Abstract

The falsification of motor vehicle papers is a form of crime that often occurs in the community. This study aims to analyze the administration of a one-stop motorized unified administrative system in preventing and overcoming the falsification of motorized vehicle documents and sanctions for falsifying documents. This research is normative juridical. The research approach is carried out through literature studies that examine secondary data in the form of books, journals, research results, and legislation. The results showed that the prevention and control of falsification of motorized vehicle documents were carried out by the Joint Office of the one-stop single administration system based on Presidential Regulation No. 5/2015 concerning the Implementation of the One-Stop One-Stop Administration System. The provisions of sanctions in the falsification of a letter are regulated in Articles 263-276 of the Criminal Code. The implementation of an integrated one-stop administration system between the Samsat Office and the police as law enforcement officers are needed to reduce the falsification of motorized vehicle documents.Keywords: SAMSAT, Letter Counterfeiting, Motorized Vehicles

Abstract

The task of the judge in realizing justice is inseparable from the decisions that are made. A qualified judge's decision is obtained through the judge's thought process through a choice of judges that reflects judicial activism. The problem in this research is how judicial activism is used by judges in issuing decisions and how the implementation of judicial activism in decision making. Judicial Activism is the choice of decision making by judges in order to realize justice. Judicial activism in the Indonesian judicial system is regulated in Article 5 paragraph (1) of Law Number 48 of 2009 concerning Judicial Power. The law requires judges to explore the law and sense of justice that lives in society. The implementation of judicial activism is carried out by judges through means of legal discovery. Through means of legal discovery, judges play an active role in realizing justice as a law that lives in a dynamically developing society.

Abstract

Program pengabdian pada Masyarakat tentang tata cara pelepasan hak tanggungan dan pengalihan hak atas tanah untuk anggota Aisyiyah Ranting Datar dilaksanakan dengan metode ceramah yang dilanjutkan dengan tanya jawab. Tujuan dari kegiatan ini adalah memberikan pemahaman terkait tentang tata cara pelepasan hak tanggungan dan pengalihan hak atas tanah sehingga masyarakat dapat mengurus sendiri pelepasan hak tanggungan dan pengalihan hak atas tanah tanpa melalui pihak ketiga. Mengurus sendiri pelepasan hak tanggungan dan pengalihan hak atas tanah di Kantor Badan Pertanahan Nasional Kabupaten akan menghemat waktu dan biaya dibandingkan apabila hal tersebut diserahkan pengurusannya kepada Pejabat Pembuat Akta Tanah (PPAT).

Abstract

The enactment of Law No. 41 Year 1999 emphasizes the position of protected forests as protected areas that must be maintained to provide protection for the surrounding area. Law No. 41/1999 stipulates that open-pit mining activities are prohibited in protected forest areas. However, the effectiveness of Law No. 41/1999 is questioned by the issuance of Law No. 19/2004 which still accommodates open-pit mining in protected forest areas with the argument that the law should not apply retroactively. This article uses normative legal research methods, namely normatively examining various related regulations governing the function of protected forests. The results show that the birth of Law No. 19/2004 which allows several mining entrepreneurs to carry out open-pit mining activities in protected forest areas has resulted in protected forest areas being no different from production forest areas. This can threaten the function of protected forest areas as areas that provide protection for surrounding areas from various natural disaster hazards.Keywords: Existence, Function of Protected Forest, Forestry Law

Abstract

The Banjarnegara Regency One Stop Integrated Licensing and Investment Service (DPMPPTSP) is one of the units in the region that organizes Online Single Submission. However, the implementation has not been maximized, so I want to know what obstacles occur in the industrial business permit process in Banjarnegara district. The purpose of this study was to identify and analyze the efforts of the One-Stop Integrated Investment and Licensing Service in implementing the granting of electrical industrial business permits. And knowing the obstacles that occur in the process of implementing industrial business permits in Banjarnegara Regency. The method in this research is using the normative juridical method. The data in this study were obtained through library research, namely a series of reading, recording, and citing books as well as using secondary data or information and explanations through data requests from relevant agencies based on the objectives. study. The results of this study indicate that the livestock industry business licensing process online through the Online Single Submission there are obstacles faced by the Office of Investment and One Stop Integrated Services such as incomplete data provided by the applicant in the industrial business permit process, besides that there are also obstacles to the community such as the type of business fields in the Online Single Submission that are not yet complete. Dinas Penanaman Modal dan Pelayanan Perizinan Terpadu Satu Pintu (DPMPPTSP) Kabupaten Banjarnegara termasuk salah satu dari unit di daerah yang menyelenggarakan Online Single Submission. Namun dalam pelaksanaannya belum maksimal, sehingga penulis ingin mengetahui kendala apa saja yang terjadi dalam proses izin usaha industri di kabupaten Banjarnegara. Tujuan penelitian ini adalah untuk mengetahui dan menganalisa upaya Dinas Penanaman Modal dan Pelayanan Perizinan Terpadu Satu Pintu dalam melaksanakan pemberian izin usaha industri secara elektrik. Dan mengetahui hambatan yang terjadi dalam proses pelaksanaan izin usaha industri di Kabupaten Banjarnegara. Metode dalam penelitian ini adalah menggunakan metode yuridis normatif, Data dalam penelitian ini diperoleh melalui Penelitian Kepustakaan yaitu serangkaian kegiatan membaca, mencatat, dan mengutip buku-buku serta menggunakan data sekunder atau informasi dan keterangan-keterangan melalui permintaan data pada instansi terkait yang berlandaskan pada tujuan penelitian. Hasil penelitian ini menunjukkan bahwa proses perizinan usaha industri peternakan secara online melalui Online Single Submission terdapat hambatan yang dihadapi Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu seperti kurang lengkapnya data yang diberikan pemohon dalam proses izin usaha industri, selain itu terdapat juga hambatan pada masyarakat seperti jenis bidang usaha didalam Online Single Submission yang belum lengkap. Abstract

