Abstract

Abstrak: Badan Penyelenggara Jaminan Produk Halal(BPJPH) merupakan lembaga yang berperan penting dalam proses sertifikasi halal menjadi tolak ukur konsumen dalam membeli maupun menggunakan produk. Saat ini pariwisata halal telah banyak berkontribusi dalam pertumbuhan ekonomi di indonesia yang mengalami peningkatan. Semakin berkembanganya wisata halal regulasi yang mengatur pariwisata halal masih mengacu secara umum dalam regulasi barang dan jasa secara umum yang tercantum dalam Undang-Undang Jamian Produk Halal(JPH). Tujuan dari penelitian ini adalah mengeksplorasi peran potensi BPJPH dalam penanganan sertifikasi pariwisata halal di Indonesia. Metode pengumpulan artikel ini menggunakan metode yuridis normatif,, yang bersumber dari Undang-Undang Nomor 33 Tahun 2014 Tentang Jaminan Produk Halal, Undang-Undang Nomor 11 tahun 2020 tentang Cipta kerja Fatwa DSN-MUI Nomor.108/DSN-MUI/X/201 Tentang Pariwisata Syariah serta dikumpulkan melalui studi pustaka, mencakup analisis terhadap kebijakan BPJPH, jurnal ilmiah, situs web, dan penelitian terdahulu. Dalam temuan Artikel ini yaitu belum ditemukannya regulasi dalam Undang-Undang Jaminan Produk Halal yang mengatur secara komprehensif terkait pariwisata halal. BPJPH sebagai lembaga krusial saat ini belum memiliki regulasi khusus terkait pariwisata halal. BPJPH sebagai administrator sudah semestinya meregulasi peraturan terkait pariwisata halal, disamping perkembangan pariwisata halal sangat berkontribusi terhadap sektor PDB Indonesia, maka perlu adanya perluasan kebijakan Undang-Undang Jaminan Produk Halal yang harus direvisi oleh pemerintah. Kata Kunci: BPJPH; pariwisata halal; JPH Abstract: : The Halal Product Guarantee Organizing Agency (BPJPH) is an institution that plays an important role in the halal certification process as a benchmark for consumers in purchasing or using products. Currently, halal tourism has contributed greatly to economic growth in Indonesia which has increased. The increasing development of halal tourism, regulations governing halal tourism still refer generally to the general regulations on goods and services contained in the Halal Product Guarantee Law (JPH). The purpose of this study is to explore the potential role of BPJPH in handling halal tourism certification in Indonesia. The method of collecting this article uses the normative juridical method, which is sourced from Law Number 33 of 2014 concerning Halal Product Guarantee, Law Number 11 of 2020 concerning Job Creation, DSN-MUI Fatwa Number.108/DSN-MUI/X/201 concerning Sharia Tourism and collected through literature studies, including analysis of BPJPH policies, scientific journals, websites, and previous research. In the findings of this article, there has been no regulation in the Halal Product Guarantee Law that comprehensively regulates halal tourism. BPJPH as a crucial institution currently does not have specific regulations related to halal tourism. BPJPH as an administrator should regulate regulations related to halal tourism, besides the development of halal tourism greatly contributing to Indonesia's GDP sector, there needs to be an expansion of the Halal Product Guarantee Law policy which must be revised by the government. Abstract

