Abstract

ABSTRAKDalam penulisan skripsi ini penulis membahas mengenai masalah Tinjauan Atas Kebijakan Pemerintah Kota Malang Dalam Pelepasan Tanah Negara Kepada Orang Yang Menguasai. Hal ini dilatarbelakangi dengan semakin meningkatnya jumlah penduduk kota malang namun ketersediaan tanah sebagai tempat tinggal semakin menipis. Mengingat hal tersebut, masyarakatpun mulai memanfaatkan tanah-tanah kosong milik pemerintah yang sudah lama tidak didayagunakan. Hal ini sudah berlangsung lama dan terus-menerus, sehingga timbul perasaan khawatir dari masyarakat jika sewaktu-waktu tanah yang didayagunakan oleh masyarakat tersebut akan digunakan dan diambil kembali oleh pemerintah. Oleh karena itu, sejak jaman orde baru banyak sekali masyarakat Kota Malang yang melakukan permohonan pelepasan aset tanah negara. Namun, sejak berlakunya Undang-Undang Nomor 1 Tahun 2004 tentang Perbendaharaan Negara, kebijakan tersebut tidak lagi berjalan dengan optimal, mengingat pelepasan aset untuk saat ini memerlukan persetujuan DPRD Kota Malang.Kata Kunci : Kebijakan Pemerintah, Tanah Negara.

Abstract

The economic independence of the community through Micro, Small, and Medium Enterprises (UMKM) is an important priority that supports social economy. Especially during a crisis and pandemic COVID19, UMKM are one of the business actors who are still able to survive when economic activity declines. However, in this great potential, UMKM actors in the mangrove ecosystem in the Mahakam delta area have weaknesses in legal understanding as evidenced by the incomplete licensing requirements, and also do not have an understanding of the urgency and procedures for making contracts and other legal aspects. Therefore, training is needed to increase the legal capacity of UMKM actors. The method used is a training involving UMKM business actors in three stages; UMKM mapping; provide material on opportunities and challenges for UMKM in mangrove ecosystems and legal knowledge for UMKM; preparation of strategic plans for UMKM for mangrove ecosystems. The results of this activity indicate an increase in the legal understanding of UMKM actors and a strategic plan for strengthening UMKM in the mangrove ecosystem in the Delta Mahakam area has been formulated. Abstract

Football has developed in such a way as to become an industry involving many actors and a huge economic turnover. Along with the development of the football industry, the legal relationship of the actors outlined in the contract is increasingly complex. The purpose of this paper is to describe the contractual complexities faced by professional football clubs in Indonesia. Using doctrinal research methods supported by a participatory approach, an understanding was obtained that each Liga 1 Indonesia football club at least interacts with 7 (seven) types of contracts where each contract has a different format, substance, and choice of law. Therefore, every professional football club in Indonesia is required to be able to adapt to the development of the global football industry, especially for legal consultants in each club must improve their knowledge and ability to draft contracts in order to protect the interests of the club. Keywords: Football industry; Contract; Football club, Choice of law Sepak bola telah berkembang sedemikian rupa menjadi sebuah industri dengan melibatkan banyak aktor dan perputaran ekonomi yang sangat besar. Seiring dengan perkembangan industri sepak bola, hubungan hukum para aktor yang dituangkan dalam kontrak semakin kompleks. Tujuan penulisan ini adalah untuk mendeskripsikan kompleksitas kontrak yang dihadapi klub sepak bola profesional di Indonesia. Menggunakan metode penelitian doktrinal ditunjang dengan pendekatan partisipatoris diperoleh pemahaman bahwa setiap klub sepak bola Liga 1 Indonesia setidaknya berinteraksi dengan 7 (tujuh) jenis kontrak dimana masing-masing kontrak memiliki format, substansi, dan pilihan hukum yang berbeda-beda. Oleh karena itu, bagi setiap klub sepak bola profesional di Indonesia dituntut untuk mampu beradaptasi dengan perkembangan industri sepak bola global, terutama bagi para konsultan hukum di setiap klub harus meningkatkan pengetahuan dan kemampuan dalam menyusun kontrak dalam rangka melindungi kepentingan klub.kata kunci: Industri sepak bola; Kontrak; Klub sepak bola, pilihan hukum

