Abstract

 Setiap warga negara memiliki hak yang sama, peluang yang sama, dan kedudukan yang sama dihadapan hukum.  Hak Asasi Manusia (HAM) merupakan hak dasar yang secara kodrati melekat pada hakikat dan keberadaan manusia sebagai makhluk Tuhan Yang Masa Esa dan merupakan anugrah-Nya. HAM wajib dihormati, dilindungi, dipenuhi, ditegakkan dan dimajukan demi harkat dan martabat kemanusian. Pelaksanaan penghormatan, pemenuhan, perlindungan, penegakan, dan pemajuan HAM pada dasarnya merupakan kewajiban dan tanggung jawab negara, terutama pemerintah. Pemenuhan dan perlindungan hak penyandang disabilitas adalah segala tindakan dan/atau kegiatan untuk menjamin dan melindungi hak konstitusional para penyandang disabilitas sesuai dengan harkat dan martabat kemanusiaan serta terhindar dari tindak kekerasan dan diskriminasi. Tujuan perlindungan dan pemenuhan hak penyandang disabilitas meliputi: meningkatkan taraf kesejahteraan, kualitas serta kelangsungan hidup dan kemandirian penyandang disabilitas; (a) meningkatkan ketahanan sosial dan ekonomi penyandangdisabilitas; (b) meningkatkan kemampuan, kepedulian dan tanggung jawab Pemerintah Provinsi, dunia usaha dan masyarakat dalam perlindungan dan pemenuhan hak penyandang disabilitas secara melembaga dan berkelanjutan;dan (c) meningkatkan kualitas kehidupan dan penghidupan penyandang disabilitas. Kata kunci : studi kebijakan, penyandang stabilitas, hak asasi manusia.

Abstract

Negara Indonesia merupakan salah satu dari sekian banyak negara berkembang di dunia. Indonesia juga merupakan negara yang menjunjung tinggi prinsip welfare state, dimana negara memiliki prinsip sebagai negara kesejahteraan. Dengan predikat negara kesejahteraan tersebut maka pemerintah Indonesia mengupayakan berbagai program yang bertujuan untuk meningkatkan kesejahteraan masyarakatnya. Sehingga pemerintah mengambil kebijakan mengeluarkan program bantuan sosial yang berupa beras kepada masyarakat dengan kategori fakir miskin. Program tersebut terus diperbaiki dari semula bernama beras miskin (RASKIN) menjadi beras sejahtera (RASTRA) dan yang terbaru saat ini adalah Bantuan Pangan Non Tunai (BPNT). Program tersebut diatur dalam Permensos No 20 Tahun 2019 tentang Penyaluran Bantuan Pangan Non Tunai. Untuk mengetahui bagaimana pelaksanaan program tersebut, penulis menggunakan metode pendekatan secara Yuridis Normatif, dengan spesifikasi penelitian clinical legal research. Metode penyajian data disajikan dalam bentuk uraian-uraian yang dikelompokkan dan kemudian disusun secara sistematis. Kesimpulan : Berasarkan pembahasan terhadap hasil penelitian, maka dapat disimpulkan : -Pelaksanaan program Bantuan Pangan Non Tunai di Desa Karanganyar Kecamatan Kalibening Kabupaten Banjarnegara belum dilaksanakan sesuai dengan Undang – Undang Republik Indonesia Nomor 13 Tahun 2011 tentang Penanganan Fakir Miskin dan Peraturan Kementerian Sosial Republik Indonesia Nomor 20 Tahun 2019 tentang Penyaluran Bantuan Pangan Non Tunai serta Pedoman Pelaksanaan Bantuan Pangan Non Tunai Tahun 2019. Dalam proses validasi di tahun 2019 masih terdapat data dari Pusat Data dan Informasi tentang Basis Data Terpadu Penanganan Fakir Miskin yang tidak sesuai dengan kondisi dilapangan sehingga mengakibatkan data tersebut belum tepat sasaran terhadap calon peseta keluarga penerima manfaat.