Sebagai salah satu penyedia layanan keuangan berbasis syariah, Safe Deposit Box menawarkan tempat penyimpanan barang berharga dengan akad ijarah multijasa yang sesuai dengan prinsip-prinsip syariah, menghindari unsur riba, gharar, dan maysir. Dalam perbankan syariah, produk ini diatur oleh beberapa fatwa Dewan Syariah Nasional (DSN-MUI), termasuk Fatwa No. 24 Tahun 2002 yang mengatur ketentuan barang yang dapat disimpan sesuai dengan prinsip syariah, serta Fatwa No. 44 Tahun 2004 yang mengatur penggunaan akad ijarah multijasa untuk berbagai layanan perbankan syariah. Penelitian ini bertujuan untuk menganalisis secara mendalam kepatuhan syariah pada penggunaan safe deposit box sesuai dengan fatwa DSN MUI yang telah ditetapkan oleh Lembaga Keuangan Syariah. Penelitian ini menggunakan pendekatan yuridis empiris dengan mengumpulkan data melalui wawancara langsung di lapangan, yang melibatkan pihak terkait untuk menggali data mengenai penerapan dan kepatuhan syariah dari layanan Safe Deposit Box di KC Asia Afrika Kota Bandung. Hasil penelitian menunjukkan bahwa layanan Safe Deposit Box di KC Asia Afrika Kota Bandung telah memenuhi ketentuan syariah dengan adanya transparansi biaya, keamanan penyimpanan, dan perlindungan privasi nasabah. Penerapan akad ijarah dan pedoman Fatwa DSN MUI yang mendasari produk ini, menjadikannya pilihan yang sesuai bagi nasabah yang membutuhkan layanan penyimpanan barang berharga dengan jaminan kepatuhan syariah. Produk Safe Deposit Box menunjukan tidak hanya menawarkan kenyamanan bagi nasabah dalam menjaga barang berharga, tetapi juga memenuhi standar kepatuhan syariah yang ketat.

Abstract

Waqf is a crucial institution in Islamic social practices utilised for community welfare since the era of Prophet Muhammad (peace be upon him). Initially, waqf primarily consisted of immovable assets, such as agricultural land, as Umar ibn Khattab's waqf demonstrated. In Islamic law, waqf has distinct legal characteristics that set it apart from zakat, infaq, sadaqah, and hibah, even though they share similarities in material nature. Over time, the scope and management of waqf have evolved, particularly in Islamic boarding schools (pesantren), which leverage waqf to foster economic independence for the Muslim community. This study explores waqf management within Persatuan Islam (Persis) pesantren in West Java, focusing on its regulatory framework, implementation, and distribution of benefits. The findings indicate that waqf management within Persis adheres to structured guidelines, as outlined in the Kaifiyat Kerja and Pedoman Jam’iyyah Persatuan Islam (2011). Waqf management in Persis pesantren is carried out independently, with pesantren acting as both managers (nadzir) and implementers. The distribution of waqf benefits is predominantly directed toward social and educational initiatives. However, efforts to expand its role in developing broader economic independence require further collaboration with economic actors to fully realise the potential of waqf in supporting the community's welfare.

Abstract

Artikel ini bertujuan untuk menelaah relevansi Putusan Mahkamah Konstitusi No. 168/PUU-XXI/2023 dalam konteks pemenuhan hak hidup layak bagi pekerja sesuai Universal Declaration of Human Rights (UDHR). Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan analisis dokumen, yang mencakup kajian terhadap putusan MK, instrumen hukum internasional seperti UDHR, dan literatur akademik. Hasil penelitian menunjukkan bahwa meskipun putusan MK mempertegas aspek perlindungan hak pekerja, tantangan tetap muncul dalam implementasi kebijakan ketenagakerjaan. Di antara tantangan tersebut adalah fleksibilitas durasi PKWT, penghapusan batasan jenis pekerjaan outsourcing, serta ketidakjelasan dalam pengaturan upah minimum sektoral. Artikel ini merekomendasikan penguatan regulasi dan pengawasan untuk memastikan hak hidup layak pekerja sesuai prinsip UDHR dapat terpenuhi secara optimal.

Abstract

Halal sports tourism is a sports tourism activity that is equipped with halal facilities. The concept of sport tourism and halal tourism has been widely developed in Indonesia. However, the idea of halal sports tourism still needs to be discovered. According to Databox, Java Island is the most popular island and a favorite tourist destination in Indonesia. Java Island has a variety of natural tourist destinations that are suitable as sports tourism destinations. Apart from that, the majority of the population of Java Island is Muslim. Therefore, this research aims to determine the potential for developing halal sport tourism on the island of Java. This research is qualitative research with descriptive methods. Data collection techniques were carried out through observation, interviews, documentation studies, and literature studies. This research shows that Java Island has great potential for developing halal sports tourism. Sports tourism destinations on the island of Java are divided into halal sports tourism destinations in West Java, Central Java, and East Java. Each province has a halal sports tourism destination consisting of natural, cultural, and artificial destinations. Apart from that, various sports tourism destinations on the island of Java have Muslim-friendly facilities. Thus, halal sports tourism can be developed on Java Island.