Abstract

ABSTRACT To prevent and overcome domestic violence, a comprehensive approach is needed that involves various aspects, such as law enforcement, public education, psychological support, and cultural considerations. The problem of partners in this community service activity is the lack of public knowledge about domestic violence and how to handle it. Public education aims to increase public awareness of individual rights, the negative impacts of domestic violence, and the stages of handling it. The method of legal counselling / public Education to partners in this community service activity uses lectures, discussions, questions and answers. Partners participate in this activity by providing time and place and presenting their members as participants in legal counseling to raise public awareness of the dangers of domestic violence. The many questions about the cases experienced indicate an increase in awareness to involve law enforcement, which is a positive step toward overcoming domestic violence. With this legal counseling, a safer family environment is hoped to be created. The community needs a more comprehensive and sustainable support system. Abstract

The decision to build a new capital on the Kalimantan Island called Nusantara caused various conflicts, such as the neglect and marginalization of indigenous peoples and the ignoring of their certainty of access and meaningful participation. This paper explains how the substance of the Nusantara Capital development regulation is to provide full protection to Indigenous peoples or vice versa, how it impacts the protection of Indigenous people's rights, as well as how the affirmative action model fulfills the rights of Indigenous peoples in the Nusantara Capital area. Through a socio-legal approach as the method, the results of the study found that the constitution has regulated the recognition of indigenous peoples, but in the substance of regulations related to the Nusantara capital, the phrases that regulate are very weak. The phrases used do not explicitly ensure the protection of the rights of indigenous peoples, which has an impact on various neglect of the existence of indigenous peoples. As a result, a model of affirmative action is needed for indigenous peoples in the regulation of the Nusantara capital. This includes ensuring access for indigenous peoples to be involved in policymaking. Furthermore, transparency of information in the development of the Nusantara capital is important to formulate policies that accommodate the protection and fulfillment of the rights of indigenous peoples. It is important to ensure the recognition of indigenous peoples and their living space through an affirmative action model regulated by the head of the Nusantara capital authority.

Abstract

Pengetahuan dan keterampilan masyarakat Samarinda Ilir dalam hal pemanfaatan TOGA masih kurang dan terbatas dalam hal budidaya untuk konsumsi pribadi tanpa melihat nilai ekonominya sebagai suatu produk unggulan komersial yang berdaya jual tinggi. Pelaksanaan kegiatan Pengabdian kepada Masyarakat ini diharapkan menjadi solusi atas permasalahan yang dihadapi mitra di lapangan. Kegiatan Pengabdian kepada Masyarakat ini bertujuan untuk meningkatkan pengetahuan masyarakat terkait manfaat tanaman TOGA untuk kesehatan dan kesejahteraan. Pelaksanaan Kegiatan dengan metode penyuluhan kepada masyarakat. Lalu untuk menilai keberhasilan kegiatan akan diberikan lembar pretest dan postetst. Hasil pelaksanana kegiatan menunjukkan nilai pretest yaitu  71,56 dan nilai posttest yaitu 87,73. Pada uji statistik dengan uji pair t test diketahui nilai p value adalah < 0,05. Hal ini menunjukkan terjadi peningkatan pengetahuan masyarakat yang signifikan. Berdasarkan hasil kegiatan Pengabdian Masyarakat yang telah dilakukan dapat disimpulkan bahwa masyarakat memahami dan mengetahui serta terdapat peningkatan pengetahuan masyarakat mengenai manfaat dan khasiat tanaman obat yang ditanam di Kebun TOGA atau pekarangan rumah Masyarakat

