Abstract

One of important phenomenons in Indonesia history is growing of Negara Islam Indonesia (NII) founded by SM. Kartosoewiryo in early independence. NII is stated as an insurgent movement that disturbed country stability. The government finished this movement by military operation (operasi pagar betis), then its leader was executed to death in September 5, 1962. But NII buffetings was not ended because after SM. Kartosoewiryo, NII was divided become some groups, among others NII Fillah in Garut by Sensen Komara’s leadership who could defend it till now. This research uses qualitative approach. This research concludes that NII Fillah Sensen Komara constitutes continuance of NII Kartosoewiryo after some leadership changes, from Jaja Sudjadi, Bakar Misbah, and Sensen Komara as the third leadership till now. While NII Fillah understanding about Islam country concept, they have opinion that Islam country constitutes politics power having function to apply and put Islam laws into effect and only one tariqah in applying a system and its laws overall in national and state life. Keyword: religious social movement, NII Fillah   Abstrak Salah satu peristiwa penting yang meninggalkan bekas dalam catatan sejarah Indonesia adalah berdirinya Negara Islam Indonesia (NII) di bawah pimpinan SM. Kartosoewiryo di awal masa kemerdekaan. NII dinyatakan sebagai gerakan pemberontak yang mengganggu stabilitas negara. Pemerintah menghabisi gerakan ini dengan operasi militer (operasi pagar betis), kemudian pimpinannya di eksekusi mati pada 5 September 1962. Namun perjalanan perjuangan NII tidak berakhir begitu saja, karena pasca SM. Kartosoewiryo, NII terpecah menjadi beberapa faksi, diantaranya adalah NII Fillah di Garut dengan pimpinan Sensen Komara yang berhasil mempertahankan eksistensinya hingga sekarang. Penelitian ini menggunakan pendekatan kualitatif. Hasil penelitian ini menunjukkan bahwa NII Fillah pimpinan Sensen Komara merupakan kelanjutan dari NII Kartosoewiryo setelah mengalami beberapa pergantian kepemimpinan, dari Jaja Sudjadi sebagai pimpinan NII Fillah pertama, Bakar Misbah sebagai pimpinan NII Fillah kedua, kemudian tonggak kepemimpinan jatuh kepada Sensen Komara sebagai pimpinan NII Fillah ketiga hingga sekarang. Sedangkan pemahaman NII Fillah mengenai konsep negara Islam, mereka berpendapat bahwa negara Islam merupakan kekuatan politik yang berfungsi untuk menerapkan dan memberlakukan hukum-hukum Islam serta satu-satunya tariqah dalam menerapkan sistem dan hukum-hukumnya secara menyeluruh dalam kehidupan berbangsa dan bernegara. Abstract

In general, economic studies are divided into macroeconomics and microeconomics. Macroeconomics discusses more about policies made by the government in order to regulate monetary and fiscal matters, while microeconomics discusses more about corporate economic actors. Company management itself consists of operational management, marketing management, human resource management and financial management. Financial management is in charge of how companies seek and manage sources of funds, both own capital and foreign capital (loans) to meet the company's needs in producing products and services to be effective and efficient. Islam exists as a value and order in business with the term Maqashid syari'ah which was first coined by Al-Syatibi. It turns out that these values ​​can be implemented in company financial policies so that they can improve financial performance. And it can be concluded that an Islamic company is a company that implements or tries to apply the values ​​that exist in the Maqashid syari'ah. By implementing a murabahah financing scheme in Islamic banking, the rate of return is more profitable for both companies that receive financing and for banks that distribute financing. This is due to differences in financial structuring patterns between Islamic banking and conventional banking. Keyoword: Maqashid Syari'ah, financial structuring, Islamic financial institutions Abstrak Pada umumnya kajian ekonomi itu terbagi dalam ekonomi makro dan ekonomi mikro. Ekonomi makro lebih banyak membahas tentang kebijakan yang dibuat oleh pemerintah dalam rangka mengatur moneter dan fiskal, sedangkan ekonomi mikro lebih banyak membahas tentang pelaku ekonomi perusahaan. Manajemen perusahaan sendiri terdiri dari manajemen operasional, manajemen pemasaran, manajemen sumber daya manusia, dan manajemen keuangan. Manajemen keuangan bertugas bagaimana perusahaan mencari dan mengelola sumber dana baik modal sendiri maupun modal asing (pinjaman) untuk memenuhi kebutuhan perusahaan dalam menghasilkan produk dan jasa agar efektif dan efisien. Islam hadir sebagai sebuah nilai dan tatanan dalam bisnis dengan istilah Maqashid syari’ah yang pertama kali dicetuskan oleh Al-Syatibi. Ternyata nilai-nilai tersebut bisa diimplementasikan dalam kebijakan keuangan perusahaan sehingga bisa meningkatkan kinerja keuangan. Dan bisa disimpulkan bahwa perusahaan islam itu adalah perusahaan yang menerapkan atau berusaha mengaplikasikan nilai-nilai yang ada pada Maqashid syari’ah. Dengan menerapkan skem pembiayaan murabahah di perbankan islam maka tingkat pengembalian hasil lebih menguntungkan baik bagi perusahaan yang menerima pembiayaan maupun pihak bank yang menyalurkan pembiayaan. Hal ini dikarenakan adanya perbedaan pola strukturisasi keuangan antara perbankan syariah dengan perbankan konvensional.   Kata Kuci: Maqashid Syari’ah, strukturisasi keuangan, instansi keuangan syariah

