Abstract

Kemajuan zaman membuat manusia berlomba lomba memperlihatkan kemampuannyadalam hal apapun yang ia minati tidak terkecuali yaitu dokter,seorang dokter telah menunjukkan ekpetasinya sebagai ilmuawan telah mewujudkan penelitian penelitian berbagai uji coba dalam bidang tranplantasi dimulai dari mentranplantasikan sulam rambut, menambal tulang, juga kornea hingga bedah jantung dan lain sebagainya.maka dari situ seserang yang mengkaji ilmu hukum islam para ulama‟ telah mnegkaji bagaina tindakan yang di lakukan oleh pra dokter tersebut,apakah bisa di benarkan menurut hukum islam atau tidak,maka dengan adanya problem tersebut ulama‟telah menerapkan dan mengkaji dengan landasan hukum hukum Allah yaitu AL quran dan sunnah sunnah nabi saw.untuk memutuskan kebolehan atau tidaknya tranpalantasi yang di lakukan oleh para ilmuan dalam bidang tranplantasi. Jenis penelitian ini termasuk dalam kategori penelitian kepustakaan (library research)yaitu suatu penellitian yang menggunakan buku buku dan kitab kitab fiqih sebagai sumber datanya.sedangka apabila dilihat dari sifatnya pnelitian ini bersifat deskriptif analitik-komparatif,yakni memaparkan data dat tentang suatu hal dengan analisa dan komparasi untuk menentukan hum tranplantasi dalam prespektis ulama‟ 4 madzhab.Dari hasil penelitian ditemukan bahwa hukum tranplantasi dalam prespektif ulama‟ 4 madzhab terdapat dua pendapat pendapat pertama yaitu 4 madzhab sepakat bahwasanya tranplantasi dalam keadaan hidup maupun koma hukumnya haram,adapun pendapat ke dua pendapat madzhab hanafi dan madzhab maliki mengenai tranplantasi dalam keadaan meninggal haram,karena bahayanya tidak sampai melebihi bahayanya merusak kehormatan mayyit.akan tetapi dalam pandangan madzhab syafi‟i dan hambali membolehkan tranplantasi dalam keadaan meninggal.hal itu untuk menyelamatkan nyawa orang lain demi keberlangsungan hidup.

Abstract

Penelitian ini bertujuan untuk mengkaji tradisi sombhengan dalam pelaksanaan walimah al-‘urs (resepsi pernikahan) di Desa Brani Wetan, Kecamatan Maron, Kabupaten Probolinggo, dengan pendekatan sosiologi hukum Islam. Tradisi sombhengan merupakan bentuk kontribusi sosial masyarakat berupa pemberian sumbangan, baik berupa uang maupun barang, kepada pihak yang menyelenggarakan hajatan. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi lapangan melalui wawancara, observasi, dan dokumentasi. Hasil penelitian menunjukkan bahwa sombhengan dipandang masyarakat sebagai simbol solidaritas dan bentuk dukungan sosial yang memperkuat kohesi antarindividu. Namun, dalam praktiknya, terdapat pergeseran makna di mana tradisi ini cenderung menjadi kewajiban sosial yang menimbulkan tekanan dan beban moral, terutama karena adanya tuntutan untuk membalas sumbangan dalam jumlah yang sama atau lebih. Dalam perspektif sosiologi hukum Islam, sombhengan dapat dikategorikan sebagai ‘urf shahih selama dilakukan secara sukarela dan tidak melanggar prinsip-prinsip syariat. Oleh karena itu, perlu adanya pemahaman yang lebih mendalam terhadap nilai-nilai hukum Islam agar tradisi ini tetap lestari tanpa menimbulkan distorsi makna.

Abstract

Child marriage remains a significant legal and social issue in Indonesia, particularly in Probolinggo, which has one of the highest child marriage rates in East Java. This phenomenon negatively affects children in terms of education, health, economy, and social well-being. This study analyzes child marriage prevention using the Sadd al-Dzari’ah approach, which aims to prevent actions leading to harm. Employing an empirical juridical method with a qualitative approach, data were gathered through interviews, observations, and legal document analysis. The findings reveal that preventing child marriage is not only permissible but also recommended in Islamic law. The Sadd al-Dzari’ah approach is applied through three key elements: al-ifda (the negative impacts of child marriage), al-wasilah (preventive measures such as education and legal enforcement), and al-mutawasal ilaih (the ultimate goal of protecting children’s rights and well-being based on Maqasid Shariah). The study also highlights challenges in implementation, such as legal loopholes in marriage dispensation, socio-cultural norms, and economic factors that continue to drive child marriages. Strengthening policies, increasing public awareness, and integrating Islamic jurisprudence with national law are essential in effectively reducing child marriage rates.

