Abstract

Financial technology is a part of digital ecosystem which development is rapid and massive, so does the sharia fintech. However, conventional and sharia fintech are two different systems and should have each regulation. The problem is if sharia fintech regulations in Indonesia is appropriate. Then what about Malaysia which are considered successful in developing the sharia fintech. This study compares sharia fintech regulations in Indonesia and Malaysia. The aim is to find out the readiness of Indonesia and Malaysia in supporting the sharia fintech trend realized in the regulations. This is a qualitative research using books and academic articles as an addition to the literature and regulations as the analytical method. The results indicate that Indonesia and Malaysia try to accommodate sharia fintech regulations. Indonesia still uses The Financial Services Authority Regulation (POJK) and Bank Indonesia regulations, both of which do not meet the sharia principles. Meanwhile, Malaysia uses the 2013 Islamic Financial Services Act (IFSA), a law to regulate sharia compliance of the Islamic financial services sector, including the Sharia Fintech. In addition, Malaysia also has a Sharia Advisory Council as a supervisor for the Islamic financial services implementations. Malaysia’s and Indonesia’s regulations have yet answered the sharia fintech developments. Financial technology merupakan bagian dari ekosistem digital yang perkembangannya sangat pesat dan masif, tak terkecuali fintech syariah. Namun, fintech konvensional dan syariah adalah dua sistem yang berbeda dan seharusnya memiliki peraturan yang berbeda pula. Permasalahannya apakah regulasi fintech syariah di Indonesia sudah tepat apa belum, lalu bagaimana dengan regulasi di Malaysia yang dianggap berhasil mengembangkan fintech syariah. Tujuannya adalah untuk mengetahui sejauhmana kesiapan Indonesia dan Malaysia dalam mendukung trend fintech syariah dalam regulasi. Penelitian kualitatif ini menggunakan buku dan artikel akademis sebagai tambahan literatur dan peraturan sebagai metode analisis. Hasil penelitian menunjukkan bahwa Indonesia dan Malaysia sama-sama berusaha mengakomodasi regulasi. Indonesia masih menggunakan Peraturan Otoritas Jasa Keuangan dan Peraturan Bank Indonesia, dan belum memenuhi prinsip syariah. Malaysia menggunakan Islamic Financial Services Act (IFSA) 2013, sebuah Undang-Undang yang mengatur kepatuhan syariah dari sektor jasa keuangan Islam. Malaysia juga memiliki Dewan Pertimbangan Syariah sebagai pengawas pelaksanaan jasa keuangan Islam. Regulasi yang dimiliki oleh Malaysia dan Indonesia belum menjawab perkembangan fintech syariah.

Abstract

The outbreak of the Covid-19 pandemic in Indonesia is attacking not only public health but also the economy. The presence of Covid-19 has many important impacts on developed countries. There are at least four industries most impacted by this pandemic, including households, MSMEs, companies and the financial industry. However, the halal industry is believed to be more resilient to the Covid-19 pandemic. This durability is because of the principles attributed to the halal sector, namely the importance of fairness, balance and openness. The author’s goal is therefore to carry out more in-depth research on the role of the halal industry in supporting the national economy, which is under pressure because of the COVID-19 pandemic. This type of study is a literature review with a material analysis approach that explores the conditions of the halal industry in Indonesia in depth. The material received is as books, published information, and online news. The findings of this study reveal that there are three halal business sectors that are believed to be more vulnerable to the Covid-19 pandemic in order to facilitate national economic recovery. Halal finance, halal food and halal fashion industries are among them. Halal finance from both the banking sector and the Islamic stock market has proved to be more robust than the mainstream financial sector. Besides guaranteed halal food, its wellbeing is also guaranteed, and halal fashion is now on the rise as Muslim fashion is increasingly innovative and global. We believe the three of them to have experienced vigorous growth, and also to continue to draw customers. And also after the Covid-19 pandemic, these three sectors could survive. Thus the halal industry also contributes to Indonesian economy.

