Abstract

Complexity and challenges in uncovering crimes by the police have brought the law enforcement process to purely formal matters. Since the Indonesian police agency separated from the armed forces, their formal and professional attitude has faced many realities on the ground: choosing formal precedence (legal procedures) and ignoring the interests of victims. Legal procedures are more focused on formal justice in accordance with existing, written rules of the game and cannot provide freedom of action. The police are only the spokesperson for written laws and regulations. The idea of ​​being part of people's lives is collided with formal procedures. This condition requires the police to ignore substantial justice, whose importance is more important than mere procedural matters. Law enforcement that is only based on procedures without being balanced with efforts to achieve the goals of law enforcement actually has the potential to damage the order of human rights values. The type of research used is normative legal research using a legal approach, a historical approach, and a philosophical approach. Law enforcement by the police which tends to discriminate against the rights of victims has an impact on the low level of public trust in the police institution which ultimately makes many victims reluctant to report to the police.

Abstract

Selama ini masih banyak masyarakat (konsumen) khususnya mahasiswa di Kota Palu yang belum mengetahui tentang regulasi yang mengatur dan melindungi hak-hak mereka sebagai konsumen. Oleh karena itu, perlu adanya pengetahuan dan pemahaman untuk mengatasi permasalahan tersebut, agar kedepannya masyarakat terhadap hukum semakin baik, dan pada akhirnya dapat meminimalisir tindakan pelaku usaha yang dapat merugikan konsumen. Pengabdian ini laksanakan yang menghadorkan mahasiswa yang tergabung dalam Ikatan Pemuda Pelajar Mahasiswa Kabupaten Luwu Timur (IPPMK-Lutim). Dengan metode yang dilakukan yakni metode ceramah dan diskusi dengan mahasiswa yang hadir. Hubungan hukum dalam perlindungan konsumen merupakan hubungan hukum segitiga dengan menempatkan konsumen dan pelaku usaha sebagai pelaku utama dalam proses transaksi barang dan/atau jasa. Hubungan ini dalam ranah hukum privat dimana kedua belah pihak memiliki kedudukan yang setara. Hubungan hukum terjadi berdasarkan asas kebebasan berkontrak dan asas konsensualitas. Selain konsumen dan pelaku usaha, terdapat pihak ketiga yaitu pemerintah yang berperan sebagai regulator dalam mengatur pola hubungan hukum antara konsumen dengan pelaku usaha. Oleh karena itu, mahasiswa dipelolopri sebagai motivator yang diharapkan akan dapat lebih paham dalam regulasi perlinddungan konsumen terlebih dalam kondisi pandemi ini.

Abstract

Consumers and business actors are the main actors in the process of transacting goods and / or services. In addition to consumers and business actors, the Government acts as a regulator in regulating the pattern of legal relations. This service activity is carried out to be able to increase students' knowledge and understanding of consumer law protection. By using the lecture and discussion method with the target students at SMAN 1 Palu. The conclusion is the lack of information and socialization of students regarding consumers and their protection. For the students, they only know the purchase of goods without realizing that every thing used must be protected. Especially if there are goods that are not suitable even to the detriment of consumers.

Abstract

AbstractMarriage is an inner and outer bond between a man and a woman who becomes husband and wife with the aim of eternal marriage, obtaining happiness and having children. So that the goal of eternal marriage can be realized, then the provisions stipulated in the Marriage Law No. 1 of 1974 must be obeyed, one of which is marriage without coercion and the age limit for marriage, Kabalutan Village with local wisdom which has a tradition, if a man and a woman are found together after 12 o’clock at night, then by community leaders the couple is immediately married, an immature marriage causes easy divorce. Divorce that occurs due to couples who are not physically and mentally ready, so that the divorce rate in Kabalutan Village increases, triggers Kabalutan Village to be known as Kampung Janda. However, in recent years, based on the results of deliberations between community leaders and traditional leaders, the sanctions were later changed to sanctions for lifting stones (baka batu) of at least 2 cubic meters. These sanctions make people afraid of violating them and these sanctions are very effective in reducing the number of widows, especially widows at a young age. This paper uses a juridical-empirical research method, the conclusion of this paper is that the nickname of the widow’s village in Kablutan Village, Central Sulawesi is the impact of a living and developing tradition, namely by sanctioning direct marriage of male and female couples who are found alone at 12 o’clock at night.Keywords: Widow Village; Marriage Law; Divorce. AbstrakPerkawinan adalah ikatan lahir bathin antara seorang laki laki dan perempuan menjadi suami isteri dengan tujuan perkawinan yang kekal, mendapatkan kebahagiaan dan mempunyai keturunan. Nagar tujuan perkawinan kekal dapat terwujud, maka ketentuan yang diatur dalam UU Perkawinan No 1 Tahun 1974 harus ditaati, salah satunya yakni perkawinan tanpa paksaan dan batas usia kawin, Desa Kabalutan dengan kearifan lokal memiliki tradisi, jika seorang laki laki dan seorang perempuan kedapatan berduaan diatas jam 12 malam, maka oleh tokoh masyarakat pasangan tersebut langsung diberikan sanksi yakni dikawinkan, perkawinan yang tidak matang menyebabkan mudahnya perceraian. perceraian yang terjadi akibat pasangan yang tidak siap jiwa raga, sehingga angka perceraian di Desa Kabalutan meningkat, dan menjadi pemicu Desa Kabalutan dikenal dengan julukan Kampung Janda. Akan tetapi beberapa tahun belakangan, berdasarkan hasil musyawarah tokoh masyarakat dan tokoh adat, sanksi kemudian diganti menjadi sanksi mengangkat batu (baka batu) minimal 2 kubik. sanksi tersebut membuat masyarakat takut melanggarnya dan Sanksi tersebut sangat efektif mengurangi angka janda, terutama janda diusia muda. Tulisan ini menggunakan metode penelitian yuridis-empiris, kesimpulan dari tulisan ini , bahwa julukan kampung janda di Desa Kablutan Sulawesi Tengah adalah dampak dari tradisi yang hidup dan berkembang yakni dengan sanksi mengawinkan langsung pasangan laki-laki dan perempuan yang kedapatan berduaan diatas jam 12 malam.Kata Kunci: Kampung Janda; Hukum Perkawinan; Perceraian.

