Abstract

This study aims to determine the role of Muslim women’s dakwah outside the home in the context of the al-Ḍarar al-Asyaddu Yuzālu bi al-Ḍarar al-Akhaf rule, with a particular focus on the activities of Muslim women engaged in dakwah outside the home. This research employs a descriptive qualitative approach, eschewing statistical analysis, and focuses on case studies derived from field research. The study employs a normative and phenomenological methodology, with a qualitative descriptive analysis. The findings revealed that the Muslimah Wahdah Islamiyah Tanralili Branch exerted a significant impact on the dissemination of da’wah in Tanralili District. Through the active organisation of religious activities in Tanralili, the Branch facilitated a gradual understanding of Islamic law among the community, enabling its practical application in their lives. With regard to the activities of Muslim women in the field of da’wah, if we consider them in the context of the rule al-Ḍarar al-Asyaddu Yuzālu bi al-Ḍarar al-Akhaf, we find that the situation of Muslim women engaged in da'wah today is one that entails certain risks. These dangers are lessened when compared to the dangers of Muslim women not preaching in the community, namely the spread of shirk and the distance of the community from Islamic law. The findings of this research imply that women are permitted to leave the house for reasons outside the home, such as preaching, but they must still adhere to the principles of modesty and decorum that are expected of them as Muslim women. They must also fulfil their domestic responsibilities before leaving the house.

Abstract

The research aims to analyse the law of sharia developer practices without bank credit in Istiqomah Housing in the perspective of fiqh muamalah. This research uses qualitative field research with a research approach using normative and sociological approaches. As for data collection through interviews and documentation, then the data is analysed using qualitative descriptive analysis. The results of the research found that long-term credit begins with negotiations between the housing authority and consumers regarding the fees to be paid, as well as determining the time to install the house with a maximum time of 10 years. This agreement is written, signed and owned by both parties. Home financing in Istiqomah housing uses an istiṣnā‘ contract, where istiṣnā’ is a form of sale and purchase contract that involves ordering the manufacture of goods. The housing developer provides a credit payment system without going through a bank, and this credit sale and purchase is allowed in sharia. The ruling on the sale and purchase of housing is permissible because it fulfils the pillars and conditions of the sale and purchase contract and does not contradict the Islamic Shariah. The implications of the research are expected to be a good reference for developers, consumers, and the community to always apply home sale and purchase financing in accordance with Islamic law.

Abstract

This research project aims to analyze the effectiveness of food social assistance regulations in Indonesia on multidimensional welfare from the perspective of maqāṣid al-syarī’ah. This research employs a mixed-methods approach, integrating both quantitative and qualitative techniques. The quantitative methods include linear regression tests, while the qualitative methods comprise qualitative descriptive analysis. The findings of this research indicate that the food social assistance program, implemented from 2020 to 2023, had a negligible impact on multidimensional welfare indicators in Indonesia, including the unemployment rate, poverty, and the human development index. While the relationship between food social assistance and the Human Development Index (HDI) is relatively weak, there are indications that adequate food access can improve people's nutrition and health. When viewed through the lens of maqāṣid al-syarī’ah, which prioritizes the pursuit of beneficial outcomes, the implementation of food social assistance aligns with the principles of maqāṣid al-syarī’ah, namely the preservation of religion (hifdz al-dīn), the preservation of the soul (hifdz al-nafs), the preservation of reason (hifdz al-’aql), the preservation of property (hifdz al-māl), and the preservation of offspring (hifdz al-nasl). It is hoped that this research will provide guidance for the government in improving food social assistance and other policies for the benefit of the community in line with maqāṣid al-syarī’ah.