Abstract

Islamic politics faced challenges in influencing the future of Indonesia during the post-independence era. Modernist Islamic groups struggled to counter the growing influence of the guided democratic authoritarianism regime. As a result, the Islamic political party Masyumi was disbanded, and its leader, Mohammad Natsir, faced derogatory nicknames such as "ringworm cat" from the authorities. The Nahdlatul Ulama (NU), which sought to compromise with power, had a limited role on the national political stage. This study employs a qualitative method with a literature review approach. The findings indicate that the relationship between religion and power varies across different religions in terms of practice and doctrine. Nonetheless, it is evident that religion and state power are deeply interconnected, with "religion becoming the core of power and power becoming the core of religion." It is crucial to examine this perspective within the context of our respective religious communities. Politik Islam mengalami kemandulannya, setelah gagal di pentas Nasional dalam menentukan Indonesia masa depan pada pasca-kemerdekaan. Saat itu kelompok Islam modernis tidak mampu membendung kecenderungan rezim otoritarianisme demokrasi terpimpin. Bahkan partai politik Islam Masyumi harus bubar sebagai jawaban kekalahan politik itu dan Mohammad Natsir, ujung tombak kekuatan kelompok ini harus rela dijuluki “kucing kurap” oleh penguasa saat itu. Sementara NU yang berusaha melakukan kompromi dengan kekuasaan, pada akhirnya tidak memiliki peran yang signifikan dalam pentas politik Nasional. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kepustakaan. Hasil penelitian menunjukkan bahwa hubungan agama dan kekuasaan berbeda dari satu agama ke agama yang lain dalam praktik maupun dalam doktrinnya. Namun pengalaman menunjukkan bahwa agama dan kekuasaan negara sulit dilepaskan. “Agama menjadi inti kekuasaan dan kekuasaan menjadi inti agama”. Pandangan ini perlu kita periksa dalam realitas komunitas agama masing-masing.

