Not only Islamic financial institutions rate impressively, but also Islamic banking. Statistics released by Bank Indonesia prove the premise. At the same time, supporting the legality of Islamic banking operations became more solid. Although at the beginning of its establishment faced legal problems, but since the enactment the Islamic Banking No. 21 of 2008 has been issued, the problem is resolved. Authority that important in the dynamics of Islamic banking regulation is the National Sharia BoardCouncil of Ulama Indonesia (DSN-MUI). The council became the source of authoritative institutions in guarding the observance of the Islamic banking industry to comply with the rules of sharia. All Islamic banking products must be controlled under sharia compliance by the DSN-MUI. Then, the fatwa is absorbed by Bank Indonesia and Bank Indonesia Regulation (Peraturan Bank Indonesia) is set to be. Thus, tort committed by one of the parties can not be separated fromthe legal reference contained in the KUHPerdata and Kompilasi Hukum Ekonomi Syariah. Applicablelaw in Indonesia has been providing the forum choice: the ways of litigation and non-litigation. Litiga-tion way, sharia business disputes can be solved in Pengadilan Agama atau Pengadilan Negeri (IslamicCourt or the District Court); while the non-litigation way, sharia business disputes can be solved inBasyarnas or BANI through the establishment of a special assembly at the request of the parties to thedispute. The background of the article is the contents of Article 59 paragraph (3) and explanation of paragraph (1) of the Law on Judicial Power. The article authorizes the District Court to implement the decision of the Sharia arbitration body on the resolution of Islamic economic disputes. The article and explanation of the verse contradicts the absolute authority of the Religious Courts regulated in Article 49 letter (i) of the Law on Religious Courts. This shows that, the legislators are not consistent in making laws and regulations, so that it creates legal uncertainty. By applying the normative legal research method to the statute approach and case approach, this article seeks to describe the phenomenon of legal conflicts that occur. From the in-depth analysis it can be concluded that the legal provisions regarding the implementation of the decision of the National Sharia Arbitration Board are regulated in the Arbitration Law, the Judicial Power Act and the Religious Courts Act. The legal substance of the provisions therein enables antinomy or legal conflicts. Pembiayaan dalam Bank Syariah memiliki macam-macam produk penyaluran dana (pembiayaan) dengan berbagai macam pola, salah satunya adalah pembiayaan mikro  dengan pola jual beli (murabahah) yang diperuntukan kepada nasabah untuk memenuhi kebutuhan konsumsif. Tetapi dalam pembiayaan ini pihak bank meminta jaminan tambahan yang seharusnya tidak diwajibkan oleh Peraturan Menteri Keuangan nomor 135/PMK.05/2008  pasal 10 ayat (2) yang berisikan agunan tambahan bagi KUR mikro tidak diwajibkan.Berdasarkan hal tersebut, penelitian ini bertujuan untuk  mengetahui: 1.) Bagaimana prosedur jaminan tambahan pada pembiayaan mikro dengan akad Murabahah bil Wakalah di bank BRI Syariah KCP Soreang, 2.) Faktor apa saja yang mempengaruhi bank mensyaratkan adanya jaminan, 3.) Bagaimana jaminan tambahan dalam akad Murabahah bil Wakalah  dalam perspektif hukum ekonomi syariah.Penelitian ini menggunakan metode studi kasus.Dengan jenis data yang digunakan ialah jenis data kualitatif. Adapun pengumpulan datanya menggunakan teknik wawancara dan studi kepustakaan.Berdasarkan hasil penelitian, bahwa pada pelaksanaan pembiayaan mikro dengan menggunakan akad Murabahah bil Wakalah  dan adanya jaminan tambahan pada pembiayaannya diperbolehkan dikarenakan sebagai faktor akan kembalinya modal, tetapi dilihat dari kinerja nasabah sudah sesuai dengan perjanjian di awal dengan pihak nasabah agar tidak terjadinya moral hazard yang berupa penyimpangan dari pengolahan dana itu sendiri. Pada pasal 23 Undang-undang No. 21 Tahun 2008 menegaskan bahwa adanya norma agunan. Prinsip adanya agunan dalam bank syariah dilihat dari adanya prinsip rahn dan kafalah dalam Islam, kaidah al-urf dan kaidah usuliyah-fiqhiyah. Selain itu dari pihak bank tersendiri melihat dari dana yang disalurkan merupakan dana masyarakat yang harus di awasi dengan sangat hati-hati dengan pertimbangan resiko dan moral hazard.

This research aims to examine philosophically the existence of al-'Uqûd al-Murakkabah (multiple contracts). The search is concentrated on the opinions of fuqaha and muhadisin, as well as its application in Islamic Financial Institutions. This study is urgent, because in the form of a single contract is not able to respond to contemporary financial transactions that are always moving and affected by the financial industry both nationally, regionally and internationally. By using qualitative methods and literature, this study concludes that, first, the contemporary fiqh muamalah view of the hadiths related to the hybrid contract model leads to the wording of the prohibition of bai'ataini fi bai'atin (two trades in one trade), Second, the construction of the hybrid contract model in Islamic banks is aimed at the construction of al-'Uqûd al-Mutaqâbilah (dependent or conditional contract), which is implemented in the Bank Guarantee (BG), and al-'Uqûd al-Mujtami'ah

In determining the law, the source of Islamic law is the most basic and significant instrument in the process of determining a particular law. In Islam, there are main sources of law, namely the Al-Quran and sunnah, although scholars from the mu'tazilah group believe that the main source of Islamic law is not the Al-Quran and sunnah but reason is more important. The difference in perspective is very interesting to be discussed in the field of comparative economic fiqh. The method of this paper is a study using normative juridical methods, with secondary data types and sources, collected by documentary methods and analyzed with descriptive qualitative, with the aim of finding differentiation and equality between the two different fiqh paradigms related to the sources of Islamic law used in determining a sharia economic law product.