Abstract

Pembiayaan dalam Bank Syariah memiliki macam-macam produk penyaluran dana (pembiayaan) dengan berbagai macam pola, salah satunya adalah pembiayaan mikro  dengan pola jual beli (murabahah) yang diperuntukan kepada nasabah untuk memenuhi kebutuhan konsumsif. Tetapi dalam pembiayaan ini pihak bank meminta jaminan tambahan yang seharusnya tidak diwajibkan oleh Peraturan Menteri Keuangan nomor 135/PMK.05/2008  pasal 10 ayat (2) yang berisikan agunan tambahan bagi KUR mikro tidak diwajibkan.Berdasarkan hal tersebut, penelitian ini bertujuan untuk  mengetahui: 1.) Bagaimana prosedur jaminan tambahan pada pembiayaan mikro dengan akad Murabahah bil Wakalah di bank BRI Syariah KCP Soreang, 2.) Faktor apa saja yang mempengaruhi bank mensyaratkan adanya jaminan, 3.) Bagaimana jaminan tambahan dalam akad Murabahah bil Wakalah  dalam perspektif hukum ekonomi syariah.Penelitian ini menggunakan metode studi kasus.Dengan jenis data yang digunakan ialah jenis data kualitatif. Adapun pengumpulan datanya menggunakan teknik wawancara dan studi kepustakaan.Berdasarkan hasil penelitian, bahwa pada pelaksanaan pembiayaan mikro dengan menggunakan akad Murabahah bil Wakalah  dan adanya jaminan tambahan pada pembiayaannya diperbolehkan dikarenakan sebagai faktor akan kembalinya modal, tetapi dilihat dari kinerja nasabah sudah sesuai dengan perjanjian di awal dengan pihak nasabah agar tidak terjadinya moral hazard yang berupa penyimpangan dari pengolahan dana itu sendiri. Pada pasal 23 Undang-undang No. 21 Tahun 2008 menegaskan bahwa adanya norma agunan. Prinsip adanya agunan dalam bank syariah dilihat dari adanya prinsip rahn dan kafalah dalam Islam, kaidah al-urf dan kaidah usuliyah-fiqhiyah. Selain itu dari pihak bank tersendiri melihat dari dana yang disalurkan merupakan dana masyarakat yang harus di awasi dengan sangat hati-hati dengan pertimbangan resiko dan moral hazard.

Abstract

This study aims to determine the implementation of the DSN MUI fatwa Number 26 of 2013. Furthermore, how it affects the purchase decision of Generation Muslimah Y and Z in choosing and buying cosmetic products—using qualitative methods with triangulation techniques, namely using various data collection methods consisting of observations, interviews, questionnaires, and documentation studies. The results show that the critical point of halal in cosmetics consists of the composition of the ingredients used and the resistance of cosmetics to water. Among the Muslim generations Y and Z, some already know, and some do not know the halal standards of cosmetics. However, according to Generations Y and Z, cosmetic halal standards in DSN – MUI Fatwa Number 26 of 2013 can affect their purchase decision on halal cosmetic products. Halal certification is still the main reason for purchasing halal cosmetics compared to prices, trends, and brands. It did by the Muslimah Generation Y and Z. In conclusion, DSN Fatwa–MUI Number 26 of 2013 applies effectively to The Muslimah Generation Y and Z as a consideration in choosing and buying halal cosmetics. This research implies that halal labeling can be used as a marketing strategy for a cosmetic product. The originality of this research lies in the object of research, which is only limited to Generations of Muslim women Y and Z and Fatwa DSN MUI Number 26 of 2013 as an analytical tool.

