Abstract

Prinsip pencemar membayar adalah prinsip yang sering diucapkan dalam deklarasi internasional yang kemudian masuk ke dalam konvensi-konvensi internasional dan menjadi prinsip hukum lingkungan internasional. Instrumen internasional pertama yang mengacu pada prinsip pencemar membayar adalah Organisation for Economic Co-operation and Development (OEDC) 1872, yaitu sebuah organisasi ekonomi internasional yang didirikan oleh 34 negara pada tahun 1961, yang bertujuan untuk menstimulasi perkembangan ekonomi dan perdagangan dunia. Penerapan prinsip pencemar membayar sebagai sebuah risiko dari pelaku usaha melakukan usahanya diatur dalam Peraturan Menteri Negara Lingkungan Hidup Republik Indonesia Nomor 13 Tahun 2011 tentang Ganti Kerugian Akibat Pencemaran dan/atau Kerusakan Lingkugan Hidup. Pertimbangan tuntutan ganti rugi lingkungan terdapat pada bagian menimbang huruf b dan c yang menyatakan bahwa besaran ganti rugi akibat pencemaran dan/atau kerusakan lingkungan hidup ditetapkan berdasarkan kesepakatan antara para pihak yang bersengketa atau putusan pengadilan.

Abstract

In terms of wage protection and protection for workers in the workplace, the entrepreneur can postpone the payment of wages (if the entrepreneur is unable to pay the wage according to the minimum wage), by first conducting negotiations with the worker / laborer or trade / labor union regarding the suspension. The postponement of the payment of the minimum wage by the employer to the worker / laborer does not automatically eliminate the obligation of the entrepreneur to pay the difference in the minimum wage during the suspension period. To deal with and overcome the crisis caused by the corona virus outbreak or COVID-19, on March 31, 2020, President Joko Widodo has issued Government Regulation in Lieu of Law (PERPU) No. 1 of 2020 concerning “State Financial Policy and Financial System Stability for Handling the Corona Virus Desease 2019 (Covid-19) Pandemic and / or in the context of Facing Threats that Endanger the National Economy and / or Financial System Stability. However, PEPRU No.1 / 2020 has not fully accommodated those related to the world of labor. Affairs related to labor are entirely in the hands of the company and it is risky to cause company arbitrariness

Abstract

The corona virus pandemic has shaken not only Wuhan, but also the world. This virus has spread widely to almost all countries in a short time. Meanwhile, in Indonesia the corona virus began to be detected when two Indonesian citizens (WNI) tested positive for the corona virus on March 1, 2020. The two Indonesians had previously had contact with a foreign national (WNA) from Japan who lived in Malaysia at an event. in Jakara. Based on data up to April 20, 2020, the number of victims due to the corona virus was 6,760 cases. A total of 590 of them died and 747 people were declared cured. Termination of Employment (PHK) is something that is very feared by employees. This is due to the chaotic economic conditions which have an impact on many companies that have to go out of business, and of course have an impact on the unilateral termination of employment by employers. To protect workers' rights due to layoffs, the Government as one of the elements in carrying out industrial relations has provided legal protection guarantees for workers whose employment has been terminated by employers as regulated in Chapter XII, precisely in Article 150-172 of Law Number 13 of 2003 concerning Manpower.

Abstract

Dalam hubungan di antara kelompok sosial sering kali ketidakseimbangan kekuasaan muncul, sehingga memicu diskriminasi perbedaan gender adalah salah hingga alasan diskriminasi, bukan hanya di Indonesia, tetapi juga di dari masyarakat internasional. Perempuan sering merasa ketidakadilan karena dipandang lemah dan pembatasan memiliki hak dibandingkan dengan laki-laki meskipun hak perempuan sebenarnya juga bagian dari hak asasi manusia hak asasi manusia. hak perempuan dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, namun hal ini tidak serta merta mengurangi diskriminasi di masyarakat. Berbagai kebijakan pemerintah serta usaha masyarakat Indonesia dilakukan untuk memberantas diskriminasi dan melindungi hak-hak perempuan. Salah satu usaha pemerintah Indonesia dalam melindungi hak perempuan ialah dengan meratifikasi konvensi yang berkenaan dengan kaum perempuan serta membahas penghapusan diskriminasi yakni Convention for the Elimination of All Forms of Discrimination Against Women (CEDAW). Konvensi ini menjadi tonggak baru bagi kebijakan pemerintah Indonesia dalam melindungi hak-hak perempuan di Indonesia.

Abstract

Abstract

Hakim dalam mengadili permohonan ijin poligami yang dasar alasan-alasan dan syarat-syaratnya tidak sesuai hukum positif saat ini yakni pasal 4 ayat 2 dan pasal 5 ayat 1 huruf (a) dan ayat 2 Undang-undang Nomor 1 tahun 1974 tentang Perkawinan tetap dikabulkan dengan pertimbangan kemaslahatan dan keadilan, dan hakim dibenarkan melakukan ijtihad hukum dengan menyimpangi norma hukum yang ada (Istihsan), demi tercapainya kepastian dan keadilan hukum berdasarkan prinsip the judge made of law dan living law, guna memberikan kepastian hukum, manfaat hukum serta keadilan hukum bagi keluarga besar poligami (Rech Ide) untuk menolak akibat bahaya ( Madlorot), yang lebih besar dikemudian hari.

Abstract

Gender equality in Indonesia is a very serious problem, because of the patriarchal culture that develops in society. With the development of information and communication technology, various forms of crime have also adapted. One example is the emergence of a new form of gender-based violence, namely Online Gender-Based Violence (KBGO). Online gender-based violence has been a global phenomenon since the early days of internet use. It has become a serious problem, and the COVID-19 pandemic has made things worse. During the COVID-19 pandemic, cases of online gender-based violence increased drastically. This is due to situations and conditions where activities that could previously be carried out directly, must be carried out online or online such as work, teaching and learning, and others. In addition, social media platforms are now very insecure because of the large number of users whose accounts are not based on real identities. In handling it, it is also not enough to only use pre-existing regulations, because it will only become a boomerang for the victims. Cases of online gender-based violence should be a serious concern for all parties.