Abstract

One of the characteristics of State Administrative Law, among others, states that the field of state administrative law is difficult to codify because its arrangements are scattered in various institutions / institutions / government agencies. However, difficult does not mean it can not be done. The promulgation of Law 30 of 2014 concerning Government Administration proves that there has been a codification of the law governing the practice of government administration, therefore it is expected to be able to reinforce the existence of the State Administrative Court in administrative law enforcement. Through this paper, the author tries to explain the authority of the State Administrative Court after the Government Administration Act. This research uses the Normative Juridical Approach method, by tracing, examining the object of research through its legal principles, through its laws and legal history, which is used to find out the rationale, background of the legislation that is the object of research, namely the Law 30 of 2014 concerning Government Administration. So at the end of this study it can be concluded that the enactment of Law Number 30 of 2004 concerning Government Administration has increasingly complemented and strengthened the role of the State Administrative Court in the order of administrative law in Indonesia, and as a legal political basis for law enforcement in state administration

Abstract

This study aims to find out how the implementation of the principle of equality of treatment in public services in thehealth sector at the Regional General Hospital (RSUD) dr. R. Goeteng Taroenadibrata, Purbalingga Regency, and tofind out what factors hinder the hospital in applying the principle of equality of treatment in the health sector toinpatients who use BPJS services (Social Security Administering Body) and patients who use public services. Theapproach method used in this study is a sociological juridical research method, and data analysis in this study usesqualitative analysis methods. The results of research at the Regional General Hospital (RSUD) dr. R. GoetengTaroenadibrata in providing health services to inpatients using BPJS (Social Security Administering Agency) servicesand patients using public services, there are still differences in health services to inpatients using BPJS services(Social Security Organizing Agency) and patients using services In general, the difference is in the room facilities forinpatients. In Purbalingga Regency Regional Regulation Number 3 of 2020 concerning Public Services Article 4, it isclearly stated that there should not be unequal treatment (discrimination) in public services, one of which is relatedto health services. Even so, in the implementation of health services by applying the principle of equal treatment ofpatients, there are still several inhibiting factors. Abstract

Law Number 21 of 2008 concerning Sharia Banking in Article 68 paragraph 1 and Article 40 Article 40 PBI No.11/10/ PBI / 2009 mandates that every Sharia Business Unit (UUS) that becomes a sharia unit at aConventional Commercial Bank (BUK) to separate itself (spin-off). and explained that UUS is required toseparate into BUS if UUS asset value has reached 50% (fifty percent) of the total asset value of its parent BUK.The spin-off time is no later than 15 (fifteen) years since the law was enacted, namely in 2023. If the spin-offorder is not carried out by each UUS, then Bank Indonesia as the central bank will impose sanctions in the formof revocation of operational licenses. But the problem that arises is in the face of time spin-offs are not a fewUUS are overwhelmed in preparing capital so that they have not been able to stand on their own afterseparating. The purpose of writing is to find out the impact of the spin-off for UUS by analyzing the solutionsthat can be offered. The results of the study indicate that it is necessary to review Law Number 21 of 2008concerning Islamic Banking by considering the financial condition of UUS. In addition, UUS which have carriedout a spin-off by becoming a new BUS can optimize the utilization of Third Party Funds in the form of financingand other services. In order to encourage the growth of BUS, support from the government is needed, such asproviding tax incentives and simplifying regulations on equity participation. In addition, the new BUS needs tocarry out various innovations by adding financing products and developing products that have beenimplemented. This study aims to provide an overview of the readiness of the Spin Off obligations for UUS tobecome BUS and issues related to readiness to fulfill UUS obligations to become BUS in July 2023.

Abstract

The enactment of Law Number 22 of 2001 concerning Oil and Gas, is an important milestone in regulating oil andgas mining business in Indonesia. One of the interesting provisions is regarding the production sharing contract.However, in this study, the formulation of the problem that will be reviewed is the history of the birth of LawNumber 22 of 2001 concerning Oil and Gas. The method used in this discussion is the normative juridical methodthrough literature studies such as literature books and Law Number 8 of 1971; Law Number 22 of 2001concerning Oil, Gas and Natural Gas by doing a comparison or comparison of the two laws and regulations. Thespecifications used in this discussion are Analytical Descriptive, which describes the facts regarding provisionsregarding oil and gas and natural gas. In order to fulfill the wishes of foreign investors, the economic reformagenda contained in the letter of intense, includes the energy sector reform program. The energy sector reform isstated in the agreement item letter F (The energy Sector) in the Memorandum of Economic and Financial Policies(Letter of Intense), January 20, 2000.