Abstract

Abstract: The word "halal" is now widely found in various products, including e-commerce platforms, such as Tokopedia Salam. Indonesia is a country with the highest number of e-commerce users in the world, and Tokopedia is the first unicorn platform to have sharia services. This study aimed to determine the perspective of Islamic economic law on Tokopedia Salam. The method used is qualitative-descriptive through a literature review. The results of this study indicate that Tokopedia Salam is not only market products that have been certified halal because there are still many products that have not been certified halal, which can be found on the Tokopedia Salam platform. In addition, the Tokopedia Salam payment system still uses conventional financial institutions, and this shows that Tokopedia Salam has not fully supported the halal industry. The transaction model at Tokopedia Salam is still the same as Tokopedia, not using salam and ijarah contracts as stipulated in sharia. In conclusion, Tokopedia Salam cannot be categorized as sharia e-commerce in Indonesia, but Tokopedia Salam has sharia services to complement the worship of the Muslim community in Indonesia.Abstrak: Penggunaan kata “halal” kini banyak ditemukan diberbagai produk, termasuk platform e-commerce, seperti tokopedia salam. Indonesia merupakan negara dengan pengguna e-commerce tertinggi di dunia dan tokopedia merupakan platform unicorn pertama yang memiliki layanan syariah. Tujuan penelitian ini untuk mengetahui perspektif hukum ekonomi syariah terhadap tokopedia salam. Metode yang digunakan adalah kualitatif-deskriptif melalui kajian pustaka. Hasil penelitian ini menunjukkan bahwa tokopedia salam tidak hanya memasarkan produk-produk yang sudah tersertifikasi halal, karena masih banyak produk yang belum tersertifikasi halal dapat ditemukan di platform tokopedia salam. Selain itu, sistem pembayaran tokopedia salam masih banyak menggunakan lembaga keuangan konvensional, hal ini menunjukkan tokopedia salam belum mendukung industri halal sepenuhnya. Model Transkasi yang dilakukan di tokopedia salam masih sama dengan tokopedia, tidak menggunakan akad salam dan ijarah sebagaimana ketentuan syariah. Kesimpulannya, tokopedia salam belum dapat dikategorikan sebagai e-commerce syariah di Indonesia, namun tokopedia salam memiliki layanan – layanan syariah untuk melengkapi ibadah masyarakat muslim di Indonesia.

Abstract

This research is an effort to support the development of halal tourism in Indonesia. Indonesia has two crucial points in halal tourism: having a variety of attractive halal tourist destinations and a sizeable Muslim community. However, Indonesia still needs to improve compared to other countries. The authors found that the main factor was improper, clear, and comprehensive regulations. This type of research is juridical–empirical research. The research data was obtained through indirect interviews and secondary data. The stages are preparation, planning, implementation, and formulation of research results. The result is that the regulation of halal tourism in Indonesia is an unwritten law, namely the DSN – MUI Fatwa Number 108/DSN-MUI/X/2016, concerning Tourism Implementation Based on Sharia Principles. Another written regulation used as a guideline for halal tourism is Law Number 33 of 2014 concerning Guaranteed Halal Products. However, Law Number 33 of 2014 is impractical for implementing halal tourism in Indonesia. In conclusion, the Indonesian government must make a law that explicitly regulates halal tourism. The advice is the DSN-MUI Fatwa Number 108/DSN-MUI/X/2016 concerning implementing Tourism Based on Sharia Principles can be transformed into positive law.

