Abstract

ABSTRAKPenelitian ini akan mengkaji tentang potensi ancaman keamanan di perairan Indonesia yang berbatasan dengan negara Filipina. Dengan menggunakan metode kualitatif, temuan penelitian menggambarkanbahwa terdapat 4 potensi ancaman yang harus dihadapi oleh pemerintah dan masyarakat Indonesia di wilayah perbatasan dengan negara Philipina. Keempat potensi ancaman itu ialah Illegal Fishing, Human Trafficking, penyelundupan, narkoba, dan imigran gelap. Dan dari  keempat potensi ancaman tersebut, yang belum terjadi di perairan tersebut, yaitu human trafficking dan penyelundupan narkoba. Namun, dua lainnya sudah sering terjadi di perairan tersebut, yaitu illegal fishing dan imigran gelap. Sebenarnya permasalahan illegal fishing sempat berkurang pada saat ibu Susi Pudjiastuti menjadi menteri Kelautan Dan Perikanan, sementara kalau tentang imigran gelap sering terjadi dikarenakan kebanyakan masyarakat yang tinggal di pulau-pulau dekat negara Filipina mempunyai hubungan kekerabatan dengan mereka yang tinggal di Philipina. Kata Kunci: Potensi; Ancaman Keamanan; Perbatasan; Indonesia; Filipina ABSTRACTThis study will examine the potential security threats in Indonesian waters bordering the Philippines. By using qualitative methods, the research findings illustrate that there are 4 potential threats that must be faced by the government and the Indonesian people in the border area with the Philippines. The four potential threats are Illegal Fishing, Human Trafficking, smuggling, drugs, and illegal immigrants. And of the four potential threats, which have not occurred in these waters, namely human trafficking and drug smuggling. However, the other two have frequently occurred in these waters, namely illegal fishing and illegal immigrants. Actually, the problem of illegal fishing was reduced when Mrs. Susi Pudjiastuti became Minister of Maritime Affairs and Fisheries, meanwhile, illegal immigrants often occur because most people living on islands near the Philippines have kinship with those who live in the Philippines. Keywords: Potential; Security Threats; Border; Indonesia; Philippines

Abstract

Employment law in Indonesia is very important to ensure that citizens can obtain jobs as well as recognized rights and obligations. The employment relationship resembles a binding agreement between the employer and the worker, in which there are balanced rights and responsibilities. This is regulated by various parties, including employers, the government, wage boards, and labor unions. However, there are problems in the labor sector in Indonesia, one of which is unilateral termination of employment (PHK) by companies. One example of unilateral termination of employment in Indonesia is the case of the unilateral dismissal of 44 employees at the Goodyear tire factory. The author uses a normative juridical method. Primary legal sources are taken from Law No. 13 of 2003 concerning Manpower, while secondary legal sources are obtained through a review of legal literature related to labor, journals, and the internet. This study aims to understand labor issues in Indonesia, namely unilateral termination of employment by companies. The results of the study indicate that the implementation of termination by the company towards the employees of the Goodyear tire factory should comply with Law No. 13 of 2003 concerning Manpower. The company must also be responsible to the employees by paying severity pay, service appreciation money, and compensation for rights that should be received.

Abstract

This article discusses the discrimination that occurred on Rempang Island due to the construction of Eco City. This study was conducted to first find out the regulations on Land Use Authority in Batam City, especially Rempang Island, to find out the concept of legal protection for communities with land rights status in the Rempang Island area, and to find out how the government's development communication efforts are in handling this case. The method used in this article is a literature review, which is a systematic approach used to collect, analyze, and synthesize information from various sources that are relevant to the research topic. The results of this study indicate that there is a conflict between the Rempang Island community and the government regarding the construction of Eco City and how legal efforts and the government are to overcome this problem. From this conflict, development communication needs to be carried out effectively so that discrimination does not occur which results in conflict between indigenous peoples and the government.

