Abstract

This study examines the disparity between the theoretical framework and practical implementation of arbitration in Tulungagung Regency. Employing an empirical legal approach, the research analyzes data collected from interviews with 12 lawyers and 12 individuals seeking justice. While arbitration offers several advantages, including time efficiency, lower costs, confidentiality, and procedural flexibility, its implementation in Tulungagung Regency encounters significant challenges. The findings indicate that arbitration remains largely unfamiliar to the public, primarily due to limited outreach efforts, the centralized location of arbitration institutions in major cities, and the high fees associated with arbitrators. Furthermore, ambiguities in the enforcement of arbitration decisions and inconsistencies between arbitration rulings and the jurisdiction of certain courts present additional obstacles. These results highlight the necessity for a comprehensive strategy to enhance accessibility and public awareness of arbitration as an effective alternative dispute resolution mechanism.

Abstract

Penelitian ini akan berfokus menganalisis implementasi Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019 tentang Desa Adat dalam proses penetapan Bandesa Adat di Desa Selat melalui perspektif das sollen dan das sein memberikan gambaran yang jelas tentang tantangan yang ada dalam mewujudkan cita-cita hukum yang adil dan inklusif. Implementasi Perda Bali No. 4 Tahun 2019 di Desa Selat berjalan dengan mengedepankan musyawarah mufakat sesuai perarem dan tata cara adat setempat. Pemilihan Bandesa Adat didasarkan pada daftar krama ngarep dan difasilitasi oleh Majelis Desa Adat untuk menjaga transparansi serta kesesuaian dengan aturan. Hambatan masih ada, terutama terkait kesetaraan gender dan transparansi akibat dominasi laki-laki dalam tradisi serta dinamika internal krama. Namun, konflik diselesaikan melalui musyawarah adat. Upaya terus dilakukan untuk menyeimbangkan kearifan lokal dengan prinsip modernisasi dan demokrasi yang inklusif.

Abstract

Land registration through the substantiation of prior rights may be conducted on the basis of physical possession for 20 years or more, as evidenced by a sporadic statement letter and witnessed by at least two witnesses. However, this provision creates an opportunity for the use of testimonium de auditu, namely testimony based on hearsay that cannot be materially verified. In practice, the assessment of proof of prior rights as regulated under Article 24 paragraph (1) of Government Regulation Number 24 of 1997 concerning Land Registration contains the phrases “degree of truth” and “deemed sufficient” without clear parameters, thereby giving rise to legal uncertainty. This normative juridical research employs the theory of legal certainty and the theory of evidence to analyze two principal issues: the regulation of land registration in Indonesia and the evidentiary strength of de auditu testimony. The findings indicate that de auditu testimony does not meet the criteria of valid witness evidence and fails to provide legal certainty, while the ambiguity of the norm necessitates further regulatory clarification.

Abstract

The return of state assets resulting from corruption and money laundering in Indonesia is still relatively low. This is caused by the dependence of the legal system on the concept of Conviction Based Asset Forfeiture (CBAF) which requires a criminal verdict against the perpetrator. Legal problems arise when the perpetrator dies, flees, or is incompetent to stand trial, causing a legal vacuum in asset execution. This study aims to analyze the urgency and mechanism of Non-Conviction Based Asset Forfeiture (NCBAF) as a legal solution. The research method used is normative juridical with statutory, conceptual, and comparative approaches. The results of the study indicate that the application of NCBAF allows asset forfeiture through in rem (civil) lawsuits against the asset itself without waiting for the conviction of the perpetrator. This concept applies the principle of shifting burden of proof and preponderance of evidence. The ratification of the Asset Forfeiture Bill which accommodates NCBAF is a necessity to harmonize national law with UNCAC and increase the effectiveness of state financial recovery.
