Abstract

More and more BPRs have had their operational permits revoked by the OJK. The revocation of a BPR license is due to the bank's unhealthy financial condition, which has the potential to threaten the banking system and harm various parties. Therefore, the bank must have its business license revoked with several previously determined considerations. One of the BPRs whose business license was revoked was BPR Persada Guna Pasuruan. This research aims to analyze the forms of legal violations in the case of revocation of BPR Persada Guna's business license and find out the follow-up given by the authorities in the case of BPR Persada Guna Pasuruan. This research uses a normative juridical approach. The research results show that the forms of legal violations include credit violations, capital insufficiency, and violations of bank governance. Meanwhile, the follow-up provided is through the Decree of the Members of the Board of Commissioners of the Financial Services Authority Number KEP-84/D.03/2023 dated 4 December 2023 regarding the Revocation of the Business License of PT Bank Kredit Kredit Rakyat Persada Guna.

Abstract

This research analyzes the administrative sanctions given by the Financial Services Authority (OJK) to PT Maseri Aset Manajemen for governance violations, such as the absence of a physical office, business inactivity, not having professional employees, and not complying with OJK regulations. This research uses normative legal methods and a descriptive approach. The findings in this study show the importance of implementing Good Corporate Governance (GCG) and compliance with regulations. The research recommends increased stringent regulations and increased company compliance with OJK regulations

Abstract

This research aims to analyze the effectiveness of consumer protection regulations in handling fraudulent investments, focusing on the case of Doni Salmanan, a social media influencer involved in illegal investment promotion. Fraudulent investments have become a serious threat to society in Indonesia, especially in the context of the development of digital technology that allows the rapid dissemination of information. This research uses a normative legal research method with a case study approach, examining applicable regulations such as Law Number 8 Year 1999 on Consumer Protection and regulations of the Financial Services Authority (OJK). The results of the analysis show that although there are existing regulations to protect consumers, the implementation and supervision of illegal investment activities are still weak. Weak supervision, low public financial literacy, and inadequate sanctions against fraudulent investment actors indicate the need to update and strengthen regulations. This study provides recommendations to improve the effectiveness of consumer protection regulations and build more adaptive mechanisms to prevent investment fraud in the digital era.

Abstract

The chicken cartel in Indonesia that was exposed in 2016 has become a major issue affecting market structure and corporate competition. This strategy involves 12 large companies collaborating to control the availability and price of chicken by limiting chicken production (parent stock). Using a descriptive approach and normative legal research methods, this study examines how the cartel affects market structure, corporate competitiveness, and consumer welfare. This study reveals that the chicken cartel encourages oligopolistic conditions that are detrimental to small producers, consumers, and the economy as a whole. Large companies dominate the market, causing consumers to pay unfair prices, while small farmers lose their competitiveness.

Abstract

The operational license of PT Sarana Majukan Ekonomi Finance Indonesia (PT SMEFI) has been revoked through a Decree from the OJK Board of Commissioners with the number KEP-2/D.06/2024, which was issued on January 15, 2024. This decision was taken because PT SMEFI was declared a company whose condition could not be improved. Prior to the revocation of the business license and the decision was made, the OJK had classified PT SMEFI as a company under intensive supervision as a result of an overall evaluation of the company's health which was considered unfavorable. PT SMEFI has also received administrative sanctions in the form of a Third Warning due to violations of the provisions of the applicable provisions, namely regarding the Financing to Asset Ratio (FAR). Every action carries legal consequences that must be accounted for. Leasing, as a form of financing in the financial sector, is required to comply with existing regulations, including operational permits issued by the Financial Services Authority (OJK). Regarding permits, it is the legal basis for leasing companies to carry out their operations.

Abstract

This study examines the debt restructuring process of PT Adhi Persada Properti through a Penundaan Kewajiban Pembayaran Utang (PKPU) proceeding. By employing a normative legal research method with a descriptive approach, this study analyzes the legal framework governing PKPU and its application in the case of PT Adhi Persada Properti. The findings reveal that the company's delay in submitting a peace plan and the lack of a clear restructuring strategy have raised concerns about the fairness of the process for creditors. The study highlights the importance of timely compliance with legal requirements in PKPU proceedings and the need for a balanced approach that protects the interests of both debtors and creditors.