Abstract

Abstract People currently do not know how to implement parallel ijarah contracts in collateral-free multipurpose financing in Islamic banking and they tend to enter into contracts with other individuals without knowing what the appropriate terms and mechanisms are like, including the risks posed due to the lack of guarantees provided. customers so that many of them commit acts of default. The purpose of this study was to determine the implementation of parallel ijarah contracts in multipurpose financing without collateral in Islamic banking. This study uses an empirical sociological approach that is descriptive analysis using qualitative data as a type of research and library research as one of its data collection techniques. The difference between this research and previous research lies in the objects and subjects studied which are more complex and structured in discussing parallel ijarah contracts in collateral-free multipurpose financing in Islamic banking. The results of the study found that the implementation of parallel ijarah contracts in multipurpose financing without collateral in Islamic banking is carried out through a submission process consisting of interview processes, customer business surveys, financing agreements, and implementation of MTA financing activities with monthly installment fees supervised by the bank and the supervisory board sharia with transparency or openness from all parties so that problematic financing does not occur either in the form of default. Keyword: Parallel Ijarah, Multipurpose Without Collateral, Sharia Banking Abstrak Masyarakat saat ini kurang mengetahui bagaimana cara pengimplementasian akad ijarah paralel dalam pembiayaan multiguna tanpa agunan di perbankan syariah dan mereka cenderung melakukan akadnya dengan individu yang lain tanpa mengetahui istilah dan mekanisme yang sesuai itu seperti apa, termasuk terkait resiko yang ditimbulkan karena tidak adanya jaminan yang diberikan nasabah sehingga banyak dari mereka melakukan perbuatan wanprestasi. Tujuan penelitian ini adalah untuk mengetahui implementasi akad ijarah paralel dalam pembiayaan multiguna tanpa agunan di perbankan syariah. Penelitian ini menggunakan metode pendekatan sosiologis empiris yang bersifat deskriptif analisis dengan penggunaan data kualitatif sebagai jenis penelitiannya dan studi kepustakaan (Library Research) sebagai salah satu teknik pengumpulan data nya, selanjutnya data yang telah dihimpun disusun untuk kemudian disimpulkan secara objektif. Pembeda penelitian ini dengan penelitian sebelumnya yaitu terletak pada objek dan subjek yang diteliti lebih kompleks dan terstruktur membahas akad ijarah paralel dalam pembiayaan multiguna tanpa agunan di perbankan syariah. Hasil penelitian menemukan bahwa implementasi akad ijarah paralel dalam pembiayaan multiguna tanpa agunan di perbankan syariah dilakukan melalui proses pengajuan yang terdiri dari proses wawancara, survei usaha nasabah, kesepakatan pembiayaan, dan pelaksanaan kegiatan pembiayaan MTA dengan biaya angsuran setiap bulan yang diawasi oleh perbankan dan dewan pengawas syariah dengan adanya transparansi atau keterbukaan dari semua pihak agar tidak terjadi pembiayaan yang bermasalah baik dalam bentuk wanprestasi. Abstract

The decision of customers to engage with Islamic banking products is influenced by factors that cater to their desires and needs, with Hajj being a profound aspiration for every Indonesian Muslim. This study aims to scrutinize the impact of promotion and corporate image on customer decisions regarding the utilization of the Haji iB Maslahah savings product at Bank Jabar Banten Syariah KCP Cikurubuk. Questionnaires were distributed to customers of Mudharabah savings products at the mentioned bank, yielding 20 purposively sampled respondents. The data analysis involved multiple linear regression. The findings indicate that both promotion and corporate image collectively influence customer decisions, supported by F counts > F tables (7.819 > 3.59). On a partial level, promotion significantly impacts customer decisions (t calculate > t table: 3.345 > 2.10092), while corporate image, unfortunately, does not have a significant effect on customer decisions (t calculate < t table: 0.683 < 2.10092). This underscores the critical importance of robust promotion strategies and the ongoing maintenance of a positive corporate image. The implications of this research extend to Islamic banking, urging continual enhancement of promotion efforts and corporate image management to enhance customer decisions in favor of their products.

Abstract

The obligation to certify halal products in circulation is limited to food, beverages, goods, or services. This study determined the effect of halal labeling on the purchase intention of Indonesian Muslim communities in non-food halal products. Even though laws regulate halal products in circulation, not all people know about halal products, especially non-food products. This research method used a mixed method, which combined quantitative and qualitative methods. The design was a two-phase mixed method, with data collection techniques based on explanatory strategies. The results were analyzed with sequential data; quantitative was used as the basis for collecting qualitative data. The results of this study indicated there was a partially accepted influence of religiosity on Purchase Intention. Religiosity positively and significantly affected the Purchase Intention of non-food halal products. Furthermore, the hypothesis that said there was influence of the Perception of the Halal Label on Purchase Intention was partially accepted. Thus, the Perception of the Halal Label positively and significantly affected the Purchase Intention of non-food halal products. The significant level that produced 0.000, smaller than the specified significance level, was 0.05, so the significance level of Religiosity and Perception of Halal Labels was significant to Purchase Intention. It could also be seen that the f-count value was 118.210 with an f-table value of 3.1504, so the f-count > f-table or 118.210 > 3.1504, which means Religiosity and Perception of the Halal Label simultaneously affect Purchase Intention. In conclusion, Religiosity and Perception of the Halal Label simultaneously affect Purchase Intention on Non-Food Halal Products.

