Abstract

Work motivation is an encouragement to increase the individual efforts of employees in doing their work in order to achieve organizational goals. With the motivation of work makes employees more passionate in carrying out their work. The higher the motivation given, the higher the performance of employees in a company. This study aims to find out how strong the relationship between work motivation and work environment and employee performance at Bank BRI Syariah KCP Kebumen. The sample in this study amounted to 24 people taken from the total number of employee population at Bank BRI Syariah KCP Kebumen. This study used primary data by distributing questionnaires sourced from employees at Bank BRI Syariah KCP Kebumen. Secondary data sourced from documents. Data analysis techniques in this study used multiple creation analysis processed using IMB SPSS Statistic 25. From the results of data processing analysis shows that there is a positive and direct relationship between work motivation and work environment with employee performance, but the closeness of relationships in this study is low at 0.288. Looking at the guidelines for relationship density, this study was in the number 0.20 – 0.399. This means that if the work motivation and work environment improves, the performance of employees at Bank BRI Syariah KCP Kebumen increases.

Abstract

The relationship between Islamic law and the pitu market tradition in the form of practices carried out by Javanese society as part of pre-marriage is a form of strengthening in the development of Islamic law and gluing together traditions that develop in the community, so that this tradition is based on the maqosid sharia approach by involving prospective brides that visit seven different markets before getting married needs to be tested for its relationship and contribution to Islamic law and the community tradition. The research method used in the study used a qualitative study by conducting in-depth interviews with analysis using maqosid sharia. This research shows that the pitu market tradition has values in line with several fundamental aspects in the maqosid sharia framework such as hifz al-din and hifz al-'aql, hifz al-nasl, hifz al-mal. Thus the market pitu tradition carried out by the community as a pre-marriage has social, spiritual, and economic values in running the bride and groom's household life in the future. This market pitu tradition is a practice that is believed to provide blessings and introduce a form of responsibility if after a marriage from various aspects in the practice of the market pitu tradition.

Abstract

This study discusses the DSN-MUI fatwa regarding the dropship business practice from the sharia perspective using the maqashid al-muamalah approach. Dropship is an innovative business concept where merchants sell goods to customers without stocking inventory. Although the DSN-MUI Fatwa has provided legal guidance regarding dropshipping, understanding the Sharia principles underlying this Fatwa remains inadequate. The aim of this research is to evaluate the maqashid al-muamalah dimensions introduced in the DSN-MUI Fatwa on dropship and to understand its consequences and relevance within the framework of sharia economics and law. The research method employed is literature review, involving the collection and review of the DSN-MUI Fatwa on dropship and related literature on dropship and maqasid al-mu’amalah. The findings indicate that the DSN-MUI Fatwa reflects characteristics and principles relevant to the maqashid al-muamalah dimensions, such as sustainability, transparency, stability, protection, and justice. The fatwa aims to regulate dropship practices fairly, transparently, and in accordance with sharia values in the context of modern economics. This research provides practical guidance for merchants, consumers, and religious authorities involved in dropship. It is hoped that this research will strengthen the sharia legal framework related to modern business in the context of the global economy and enhance understanding of dropship practices from the perspective of maqashid al-muamalah

Abstract

phenomenon in Indonesia despite regulations that limit the minimum age of marriage. Data shows that 11.21% of women are married before the age of 18, with higher rates in rural areas. The research aims to analyze the juridical and psychological perspectives of underage marriage in Indonesian society, as well as identify the relationship between legal implementation and the psychological impact on children. The research used a qualitative method with a descriptive-analytical approach, involving in-depth interviews with religious court judges, psychologists, and children who married early. The results show that the legal system is weak in protecting children, reflected in the high number of marriage dispensations, which reached 65,000 cases in 2021. Children who marry early experience significant psychological impacts, with 70% experiencing stress and anxiety, 50% experiencing depression, and 65% having difficulty managing household conflicts. The study concludes that an integrative approach combining legal and psychological aspects is needed to address early marriage, and that the legal system needs to be strengthened to provide better protection for children.

Abstract

Zakat plays a crucial role in fostering social welfare and reducing economic inequality. However, its implementation in rural areas, such as Desa Tapen, often faces challenges due to limited access to information and technology. In the digital era, zakat payments can be made more efficiently through QR CODE technology, specifically with the Quick Response Code Indonesian Standard (QRIS) system developed by Bank Indonesia. Nevertheless, online zakat payments have not yet been implemented in Desa Tapen due to the community's lack of knowledge about the platform. Therefore, there is a need for socialization regarding the use of QRIS as a modern solution for online zakat payments. It is hoped that this socialization will enhance the community’s understanding of the ease, security, and benefits of QRIS, encouraging the adoption of online zakat payments in Desa Tapen

Abstract

Arabic language learning is directed toward the mastery of language skills, including listening (al-istimā’), speaking (al-kalām), reading (al-qirā’ah), and writing (al-kitābah). This implies that Arabic instruction is expected to enable learners to communicate both receptively and productively. At the Islamic Program of MA An-Nawawi Berjan Purworejo, an integrative Arabic curriculum has been implemented since the program’s inception as part of its traditional pesantren-based educational system. This approach blends traditional and modern elements, including madrasah dīniyyah instruction and immersive Arabic language practices in the dormitory environment. This study aims to analyze the implications of the integrative curriculum on students’ skills. A qualitative descriptive method with a phenomenological approach was used, involving observation, documentation, and in-depth interviews. The results reveal that the integrative curriculum fosters a contextual and comprehensive learning environment, enhances active student participation, strengthens grammatical understanding, and builds students’ confidence in using Arabic. The findings are analyzed through the psychological lenses of behaviorism and constructivism.

