Abstract

The judiciary is a mechanism provided by the state to resolve disputes. However in practice, dispute resolution in court is not in accordance with the principles of justice, namely effective and efficient judicial institutions. This research aims to analyze the legality and development of mediation in court. The research method used is library research with secondary data sources in the form of laws and regulations, research results and literature. One of the progressive ideas of the Supreme Court of the Republic of Indonesia in order to realize effective and efficient courts, among others, is to strengthen the institution of mediation in the Court for the settlement of civil disputes. However, it seems that the efforts of the Supreme Court institutions need to be further refined through improving the quality and quantity of human resources, improving supporting infrastructure and court institutions are consistent in supporting the mediation development programs in the Court.

Abstract

This study examines students' morality in decision-making regarding online loans. The purpose of this study is to identify factors that influence students' decisions to take online loans and analyze the role of morality in this process. This study uses a combination of qualitative and quantitative methodologies, aiming to provide deeper insights into the social and economic impacts of online loans on students. Data collection techniques include surveys, in-depth interviews, and case study analysis. In the context of the increasingly widespread phenomenon of online loans, especially among students, this study identifies several factors that influence their decisions to borrow. This study also links its findings to the Theory of Planned Behavior (TPB) and Moral Theory. Individual and collective morality play an important role in decision-making regarding online loans. Collective morality, which includes the norms and values ​​of social groups, also influences online loan decisions. Students' involvement with online loans has a significant impact. In the short-term, students often experience stress and anxiety due to debt pressure. In the long-term, it can disrupt education and create a cycle of poverty.

Abstract

This study discusses law enforcement against citizens who have dual citizenship based on Law Number 24 of 2013 concerning Population Administration. The research method used is a normative juridical approach, by analyzing laws and regulations, legal literature, policy documents, and scientific works that are relevant to the content and discussion. The results of the study show that the ownership of dual identities is still a serious problem in the administrative system in Indonesia which occurs as a result of the weakness of the existing population information and administration system and then becomes a gap for irresponsible individuals to commit a violation of duplication of population identity, and lack of legal awareness of the importance of maintaining identity documents belonging to each individual. to misuse of identity for personal gain. Law enforcement is carried out through administrative mechanisms such as biometric verification and clarification, and can be followed with appropriate sanctions if elements of intentionality are found. The main obstacles in its implementation include limited infrastructure for the government to reach remote areas, human resources, and weak data integration between agencies. Therefore, it is necessary to strengthen technical regulations, update the SIAK system, increase legal literacy in the community, and synergy across institutions to ensure administrative order and social justice based on a single identity.

Abstract

This study analyzes mediation in administrative dispute resolution in Indonesian Administrative Courts. The settlement of administrative disputes through mediation is not recognized in the Administrative Court procedural law. Mediation in the dispute resolution process in Administrative Courts is still a matter of debate. One of the parties to the dispute is a public body or official who is included in the realm of public law, so that mediation is not possible. The execution of Administrative Court decisions that have permanent legal force does not guarantee justice and legal certainty. This research aims to analyze the development and implementation of mediation in settlement of public disputes in Administrative Courts. The research method used is doctrinal research or library research with secondary data sources in the form of legislation on Administrative Courts, Supreme Court regulations on mediation, and scientific journals of research results. The results showed that mediation in public dispute resolution is used as an alternative to dispute resolution and has long been applied in several countries. Mediation in administrative dispute resolution can be carried out in two ways. First, mediation can be carried out outside the Administrative Court, and then the lawsuit is revoked. Second, mediation can be carried out through Court-connected mediation in the Administrative Court. There is a need to develop and strengthen the application of Court-connected mediation for administrative dispute resolution from the aspects of procedural law and Administrative Court resources that support the mediation process.

Abstract

Land acquisition by the government for development purposes, especially to realize a just and prosperous society, is a complex action that involves the rights of certain parties, namely the people who have rights to the land. In 2012, the Government of Indonesia passed Law No. 2/2012 on Land Acquisition for Development in the Public Interest. This law is designed to ensure the protection of the rights of each party, both the government and the community, in the land acquisition process. The principles of land acquisition, as explained in the general explanation of Law No. 2/2012, are expected to be in accordance with the values of Pancasila which aims to ensure justice for all parties. This research aims to analyze land acquisition procedures based on Supreme Court Decision Number 482 K/TUN/2021 with reference to Law Number 2 of 2012 on Land Acquisition for Development in the Public Interest. The research method used is normative juridical, a legal research approach that emphasizes literature analysis. The results show that in the land acquisition process, there are stages of planning, preparation, implementation, and delivery of results, which are then determined through the issuance of a Governor Decree.

Abstract

Program pengabdian pada Masyarakat tentang tata cara pelepasan hak tanggungan dan pengalihan hak atas tanah untuk anggota Aisyiyah Ranting Datar dilaksanakan dengan metode ceramah yang dilanjutkan dengan tanya jawab. Tujuan dari kegiatan ini adalah memberikan pemahaman terkait tentang tata cara pelepasan hak tanggungan dan pengalihan hak atas tanah sehingga masyarakat dapat mengurus sendiri pelepasan hak tanggungan dan pengalihan hak atas tanah tanpa melalui pihak ketiga. Mengurus sendiri pelepasan hak tanggungan dan pengalihan hak atas tanah di Kantor Badan Pertanahan Nasional Kabupaten akan menghemat waktu dan biaya dibandingkan apabila hal tersebut diserahkan pengurusannya kepada Pejabat Pembuat Akta Tanah (PPAT).