Abstract

Abstract: This research is a comprehensive study of the implementation of executions carried out by murtahin on rahn pawn collateral, approached from the perspective of Sharia economic law. The study was conducted using a qualitative descriptive research methodology, which allowed for a detailed exploration of the execution of Rahn guarantees from the perspective of Sharia economic law. The normative legal approach was employed, using secondary sources to collect Islamic regulations and laws that were most relevant to the research problem. The research was then analyzed using the Sharia economic law doctrine. The findings of this research provide the procedures for executing rahn as per the Constitutional Court Decision Letter Number 18 of 2019, in accordance with the principles of Islamic sharia as regulated in the DSN-MUI Fatwa Number 92 of 2014 concerning financing accompanied by rahn.Abstrak: Penelitian ini bermaksud untuk melakukan kajian terhadap pelaksanaan eksekusi yang dilakukan oleh murtahin atas jaminan gadai rahn dari sudut pandang hukum ekonomi syari’ah. Penelitian ini dilakukan dengan menggunakan jenis penelitian deskriptif kualitatif yang mengeksplorasi eksekusi jaminan rahn dalam pandangan hukum ekonomi syari’ah. Pendekatan yang digunakan adalah pendekatan hukum normatif dengan menggunakan sumber sekunder yang dikumpulkan dengan cara menginven­tarisir peraturan dan hukum islam yang sesuai dengan masalah penelitian. Penelitian ini kemudian dianalisis dengan menggunakan doktrin hukum ekonomi syariah. Hasil penelitian ini adalah tata cara pelaksanaan eksekusi dalam Surat Putusan Mahkamah konstitusi Nomor 18 Tahun 2019 sesuai dengan prinsip Syari’at Islam yang diatur dalam Fatwa DSN-MUI Nomor 92 Tahun 2014 tentang pembiayaan yang disertai rahn.

Abstract

Fintech equity crowdfunding is now available in Indonesia, providing an alternative option for MSMEs to raise capital. As the majority of Indonesia's population is Muslim, sharia-based fintech equity crowdfunding is a more suitable option for those seeking funding according to Islamic principles. This system has the potential to be a capital solution for MSMEs more simply and ethically. This research aims to explore the potential of Sharia crowdfunding as an effective means for MSMEs to expand their business operations, ultimately contributing to broader economic sector improvements in Indonesia. Additionally, it assesses the conformity of this practice with OJK regulations and Fatwa DSN-MUI, as well as its compliance with Sharia principles. The descriptive-analytical method is employed, analyzing various documents and texts from various sources. The results indicate that Sharia-based fintech, particularly in the form of crowdfunding, can be an effective means for MSMEs to obtain capital through online platforms. Crowdfunding also presents opportunities for investors who wish to contribute to the funding of MSMEs in a manner that aligns with Sharia principles.

Abstract

Internet control has a close relationship with human rights because the digital space is becoming increasingly integral to social, political, and economic life. The purpose of this study is to discuss Internet control policies that support or hinder human rights and identify the right approach to solving problems related to existing problems. The research method adopts a normative juridical approach with a statute and conceptual approach. This study found that internet and social media regulations, namely Electronic Information and Transactions Law, have rubber articles that can be misused to limit freedom of expression, thus having implications for socio-political conditions, namely reducing people’s space to express their opinions, threatening democracy and political participation, including the implementation of Islamic Law in local governments based on Sharia. The researcher argues that a collaborative approach based on Islamic law, which includes truth and honesty (Sidiq), justice and equality (Adil), politeness and respect (Hilm), and preventing damage and conflict (Munkar), can be the most appropriate solution to solve existing problems in Indonesia. This study contributes to the formation and implementation of policies to address potential conflicts between freedom of expression and national security in Indonesia and various countries that have the same problems.