Abstract

Fraud remains a serious problem in the financial sector, especially banking. Data from the Association of Certified Fraud Examiners (ACFE) in 2022 showed more than 2,000 fraud cases worldwide with losses of more than 3.6 billion USD, including 23 cases in Indonesia. In Indonesia, the Financial Services Authority (OJK), which was established in 2013, plays an important role in supervising this sector, implementing anti-fraud strategies to improve bank security. OJK guidelines in OJK Regulation (POJK) No. 39/POJK.03/2019 stipulate that every bank must develop an effective fraud control system and report fraud incidents that have a major impact within three working days. POJK also regulates administrative sanctions for banks that fail to carry out this reporting obligation, including fines and restrictions on business activities. This study uses a normative legal method to analyze the effectiveness of OJK's anti-fraud regulations and evaluate strategies that can be used to prevent and handle fraud. The results of the study show the importance of implementing an effective anti-fraud strategy, which includes prevention, detection, investigation, and monitoring to maintain the stability and health of the bank and protect the interests of customers.

Abstract

Intellectual property rights are a guarantee of maintaining one's basic intellectual rights. Trademark as an intellectual property right is very important but there are still many MSMEs that have not registered a trademark because they do not understand the importance of a trademark or do not understand how to register it. This service is carried out to help MSMEs understand more about the registration and importance of brands. The location of the MSME partner that is the target of the service is in South Jakarta called MAW Juice, the location was chosen because this service aims to benefit the area around the University of the service team. These MSME partners have problems registering brands that have previously been tried but rejected due to a lack of understanding of brand registration procedures. The method of implementing activities is counseling, namely providing useful material to help provide insight and guidance in registering trademarks and dialoguing with presenters to better understand brands and accompany MSME partners in registering Trademark Rights at the DJKI. The service team succeeded in conducting counseling that increased understanding of the importance of brand registration and how to register brand procedures. The service team also succeeded in accompanying MAW Juice MSME partners in registering trademarks at the DJKI.

Abstract

The development of digital technology in the millennial era has revolutionized the way students obtain and process information, especially in the context of higher education. Podcasts, as an audio-based digital learning medium, offer flexibility, accessibility and special appeal for the younger generation who are familiar with digital content. This article analyzes the role of podcasts as a legal learning medium with a case study of three episodes of the "Mata Najwa" podcast which discuss legal issues, especially corruption cases and the justice system in Indonesia. This research uses a qualitative approach with a content analysis method, which focuses on the cognitive, affective and conative aspects of students after watching the show. The research results show that podcasts not only increase legal understanding (cognitive), but also build empathy (affective), and trigger active participation of students as agents of change (conative). Inspirational narratives and relevant content in podcasts have proven effective in building legal awareness, integrity, and student motivation to get involved in social issues. However, the use of podcasts as an educational medium also faces regulatory challenges, digital literacy, and the risk of spreading inaccurate information. With proper management and adequate policy support, podcasts can be a transformative learning strategy in the era of digital education.

Abstract

Aircraft interception is an action taken by a country's military aircraft to identify and escort foreign aircraft that enter its airspace without permission, in accordance with the provisions of the 1944 Chicago Convention and Law No. 1/2009 on Aviation. This article discusses the regulations related to interception and the actions taken by the Indonesian Air Force (TNI AU) in handling airspace violations over Bawean Island by the United States' F-18 aircraft. The discussion in this article emphasizes that interception functions as a law enforcement measure against airspace violations, with procedures that must comply with the provisions in Annex 2 of the Chicago Convention. The Bawean tragedy serves as a concrete example of the application of interception in Indonesia, highlighting the importance of airspace surveillance to safeguard the security and sovereignty of the nation