Abstract

The task of the judge in realizing justice is inseparable from the decisions that are made. A qualified judge's decision is obtained through the judge's thought process through a choice of judges that reflects judicial activism. The problem in this research is how judicial activism is used by judges in issuing decisions and how the implementation of judicial activism in decision making. Judicial Activism is the choice of decision making by judges in order to realize justice. Judicial activism in the Indonesian judicial system is regulated in Article 5 paragraph (1) of Law Number 48 of 2009 concerning Judicial Power. The law requires judges to explore the law and sense of justice that lives in society. The implementation of judicial activism is carried out by judges through means of legal discovery. Through means of legal discovery, judges play an active role in realizing justice as a law that lives in a dynamically developing society.

Abstract

ABSTRACT Purpose of the study: The state has an obligation to ensure that women obtain justice and are free from all discrimination in the criminal judicial process. Women in conflict with the law frequently feel uncomfortable when facing court proceedings in the position of suspect, victim, or witness. This paper analyzed legal considerations in the court decision of Bogor Cibinong District Court number 677/Pis.Sus/2018/PN Cbi.  Methodology: This research employed the doctrinal legal analysis methodology. This study aimed to analyze the legal protection of women in conflict with the law in the courtroom. This investigation could be a regulating juridical consideration with philosophical and conceptual approaches.  Results: The result of the consideration appeared that the criminal equity handled in court was full of ethical issues. Recently, there was the issuance of Supreme Court Regulation Number 3 of 2017 concerning Rules on the Hearing of Cases Including Women in Conflict with the Law. The Decision of Bogor Cibinong District Court Number 677/Pis.Sus/2018/PN Cbi managed a rapist of two children free from the charge of 14 years in prison for there is no witness who saw the rape. The integrated protection of women is required since they deal with the law during court proceedings and in the stages of inquiry, investigation, prosecution, and punishment.  Applications of this study: Regulation through legislation is required to protect women in conflict with the law in the criminal justice process.  Novelty/Originality of this study: In contrast to previous research, this research focused on studying how significant legal protection is for women in conflict with the law. Keywords: Legal Protection, Women, Litigation   ABSTRAK  Tujuan: Negara memiliki kewajiban untuk memastikan perempuan memperoleh keadilan dan bebas dari segala diskriminasi dalam proses peradilan pidana. Perempuan yang berkonflik dengan hukum seringkali merasa tidak nyaman ketika menghadapi proses peradilan dalam posisi sebagai tersangka, korban, atau saksi. Artikel ini bertujuan untuk menganalisis pertimbangan hukum dalam putusan Pengadilan Negeri Bogor Cibinong nomor 677/Pis.Sus/2018/PN Cbi.  Metodologi: Penelitian ini menggunakan metodologi analisis hukum doktrinal. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap perempuan yang berkonflik dengan hukum di ruang sidang. Investigasi tersebut menjadi pertimbangan yuridis dengan pendekatan filosofis dan konseptual.  Hasil: Dari hasil penelitian ditemukan bahwa peradilan pidana yang ditangani di pengadilan sarat dengan persoalan etik. Baru-baru ini, telah diterbitkan Peraturan Mahkamah Agung Nomor 3 Tahun 2017 Tentang Pedoman Mengadili Perkara Perempuan Berhadapan dengan Hukum. Putusan Pengadilan Negeri Bogor Cibinong Nomor 677/Pis.Sus/2018/PN Cbi membebaskan pemerkosa dua anak dari dakwaan 14 tahun penjara karena tidak ada saksi yang melihat pemerkosaan tersebut. Perlindungan terpadu terhadap perempuan diperlukan karena mereka berhadapan dengan hukum selama proses peradilan dan pada tahap penyelidikan, penyidikan, penuntutan, dan hukuman.  Aplikasi penelitian ini: Pengaturan melalui peraturan perundang-undangan diperlukan untuk melindungi perempuan yang berkonflik dengan hukum dalam proses peradilan pidana.  Kebaruan/Orisinalitas: Berbeda dengan penelitian sebelumnya, penelitian ini berfokus untuk mengkaji seberapa signifikan perlindungan hukum bagi perempuan yang berkonflik dengan hukum.  Kata kunci: Perlindungan Hukum, Perempuan, Litigasi

Abstract

Digital forensic expert testimony is required by judges to resolve cases related to information technology. However, there are allegations of violations committed by certain parties on several servers such as illegal access, configuration changes, and shutdowns. This is increased by the destruction of crime scene and digital evidence.  In some cases, analyzing the data collected can be time-consuming, and practical understanding is needed by judges to avoid irrelevant questions for digital forensic experts in court. Therefore, this research aims to determine and analyze forensic digital experts in court hearings, the duties and roles of judges in resolving information and technology cases as well as the position of forensic experts in the judicial process. The doctrinal research is sourced from secondary data in the form of Electronic Information and Transaction laws, criminal procedure laws, research reports, books, and scientific journals. The results show that digital forensics expert testimony is needed to assist judges as gatekeepers in obtaining material truth. Practical digital forensic knowledge is used to increase the efficiency of case examination time by avoiding irrelevant questions. Best practices are used in the actions, procedures, handling, and analysis of electronic evidence as well as digital forensic expert testimony in judicial practice.