Abstract

Akibat dari diberlakukannya UU Nomor 16 Tahun 2019, maka tidak diizinkannya pernikahan antara pria dan Wanita yang masih di bawah umur 19 tahun. Maka dari itu Kantor Urusan Agama (KUA) Kecamatan Pituruh Kabupaten Purworejo menolak pernikahan antara calon mempelai pria dan calon mempelai wanita dengan surat Nomor: 97/Kua.11.06.16/PW.01/05/2023. Penelitian bertujuan untuk menganalisis dan membahas tentang Pertimbangan Putusan Hakim Permohonan Dispensasi Nikah Nomor: 101/Pdt. P/2023/PA/Pwr. Studi Kausus Di Pengadilan Agama Purworejo. Penelitian ini merupakan penelitian kualitatif jenis penelitian hukum normatif menggunakan pendekatan yuridis normatif, dan menggunakan pendekatan sosiologis. Metode pengumpulan data menggunakan analisis dokumen putusan perkara nomor: 101/Pdt. P/2023/PA/Pwr, dan dokumentasi. Latar belakang penelitian ini adalah Undang-Undang No 16 Tahun 2019 Pasal 7 ayat 1 mengenai umur minimal pernikahan yaitu 19 tahun bagi pria dan wanita, serta ayat 2 & 3 mengenai pemberian dispensasi nikah dengan alasan sangat mendesak. Analisis data yang digunakan yaitu dengan analisis data deskriptif. Adapun hasil penelitian ini bahwa latar belakang dispensasi nikah di Pengadilan Agama Purworejo yaitu, pertimbangan hakim dalam memutuskan dispensasi nikah usia dini di Pengadilan Agama Purworejo Putusan Nomor: 101/Pdt. P/2023/PA/Pwr adalah, tinjauan hukum Islam terhadap dispensasi nikah usia dini di Pengadilan Agama Purworejo pada perspektif maslahah mursalah yaitu dikarenakan untuk menghindari zina. Dalam penelitian ini, maslahah mursalah ditunjukkan untuk mencegah kerusakan dan menarik kemanfaatan.

Abstract

Early marriage is a growing phenomenon in many countries, including countries with a Muslim majority. In the perspective of Islamic law, marriage is a part of worship that is highly valued, but there are provisions that must be considered so as not to harm the parties involved, especially in the context of early marriage. One approach used to assess whether early marriage is permitted or not in Islamic law is through the concept of maslahat mursalat, which is an effort to achieve public welfare that is not explicitly regulated in the Shari'a, but can be taken based on the goals and basic principles of Islam. This paper aims to analyze the application of the concept of maslahat mursalat in the context of early marriage, as well as its implications for the implementation of Islamic law. This study includes an analysis of the social, economic, and health impacts associated with early marriage, and discusses how Islamic law assesses young marriage by considering maslahat and mudarat (benefits and disadvantages). This study also seeks to examine how the orientation of maslahat mursalat can help align Islamic law with the needs of today's society, amidst the challenges of early marriage that often ignore the emotional, social, and physical readiness of individuals. The results of this study indicate that from the perspective of maslahat mursalat, early marriage is only permitted if it meets the criteria of greater welfare and does not bring harm to the parties involved. In addition, policy recommendations regarding early marriage need to consider various factors that support individual welfare, including education, mental readiness, and social and economic support. Therefore, the implementation of early marriage must be carried out carefully and wisely, ensuring that it does not violate the basic principles of Islamic law which emphasize the welfare of humanity.

Abstract

This study aims to analyze the implications and relevance of the perspective of maslahah in legal practice related to the division of common property in the context of the judge's Decision Number 584/Pdt.G/2021/PA.Pwr. This study uses the method of document analysis to analyze the judge's Decision Number 584/Pdt.G/2021/PA.Pwr and related legal contexts. The study's findings indicate that the perspective of maslahah has significant implications for the division of common property. In the decision of Judge Number 584/Pdt.G/2021/PA.Pwr, maslahah perspective is reflected in determining the ratio of 1/3 and 2/3 for the plaintiff and defendant. This decision can be interpreted as an attempt to achieve a fair division and consider each party's contribution in acquiring and maintaining the common property during the marriage or relationship. In addition, the perspective of maslahah is relevant in ensuring wisdom in the division of common property. Considering financial and non-financial contributions, financial needs and capabilities, and the children's best interests are important factors in achieving fair and sustainable distribution. Judge's decision Number 584/Pdt.G/2021/PA.Pwr. The PWR is believed to have considered these factors in maintaining fairness and discretion in the division of common property.