Abstract

Land acquisition by the government for development purposes, especially to realize a just and prosperous society, is a complex action that involves the rights of certain parties, namely the people who have rights to the land. In 2012, the Government of Indonesia passed Law No. 2/2012 on Land Acquisition for Development in the Public Interest. This law is designed to ensure the protection of the rights of each party, both the government and the community, in the land acquisition process. The principles of land acquisition, as explained in the general explanation of Law No. 2/2012, are expected to be in accordance with the values of Pancasila which aims to ensure justice for all parties. This research aims to analyze land acquisition procedures based on Supreme Court Decision Number 482 K/TUN/2021 with reference to Law Number 2 of 2012 on Land Acquisition for Development in the Public Interest. The research method used is normative juridical, a legal research approach that emphasizes literature analysis. The results show that in the land acquisition process, there are stages of planning, preparation, implementation, and delivery of results, which are then determined through the issuance of a Governor Decree.

Abstract

This article discusses digital transformation as an effective and efficient paradigm in court services in Indonesia. The Supreme Court has used digital transformation in court administration by developing an electronic court system or e-Court since 2018. However, procedural law has no legal basis related to electronic trials. The development of online dispute resolution is very fast, while procedural principles regarding due process and neutrality must remain the court's main task. In addition, establishing Internet courts involves three fundamental legal ethical principles: restoring the ceremonial aspects of litigation and creating risk management mechanisms between the legal and technological systems. This study aims to analyze the court's efforts to create an effective and efficient trial in Indonesia. A normative legal method was employed, incorporating various approaches such as the statute, conceptual, and comparative approaches. The research results show that the digital transformation policy was incorporated into the 2010-2035 blueprint of the Supreme Court of the Republic of Indonesia, which has brought about the need to accelerate digital transformation in the justice system. Settlement of civil disputes is carried out using an electronic court (e-court) application with an electronic litigation (e-litigation) mechanism. Meanwhile, the criminal trial was conducted through teleconference media. Still, they have encountered obstacles: limited facilities and infrastructure in conducting the trial, such as internet stability in various regions and limited courtrooms with electronic trial equipment. Need to improve infrastructure and improve the quality of human resources.

Abstract

The current criminal code has been in force in Indonesia since 1918. Indonesia formulated criminal law reform in 1963 and in 2023, a law on the national criminal code was issued. The spirit of the Indonesian criminal code is reformative, progressive, and responsive to changes to the law. One of the strengths of criminal law is regulating criminal law from the perspective and achievement of justice to repair and restore the situation after the event and judicial process known as restorative justice. The desire to strengthen restorative justice programs takes a long time and is complicated. This research aims to analyze the development of the concept of social reintegration through the application of restorative justice in the criminal justice process. This research was conducted qualitatively using secondary data and doctrinal legal study methods. The results showed that changes in criminal law arrangements caused opinion differences since restorative programs are widely used as a substitute for traditional and retributive approaches. The application of restorative justice in national criminal law must be implemented. Social reintegration in the implementation of restorative justice as regulated in the Criminal Code can be successful through commitment and collaboration between the community, government and law enforcement officials

Abstract

Climate change has become a global phenomenon characterized by an increase in the earth's average temperature, which is largely caused by human activities. The use of Litigation to resolve climate change issues has more than doubled since 2017 and is still growing. This research aims to explore the challenges and strategies in mainstreaming climate justice in Indonesia through climate change courts. With a doctrinal approach, this research will examine primary legal sources, such as legislation, jurisprudence, and international documents, as well as secondary sources, such as academic literature and organizational reports, to produce evidence-based recommendations for the development of a legal framework for climate justice in Indonesia. The research results show that climate change makes courts an important player in multi-level climate governance, therefore courts must have climate sensitivity and awareness. There is a need for specific material and procedural laws regarding climate and the need to develop the knowledge and skills of judges.
