Abstract

Land as a gift of God Almighty is a natural resource which is indispensable man for earning his living. Land has economic value as well in addition to social functions, One of the common interest of traditional market. To build a traditional market of land needed to be done by way of land acquisition, which is a legal act by the government to obtain by way of land acquisition, which act by the government for specific interest by providing compensation to landowners according to the procedure in the act. Development of common interests, are owned by the government, while it must be done by the private sector by a treaty. If the public interest is ultimately owned by either private ownership or management then it isn’t regulated in accordance with Law Number. 2 of 2012 on Land Procurement for Development for Public Interest. The method used in this research is normative juridical research, specifically a library law research or secondary data with primary, secondary and tertiary legal sources. As for the research approach used in this case the legislation relating to land acquisition and the method of collecting the legal materials are carried out by identifying and taking an inventory of positive law, journals and other legal sources. The method used in analyzing the legal materials (interpretation) is to get views on the public interest is ultimately owned by either private ownership or management. to get legal certainty and legal construction method. From the research results can be obtained that District Government Karawang after Turi Tempuran land procurement market is not accompanied by management well, so when the market was transferred by the village government to the private sector can’t by a treaty. This causes the market being owned and managed by private parties

Abstract

Pembahasan mengenai implementasi perjanjian bagi hasil dalam sistem pembiayaan musyarakah terhadap nasabah wanprestasi pada bank syariah. Penelitian yang dilakukan dengan menggunakan metode yuridis normatif. Bank berdasarkan prinsip syariah adalah aturan perjanjian berdasarkan hukum Islam antara bank dengan pihak lain untuk menyimpan dana atau pembiayaan usaha atau kegiatan perbankan lainnya. Kredit pembiayaan berdasarkan prinsip syariah jangka pendek dari Bank Indonesia ini adalah kredit atau pembiayaan berdasarkan prinsip syariah yang diberikan kepada bank untuk mengatasi kesulitan pendanaan jangka pendek dari bank yang bersangkutan. Permasalahan dalam penelitian bagaimana  Kepastian hukum perjanjian bagi hasil dalam sistem pembiayaan  musyarakah  terkait wanprestasi pada bank syariah. Pembahasan Kepastian hukum perjanjian bagi hasil dalam sistem pembiayaan  musyarakah  terkait wanprestasi pada bank syariah bahwa dalam pembiayaan syariah, Peraturan Bank Indonesia (PBI) nomor 10/16/PBI/2008 menyebutkan bahwa fatwa-fatwa Dewan Syariah Nasional Majelis Ulama Indonesia (DSN-MUI) dapat digunakan sebagai dasar hukum jaminan dalam perbankan syariah. Fatwa-fatwa tersebut mencakup berbagai aspek pembiayaan syariah.

Abstract

This study analyses the role of Notaries in drafting fiduciary guarantee deeds with intellectual property as collateral, and the challenges encountered in verification and economic valuation. Problems arise because some Notaries face obstacles in preparing intellectual property guarantee deeds due to limited experience, complex document requirements, and difficulties verifying ownership. This study employs a normative juridical method, drawing on statutory and conceptual approaches. Secondary data were obtained from primary legal materials, including legislation, and from secondary legal materials comprising relevant legal literature. The findings indicate that Notaries play a central role in ensuring legal certainty by preparing authentic deeds, registering fiduciary guarantees, and processing fiduciary guarantee certificates. Notaries also act as authorized representatives to register fiduciary guarantees on behalf of fiduciary recipients. The main challenges faced by Notaries include verifying the registration status of intellectual property with the Ministry of Law and Human Rights, understanding the specific characteristics of intangible intellectual property, and assessing the economic value, which is often subjective and fluctuating. This study concludes that Notaries need to apply the principle of prudence by ensuring that intellectual property licenses are documented in notarial deeds, carefully verifying ownership and legal status, and considering potential infringement risks against the collateral objects.