Abstract

This study aims to explore the legal awareness of MSME actors in business legalization under the guidance of the UMKM Juara program by the West Java Provincial Government in Kecamatan Cisalak-Tanjungsiang. The research adopts a juridical-empirical method with data collected through semi-structured interviews and literature studies to understand the perceptions and motivations of MSME actors regarding business legality. The findings reveal that although MSME actors generally understand the importance of business legality, they are often reluctant to pursue it, as it is perceived to provide no direct benefits. The primary motivation for legalization is driven by the need for halal certification, rooted in religious values. However, the lack of information on legalization procedures and limited support in guidance are the main obstacles. Social, cultural, and religious factors significantly influence legal awareness and the legalization process among MSMEs in the area.

Abstract

Ideally, legal discovery by judges is expected to create both legal certainty and substantive justice simultaneously. However, in reality, the practice of legal discovery in Indonesia often leads to legal uncertainty due to differences in interpretation and the varied use of interpretative methods. Flexibility in legal discovery also has the potential to be misused if not supported by ethical foundations and adequate competence. This study aims to analyze the legal basis, methods, and implications of legal discovery by judges in Indonesia on legal certainty and justice. This research employs a juridical-normative approach by analyzing Law No. 48 of 2009, court decisions, and legal doctrines related to methods of legal interpretation. The results show that legal discovery by judges is necessary to address legal gaps and adapt the law to social developments. However, flexibility in legal discovery must be balanced with consistency in legal application to maintain legal certainty.

Abstract

Productive zakat is an important part of Islamic social finance that aims to help reduce poverty by supporting micro and small businesses. Unlike traditional charity, productive zakat gives business capital to help zakat recipients (Mustahik) become independent. In Indonesia, especially in rural areas, this type of support plays a key role in improving people’s economic conditions. This study focuses on how a zakat institution attempts to help micro and small businesses through its productive zakat programmes. The research employed a qualitative method using a case study approach conducted at BAZNAS in Bone Regency, Indonesia. Data were collected through interviews and field observation involving BAZNAS staff, Mustahik, and leaders of local MSEs, and related document review. The results show that the mentoring provided is mostly limited to short verbal guidance when the funds are first given. There are no structured trainings and regular follow-ups. These issues are compounded by a lack of staff, long distances between locations, and no clear way to measure progress. However, we find that there are also chances to improve the programme, such as the use of digital tools, building partnerships, and strengthening local MSE organisations. This study demonstrates that mentoring needs to be more measurable so that productive zakat truly helps people become economically independent. We also offer insights from this study for improving zakat programmes in other rural areas

Abstract

Sukuk ijarah is one of the rapidly growing Islamic capital market instruments and is tradable in the secondary market. However, ambiguity remains regarding the resale mechanism of such sukuk, particularly concerning compliance with Sharia principles and prevailing legal frameworks. This study aims to examine the permissibility of sukuk ijarah resale from the perspective of Islamic economic law and to assess the role of Islamic financial institutions in ensuring Sharia-compliant transactions. The research employs a normative juridical method with data collected through literature study of primary and secondary legal sources. The findings indicate that the resale of sukuk ijarah is permissible as long as it is based on real assets rather than debt instruments and conducted at a fair market value. Key Sharia principles such as justice, transparency, and the prohibition of gharar, maysir, and riba are generally upheld in practice. Nonetheless, more comprehensive regulations are required to clarify the responsibilities of Islamic financial institutions in overseeing secondary market sukuk transactions. This study recommends regulatory enhancement to ensure a fair, transparent, and legally certain secondary market environment, thereby increasing investor confidence in Islamic financial instruments.
