Abstract

Konsep paling penting dalam struktur maqashid syari’ah klasik dan masih bertahan hingga kini adalah hifz ad-din. Yang mencakup dua dimensi: min janib al-wujud dan min janib al-‘adam. Keduanya, dengan sengaja, penulis jadikan kerangka berpikir dalam rangka melakukan reinterpretasi terhadap konsep pelestarian agama. Penelitian yang dilakukan penulis adalah penelitian hukum Islam normatif, yang memiliki tujuan untuk menyelidiki norma-norma hukum Islam untuk memperoleh kaidah tingkah laku yang dipandang terbaik. Menurut Bambang Sunggono, penelitian hukum normatif mencakup ilmu kaidah dan ilmu pengertian (yang biasa disebut dengan dogmatik hukum). Jika melihat pada permasalahan yang dikaji dan diteliti penulis, maka penelitian ini termasuk jenis penelitian normatif. Yang dimaksud penelitian hukum normatif atau penelitian literer (library research) adalah metode atau cara yang diaplikasikan dalam penelitian hukum yang ditempuh dengan cara mengkaji dan meneliti bahan-bahan pustaka yang sudah tersedia. Pada penelitian ini, penulis memanfaatkan pendekatan maqashid syariah. Dari kajian yang dilakukan dapat diketahui bahwa melestarikan agama min janib al-wujud sejalan dengan hukum positif sebagaimana tercantum dalam Pasal 28E ayat 1 dan 2, 28I ayat 1, dan Pasal 29 ayat 2. Sedangkan, min janib al-‘adam terdapat dalam UU No. 1 Tahun 1965 berikut sanksi hukum dalam Pasal 156a KUHP. Sehingga, beberapa kebijakan hukum yang terdapat dalam kerangka hifz ad-din klasik seperti jihad dan hukuman bagi murtad, perlu dipertimbangkan kembali.

Abstract

This article examines Ramadan as an essential momentum for character development through a values education approach within the Islamic school curriculum using a systematic literature review. Character development has become increasingly vital, highlighting the importance of embedding moral values and ethical awareness among students. Ramadan presents a unique educational context due to its emphasis on spiritual growth, moral reflection, and behavioral discipline central to Islamic teachings. The systematic review analyzes existing literature sourced from reputable academic databases, focusing explicitly on values-based educational practices conducted during Ramadan in Islamic educational institutions. The findings indicate that Ramadan significantly facilitates the internalization of essential values such as empathy, patience, gratitude, discipline, spirituality, and social responsibility among students. The identified instructional strategies include reflective classroom dialogues, experiential learning activities, and structured community engagement programs integrated into Ramadan-specific curricula. The reviewed literature demonstrates measurable positive impacts on student behaviors, ethical reasoning, interpersonal relationships, and overall character maturity following participation in these curricular practices. Challenges identified in the literature relate mainly to sustaining and consistently applying values education beyond the Ramadan period. This article provides insights and practical implications for educators and policymakers to strengthen character education initiatives within Islamic schooling contexts. Further research is recommended to evaluate the long-term effectiveness of Ramadan-based values education programs and their potential application in broader educational settings.

Abstract

This study examines the legal status of zakat on professional income earned by Indonesian migrant workers in South Korea, based on the views of Yusuf al-Qaradawi. It evaluates the applicability of his perspective to the practice of zakat in this context. Using a descriptive-analytical approach, the research is based on field data obtained through observation and structured interviews. The findings show that professional income is subject to zakat if workers meet the legal and religious requirements. The income is classified as al-mal al-mustafad al-amalah, meaning earnings derived from wages or salaries through professional work. Furthermore, the average monthly income of these workers exceeds the nisab threshold when compared to the regional minimum wage, thus fulfilling the obligation for zakat. Yusuf al-Qaradawi’s interpretation remains relevant, as he draws an analogy between zakat on professional income and zakat on monetary assets, underscoring its necessity among migrant workers.

Abstract

Marriage in Islam is part of the Prophet’s sunnah, not only as a form of worship but also as a legal institution, one aspect of which is the practice of ta’lik talak (conditional divorce) declared after the marriage contract. In Indonesia, this practice serves as a legal mechanism to protect wives from potential abuse of power by husbands. This study employs a qualitative method with a library research approach, drawing data from Abu Ishaq Al-Syatibi’s Al-Muwāfaqāt fī Uṣūl al-Sharī‘ah and relevant supporting literature. The results indicate that ta’lik talak is normatively justified under Article 45 paragraph 1 of the Compilation of Islamic Law (KHI) and aligns with the principle of maslahah (public interest) in Islamic legal theory. Ta’lik talak serves a dual function: as a moral reminder for the husband and as legal protection for the wife, preventing arbitrary actions and encouraging household harmony. According to Al-Syatibi, maslahah must protect essential human rights, serve collective good, and avoid subjective interests. Therefore, the practice of ta’lik talak embodies maqāṣid al-sharī‘ah (higher objectives of Islamic law), contributing to the realization of a harmonious and righteous family life. Abstract

Purpose –This study aims to investigate the concept of a youth education curriculum based on Islamic hadith literature. The study is based on the idea that curriculum design should be thoroughly understood by educators, particularly by institutional leaders who engage with teenagers.Methodology – This qualitative study employs a library research design combined with a descriptive method. The key sources of information are Sahih Bukhārī, Fathul Baari, and Umdatul Qaari. Secondary materials include Tarbiyatul Awlad and an educational resource on curriculum development. Data was obtained using triangulation and the term "Anas," which refers to Anas ibn Malik, the Prophet's teenage companion. To verify the data, the double-entry method was applied, and data analysis followed a deductive approach supported by thematic categorization.Findings – The research identified 11 hadiths related to the objectives of the youth education curriculum, 403 hadiths for the content component, 25 hadiths addressing instructional strategies, and five hadiths related to evaluation. These findings suggest that the prophetic model provides a comprehensive and systematic approach to youth education, offering extensive guidance on learning goals, topic selection, teaching methods, and assessment criteria tailored to the developmental needs of teenagers.Contribution – This study advances the subject of Islamic education by providing a structured curriculum framework based on hadith. It offers significant insights for educators, curriculum creators, and institutional leaders seeking to develop exceptional youth education programs grounded in prophetic traditions and tailored to the needs of today's learners.
