Abstract

Certificate of land ownership regulated in the Undang-Undang Pokok Agraria (UUPA) is an ownership proof of the land right where it becomes powerful evidence. The increasement of necessity of a land is not followed by the increasement of the availability of land that can be utilized by the society, which causes many disputes related to the ownership or land right. One of many problems that arises is double certificate on a land. Double certificate on a land causing risks on the owner of land right where such phenomena caused by the maladministration to criminal action. Badan Pertanahan Nasional (BPN) as an institution established by the Government that holds the sole authority in national land should be responsible in the matters related to the land dispute, especially double certificate. Beside that, there is a necessity on the legal protection to be provided by the State for the owner of land right to protect the rights of the land owner. The research performed using juridical normative with legislation approach and conseptual approach. The results of the research will be presented in the form of an explanatory-analysis where the author explains the legal certainty for land ownership holders regarding the issuance of double certificates

Abstract

Pejabat Pembuat Akta Tanah (PPAT) menurut Pasal 1 angka 1 Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah sebagaimana telah diubah dengan Peraturan Pemerintah Nomor 24 Tahun 2016 tentang Perubahan atas Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah, adalah pejabat umum yang diberikan kewenangan untuk membuat akta-akta otentik mengenai perbuatan hukum tertentu mengenai hak atas tanah atau Hak Milik Atas Satuan Rumah Susun. Pada praktiknya, terdapat PPAT yang melakukan peralihan hak atas tanah kepada pembeli tanpa sepengetahuan penjual sedangkan belum terjadi pelunasan, sehingga menimbulkan kerugian bagi penjual. Penelitian ini adalah penelitian hukum normative yang menggunakan data sekunder yang dikumpulkan melalui studi kepustakaan. Hasil penelitian ini menunjukkan bahwa, pertimbangan Hakim didasarkan pada perbuatan PPAT yang bertentangan dengan asas tunai dalam pembuatan Akta Jual Beli (AJB), karena faktanya, PPAT tetap melakukan penomoran AJB tanpa sepengetahuan penjual (Penggugat) yang mana kemudian dijadikan dasar untuk peralihan hak dari atas nama Penggugat ke atas nama pembeli (Tergugat I) dalam bentuk sertifikat. Pertanggungjawaban hukum PPAT selain secara keperdataan dinyatakan melakukan perbuatan melawan hukum, secara administratif adalah potensi dijatuhi sanksi berupa teguran tertulis sampai pemberhentian dari jabatannya, dan secara pidana adalah potensi diancam dan dipidana karena melakukan pemalsuan akta otentik secara bersama-sama.

Abstract

Profesi seorang Notaris sebagai pembuat akta tanah, maka tentu akan berhubungan dengan tanggung jawab. Tanggung jawab seorang notaris tidak hanya pada proses pembuatan akta otentik saja, tetapi sampai dengan terwujudnya akta otentik sampai pada saat setelah akta otentik itu terbentuk. Akta yang dibuat oleh notaris pada prinsipnya merupakan akta otentik, namun pada praktek akta otentik tersebut dapat berubah menjadi akta di bawah tangan dengan berbagai alasan tertentu. Metode yang digunakan yaitu yuridis normatif dengan studi pustaka, Hasil penelitian ditemukan akibat hukum terhadap akta yang cacat hukum dapat mengalami degradasi menjadi akta di bawah tangan apabila di dalam akta tersebut terdapat suatu pelanggaran sebagaimana diatur dalam Pasal 1869 KUHPerdata. Pertanggungjawaban notaris terhadap akta yang cacat hukum, notaris dapat diminta pertanggungjawaban secara administratif, tanggung jawab secara perdata dan tanggung jawab secara pidana apabila memang terbukti melakukan kesalahan dalam menjalankan jabatannya sebagai pejabat umum yang membuat suatu akta otentik.

Abstract

Civil law regulates and determines so that in the association of society, people can know and respect the rights and obligations of each other, so that the interests of each person can be guaranteed and maintained as well as possible. (Christina Bagenda, 2023) This research aims to analyze whether the Deed of Sale and Purchase Agreement hereinafter referred to as APJB (Elfa Mirnawati Damayantia, 2023) made by and before Khairu Subhan, S.H. as Notary (Defendant II) in Decision Number 95/PDT/2021/PT SMR has fulfilled the valid requirements of an agreement according to Article 1320 of the Civil Code. The research method used is normative with an analytical descriptive approach. The results showed that although the APJB (Elfa Mirnawati Damayantia, 2023) initially fulfilled the valid terms of the agreement, there was a default by Yusi Ananda as Defendant I in its implementation which resulted in the valid terms of the agreement no longer being fulfilled and had no legal force because Diponogoro K. Fernandez as the Plaintiff requested a request for annulment to the Court. Abstract

This article will discuss the efficient utilization of Geo Stationary Orbit (GSO). The research of this article aims to find out related to the utilization of GSO by countries that must be done efficiently so as to meet the needs of all mankind. The research method in this article is normative juridical. As a limited natural resource, GSO should be utilized jointly and efficiently so as not to exceed its orbital carrying capacity so as not to cause saturation. The utilization of GSO must be carried out rationally, efficiently and economically so that its access can be utilized equally for the benefit of all mankind by taking into account the needs of developing countries. GSO, which is part of space, is called the province of all mankind, so it cannot be claimed for ownership or sovereignty by the state. To achieve peace, the utilization of GSO must be done for the benefit of every country, regardless of its economic level or technological and scientific progress.

