Abstract

Ibadah haji termasuk dalam Rukun Islam kelima harus dipraktikkan oleh umat Islam sedunia yang memenuhi atau mampu memenuhi standaroistita’ah, termasuk kemampuan material, fisik,odanomental. Tawaf adalah salahosatu rukun haji yang tidak bisa ditinggal atau diwakilkan siapapun. Jama’ah haji asal Indonesia didominasi pengikut madzhab Syafi’i yang berarti mereka mengikuti pendapat bahawa bersentuhan antara laki-laki dan perempuan tampa penghalang adalah salah satu hal yang bisa membatalkan wudhu sebagaimana pendapat yang masyur dalam kalangan syafi’iyah Ada beberapa pendapat lintas madzhab yang menyatakan bahwa besentuhan lain jenis tidak membatalkan wudhu selama tidak syahwat namun dengan syarat harus pindah ke madzhab lain (intiqalul madzhab). Konskuensinya jika seseorang ingin pindah ke luar madzhab syafi’i maka harus maka harus pindah satu paket (satu qadliyah). Artinya mengikuti madzhab lain itu mulai dari syarat rukun hingga batalnya wudhu. Penelitian ini menggunakan penelitihan Perpustakaan (library research), yaitu penelitian dengan menggunakan buku sebagai sumber informasi. Meskipun sifat penelitian ini adalah deskriptif analisis, yaitu. mendeskripsikan dan menjelaskan secara sistematis materi pembahasan dari berbagai sumber kemudian menganalisisnya untuk mendapatkan hasil penelitian. Metode pengumpulan data penelitian ini didasarkan pada sumber data. Dalam pendidikan, sumber data berarti subjek mata dapat ditangkap. Ketika peneliti menggunakan dokumentasi, maka dokumen atau catatan adalah sumber informasi sedangkan isi catatan adalah objek penelitian atau variabel penelitian. Meskipun hasil penelitian ini adalah 1. Rukhsoh wudhu’ dalam hal bersentuhan bagi jamaah haji Indonesia menurut pandangan empat mazhab yaitu menurut imam malik tidak batal wudhu’nya jika tidak menimbulkan syahwat, menurut imam hanafi tidak membatalkan dengan catatan tidak bersetubuh, menurut imam syafi’i mutlak batal ketika bersentuhan dengan lawan jenis. Menurut imam ahmad bin hambali itu tidak batal ketika tidak syahwat. 2. Dalam hal bersentuhan bagi jamaah haji Indonesia lebih mudah ketika melakukan thowaf untuk menghimbau bersentuhan bukan mahrom, jamaa’ah haji Indonesia memakai mazhab hanafi dalam hal wudhu’ supaya dalam cacatan bersentuhan bukan mahrom tidak batal menurut imam hanafi tetapi harus satu qoidah menggunakan imam hanafi dalam segi rukun dan batalnya wudhu’ ketika melakukan haji untuk mengatisi bersentuhan. Abstract

Penelitian ini bertujuan untuk menganalisis peran faktor ekonomi dalam penentuan nafkah pasca perceraian menurut perspektif hukum Islam, dengan studi kasus pada Putusan Pengadilan Agama Probolinggo No. 312/Pdt.G/2023. Dalam konteks perceraian, masih banyak ditemukan kasus di mana anak tidak menerima hak nafkah secara penuh dari orang tua, meskipun terdapat putusan pengadilan yang mengaturnya. Penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif-analitis. Data diperoleh melalui wawancara dengan hakim dan mediator, serta analisis dokumen putusan pengadilan. Hasil penelitian menunjukkan bahwa pengadilan mempertimbangkan kondisi ekonomi pihak ayah dalam menetapkan jumlah nafkah, sebagaimana prinsip-prinsip keadilan dalam hukum Islam. Putusan pengadilan juga merujuk pada ketentuan dalam Kompilasi Hukum Islam dan yurisprudensi Mahkamah Agung, serta mempertimbangkan kemampuan finansial ayah dan kebutuhan anak sebagai dasar hukum. Temuan ini menegaskan pentingnya integrasi antara prinsip syariah dan realitas ekonomi dalam mewujudkan keadilan nafkah pasca perceraian di Indonesia.