Abstract

Pembagian harta bersama setelah perceraian merupakan bentuk ideal pengelolaan sistem keluarga egaliter, akibat adanya aturan harta bersama dalam perkawinan. UU Perkawinan, PP No. 09 Tahun 1975 dan KHI No. 01 Tahun 1991 telah mengatur secara tegas tentang harta bersama dan pembagian harta bersama. Penelitian ini akan mengkaji konsep pembagian harta bersama yang telah diatur dalam UU Perkawinan, dan secara khusus diatur dalam Kompilasi Hukum Islam pasal 97 dengan menjadikan maqasidh syariah Jasser Auda sebagai teori analisis. Sebagai metode penelitian untuk mendapatkan hasil yang optimal, peneliti menggunakan dua pendekatan. Yang pertama adalah pendekatan konseptual dan yang kedua adalah pendekatan negara. Hasil penelitian menunjukkan bahwa secara filosofis aturan pembagian harta bersama memiliki semangat filosofis Islam. Dalam tinjauan maqashid syariah, Jasser Auda, pembagian harta setelah perceraian memiliki semangat menjaga aspek kekeluargaan dan martabat manusia, bukan maqoshid syariah yang bersifat individualistis.

Abstract

Child marriage remains a persistent issue in Probolinggo Regency, posing risks to children’s well-being and raising complex legal, religious, and socio-cultural challenges. This study aims to explore how the values of love and tolerance in Islamic law, along with local wisdom, can be harmonized to address the practice of child marriage. Employing a normative-empirical approach, the research analyzes classical and contemporary Islamic legal sources, especially through the lens of maqāṣid al-sharī‘ah and integrates field data gathered from interviews and observations. Findings reveal that child marriage in the region is often driven by economic hardship, cultural norms, and religious misinterpretation. Islamic law, when viewed contextually, offers a strong foundation for child protection as a central objective. Moreover, local wisdom that emphasizes social harmony, compassion, and deliberation serves as a potential entry point for legal reconstruction. The discussion proposes a model of harmonization between Islamic legal principles and cultural practices, rooted in love and tolerance, as a strategic solution to reduce child marriage. The study recommends community-based legal education that integrates religious values and cultural sensitivity to prevent child marriage effectively.

Abstract

This article examines the harmonization of Islamic law and local wisdom in family law issues through the development of the ijtihad method from the perspective of Yusuf al-Qaradawi's istinbāṭ method. Given that contemporary Muslim family issues are increasingly complex, this study emphasizes the need for an istinbāṭ framework that maintains the authenticity of naṣṣ while being responsive to social realities. This study employs a qualitative-normative approach, using usul al-fiqh analysis, and examines al-Qaradawi's key concepts as instruments for integrating local wisdom. Data were collected from exploring library materials related to Yusuf al-Qaradawi's works within the framework of istinbāṭ that was developed. The results of this study show that Yusuf al-Qaradawi developed an istinbāṭ method called istinbāṭ at-taysīr with three types, namely intiqā’iy tarjīhiy, ibdā’iy insyāiy, and intiqā’iy insyā’iy. This method combines as-salafiy, which does not adhere to the opinions of the fiqh schools, and al-mażhabiy, which is guided by the opinions of the imams of the schools, by re-examining the various opinions of the scholars or conducting their own ijtihad and choosing the opinion that provides leniency, provides convenience, is in accordance with the conditions, and combines local wisdom, to realize the greater good. The contribution of this article lies in providing a methodological model to bridge the tension between textuality and contextuality in family law, while offering academics and policymakers a basis for formulating norms that are more just, relevant, and in line with the demands of modern society.

Abstract

Conception and harmonization of religious culture and traditions within multifaith families in three villages known as centers of religious moderation in Malang City. The background to this study arises from the complexity of urban life characterized by religious and cultural diversity, which demands harmonious management of differences within the family and community context. This research uses a qualitative approach with a case study method, involving in-depth interviews, participant observation, and analysis of local documents as the primary data sources. The results show that multifaith families in the three villages are able to build harmony through several strategies: mutual respect for each member's religious practices, adapting traditions and rituals to be inclusive, and maintaining open communication between family members and neighbors. Furthermore, social interactions at the village level, such as joint celebrations, community activities, and support among residents, contribute to strengthening social cohesion and fostering values of tolerance. This research confirms that the harmonization of religious culture and traditions is not merely a normative concept, but a practice that can be realized through awareness, flexibility, and appreciation of differences. These findings contribute to the understanding of religious moderation at the local level and serve as a reference for developing an adaptive and harmonious model for managing multifaith family diversity.