Abstract

Soil functions as the surface layer of the earth that supports plant roots' growth, supports upright plants and meets water and air needs. The importance of land for humans is very clear, because humans cannot live without land. Therefore, land registration becomes increasingly important for society as time goes by. The land registration process produces legal consequences, namely the issuance of a land certificate which functions as legal and strong evidence for the holder of rights to the land. However, with the large number of certificates issued by the National Land Agency (BPN), the possibility of errors in the certificate issuance process remains, even though the chance of such errors occurring is small. One error that may occur is an error in recording the origin of land over management rights, as illustrated in the Decision of the State Administrative Court for Judicial Review Number 206/PK/TUN/2023. This research uses normative juridical research methods. Errors or omissions in issuing a certificate can cause the certificate to become invalid, either due to inaccurate data on the legal subject or legal object stated in the certificate. These errors can occur at various stages of land registration. Adding phrases such as "Above HPL No. 1/Jatinegara” can affect the meaning and legal consequences for PT ABC as the legal owner of the land. The existence of provisions regarding certificates and land rights is a preventive step to protect land rights and prevent disputes. For repressive legal protection, which is applied after a dispute occurs, the aim is to resolve the conflict. If a land dispute arises, repressive legal protection can take the form of restoring rights to the original owner of the land

Abstract

Dengue fever is an infectious disease transmitted through the bite of the Aedes aegypti mosquito. Efforts to control this disease often face insecticide resistance and environmental factors. One innovation that is expected to reduce the spread of DHF is the application of gene drive by utilizing Wolbachia bacteria. This technology works by infecting mosquito populations to reduce their ability to transmit dengue virus. This article discusses the implementation of the policy on dengue treatment through gene drive based on Wolbachia bacteria in Indonesia, focusing on regulatory aspects, field tests, and community acceptance of the technology. This study used a qualitative approach with secondary data analysis from policy documents, field trial results, and interviews with stakeholders. The results showed that although field trials showed promising results in reducing the spread of DHF, the challenges faced were immature regulations and public concerns regarding environmental and health impacts. Therefore, a more integrated policy approach is needed, as well as better communication to increase public understanding and support for this innovation.

Abstract

The primary duty of a Notary is to create authentic deeds, and their role is particularly significant in the banking sector. For instance, in matters involving the heirs of bank customers, the preparation of an Inheritance Certificate is necessary for the disbursement of savings funds, even in cases where a false Death Certificate is presented. The purpose of this study is to investigate the legal protection available to Notaries when preparing inheritance certificates for savings disbursement based on falsified documents. A Normative Juridical Method is employed, utilizing normative legal research with a legislative and case-based approach. The findings indicate that when drafting an inheritance certificate for savings disbursement based on a fraudulent death certificate, the Notary must diligently verify the authenticity of the heirs, scrutinize the death certificate, and examine relevant documents such as identity cards, family cards, and the credentials of individuals authorized to sign the inheritance certificate. Additionally, the Notary must corroborate these details with witness statements to ensure accuracy. To address challenges in such cases, it is crucial for the Notary to exercise utmost caution. This diligence helps prevent errors whether intentional or unintentional that could invalidate the authentic deed due to inaccuracies or misrepresentation of facts. Ultimately, the Notary bears responsibility for any inaccuracies in the document they produce.

Abstract

This study examines the legal aspects of mystery box sales transactions in e-commerce, which raise legal challenges, particularly regarding the validity of contract objects and consumer protection. The object of mystery boxes is often unknown to consumers, potentially leading to breach of contract. Under civil law, this may violate Articles 1320 and 1238 of the Civil Code. According to Law No. 8 of 1999 on Consumer Protection, the lack of clarity in mystery box contents may violate the consumer's right to accurate information and cause harm. This study emphasizes the importance of regulation and consumer education to ensure fair and lawful transactions.

Abstract

The making of authentic deeds by a notary is part of the legal service that has the highest evidentiary value in the Indonesian civil law system. One of the formal requirements of an authentic deed according to Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary (UUJN) is the presence of two witnesses who know and directly witness the process of signing the deed. In notarial practice, notary staff are often appointed as witnesses for reasons of administrative convenience, trust, and availability of time. This study aims to examine the legal position and role of notary staff as witnesses in authentic deeds and the form of legal protection available if the deed is legally disputed. The research method used is normative legal with a statutory and conceptual approach, supported by literature studies and analysis of related court decisions. The results of the study indicate that notary staff are legally valid as witnesses as long as they meet the requirements as competent witnesses according to law. However, if a dispute arises over the deed, the staff can be asked for information as a witness in court and has the potential to face legal pressure. Therefore, legal protection for notary staff includes the principle of good faith, legal protection for witnesses, the right to legal assistance, and the ethical responsibility of notaries as employers. In conclusion, there needs to be more explicit regulations regarding the role of staff in deeds and clear protection mechanisms to maintain professionalism, integrity, and legal certainty in notarial practice.