Abstract

Marriage is a sacred institution governed by Islamic law and national marriage law. Previously, the minimum age for marriage was regulated in Article 7 Paragraph (1) of Law Number 1 of 1974, allowing men to marry at 19 and women at 16. However, this regulation was deemed irrelevant to the principle of maslahah in Islamic law, which aims to promote benefits and prevent harm. Consequently, the government enacted Law Number 16 of 2019, which raised the minimum marriage age for women to 19 years. This study aims to analyze the impact of the age limit changes introduced by Law Number 16 of 2019 from the perspective of maslahah in Islamic law. The research method employed is library research with a normative juridical approach, using primary sources such as the Qur'an, Hadith, fiqh principles, Law Number 16 of 2019, and Constitutional Court Decision Number 22/PUU-XV/2017. The findings reveal that the changes have philosophical, sociological, and juridical implications. Philosophically, they reflect the state's commitment to eliminating discriminatory practices. Sociologically, the changes have led to an increase in marriage dispensation requests in Religious Courts. Juridically, the amendments align with the principles outlined in the Compilation of Islamic Law (KHI) and Law Number 1 of 1974. From the maslahah perspective, the revised law upholds the protection of religion, life, lineage, intellect, and property while contributing to national goals, including economic growth, poverty reduction, and the protection of children's rights.

Abstract

This study aims to identify the procedures for filing for divorce at the Kraksaan Religious Court, and to find out the positive legal review and Islamic law on the decision of the Religious Judge in the Divorce Lawsuit issue for husbands who do not provide a living at the Kraksaan Religious Court. The research method used is qualitative / field research (field research) where this research is descriptive. It was concluded that the procedure for carrying out a lawsuit at the Kraksaan Religious Court must meet the requirements, including a marriage book and ID card, and the religious judge's decision on divorce lawsuits for husbands who do not provide a living from the perspective of Islamic law and positive law based on existing laws and regulations. , in Islamic law that is paying attention to qoidah fiqhiyyah and also in the Qur'an surah al Baqoroh verse 229 if it is worried that the two of them cannot carry out Allah's laws, the wife is not guilty of redeeming herself to her husband so that she can be separated from her husband.

Abstract

Abstracts: Divorce is an increasing phenomenon in Indonesia, influenced by various factors, one of which is parental intervention in their children's households. This interference can cause disharmony and lead to divorce. This article analyzes divorce due to parental intervention in the perspective of positive law and Islamic law with a case study of Decision 379/Pdt.g/2024/PA.Prob. The research method used is a normative juridical approach through literature study and analysis of court decisions. Seeing from the results of the contents of the decision that the judge considered this household could not be saved because the Plaintiff and Defendant had tried to resolve the problem.  The results of the study show that positive law in Indonesia regulates divorce as an individual right that must be processed through the courts. Meanwhile, in Islamic law, divorce is allowed but recommended to be avoided except in emergencies. This study emphasizes the importance of balancing between individual rights in marriage and the role of parents so as not to overstep limits that can damage the integrity of the household. In addition, a mediation approach and legal education are needed to prevent divorce due to external factors such as family intervention.Keywords: Divorce, Parental Intervention, Positive Law, Islamic Law, Court Decision. Abstrak : Perceraian merupakan fenomena yang terus meningkat di Indonesia faktor yang mempengaruhi salah satunya adalah intervensi orang tua dalam rumah tangga anak mereka. Campur tangan ini dapat menimbulkan ketidakharmonisan dan berujung pada perceraian. Artikel ini menganalisis perceraian akibat intervensi orang tua dalam perspektif hukum positif dan hukum Islam dengan studi kasus Putusan 379/Pdt.g/2024/PA.Prob. Metode penelitian yang digunakan adalah pendekatan yuridis normatif melalui studi kepustakaan dan analisis putusan pengadilan. Melihat dari hasil isi putusan bahwa hakim mempertimbangkan rumah tangga ini sudah tidak bisa di selamatkan karena  Penggugat dan Terguggat sudah berupaya dalam menyelesain permasalahannya. Hasil kajian menunjukkan bahwa hukum positif di Indonesia mengatur perceraian sebagai hak individu yang harus diproses melalui pengadilan. Sementara itu, dalam hukum Islam, perceraian diperbolehkan tetapi dianjurkan untuk dihindari kecuali dalam keadaan darurat. Studi ini menegaskan pentingnya keseimbangan antara hak individu dalam pernikahan dan peran orang tua agar tidak melampaui batas yang dapat merusak keutuhan rumah tangga. Selain itu, diperlukan pendekatan mediasi dan edukasi hukum untuk mencegah perceraian akibat faktor eksternal seperti intervensi keluarga.Kata kunci: Perceraian, Intervensi Orang Tua, Hukum Positif, Hukum Islam, Putusan Pengadilan.

