Abstract

Pada Putusan Nomor 295/Pdt.G/2018/PN.Mdn dan Putusan Nomor 159/Pdt.G/2019/PN.Bdg, yang mana pada kedua putusan tersebut Penggugat mengajukan gugatan untuk kedua kalinya. Namun, terdapat inkonsistensi hakim dalam memutuskan gugatan nebis in idem pada perkara perceraian yang pada akhirnya menimbulkan ketidakpastian hukum. Penelitian ini membahas mengenai pengaturan dan alasan perceraian dalam UU Perkawinan serta penerapan asas nebis in idem pada perkara gugatan cerai yang sudah berkekuatan hukum tetap dan diajukan kembali dihubungkan dengan kepastian hukum. Metode yang digunakan dalam penelitian ini berupa pendekatan yuridis normatif, yang mana objek dari penelitian ini akan diteliti dan dianalisis dengan mengedepankan norma serta asas yang terdapat dalam hukum positif berupa data sekunder dan dilengkapi data primer. Hasil dari penelitian ini yaitu pada putusan yang menjadi objek penelitian telah memenuhi alasan perceraian yang sesuai dengan hukum positif dan terdapat inkonsistensi dalam penerapan asas nebis in idem pada putusan tersebut, yang mana Majelis Hakim pada Putusan Nomor 295/Pdt.G/2018/PN.Mdn tidak mengabulkan gugatan yang diajukan untuk kedua kalinya karena mengandung unsur nebis in idem berdasarkan Pasal 1917 KUHPerdata dan SEMA Nomor 3 Tahun 2002, sedangkan Majelis Hakim pada Putusan Nomor 159/Pdt.G/2019/PN.Bdg mengabulkan gugatan yang diajukan untuk kedua kalinya yang berdasarkan Yurisprudensi Mahkamah Agung RI Nomor 110/K/KG/1992 tanggal 23 Juli 1993 yang dijadikan pula sebagai rujukan dalam Rapat Kerja Nasional Mahkamah Agung RI Tahun 2007.

Abstract

Globalization has impacted many aspects of human life. It accelerates trade transactions between producers and consumers. Despite of numerous advantageous it brings, globalization also has a potential to cause various disadvantageous and loss to the consumers that ultimately lead to consumer disputes. In general, consumer disputes involve small amount of loss and complaint filed by the consumers for material compensation. In Indonesia, consumer dispute resolution is carried out not only by the Consumer Dispute Settlement Body (BPSK) but also through the courts. Recently, there are many newly-established consumer dispute settlement institutions. This article is part of a completed study discussing a plurality of consumer dispute settlement in Indonesia and a comparative analysis with the one available in Singapore. The study applies normative juridical research method and qualitative juridical analysis, it can be concluded that the plurality of consumer dispute settlement in Indonesia has led to convoluted mechanisms and procedures in settling disputes. This leads to a lack of legal certainty. The comparative law study being the instrument of this study is a critical instrument in the framework of legal reformation. Result shows that in Singapore, consumer disputes are resolved by a Small Claims Procedure method on State Court and through CASE as a private nonlitigation agency with specific consumer characteristics and disputes.

Abstract

Based on various collected court decisions, this research aims to highlight the fact that there is a disparity in the view of courts in deciding bankruptcy and debt payment suspension petitions against state-owned enterprises (Persero) by creditors. In addition, this research also explores the original intent of the legislator in Article 2 paragraph (5) juncto Article 223 of Law Nomor 37 of 2004 regarding Bankruptcy and Debt Payment Suspension so that it can be used as an academic reference in breaking the chain of debate because of interpretation differences in judicial practice. The discussion of problems in this research is based on a normative juridical approach, in which the materials and data collected are based on primary and secondary sources. Although the theme raised in this research has been presented in various studies, this research is still based on novelties. This research uses historical interpretation to explore the original intent of the Indonesian Bankruptcy Law legislator. The spotlight on disparities in court views is based on numerous court decisions, so it is sufficient to be used as a basis for the conclusion that disparities exist in practice. Based on historical interpretation according to minutes of the law formation, the legislator's original intent was to limit the bankruptcy and debt payment suspension petitions to state-owned enterprises (Perum), which the finance minister can only submit. Therefore, this provision does not apply to state-owned enterprises (Persero), so the petition against it does not have to be submitted by the finance minister. Meanwhile, there is a disparity in the court's view of judicial practice. Hence, a specific law is needed to reaffirm which party has the authority to submit the petition to a Persero to end the disparity.