Abstract

Pengabdaian ini berjudul ”Sertifikat Sebagai Upaya Perlindungan Hukum Terhadap Masyarakat Kabupaten Parigi Moutong”. Pengabdian yang dilatarbelakangi Sertifikat Hak Milik (SHM) merupakan instrumen penting dalam melindungi hak atas tanah dan memberikan kepastian hukum bagi masyarakat. Namun, di wilayah Parigi Moutong, terdapat berbagai permasalahan terkait SHM yang berimplikasi pada aspek pendidikan andragogik dan pedagogik. Tujuannya adalah untuk memberi pengetahuan dan pemahaman tentang hukum pertanahan dan terkait hak dan kewajiban pemegang sertifikat hak milik (SHM). Tahapan dalam pelaksanaannya adalah berkoordinasi dengan pihak-pihak terkait (Stakeholder) untuk memperoleh data terkait pemegang sertifikat hak milik (SHM) di kabupaten Parigi Moutong dan selanjutnya menentukan jadwal penyuluhan sebanyak 2 kali sehari, penyuluhan yang dimaksud adalah tentang hukum pertanahan dan hari lainya tentang materi sertifikat hak milik (SHM). Di dalamnya akan ada dialog atau diskusi untuk memaksimalkan pemahaman mereka (masyarakat sasaran) dan bagaimana problem solving terkait permasalahan yang ada. Abstract

The purpose of this study is to analyze the factors that hinder the implementation of government policies against the elimination of minimal capital of legal entities as an effort to develop MSME to improve the regional economy in Palu of Central Sulawesi. This research was an empirical research method using a qualitative descriptive approach. The results showed the factors inhibiting the implementation of government policy on the elimination of minimal capital of legal entity making is the lack of information about Government Regulation Number 29 of 2016 concerning Changes in The Basic Capital of The Establishment of Limited Liability Companies, Constraints on the requirements of making Limited Liability Companies both due to large capital constraints for the manufacture of Limited Liability Companies and Due to Administrative System Constraints that are quite difficult, and the latter is the Orientation of Individualist Thinking.

Abstract

Article 1 of Marriage Law Number 16 of 2019 amending the Marriage Law 1 of 1974, states that marriage is a marriage is a physical and mental bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family based on God Almighty, a marriage that is built based on physical and mental bonds, with the aim of being eternal, and getting offspring that can continue generations. However, not all existing marriages run smoothly as expected, the many obstacles and trials in every household sometimes trigger a divorce, which consequently has an impact on one of the children born. As a result, many divorced couples feel entitled to child custody. This paper takes the formulation of the problem of how child custody due to divorce, after the decision of the Constitutional Court Number 140/PUU-XXI/2023 from the perspective of Human Rights. This paper uses a normative juridical writing method with a statutory approach.

Abstract

Setiap orang adalah konsumen tanpa melihat kedudukan hukum dan status sosialnya. Pemerintah dan pelaku usaha serta profesi lainnya saat menggunakan barang/jasa orang lain kedudukannya menjadi konsumen. Sejak manusia dalam kandungan sampai meninggal dunia adalah konsumen. Oleh karena itu hukum memberikan perlindungan agar tidak dirugikan kepentingannya oleh pelaku usaha, baik dalam keadaan normal maupun saat terjadi keadaan darurat seperti saat ini, dimana Indonesia dan seluruh dunia dilanda Pandemi Covid-19. Permasalahan dalam penelitian ini adalah bagaimana pola prilaku konsumen selama Pandemi Covid-19 dalam memenuhi kebutuhan hidupnya?. Penelitian empiris dengan menggunakan beberapa pendekatan, data dianalisa secara kualitatif-kuantitatif, dan hasilnya berbentuk deskriptif analitik. Kesimpulan penelitian adalah selama pandemi Covid-19 perilaku konsumen berubah terutama pada aspek pemenuhan kebutuhan hidup sehari-hari dan upaya meningkatkan imunitas. Olehnya, di masa Pandemi Covid-19 pemerintah harus meningkatkan perannya sebagai pengayon dan pelindung konsumen.