Abstract

Abstract: This study discusses the position of substitute heirs from the perspective of Islamic law and civil law in Indonesia. In inheritance practices, situations often occur where direct heirs have died before the testator, so that problems arise regarding who inherits the inheritance. Islamic law recognizes the concept of hijab and the division of inheritance strictly based on lineage, but does not explicitly regulate substitute heirs. On the contrary, the Civil Code (KUHPerdata) and the Compilation of Islamic Law (KHI) provide space for grandchildren as substitute heirs, especially if their parents who should be heirs have died first. Through a normative-comparative approach, this study reveals that there are differences in principle between classical Islamic law and positive law in Indonesia regarding the existence of substitute heirs. KHI as a codification of Islamic law in Indonesia tries to accommodate the principle of social justice by adopting the concept of substitute heirs, although it is not entirely in accordance with classical fiqh. This study recommends the need for harmonization between Islamic legal norms and the provisions of national laws and regulations in order to ensure legal certainty and justice in the distribution of inheritance.Keywords: Substitute heir, Islamic law, civil law, KHI, inheritanceAbstrak: Penelitian ini membahas kedudukan ahli waris pengganti dalam perspektif hukum Islam dan hukum perdata di Indonesia. Dalam praktik pewarisan, sering kali terjadi situasi di mana ahli waris langsung telah meninggal dunia terlebih dahulu dari pewaris, sehingga muncul permasalahan mengenai siapa yang mewarisi harta peninggalan. Hukum Islam mengenal konsep hijab dan pembagian warisan secara tegas berdasarkan garis nasab, namun tidak secara eksplisit mengatur ahli waris penggantinya. Sebaliknya, Kitab Undang-Undang Hukum Perdata (KUHPerdata) dan Kompilasi Hukum Islam (KHI) memberikan ruang bagi cucu sebagai ahli waris pengganti, terutama jika orang tua mereka yang seharusnya menjadi ahli waris telah meninggal dunia lebih dahulu. Melalui pendekatan normatif-komparatif, penelitian ini mengungkap bahwa terdapat perbedaan prinsip antara hukum Islam klasik dengan hukum positif di Indonesia terkait keberadaan ahli waris pengganti. KHI sebagai kodifikasi hukum Islam di Indonesia mencoba mengakomodasi prinsip keadilan sosial dengan mengadopsi konsep ahli waris pengganti, meskipun tidak sepenuhnya sesuai dengan fiqh klasik. Kajian ini merekomendasikan perlunya harmonisasi antara norma-norma hukum Islam dan ketentuan peraturan perundang-undangan nasional guna menjamin kepastian hukum dan keadilan dalam pembagian warisan.Kata kunci: Ahli waris pengganti, hukum Islam, hukum perdata, KHI, pewarisan