Abstract

Salah satu belahan bumi pertiwi yang menyimpan segala pesona alam menakjubkan, membuat Desa Srigading sering menjadi objek wisata bagi para wisatawan. Aktivitas ekonomi Desa Srigading berfokus pada sektor pertanian, hasil pertanian seperti Kopi dan Jagung menjadi salah satu komoditi unggul di Desa Srigading. Sektor Pariwisata di Desa Srigading menjadi salah satu sektor yang paling diunggulkan karena memiliki potensi yang cukup baik untuk membuat Desa Srigading menjadi Desa Wisata Alam. Pembanguanan Desa Srigading menjadi Desa Wisata Alam tidak terlepas dari campur tangan penduduk Desa untuk memaksimalkan potensi alam mereka. Wisata alam Desa Srigading masih memiliki fasilitas yang minim serta masih belum terdapat ikon-ikon wisata yang sekiranya dapat menarik minat wisatawan untuk berkunjung. Oleh karenanya perlu diadakan Revitalisasi atau upaya untuk menghidupkan kembali Rest Area tempat Wisata yang terletak di Desa Srigading menjadi lebih lengkap dan ramah terhadap wisatawan. Tujuan dari kegiatan pengabdian ini adalah untuk merevitalisasi rest area untuk menciptakan suatu Kawasan yang strategis untuk berwisata. Kegiatan revitalisasi ini tidak hanya dilakukan.

Abstract

The case of alleged violation of company secrets of PT Chiyoda Kogyo Indonesia, involving PT Maruka Indonesia, Hiroo Yoshida, and PT Unique Solutions Indonesia, who allegedly conspired to obtain confidential information in accordance with Article 23 of Law No. 5 Year 1999. This alleged violation caused potential financial losses of up to Rp 63 billion for PT Chiyoda Kogyo Indonesia and threatened its reputation. The protection of company secrets is crucial in maintaining a competitive advantage in an innovation-laden industry. This research explores the legal aspects and business impact of leaking sensitive information, focusing on the Trade Secrets Act (UURD) and the Antimonopoly Act, and its implications for fair business competition. The analysis is conducted through a normative legal approach, assessing the relevance of contract and property rights theories in the context of trade secret protection. In addition, it is recommended that companies implement stricter information security strategies, such as Non-Disclosure Agreement (NDA) contracts and confidentiality agreement renewals, to prevent future leaks.

Abstract

Salah satu desa yang berpotensi sebagai wilayah pariwisata yang memanfaatkan alam, masih belum mengelola daerahnya dengan optimal. Terdapat rest area yang dimanfaatkan untuk rehat dan menikmati keindahan alam, penataan dan kondisi masih perlu dilakukan perbaikan. Oleh karena itu, tujuan pengabdian kepada masyarakat ini untuk melakukan revitalisasi rest area berupa pembangunan rumah pohon sebagai salah satu daya tarik untuk mengunjungi lokasi rest area.  Penelitian ini merupakan penelitian literature review. Tahap penelitian meliputi tahap persiapan dan tahap pelaksanaan. Metode pengumpulan data menggunakan dokumentasi dan observasi. Analisis data menggunakan analisis kualitatif. Hasil penelitian pengabdian kepada masyarakat ini diawali dengan tahap persiapan berupa diskusi bersama mitra, kemudian merancang alat penunjang yang relevan, serta bersama mitra meninjau lokasi yang akan di revitalisasi. Tahap pelaksanaan berupa pembuatan desain rumah pohon, dilanjutkan dengan pembangunan rumah pohon bersama mitra. Hasil kegiatan ini menunjukkan adanya manfaat ekonomi yang diperoleh masyarakat dan juga merupakan salah satu strategi dalam pengembangan desa wisata. Fasilitas tersebut yaitu berupa rumah pohon yang diharapkan dapat menambah jumlah kunjungan. Adanya fasilitas tambahan, maka pengunjung semakin bertambah karena terdapat tambahan fasilitas yang menambah daya tarik wisatawan.

Abstract

Cultural infiltration can be considered as a threat to the sustainability of Indonesia's local cultural identity and values, so that in this context it can be said to be a "nation threat". This is especially the case if the adoption of a foreign culture is not carried out by considering its long-term impact on the sustainability of local culture and society. This study uses an interpretive qualitative approach with a realist ethnographic model. Literature studies and narrative interviews were used in this study to reconstruct the domain, taxonomy and interrelationships of cultural themes in this study, socio-economic issues concerning the reciprocal relationship between cultural infiltration and economic behavior. The cultural invasion of the Korean wave on the economic behavior of the Indonesian people can create purchasing decisions and people's consumption patterns. The existence of the Korean wave can change people's consumption patterns, especially digital natives who switch to consuming Korean products which are becoming a trend that has extraordinary magnetism to attract the interest of this digital native terminology group, which can threaten the sustainability of local industries and affect the nation's economic structure.
