-syarî`ah dapat menjadi solusi untuk mengatasi kejahatan di Indonesia sebagaimana konsep maqashid syariah mengatur berbagai aspek diantaranya yaitu tujuan Allah (qashdu al-syâri’) dan tujuan mukallâf (qashdu al-mukallâf) dan begitu juga dengan perspektif hukum tata negara dalam melihat kejahatan di indonesia. Negara mengatur hal yang terdapat pada staats fundamental norm, yaitu konstitusi yang terdapat di dalam UUD 1945 pasal 29. Pasal ini menggunakan pendekatan agama sebagai aturan dasar untuk mengatur tata kehidupan masyarakat hukum Indonesia agar menjalankan kehidupan dengan baik dan tidak melakukan kejahatan sebagaimana yang tertuang di dalam UUD 1945. Internalisasi maqâshid al-syarî`ah dalam hukum tatanegara menjadi alternatif dalam menjaga warga negara dari berbagai kejahatan.

Abstract

To fulfill their needs, humans engage in buying and selling transactions with one another. One of the items that constitute a tertiary human need is dolls, which are in demand among children and even adults. Scholars agree that dolls are toys that are exempt from the prohibition of statues, but scholars differ on the limits of this exception. This difference of opinion certainly has an impact on the law of buying and selling dolls. Sheikh Al Qardhawi argued that dolls are not haram regardless of their shape, because dolls are not used as a tool of worship and glorification. Sheikh Uthaymeen argued that dolls if their shape is perfect and detailed should be avoided to avoid falling into the act of tashwir. In this study, the researcher used a qualitative method to gain a deeper understanding of the doctrines and views of figures related to the research topic. This research is a field research and uses a normative and sociological approach. The data sources used were interviews and a book entitled Al Halal Wal Haram Fil Islam, and Majm? Fatawa wa Rasail Fadhilah Sheikh Muhammad Bin Salih Al Uthaymeen as primary data. And various literature related to the research topic as secondary data. In analyzing the data, the methods used were descriptive and comparative analysis. At the research location, the Istana Boneka Shop, the dolls sold were both perfectly shaped and imperfect. According to Sheikh Al Qardhawi, buying and selling dolls at the shop is permissible because they are not used as tools of worship or glorification. Meanwhile, according to Sheikh Utsaimin, buying and selling dolls without detailed details is permissible, while dolls with detailed details are makruh (rejected) and very likely to be haram (forbidden).   [Dalam memenuhi kebutuhannya manusia melakukan transaksi jual-beli antar satu sama lain. Salah satu barang yang menjadi kebutuhan tersier manusia adalah boneka, yang diminati kalangan anak-anak bahkan orang dewasa. Para ulama sepakat bahwa boneka merupakan mainan yang dikecualikan dari keharaman patung, namun ulama berbeda pendapat mengenai batas pengecualian ini. Perbedaan pendapat ini tentunya berimbas pada hukum jual-beli dari boneka. Syekh Al Qardhawi berpendapat bahwa boneka tidak haram terlepas dari bentuknya, karena boneka tidak digunakan sebagai alat pemujaan dan pengagungan. Syekh Utsaimin berpendapat bahwa boneka apabila bentuknya sempurna dan detail maka harus dijauhi agar tidak terjerumus ke dalam perbuatan tashwir. Dalam penelitian ini peneliti menggunakan metode kualitatif agar bisa memahami lebih dalam doktrin dan pandangan tokoh terkait dengan topik penelitian. Penelitian ini berjenis penelitian lapangan dan menggunakan pendekatan normatif dan sosiologis. Sumber data yang digunakan adalah wawancara dan kitab  berjudul Al Halal Wal Haram Fil Islam, dan Majm? Fatawa wa Rasail Fadhilah Syaikh Muhammad Bin Shalih Al Utsaimin sebagai data primer. Dan berbagai literatur yang berkaitan dengan topik penelitian sebagai data sekunder. Dalam menganalisis data, metode yang digunakan adalah analisis deskriptif dan komparatif. Di lokasi penelitian yaitu Toko Istana Boneka, boneka yang dijual berbentuk sempurna dan tidak sempurna. Menurut Syekh Al Qardhawi jual-beli boneka di toko tersebut halal, dikarenakan tidak digunakan sebagai alat penyembahan dan pengagungan. Sedangkan menurut Syekh Utsaimin jual-beli boneka yang tidak detail hukumnya boleh, sedangkan boneka yang detail hukumnya makruh dan sangat mungkin menjadi haram.]