Abstract

The objective of this study is to examine the differences and similarities in the application and interpretation of the fatwa on hawalah contracts between the Indonesian Ulema Council and the Malaysian Fatwa Committee. The research methodology employed in this study is qualitative research, employing a comparative approach. Following the collection of data from fatwas, books, and other literature, the data is subjected to inductive analysis in order to yield the results of this study. The analysis of similarities and differences, as well as compatibility with Islamic law, conducted between the DSN-MUI fatwa and the Regional Mufti of Biscotuan's fatwa on hawalah has led to the following conclusions: DSN Fatwa No. 12/DSN-MUI/IV/2000: The aforementioned fatwa is in accordance with Shariah principles as it fulfils the elements and conditions of hawalah without an increase in rent or profit. Fatwa No. 58/DSN-MUI/V/2007: The aforementioned instrument is not fully compliant with Shariah principles because it allows for the imposition of fees in the context of a pending hawalah transaction, which may potentially lead to riba. In contrast, the Mufti of Persekutuan Province has issued a fatwa that is compatible with Shariah principles. This fatwa ensures that hawala transactions are only between two parties with a debt-to-debt relationship and that no fees are charged. Consequently, the instrument avoids the imposition of usury. In this context, the fatwa of the Pijapat Persekutuan Mufti is more rigorous in maintaining compliance with Sharia principles, particularly in preventing usury. Although Islamic financial institutions recognise hawalah as a practical necessity, they must exercise caution to ensure that they do not contravene the fundamental Shariah principle of prohibiting usury.

Abstract

This research aims to evaluate the improvement in the Human Development Index (HDI), which encompasses health, education, and income, between 2021 and 2023. Furthermore, this research analyses the relationship between the human development index and the environmental performance index from the perspective of Maqāṣid al-Shari’ah. Employing a mixed-methods approach, this study integrates qualitative and quantitative methodologies. The quantitative method uses linear regression for data analysis and interpretation with descriptive pattern qualitative analysis. The findings reveal a negative correlation between Indonesia's HDI and its EPI. Individuals with higher levels of education, better health, and increased income tend to exhibit greater awareness of environmental sustainability. This finding supports Maqāṣid al-Shari’ah, which emphasizes the importance of protecting life, education, property and offspring. Improving human welfare and protecting the environment are key to achieving sustainable development. Government policies should simultaneously promote human development and environmental protection. This fostered sustainable prosperity in line with the principles of Maqāṣid al-Shari’ah.

Abstract

The final project in the form of a thesis is a requirement for obtaining a bachelor's degree and testing students' procedural skills, readiness, and learning outcomes. This study aimed to identify the obstacles faced by female students and their solutions in completing the thesis in the Comparative Mazhab Study Programme at STIBA Makassar in the 2022/2023 academic year. The research questions raised are: What are the obstacles and solutions for female students in completing the thesis in the Comparative Mazhab Study Programme at STIBA Makassar in the 2022/2023 academic year? This field research uses a qualitative approach with data collected through observation and questionnaires. The results showed that the main obstacles female students faced in completing the thesis were dominated by internal factors. These internal factors have a more significant impact than external factors. The main internal barriers include difficulties in mastering the thesis material, challenges in translating Arabic literature into Indonesian, and problems in mastering the Indonesian spelling system (EYD). External factors include a lack of understanding of STIBA's scientific writing guidelines, incomplete references to STIBA's women's library, and the activeness of supervisors. Solutions to these problems include supervisors directing students to focus on their research topics, encouraging them to read more, using dictionaries, and utilizing current technology. Additionally, academic institutions should impose strict deadlines to motivate students to complete their theses on time and ensure that supervisors provide adequate guidance and supervision. This study concludes that internal factors significantly hinder female students from completing their theses on time. Addressing these issues through better guidance and stricter deadlines can help to overcome these barriers

Abstract

This study aims to analyse the influence of average years of schooling and life expectancy on Indonesia's Human Development Index (HDI) for the period 2021-2023 and its implications from an Islamic economic perspective based on maqāṣid al-Syarī'ah. This study employs a mixed-method approach, combining quantitative analysis through multiple linear regression tests to analyse the impact of average years of schooling and life expectancy on Indonesia's HDI for the 2021-2023 period, with qualitative analysis through content analysis from the perspective of maqāṣid al-Syarī‘ah. The results of this study indicate that average years of schooling and life expectancy have a positive and significant impact on the improvement of the Human Development Index (HDI) in Indonesia for the period 2021-2023, contributing 73.50 per cent to HDI variation. The increase in average years of schooling reflects improved access to education, thereby supporting workforce quality, while the stability of life expectancy indicates the success of healthcare services and improving living conditions for the population. From an Islamic economic perspective, these findings reinforce the connection between HDI indicators and the five objectives of maqāṣid al-Syarī‘ah, namely the protection of religion, life, intellect, lineage, and property, indicating that HDI improvement supports human development aligned with Sharia values. The implications of these findings underscore the importance of integrating education and health policies with environmental conservation policies to achieve a fair, sustainable, and prosperous Islamic economy for society.