Abstract

This study aims to analyze the authority of Islamic law in the Indonesian national legal system using the theoretical frameworks of authority and persuasive sources from H. Patrick Glenn, as well as the perspective of fiqh siyasah. This study uses a historical-normative method, tracing the development of Islamic law from the colonial period to post-independence, and analyzing its authority in the current legal system in Indonesia. The results of the study indicate that during the colonial period, Islamic law functioned primarily as a persuasive source, namely, religious norms implemented socio-religiously without formal binding force within the state's legal structure. However, after independence, Islamic law underwent a significant transformation through normative recognition in laws and regulations, such as Law No. 1 of 1974/19 of 2019 and Law No. 7 of 1989 concerning Religious Courts. The existence of these laws implies that Islamic legal norms become legal, binding, and have legal consequences. This transformation from persuasive norms to authoritative norms does not conflict with the principles of the rule of law or the character of Indonesia as a Pancasila state, but rather reflects the dialogical and complementary relationship between religion and the state. In the fiqh siyasah perspective, the state is seen as having the legitimacy to adopt Islamic legal values oriented towards justice and public benefit into positive law.

Abstract

School libraries play a crucial role as a key supporting element in the learning process, particularly in building and developing reading interest and literacy habits among students. Optimally, these facilities go beyond mere book storage; they transform into integrated learning centers operated with a professional managerial approach. This approach encompasses essential stages such as strategic planning, effective resource management, structured daily activities, and continuous control and evaluation mechanisms to ensure high service quality. This study focuses on an in-depth analysis of the planning, implementation, and assessment stages of library management effectiveness in encouraging an increase in student literacy culture at SMA Miftahul Ulum Jatiurip, a pesantren-based educational institution. A qualitative approach with a case study design was chosen because of its ability to reveal the real picture and contextual nuances of library management practices in the school environment, which is unique due to the integration of religious values. Primary data were collected through in-depth interviews, direct field observations, and document studies, involving various key sources such as the principal, library management staff, supervising teachers, and students as the primary users. The data analysis process follows an interactive model that includes reducing raw information to essential patterns, presenting findings in a coherent narrative and visual form, and drawing inferences supported by strong evidence. This study aims to achieve a holistic understanding of the dynamics of library management at Miftahul Ulum Jatiurip High School, including a detailed understanding of key constraints such as budget or infrastructure limitations, as well as positive encouragement such as support from the Islamic boarding school community. This study is expected to summarize practical and theoretical values ​​in the development of library management in schools, especially in Islamic boarding school-based educational institutions. The findings obtained can be used as a primary reference for developing creative strategies to motivate students' interest in reading, for example through the integration of digital technology tools such as interactive e-book applications, strengthening literacy initiatives that collaboratively involve the Islamic boarding school community, and improving skills and training for library staff. As a result, the library is no longer just a supporting facility for the teaching and learning process, but is transformed into an effective center of change in building a sustainable literacy ecosystem, which is in line with the dynamics of the digital era and Islamic values ​​in the Islamic boarding school environment.

Abstract

This article explores fatherlessness in Muslim families through Fiqh al-Usrah and Qirā'ah Mubādalah. It reinterprets Surah al-Nisā' [4]:34 (qawwāmūn) and al-Taḥrīm [66]:6 (Qū anfusakum wa ahlīkum nārā), shifting paternal leadership from hierarchical authority to reciprocal moral guardianship (ḥirāsah akhlāqiyyah mubādalahiyyah), thereby legitimizing shared spiritual responsibility when fathers are absent. The study identifies the moral and spiritual deficit caused by paternal absence particularly declining ṣalāh discipline and ethical formation among children as a critical disruption of Islamic family ethics. Using a qualitative-normative approach integrating classical fiqh, Qur'ānic exegesis, and gender hermeneutics, it demonstrates that Qirā'ah Mubādalah offers a reciprocal framework for redistributing spiritual responsibility. The Qur'ānic ethic of caring for orphans (yatāmā) found in Surah al-Nisā' [4]:2-10 and al-Duḥā [93]:9 provides the dalīl shar'ī (legal proof) for mothers or communities to assume paternal religious roles (wilāyah ta'dībiyyah) when fathers are absent. This collective guardianship is grounded in maqāṣid al-sharī'ah, prioritizing preservation of faith (ḥifẓ al-dīn) and lineage (ḥifẓ al-nasl) over rigid gender roles. The study introduces relational justice ('adālah 'alāqiyyah) as an advancement beyond classical fiqh's transactional justice. While classical family law prioritized formal equity (inheritance, nafaqah, procedural fairness), it overlooked emotional labor ('amal 'āṭifī), caregiving (ri'āyah), and spiritual mentorship (tarbiyah rūḥiyyah). Relational justice mandates these as equally binding religious duties (farā'iḍ dīniyyah) shared between parents, ensuring that when one fails spiritually, the other gains full theological authority to lead, supported by communal accountability (mas'ūliyyah jamā'iyyah). The study concludes that Qirā'ah Mubādalah renews Fiqh al-Usrah by legitimizing shared moral leadership, redistributing patriarchal spiritual authority, and strengthening Muslim families' ethical foundations through reciprocity, emotional care, and functional competence.
