Abstract

ABSTRAC This study aims to find out and analyze the legal consequences for a notary against a deed canceled by the court and to find out and analyze the factors causing the cancellation of a deed by the court. This research uses normative legal researchmethods using normative case studies in the form of legal behavior. The subject ofthe study is the law which is conceptualized as a norm or rule that applies in societyand becomes a reference for everyones behavior. So that normative legal researchfocuses on an inventory of positive law, legal principles and doctrines, legal findings in concrete cases, legal systematics, legal comparisons and legal history. laws andregulations The results of this study indicate that from the results of research with the research method and approach used by the author, that the factors causing the cancellation of a deed by the court were because the deed was not read out beforethe parties, there was an element of coercion to sign the deed and the formalrequirements were not fulfilled in making the deed. deed. The author identifies thatthe responsibility of a notary if the deed is canceled due to negligence is to pay compensation to the parties, whether real (material) or intangible (immaterial)compensation. The implication of the research results is that the notary in makingthe deed acts professionally, honestly, and carefully. In addition, the parties whowant to make a deed by a notary to act honestly or provide actual information inmaking a deed by a notary. ABSTRAK Penelitian ini bertujuan Untuk mengetahui dan menganalisis akibat hukum bagi Notaris terhadap akta yang dibatalkan oleh pengadilan Dan Untuk mengetahui danmenganalisis faktor-faktor penyebab dibatalkannya suatu akta oleh pengadilanPenelitian ini menggunakan metode penelitian hukum Normatif menggunakan studi kasus normatif berupa perilaku hukum. Pokok kajiannya adalah hukum yang dikonsepkan sebagai norma atau kaidah yang berlaku dalam masyarakat danmenjadi acuan perilaku setiap orang. Hasil penelitian ini menunjuakan bahwa Darihasil penelitian dengan metode dan pendekatan penelitian yang digunakan penulis, bahwasanya faktor-faktor penyebab dibatalkannya suatu akta oleh pengadilankarena tidak dibacakannya akta dihadapan para pihak, adanya unsur pemaksaanuntuk menandatangani akta dan adanya syarat formil yang tidak terpenuhi dalampembuatan akta. Mengidentifikasi bahwasanya tanggungjawab seorang notaris apabila akta dibatalkan karena kelalaiannya adalah membayar ganti rugi kepada para pihak baik itu ganti rugi yang nyata (materil) maupun tidak nyata(immateril).Implikasi dari hasil penelitian adalah agar kiranya notaris dalam membuat akta bertindak profesioanlitas, jujur, dan cermat. Selain itu para pihak yang ingin dibuatkan akta oleh notaris untuk bertindak jujur atau memberikan keterangan yang sebenarnya dalam pembuatan akta oleh notaris.

Abstract

ABSTRAC This study aims to determine and analyze the legal protection of investors in terms of buying and selling shares online and to identify and analyze the inhibiting factors for the implementation of the factors that hinder the legal protection of investors in terms of buying and selling shares online. The research method used in this study is normative legal research in this case using material collection techniques in the form of document and library studies. The results of this study indicate the form of legal protection for investors as consumers in Law Number 8 of 1999 concerning Consumer Protection, namely the establishment of BPKN and BPSK. Then in Law Number 8 of 1995 concerning the Capital Market, it has been regulated regarding the disclosure of information that must be provided to investors and the regulation of Bapepam-LK as the supervisory body for every activityrelated to the capital market which has now been transferred to the OJK. Then Law Number 21 of 2011 concerning the Financial Services Authority aspects of legal protection provided by this Act are preventive or preventive measures and repressive or repressive measures carried out by the Financial Services Authority. The inhibiting factors faced in protecting investors are that there are still many unlicensed / illegal online stock investments and the lack of knowledge of the investor community regarding illegal investments. Research recommendations are expected by the government to be able to reform Law No. 8 of 1999 concerning Consumer Protection in order to protect consumers optimally in this era of highly developed technology development. It is hoped that in the future the government will need to regulate online stock investment in a special law. It is hoped that in the future there will be coordination and cooperation between OJK and BPKN/BPSK in ensuring investor (consumer) protection. Investors are expected to be more careful in seeking information as well as choosing Securities Companies that are obvious and have obtained permits for their activities. ABSTRAK Penelitian ini bertujuan untuk mengetahui dan menganalisis perlindungan hukum terhadap investor dalam hal jual beli saham online dan untuk mengetahui dan menganalisis faktor penghambat pelaksanaan faktor-faktor yang menghambat perlindungan hukum terhadap investor dalam hal jual belisaham online. Metode penelitian yang dilakukan dalam penelitian ini adalahpenelitian hukum normatif dalam hal ini menggunakan teknik pengumpulan bahan berupa studi dokumen dan kepustakaan. Hasil Penelitian ini menunjukkan Bentuk perlindungan hukum terhadap investor selaku konsumen dalam Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen yaitu dengan dibentuknya BPKN dan BPSK. Kemudian dalam Undang-Undang Nomor 8 Tahun 1995 Tentang Pasar Modal telah diatur mengenai keterbukaan informasi yang harus diberikan kepada investor dan diaturnya Bapepam-LK sebagai badan pengawasan setiap kegiatan yang berhubungan dengan pasar modal yang saat ini telah dialihkan kepada OJK. Kemudian Undang-Undang Nomor 21 Tahun 2011 Tentang Otoritas Jasa Keuangan aspek perlindungan hukum yang diberikanoleh Undang-Undang ini yaitu upaya pencegahan atau preventif dan penindakan atau represif yang dilakukan oleh Otoritas Jasa Keuangan. Faktor penghambat yang dihadapi dalam melakukan perlindungan Investor yaitu masih banyaknya Investasi saham online yang belum berizin / ilegaldan masih minimnya pengetahuan masyarakat investor terkait tentanginvestasi ilegal. Rekomendasi Penelitian diharapkan pemerintah untuk dapat melakukan pembaharuan terhadap Undang-Undang Nomor 8 Tahun 1999Tentang Perlindungan Konsumen agar dapat melindungi konsumen secaramaksimal di era perkembangan teknologi yang sangat berkembang ini. Diharapkan kedepannya pemeritah perlu mengatur investasi saham secara online dalam satu Undang-Undang khusus. Diharapkan kedepannya adanya koordinasi dan kerjasama antara OJK dan BPKN/BPSK dalam menjamin perlindungan investor (konsumen). Investor diharapkan agar lebih cermat dalam mencari informasi serta memilih Perusahaan Efek yang jelas dantelah mendapatkan izin atas kegiatannya.