Abstract

Abstract: This study aims to examine the implementation of mediation in resolving disputes related to women's and children's rights at the Probolinggo Religious Court. Mediation as an alternative method of dispute resolution is considered relevant in providing space for peaceful resolution and prioritizing the best interests of women and children involved in divorce cases, child custody, and division of joint property. This study uses a qualitative approach with a case study at the Probolinggo Religious Court, which involves an analysis of the mediation process carried out by mediators in the court and its impact on women's and children's rights. The results of the study indicate that although mediation provides an opportunity for the parties to reach a fair and peaceful agreement, there are challenges in ensuring that women's and children's rights are properly protected in the mediation process. Factors such as legal awareness, mediator understanding, and social pressure often influence the course of mediation. This study suggests the need to increase the capacity of mediators and more intensive assistance to ensure that the implementation of mediation can truly provide maximum benefits for women's and children's rights.Keywords: Mediation, Women's Rights, Children's Rights, Dispute Resolution, Religious Court Probolinggo. Abstrak: Penelitian ini bertujuan untuk mengkaji implementasi mediasi dalam penyelesaian sengketa terkait hak-hak perempuan dan anak di Pengadilan Agama Probolinggo. Mediasi sebagai metode alternatif penyelesaian sengketa dianggap relevan dalam memberikan ruang bagi penyelesaian secara damai dan mengutamakan kepentingan terbaik bagi perempuan dan anak yang terlibat dalam kasus perceraian, hak asuh anak, dan pembagian harta gono-gini. Penelitian ini menggunakan pendekatan kualitatif dengan studi kasus di Pengadilan Agama Probolinggo, yang melibatkan analisis terhadap proses mediasi yang dilakukan oleh mediator di pengadilan tersebut serta dampaknya terhadap hak-hak perempuan dan anak. Hasil penelitian menunjukkan bahwa meskipun mediasi memberikan kesempatan bagi para pihak untuk mencapai kesepakatan yang adil dan damai, terdapat tantangan dalam memastikan bahwa hak-hak perempuan dan anak terlindungi dengan baik dalam proses mediasi. Faktor-faktor seperti kesadaran hukum, pemahaman mediator, serta tekanan sosial sering mempengaruhi jalannya mediasi. Penelitian ini menyarankan perlunya peningkatan kapasitas mediator serta pendampingan yang lebih intensif untuk memastikan implementasi mediasi dapat benar-benar memberikan manfaat maksimal bagi hak-hak perempuan dan anak.Kata Kunci: Mediasi, Hak-Hak Perempuan, Hak-Hak Anak, Penyelesaian Sengketa, Pengadilan Agama Probolinggo.

Abstract

This study aims to analyze the Islamic educational thought of Syed Muhammad Naquib al-Attas and examine its relevance to the moral crisis of youth in the modern era. The rapid development of the digital era has significantly influenced adolescents’ lifestyles, ways of thinking, and behavior, resulting in various forms of moral degradation such as declining adab, weakening spiritual values, deviant behavior, and identity crises. This study employs a qualitative approach using library research as the research design. Data were collected through documentation studies by examining various primary and secondary sources related to Syed Muhammad Naquib al-Attas’s educational thought, the concept of ta’dib, Islamic education, and youth moral crises. The data were analyzed using content analysis methods to understand, interpret, and draw conclusions from the examined literature. The findings reveal that the concept of adab in Al-Attas’s educational thought occupies a central position in shaping knowledgeable and moral individuals. The moral crisis among youth is essentially caused not only by weak social control but also by an epistemological crisis that leads to the loss of the ability to understand the true nature of knowledge and values. The concept of ta’dib proposed by Al-Attas serves as an important solution because it emphasizes not merely behavioral formation, but also the transformation of consciousness, the integration of knowledge and values, and the development of morality oriented toward truth and spiritual responsibility. Therefore, strengthening adab in Islamic education becomes a fundamental agenda for shaping a young generation with noble character, strong morality, and the ability to face the challenges of modernity.