Abstract

Artikel ini membahas tentang aliansi strategis, dinamika kompetisi versus kerja sama, dan ketidakstabilan aliansi yang mempengaruhi kinerja organisasi. Mengacu pada lima referensi utama, artikel ini mengeksplorasi faktor-faktor utama yang mempengaruhi stabilitas aliansi strategis di pasar internasional dan bagaimana dinamika kompetisi serta kerja sama dalam aliansi mempengaruhi kinerja aliansi tersebut. Aliansi strategis memungkinkan perusahaan untuk mengakses sumber daya yang terbatas, berbagi risiko, dan memperluas jangkauan pasar. Keberhasilan aliansi ini bergantung pada faktor-faktor seperti kepercayaan, komunikasi, dan keselarasan tujuan strategis antara mitra. Ketidakstabilan aliansi di pasar berkembang, seperti Nigeria disebabkan oleh perbedaan budaya, ketidakcocokan strategi, dan perubahan kondisi pasar. Peristiwa negatif yang menimpa salah satu mitra dapat memicu ketidakpercayaan dan defeksi, yang mengancam kelangsungan aliansi. Dinamika kompetisi dan kerja sama sering kali menjadi dilema dalam aliansi strategis. Keseimbangan antara kompetisi dan kerjasama adalah kunci keberhasilan aliansi. Perusahaan perlu mengelola dinamika ini dengan hati-hati untuk memastikan kerjasama berjalan efektif tanpa mengorbankan keunggulan kompetitif masing-masing pihak. Artikel ini menyimpulkan faktor-faktor yang mempengaruhi stabilitas aliansi, serta strategi untuk mengelola kompetisi dan kerjasama sangat penting bagi perusahaan untuk mencapai keunggulan kompetitif dan keberhasilan jangka panjang di pasar global.

Abstract

Tujuan penelitian untuk mendapatkan konsentrasi terbaik Pupuk Organic Cair urine kelinci dan batang pisang terbaik terhadap pertumbuhan bibit kelapa sawit di main nursery. Penelitian dilakukan pada tanah aluvial.dengan bibit jenis DxP Unggul Socfindo Lame.yang didapat dari Pt PPKS SOCFINDO. Selanjutnya dilakukan perawatan dan pembesaran di lahan lingkungan Simaninggir, Kecamatan Kotapinang, Kabupaten Labuhanbatu Selatan Provinsi Sumatera utara. Penelitian ini menggunakan Rancangan Acak Lengkap (RAL) dengan 5 perlakuan dan 5 ulangan, sehingga terdapat 100 polibag. Perlakuan pada yang diujikan dalam penelitian ini adalah konsentrasi POC batang pisang dengan konsentrasi: perlakuan A: 0 ml/l, B: 40 ml/l, C: 80 ml/l air, D: 120 ml/l air, dan E: 160 ml/l air. Data pengamatan bibit kelapa sawit yang diperoleh dianalisis menggunakan uji lanjut Duncan’s New Multiple Range Test (DNMRT) pada taraf nyata 5%. Disimpulkan bahwa pemberian konsentrasi POC batang pisang berbeda nyata terhadap pertambahan tinggi tanaman, bobot kering brangkasan, bobot segar brangkasan, dan tidak berbeda nyata untuk pertambahan diameter bonggol, pertambahan jumlah pelepah, bobot segar akar, bobot kering akar. Pemberian konsentrasi POC urine kelinci dan batang pisang terbaik adalah perlakuan E: 160 ml/l air. Disarankan untuk melakukan penelitian lanjut dengan memberikan POC urine kelinci dan batang pisang pada konsentrasi lebih dari 160 ml/l air.

Abstract

Terrorism is a transnational crime that has evolved into an increasingly complex and organized form of threat, operating through global financing networks, cross-border recruitment, digital communication technologies, and decentralized structures that transcend national jurisdictions. These characteristics render domestic legal frameworks insufficient to address the operational dynamics of modern terrorist networks. This study aims to analyze the enforcement of international criminal law against international terrorist networks and examine its legal implications for national jurisdictions. Using a normative juridical method supported by a statute approach and case approach, this research examines international legal frameworks—including thematic conventions and United Nations Security Council resolutions—as well as relevant national regulations, particularly Indonesia’s Law No. 5 of 2018 on the Eradication of Terrorism. The findings indicate that despite the existence of numerous instruments encouraging global cooperation, the enforcement of international criminal law continues to face significant challenges, such as the absence of a universally accepted definition of terrorism, inconsistencies between national legal systems, and limited mechanisms for cross-jurisdictional implementation. Furthermore, the study emphasizes the importance of upholding human rights principles—especially fair trial guarantees, non-refoulement, and protection against torture—within counter-terrorism efforts. This research concludes that effective eradication of international terrorist networks requires stronger harmonization between international and national legal frameworks, enhancement of inter-state cooperation mechanisms, and continuous development of law enforcement capacities to address the evolving nature of transnational terrorism.
