Abstract

This study aims to find out the understanding of tarekat mursyids and their preferences / tendencies towards politics and participating in it, including their support for the 2018 governor election. This study uses a qualitative approach by interviewing respondents who are tarekat murshids who are always obeyed by students. The findings are enriched with literature, books, research results and thoughts of experts in related fields. The results show that there are mursyid tarekat in North Sumatra that allow them to enter politics for the greater benefit of the people (Syeikh Sofwan Babussalam), to uphold or magnify the word of Allah (Syeikh Sabban Rajagukguk) and to uphold justice, prosper the people and create prosperity. people (Syeikh Nazaruddin Brayan) and even Jabal Qubis Founder Sheikh Amir Damsar Syarif founded the Jabal Nur Indonesia Party although it did not qualify in 2002. The results of this study are reinforced by the results of Martin Van Bruinessen's research which says that in the history of Indonesia, it turns out that some tarekat mursyids and their members are involved in practical politics. They opposed the colonial movement such as Sheikh Yusuf al-Makkassari, Haji Marzuki Banten, the Naqsabandiyah-Qadiriyah caliph, Guru Bangkol in Lombok, Kasan Mukmin Sidoarjo, Naqsabandiyah affiliate.

Abstract

Padang is a unique city because its people have the principle of making their customs code syara 'and syara' coded as Kitabullah in everyday life. This principle has always been the motivation to act and it is not uncommon for some Padang people to be accused of radicalism and intolerance. This article explores the development of radicalism and violence in the city of Padang according to research figures, scientists, community leaders and also some students and the general public. This article is taken from the results of our interviews with several figures of Islamic mass organizations in Padang, scientists and the community, both in person (face to face) and via smartphone communication such as the Chairman of the MUI, Gus Rizal.

Abstract

One of the consequences of rape is unwanted pregnancy, which may lead to both psychological and physical distress, often resulting in the desire to undergo an abortion. According to the 2023 Indonesian Penal Code (KUHP) and the opinion of the Hanafi school of thought, abortion is permissible before the pregnancy reaches 14 weeks or 120 days. In contrast, under the 2009 Health Law and the Shafi'i school of thought, abortion is only allowed before 6 weeks or 40 days of gestation. This discrepancy calls for further examination to determine the most appropriate legal threshold for abortion in rape cases, from both the perspectives of positive law and Islamic jurisprudence. This study employs a qualitative method with a comparative approach, utilizing literature review and document analysis of statutory law, classical Islamic legal texts, and relevant medical literature. It also applies the principle of hifz al-nafs (protection of life) as a normative foundation. The findings reveal that the 2023 revision of the Penal Code, which extends the permissible period for abortion from 6 to 14 weeks, aligns with the majority of Islamic scholars who permit abortion before 120 days of gestation. Nonetheless, abortion before 40 days is preferable to avoid legal controversy and reduce medical risks and psychological trauma. This study recommends harmonizing national laws, medical ethics, and Islamic legal principles to ensure substantive justice and optimal protection for victims of sexual violence

Abstract

Penelitian ini bertujuan untuk mengkaji konsep nusyuz suami menurut pandangan ulama kontemporer Faqihuddin Abdul Kodir dengan merujuk pada QS. an- Nisa’/4: 34 dan 128. Secara umum, istilah nusyuz lebih sering dilekatkan pada istri yang dianggap tidak patuh terhadap suaminya. Namun, Faqihuddin Abdul Kodir berusaha membuka cakrawala bahwa nusyuz juga dapat terjadi pada suami. Melalui pendekatan Mubadalah (kesalingan) menawarkan pemahaman yang lebih terbuka terkait konsep nusyuz dimana suami dapat dikatakan nusyuz apabila tidak menjalankan kewajibannya sebagai kepala keluarga. Penelitian ini menggunakan metode studi kepustakaan (library research) dengan pendekatan kualitatif untuk menggali pandangan Faqihuddin dan analisis terhadap ayat-ayat yang relevan. Hasil penelitian menunjukkan bahwa pandangan Faqihuddin dalam tafsir Mubadalah mampu memberikan perspektif yang setara dalam memahami relasi suami-istri, di mana kedua belah pihak memiliki tanggung jawab yang “sama” dengan peran masing-masing untuk menciptakan keadilan dalam rumah tangga. Dengan demikian, konsep nusyuz menjadi relevan dalam membangun hubungan yang lebih setara dan adil dalam konteks pernikahan muslim kontemporer. This study aims to examine the concept of husband's nusyuz in the view of contemporary scholar Faqihuddin Abdul Kodir by referring to QS. an-Nisa'/4: 34 and 128. In general, the term nusyuz is more often attached to wives who are considered disobedient to their husbands. However, Faqihuddin Abdul Kodir tries to open the horizon that nusyuz can also occur in husbands. Through the Mubadalah approach, he offers a more open understanding of the concept of nusyuz where the husband can be said to be nusyuz if he does not fulfill his obligations as the head of the family. This research uses a library research method with a qualitative approach to explore Faqihuddin's views and analyze the relevant verses. The results show that Faqihuddin's views in tafsir Mubadalah are able to provide an equal perspective in understanding husband-wife relations, where both parties have “equal” responsibilities with their respective roles to create justice in the household. Thus, the concept of nusyuz becomes relevant in building a more equal and fair relationship in the context of contemporary Muslim marriage. Abstract

Korupsi dikategorikan ke dalam kejahatan luar biasa (extraordinary crime), karena akibat yang ditimbulkannya dapat merusak sendi kehidupan berbangsa dan bernegara. Korupsi menghambat kemajuan dan pembangunan bangsa, meningkatkan jumlah kemiskinan dan bahkan bisa membunuh ekonomi negara. Begitu berbahayanya sampai pemerintah memberikan perlakuan khusus untuk menangani kejahatan ini dengan membentuk aturan dan perangkat hukum tersendiri. Penelitian ini bertujuan untuk menganalisis kenapa pidana mati bagi pelaku korupsi tidak pernah terlaksana hingga kini. Dengan menggunakan metode analisis kualitatif terhadap data primer dan sekunder yang diperoleh melalui studi kepustakaan, maka ditemukan bahwa frasa “keadaan tertentu” dalam pasal 2 ayat (2) Undang-Undang No. 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi (UU TPK) tidak memiliki pengertian yang pasti (blur) seperti negara dalam keadaan bahaya, terjadi bencana nasional, sebagai bentuk pengulangan kejahatan, dan pada waktu negara dalam keadaan krisis ekonomi dan moneter. Penjelasan seperti ini menghilangkan hukuman pidana mati bagia pelaku korupsi di luar empat ketentuan tersebut. Dari temuan ini maka dapat disimpulkan bahwa disfungsi pidana mati bagi pelaku korupsi disebabkan adanya pembatasan keadaan cakupan perbuatan korupsi yang bisa dihukum mati yang ada pada aturan pasal 2 ayat (2) UU TPK. Untuk itu, penulis menyarankan kepada pemerintah dan badan legislatif untuk segera melakukan revisi terhadap UU TPK dengan menghapus frasa “keadaan tertentu” dan menambahkan satu pasal baru yang mengatur tentang pidana mati secara tegas mencakup semua bentuk korupsi yang merugikan bangsa dan negara, serta jelas dan terukur mengatur tentang batas minimum korupsi yang wajib dijatuhi pidana mati, misalnya minimal Rp 1.593.750.000,- berdasarkan mazhab Syafi’i, atau minimal Rp 6.375.000.000 berdasarkan mazhab Hanafi.