Abstract

Abstrak: Hukuman cambuk terhadap non muslim pelaku jarimah yang berada di wilayah NangroAceh Darussalam. Sebuah ketentuan yang berlaku dalam wilayah yang mendapat keistimewaanuntuk memberlakukan Syariat Islam, Qanun Jarimah akan mengikat bagi yang berdomisili didaerah istimewah Aceh Darussalam baik muslim sendiri maupun bagi non muslim. Qanun Acehtahun 2014 yang mengatur tentang pelaksanaanya. Ada sepuluh jenis-jenis Jarimah yang diberlakukandi daerah istimewah aceh darussalam yang masuk dalam Qanun Hukum Jinayat dan kitab UndangundangHukum Pidana. Pemberlakuan Qanun Jinayah meskipun terhadap non muslim tentunyahal ini sesuai dengan kemashlahatan bersama dan untuk menciptakan ketentraman masyarakatanya,sehingga tujuan dalam penerapan qanun jinayat dapat akan terlaksana dengan bai dan sempurna.Kata Kunci: Hukuman, Cambuk, Jarimah, Nangro Aceh Darussalam.

Abstract

There are differences of opinion between previous (classical) and current (contemporary) scholars regarding the permissibility of storing gold. Because of these differences, in-depth study or research is needed regarding investing in gold savings, which in this case is focused on one of the financial institutions providing gold savings facilities, namely Bank Syariah Indonesia. This research aims to determine the perspective of classical and contemporary Fikih regarding the relevance of investing in gold savings, the cause of differences of opinion among them, and find the strongest perspective after the Munaqasyah Adillah was held. The research method that the author uses is a normative-empirical type of research with a comparative approach and legal sociology. From the study conducted by the author, the classical Fikih perspective says that it is not permissible to carry out gold buying and selling transactions non-cash or delayed because the illat between gold and money is the same, namely tsamaniyah (price/means of payment). Meanwhile, according to contemporary jurisprudence, carrying out non-cash or deferred gold buying and selling transactions is permitted, provided that the gold is not a legal medium of exchange at that time but is in the form of goods (sil'ah). Even though some opinions allow non-cash gold buying and selling transactions, we should stick to the opinion of Salaf scholars.

Abstract

Marriage in Islamic law has been clearly stated regarding its pillars, conditions, and the permissible and prohibited provisions. This study aims to analyze the Javanese customary marriage practices of the people in Langkat Regency, North Sumatra Province, considering that the community still strongly adheres to various wedding processes as inherited from their ancestors, from the perspective of Islamic law. This research is empirical and uses a social approach. The data analysis employed is the Miles and Huberman model, with the steps of data reduction, data display, and conclusion drawing and verification. In practice, Javanese customary marriages among the people of Langkat Regency still feature a series of traditional Javanese wedding ceremonies, even though they live outside Java Island. The analysis of Islamic law's perspective on Javanese customary marriage shows a dynamic interaction between cultural traditions and religious principles. Determining auspicious wedding days based on 'primbon' can be accepted in Islam as long as it does not involve beliefs in supernatural elements contrary to Islamic law. Furthermore, the practices of 'kembar mayang' and 'pecah telur' in Javanese customary marriage are considered 'urf fasidah (customs contrary to Islamic law) because they involve beliefs in things not based on Islamic teachings. The accommodation process of Islamic law in Javanese marriage customs demonstrates a harmonious integration effort between religion and culture. From an Islamic viewpoint, cultural traditions can be accepted and integrated as long as they do not conflict with the fundamental principles of the religion.

Abstract

This study aims to examine the crime of body shaming in Indonesia from the perspective of Islamic criminal law. This study uses a normative legal research method with a comparative approach. The collected legal material is then qualitatively analyzed to describe the problem and answer the study objectives. The results show that body shaming, both verbal and non-verbal, is a reprehensible act that contradicts human values and is strictly prohibited in Islam, as emphasized in Q.S. Al-Hujurat verse 11 which prohibits acts of ridicule, reproach, and calling others by bad nicknames, and emphasizes the importance of guarding one’s tongue and using excellent and constructive words. In the legal context, body shaming falls into the category of jarimah ta’zir in Islamic criminal law and can be prosecuted under articles related to insult and defamation in positive law in Indonesia. This study recommends various preventive efforts, such as comprehensive public campaigns and education programs about the dangers of body shaming and the importance of respecting physical diversity, including integrating these values into the education curriculum and strict law enforcement. Collaboration between the government, judges, religious leaders, educators, and the community is expected to create a more inclusive environment that values everyone regardless of physical appearance.