Abstract

The purpose of this study is to find out the law of buying and selling preloved skincare on the Instagram application through the @prelovedskincare.ori account and learn the application of Law Number 19 of 2016 concerning ITE to buying and selling preloved skincare online. The method used in this research is a case study method with qualitative data types. The results obtained from this research are the practice of buying and selling preloved skincare, starting with a sale transaction between the owner and the account owner @prelovedskincare.ori. The second is buying and selling between the account owner @prelovedskincare and the buyer. Based on an analysis of Sharia economic law, selling point transactions between preloved skin care owners and @prelovedskincare account owners use ijarah contracts. In contrast, transactions between @prelovedskincare account owners and buyers buy and sell contracts and wakalah bil ujrah contracts. The ijarah contract and the parties' sale and purchase follow the pillars, terms, and conditions determined. The @prelovedskincare account has the right to get ujrah for its buying and selling services. As for the object of sale and purchase, even though the skincare is a used item, the parties have ensured that the preloved product is still usable and safe for users. The parties have also implemented Article 18 of Law Number 19 of 2016 ITE regarding legal requirements for electronic transactions. Abstrak Tujuan penelitian ini untuk mengetahui hukum jual beli preloved skincare di aplikasi instagram melalui akun @prelovedskincare.ori dan mengetahui penerapan Undang-Undang Nomor 19 Tahun 2016 tentang ITE terhadap jual beli preloved skincare secara online. Metode yang digunakan dalam penelitian ini adalah metode studi kasus dengan jenis data kualitatif. Hasil yang diperoleh dari penelitian ini praktik jual beli preloved skincare, diawali oleh transaksi titip jual antara pemilik preloved skincare dan pemilik akun @prelovedskincare.ori, kemudian yang kedua terjadi jual beli antara pemilik akun @prelovedskincare dengan pembeli. Berdasarkan analisis hukum ekonomi syariah, transaksi titip jual antara pemilik preloved skincare dan pemilik akun @prelovedskincare adalah menggunakan akad ijarah, sementara transaksi antara pemilik akun @prelovedskincare dengan pembeli adalah akad jual beli dan akad wakalah bil ujrah. Baik akad ijarah dan jual beli yang dilakukan oleh para pihak telah sesuai dengan rukun, syarat dan ketentuan yang telah ditetapkan. Akun @prelovedskincare berhak mendapatkan ujrah atas jasa jual beli yang dilakukannya. Adapun objek jual beli, meskipun skincare tersebut merupakan barang bekas pakai, tapi para pihak telah memastikan bahwa produk preloved tersebut benar-benar masih layak pakai dan aman bagi pengguna. Selain itu, para pihak juga telah menerapkan Pasal 18 Undang-Undang Nomor 19 Tahun 2016 ITE tentang syarat sah transaksi elektronik.

Abstract

This research is motivated by the trend of increasing the tourism sector to 16.11 million people in 2019, which makes halal tourism such as one of the profitable industries in the global market. However, since the confirmed case of Covid-19 in March 2020, the tourism sector has decreased by 66.02% in April 2020. It is known that tourists visiting during the COVID-19 pandemic are tourists from the millennial generation. This study aims to find out how to implement halal tourism in Indonesia and to find out how the millennial generation has the potential to increase halal tourism during the Covid-19 pandemic. This study uses a mixed-method i.e. a combination of quantitative and qualitative. Based on the distribution of questionnaires to 300 respondents, the results stated that the millennial generation was interested in and carried out halal tourism. The conclusion is the millennial Muslim generation continued to carry out tourism during the pandemic by implementing strict health protocols. This research implies that halal tourism can still revive even though a pandemic hits it.

Abstract

The burgeoning trend of online donations has assumed prominence within society. This research endeavors to elucidate the intricacies involved in the collection, management, and distribution of online donation by Yayasan Sinergi Kebaikan Ummat. It seeks to identify the contractual frameworks employed in the online donation process, while also examining the legal dimensions of online donations through the lens of Sharia Economic Law. The type of this research is qualitative. Data collection techniques encompass indirect observation, interviews, and documentation review. The data analysis is underpinned by the premise that muamalah activities, whether conducted directly or indirectly, are permissible unless explicitly proscribed. The legal framework governing muamalah derives from the Qur'an and Hadith, which establish the principles congruent with Sharia, aimed at fostering societal justice. The findings of this research reveal that Yayasan Kebaikan Ummat, acting as a campaigner, assumes the role of a third-party intermediary in the donation process. Here, the donor represents the first party, while the online platform serves as the second party. The process of raising donations involves several contractual arrangements, including ijarah, wakalah bil ujrah, and jualah contracts, all of which entail the provision of wages (ujrah). The administration fee established by the platform, termed ujrah, serves as compensation for the campaigner's fundraising assistance. Consequently, online donations facilitated through these platforms are permissible, primarily due to the incorporation of the tabarru' contract within the arrangement.
