Abstract

Public trust constitutes the primary foundation of the legitimacy of police institutions in democratic states. In Indonesia, a series of cases involving personal misconduct by members of the Indonesian National Police (Polri) throughout 2025, including serious criminal offenses and incidents that generated negative public opinion, indicate that institutional delegitimization is more frequently driven by the behavior of law enforcement personnel than by weaknesses in formal regulatory frameworks. This article aims to analyze the impact of personal misconduct on the legitimacy of the Polri institution and to propose a human-centered policing approach as a strategy for preventing misconduct and restoring legitimacy. The research employs a normative juridical method with conceptual and sociological approaches. Data were collected through a targeted review of statutory regulations, academic literature, and police policy documents, particularly internal oversight and public complaint data, and were evaluated using thematic analysis. Consequently, the conceptual and policy analysis indicates that police legitimacy depends not only on formal legal authority but, more importantly, on moral integrity, ethical compliance, and public trust. The human-centered policing approach positions police personnel as human subjects with psychological, social, and moral complexities, thereby emphasizing personnel development, early detection mechanisms, and welfare support as proactive strategies to prevent personal misconduct. When implemented consistently, this approach not only strengthens internal legitimacy and institutional integrity but also builds a sustainable foundation of public trust, ultimately fostering a police institution that is professional, accountable, and democratic.

Abstract

Early Childhood Education (ECE) services in Indonesia are largely delivered through non-formal, community-based institutions. However, the legal framework governing the professional status of non-formal ECE educators remains inconsistent with the formal recognition of non-formal education within the national education system. This condition creates a gap between legal norms and empirical realities, resulting in unclear professional status, limited access to certification, and inadequate welfare protection for educators. This study aims to analyze the legal recognition gap affecting non-formal ECE educators and examine its implications from the perspective of education policy and empirical legal studies. The research employs an empirical legal method with a qualitative approach, using semi-structured interviews, field observations, and document analysis of relevant education regulations. The findings reveal a regulatory inconsistency between the National Education System Law, which recognizes non-formal education, and the Teacher and Lecturer Law, which primarily focuses on formal education. As a result, non-formal ECE educators remain structurally marginalized, often categorized as volunteers, with limited access to certification and professional development opportunities. This situation reflects a broader structural inequality within the education system. This study contributes to the literature by framing the issue of non-formal educator professionalization within the gap between das sollen and das sein, an approach that remains underexplored in previous research. Therefore, regulatory reform is necessary to establish inclusive professional recognition, equitable certification mechanisms, and sustainable governance of non-formal ECE within the national education system.