Abstract

Elections are an arena for political contestation in the country. to determine the direction of policy that will be chosen by the leader resulting from the results of the election itself. So our involvement in elections is very necessary so that citizens have political rights, namely the right to vote. So we should have to vote in determining the future leader, because one vote of our choice means a lot for Indonesia in the next five years. Islam as a religion, has clearly provided guidelines for us in determining potential leaders in accordance with the Shari'a, as a real illustration of this is reflected in the behavior of the Prophet Muhammad Sallallahu 'Alahi Wassalam and his companions which until now has been applied and improvised by the leaders around the world. This research tries to analyze the concept of Imam Al-Mawardi's thinking in viewing and determining choices in the 2024 elections for leaders who are in accordance with Islamic guidance based on the criteria expressed by Imam Al-Mawardi. This research is qualitative research using a normative-empirical approach based on library research data (literature review). Based on existing analysis, it shows that the criteria possessed by candidates for head of state in the 2024 elections are clearly visible and are in accordance with the views expressed by Imam Al-Mawardi.

Abstract

Penelitian ini bertujuan untuk meneliti tentang tindak pidana kejahatan pedofilia yang pada umumnya terjadi pada anak-anak sebagaimana yang terjadi di Kabupaten Langkat, pada penelitian ini meneliti mengenai bagaimana pengaturan hukum positif terhadap pelaku tindak pidana pedofilia, bagaimana pengaturan hukum pidana Islam terhadap pelaku tindak pidana pedofilia , bagaimana analisis yuridis tentang tindak pidana pedofilia. Penelitian ini merupakan penelitian kualitatif dengan jenis pendekatan yuridis empiris yang menggunakan dua sumber data yaitu sumber data primer dan juga sumber data sekunder. Hasil dari penelitian ini menunjukkan bahwa di dalam KUHP pidana ada menjelaskan secara khusus mengenai sanksi hukum bagi pelaku pedofilia  pada anak, akan tetapi di dalam undang-undang Nomor 17 Tahun 2016 pada pasal 81 ayat 1 dan 2 dijelaskan bahwa orang yang melanggar ketentuan pasal 76d maka dijerat pidana minimal 5 tahun penjara dan maksimal 15 tahun dengan denda sebesar Rp. 5.000.000.000. Dalam ketentuan hukum pidana Islam mengenai tindakan pedofilia atau terhadap anak adalah jarimah dan hukumannya adalah hukuman ta’zir, Praktik tindak pidana pedofilia misalnya yang terjadi di Jln. Tengku Amir Hamzah No.1 Stabat Kabupaten Langkat Provinsi Sumatera Utara dialami oleh dua orang anak di bawah umur, yang mana berdasarkan ketentuan hukumnya maka pelaku dijerat dengan  jarimah ta’zir.

Abstract

The feast in the context of sacrifice is the practice of distributing and serving sacrificial meat to the community as part of a worship ritual aimed at fostering devotion and sincerity to Allah SWT. This study aims to analyze the comparative views of two great scholars, namely Imam Ibn Hajar Al-Haitami and Imam Mansur Al-Buhuti, regarding the law of distributing sacrificial meat to non-Muslims. This study is a qualitative study with a comparative normative sociological approach through a case study method. The results of the study indicate significant differences between the two views. Imam Ibn Hajar Al-Haitami argues that distributing sacrificial meat to non-Muslims is not permitted, in contrast, Imam Mansur Al-Buhuti permits giving sacrificial meat as a form of gift to non-Muslims. The comparative analysis reveals that Imam Mansur Al-Buhuti's view is more relevant to the social conditions of the Kotanopan community, which practices distributing sacrificial meat to non-Muslims as a means of strengthening inter-community relations and creating social harmony. Through this approach, the study seeks to provide new insights into the aspects of halalness, ethics, and benefits in the socio-religious practices of modern society. These findings indicate that this practice is in line with the Islamic principle of being a blessing for all of nature, while enriching the contemporary jurisprudence and providing practical guidance for Muslim communities in building inclusive social relations in a multicultural society.