Abstract

This study examines the practice of child detention by the Public Prosecutor in general criminal cases at the Buton District Prosecutor’s Office, focusing on its conformity with the principles of ultimum remedium and the best interests of the child as mandated by the Juvenile Criminal Justice System Law (UU SPPA). Although the legal framework emphasizes that detention should only be applied as a last resort, empirical findings indicate a tendency toward overuse: from 47 child cases handled between 2020 and 2025, 41 children were detained while only 6 were not. The majority of cases involved theft, violence, narcotics offences, and sexual crimes. Survey data show that 90% of respondents perceived detention as “effective,” reflecting a preference for legal certainty and public order rather than rehabilitation and restorative justice. The study identifies three key factors contributing to this pattern: limited understanding of restorative justice principles, structural constraints such as inadequate child-specific detention facilities and inconsistent inter-agency coordination, and cultural pressures from society and the media that encourage punitive approaches. The findings highlight a significant disparity between normative child protection standards and prosecutorial practices. Strengthening restorative justice, expanding non-custodial measures, improving infrastructure, and enhancing institutional coordination are crucial for aligning detention practices with child protection principles

Abstract

Penelitian ini bertujuan untuk mengkaji sinkronisasi pengaturan royalti atas praktik cover lagu dan pemutaran musik di ruang publik guna memberikan perlindungan terhadap hak ekonomi pencipta di tengah perkembangan monetisasi digital. Dinamika distribusi musik berbasis platform menghadirkan tantangan baru, khususnya terkait batas penggunaan komersial dan nonkomersial yang belum dirumuskan secara eksplisit. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual guna menilai konsistensi norma serta relevansinya terhadap praktik aktual. Kebaruan penelitian ini terletak pada analisis terhadap norma kabur dan kekosongan norma parsial dalam klasifikasi penggunaan digital yang berimplikasi pada ketidakpastian hukum. Hasil penelitian menunjukkan bahwa meskipun sistem pengelolaan royalti telah diatur dan dilembagakan, implementasinya masih menghadapi tantangan berupa ambiguitas parameter komersialisasi, rendahnya kesadaran hukum pengguna, serta kebutuhan peningkatan transparansi dalam distribusi royalti. Kesimpulannya, perlindungan hak ekonomi pencipta telah tersedia secara normatif, namun efektivitasnya dalam menjamin kepastian hukum masih memerlukan penguatan pada aspek implementatif. Rekomendasinya, diperlukan penegasan parameter monetisasi digital, harmonisasi pengaturan klasifikasi penggunaan komersial, serta penguatan transparansi dan akuntabilitas sistem pengelolaan royalti guna mewujudkan kepastian hukum yang lebih adaptif dan berkeadilan di era digital. Abstract This study aims to examine the synchronization of royalty regulations on song cover practices and music playback in public spaces in order to protect the economic rights of creators amid the development of digital monetization. The dynamics of platform-based music distribution present new challenges, particularly regarding the boundaries between commercial and non-commercial use, which have not been explicitly defined. This study uses a normative legal method with a legislative and conceptual approach to assess the consistency of norms and their relevance to actual practices. The novelty of this study lies in its analysis of vague norms and partial normative gaps in the classification of digital use, which have implications for legal uncertainty. The results show that although the royalty management system has been regulated and institutionalized, its implementation still faces challenges in the form of ambiguity in commercialization parameters, low legal awareness among users, and the need for increased transparency in royalty distribution. In conclusion, the protection of creators' economic rights is available normatively, but its effectiveness in ensuring legal certainty still needs to be strengthened in terms of implementation. The recommendation is that it is necessary to clarify the parameters of digital monetization, harmonize regulations on the classification of commercial use, and strengthen the transparency and accountability of the royalty management system in order to achieve greater legal certainty that is more adaptive and equitable in the digital era.
