Abstract

This research focuses on the relevance of the marital rape criminal sanction contained in Regulation Number 23 of 2004 concerning the Elimination of Domestic Violence with Criminal Sanctions in Fiqh Jinayah. This research is library research using the method of comparative legal interpretation (comparative). The type of research used is qualitative research. The legal materials used are primary legal materials in the form of classic and contemporary books as well as secondary legal materials in the form of books related to marital rape, as well as legal science journals. The data collection technique in this study is documentation. The data analysis used in this study uses Abdul Qadir 'Audah's'' analysis of thought. In this study, two conclusions were obtained, namely, that, according to Islamic law, marital rape is not in accordance with the teachings of Islamic law because Islam has taught procedures and behaviors in husband-wife relations that must be muasyarah bil ma'ruf by not hurting each other. Second, when viewed from the perspective of Abdul Qadir Audah's fiqh jinayah, the sanctions contained in the PKDRT Law have relevance to criminal sanctions in Islamic law.

Abstract

The simultaneous holding of the general election on April 17, 2019, marks a new chapter in the electoral process in Indonesia. This development is the result of the Constitutional Court Decision Number 14/PUU/2013, which reviewed Law Number 42 of 2008 concerning the Election of the President and Vice President. Despite the acknowledgment that simultaneous elections are considered an improvement compared to previous ones, it doesn't mean that the implementation is flawless. The most alarming issue is the significant loss of lives among election organizers, seen as a consequence of the 2019 simultaneous elections, along with other technical problems. Considering the various aspects arising from the 2019 elections, it is essential to reevaluate whether simultaneous elections are ideal for Indonesia's governance. This research is of a juridical-normative nature, utilizing a legal approach and case analysis. The data collection technique and arguments presented in this paper rely on qualitative studies. The findings of this research state that simultaneous elections represent a new breakthrough for Indonesian democracy, but there are still specific areas that require special attention. In this regard, the Constitutional Court proposes alternative models for simultaneous elections that can be chosen and deemed constitutional based on the 1945 Constitution.

Abstract

Abstract The government issued a policy of an electric motorcycle purchase assistance programme through the Minister of Industry Regulation Number 21 of 2023. This policy aims to accelerate the development of the electric vehicle ecosystem in Indonesia to create a sustainable environment. Subsidising the purchase of electric motors can be considered an appropriate policy from an environmental and energy diversification perspective. Economically, such subsidies can encourage the adoption of green technologies and reduce dependence on fossil fuels. The type of research used is qualitative research using documentation data collection techniques and then analysed by reducing data, presenting data and then drawing a conclusion. This policy needs continuous monitoring and evaluation is needed to ensure that this policy is in line with the principles of a sustainable economy, including the integration of environmental, social, and economic aspects in decision-making. Are these incentives short-term or can they provide long-term economic sustainability? In further analyses, it is necessary to consider the concept of demand elasticity. The result of this study is that subsidies can increase consumer purchasing power for electric motorbikes, resulting in increased demand. However, the effect may vary depending on the price elasticity of demand. If demand is inelastic, the increase in price due to subsidies may not be proportional to the increase in demand, so this policy has not been fully implemented.