Abstract

The availability of regulatory opportunities for the expansion of autonomous regions, or the formation of newautonomous regions, is actually not a new thing in the history of regional government in Indonesia. Since thecentralized system of government during the New Order era, the government has also done a lot of establishingnew autonomous regions. In the 1945 Constitution of the Republic of Indonesia, the territory of the Unitary Stateof the Republic of Indonesia is divided into provincial areas and provincial areas are divided into regencies/cities,each of which has a regional government to carry out regional autonomy as widely as possible. Regionalautonomy is the right, authority, and obligation of an autonomous region to regulate and manage its owngovernment affairs and the interests of the local community in accordance with statutory regulations. Thepurpose of this study is to find out more about the impact of the division of districts/cities in a decentralizedunitary state. The research method used in this research is using normative legal research methods, with theresult that the ability of the regions to exercise authority after the division is not the same because each hasdifferent conditions and characteristics. Regional expansion has an impact on culture, public services, economicdevelopment, defense, security and national integration. The formation of regions through the division ofregency/municipal regions in reality cannot be the main choice in accelerating development. But on the otherhand, regional formation is also not something to be avoided. The conclusion of this study is that the formation ofregions through the division of regencies/municipalities is actually a difficult thing, but the trend of expansioncontinues to increase, in fact regional expansion cannot be the main choice in accelerating development. But onthe other hand, regional formation is also not something to be avoided

Abstract

The purpose of this paper is to analyze the harmonization of the principle of discretion in government over thepolicies of the central government with local governments in handling the Covid 19 pandemic in Indonesia. Theresearch method used in this research is to use normative legal research methods, with the result that the spreadof the Corona Virus in Indonesia has made the government, local governments, and the Indonesian peoplecontinue to be alert and alert. Vigilance and preparedness are important so that prevention and control of thecorona virus pandemic in Indonesia can be done as well as possible. The form of handling the Covid 19 pandemic,both the central and local governments, both provincial and district / city, have implemented existing legalinstruments and issued approaches both social approaches and legal instruments issued by authorizedgovernment officials through freedom of action or discretion as an effort to harmonize central governmentpolicies with local governments.

Abstract

The purpose of this research is to determine the procedures and obstacles in implementing the Employment Social Security Administering Agency at PT. Wonebesco Group Indonesia Purwokerto Banyumas Regency. The approach method in this research is normative juridical, namely an approach that uses a legalistic positivistic conception., the data used is primary data through observations and interviews with sources and respondents as main data, secondary data as supporting data in the form of legal materials, research specifications using research Clinical law (Clinical Legal Research) is research to apply law in abstracto to cases in concrete. The data obtained will be analyzed using qualitative analysis methods, namely by observing the data obtained with the provisions and legal principles related to the problem being studied. This research was conducted to answer the procedures and obstacles in the Implementation of the Employment Social Security Administering Agency at PT. Wonebesco Group Indonesia Purwokerto Banyumas Regency. with a positivistic legal conception method. Implementation of BPJS Employment at PT. Wonebesco is in accordance with applicable laws and regulations by applying the percentage of contributions borne by the employer and the workforce. Giving rights to workers who have passed their term of employment or have not received a contract extension to receive assistance and guidance by the company in making claims against BPJS Employment

Abstract

The existence of state direction in the history of the Indonesianconstitutional system has changed. In the Old Order and New Order eras,the role of state policy became very vital as a guide to state development,which at that time, its formal form was called the Outline of State Policy(GBHN). However, after the reform, the existence of state policy was lostas the 1945 Constitution was amended which eliminated the existence ofstate policy in the constitution. State direction is a national developmentconcept that refers to the state's goals to be achieved through a planningsystem that has future projections in order to realize state goals as themain foundation of the state's policy concept.Keywords: Amendments, State Policy, State GoalsAbstrak. Keberadaan haluan negara dalam sejarah sistemketatanegaraan Indonesia mengalami perubahan. Di era Orde Lamadan Orde Baru, haluan negara perannya menjadi sangat vital sebagaipedoman pembangunan negara, yang kala itu, wujud formalnyadisebut sebagai Garis-Garis Besar Haluan Negara (GBHN). Namun,setelah reformasi eksistensi haluan negara menjadi hilang seiringdiamandemen UUD 1945 yang menghilangkan eksistensi haluannegara dalam konstitusi. Haluan negara adalah konsep pembangunannasional yang merujuk pada tujuan negara yang hendak dicapaimelalui sebuah sistem perencanaan yang memiliki proyeksi ke depandalam rangka mewujudkan tujuan negara sebagai fondasi utama darikonsep haluan negara.Kata kunci: Amandemen, Haluan Negara, Tujuan Negara