Abstract

This research aims to unravel the consequences of the acceptance of the concept of Indonesia as an archipelagic state, because the increasing size of Indonesian waters triggers the responsibility of the state to ensure that its territorial waters are free from the threat of maritime challenges, disturbances and obstacles (ATGH). State institutions in Indonesia's territorial waters are currently multisectoral, which has led to widespread problems and negative impacts, because Indonesia's maritime security and safety institutions are not well organized. If left unchecked, Indonesia will not only be unable to play a role and contribute much to maintaining global maritime security and safety. It will also bury its dream of becoming the world's maritime axis. The three main issues in this research are how is the regulation of security and safety of marine areas in terms of international law of the sea? What is the urgency of structuring maritime security and safety institutions in Indonesia? What political policies can the government take to organize maritime security and safety institutions in Indonesia? The type of research used to answer these issues is a normative juridical research method with 2 (two) approaches, namely a statutory approach, and a conceptual approach. This research concludes that, first, the consequence of Indonesia's status as an archipelagic state gives Indonesia the authority to regulate its territorial waters in accordance with the provisions of UNCLOS 1982. Second, there are 3 (three) main reasons for the need for structuring Indonesia's maritime security and safety institutions. Starting from philosophical, sociological and political reasons. Third, the political policy that needs to be taken in order to organize Indonesia's maritime security and safety institutions is to form an Omnibus law on the Law on Marine Security and Safety or the Law on the Marine Security Agency.

Abstract

Land is a basic human right, including for women. As a living space, land occupies a strategic position in the fulfillment of human rights. Constitutionally, women's equal rights to land are guaranteed by law, but in reality, it is neglected and lacks recognition and protection, especially in the natural resource extraction area. Economics that rely on mining extraction have the consequence of widespread ecological and environmental crises that affect people's lives, including vulnerable groups of women. The gender inequality in tenure, ownership, access and control over land has many impacts on women's lives. This research focuses on the law guarantees the recognition and protection of women's human rights to land, and the reality of recognition and protection of women's human rights to land in mining areas. The research findings show that ideally the law provides recognition of equal rights between women and men in access, control, and ownership of land. However, mining regulations provide more convenience for mining business actors, not ensuring protection for the community, especially women. In addition, the male paradigm as the head of the family has led to the marginalization of women in decision-making related to their land and living space. In the midst of conflicts in mining areas, efforts to assert rights and struggle for women's basic rights to land often receive discriminatory treatment and gender bias. The ecological crisis situation is a problem for the protection of women's human rights to land in mining extraction areas.

Abstract

Background: The surge in migration to Europe, particularly to Italy, has prompted bilateral cooperation with Albania through the Italy-Albania Protocol on Extraterritorial Migration and Asylum Management. This protocol aims to reduce Italy’s burden by transferring the asylum status determination process to facilities in Albania. Meanwhile, Indonesia faces challenges related to Rohingya refugees fleeing persecution in Myanmar, making it a transit country for those seeking protection. This study aims to analyze the legality of the Italy-Albania Protocol in the context of fulfilling the human rights of asylum seekers and explore the application of the concept of externalization of asylum control from the protocol in Indonesia to address the Rohingya issue. The method used is doctrinal research with a legislative and comparative approach, as well as an analysis of international legal instruments such as the Universal Declaration of Human Rights and the 1951 Refugee Convention. The results of the study indicate that the substance of the articles in the Italian-Albanian protocol does not explicitly violate human rights and is in line with international principles. The externalization of asylum control is recognized as a global strategy to reduce migration pressure. However, Indonesia faces limitations in facilities, human rights violations, and the lack of ratification of the 1951 Refugee Convention, while Presidential Regulation No. 125 of 2016 has not been optimal in guaranteeing the rights of asylum seekers. Therefore, international cooperation and ASEAN synergy are essential for responsibility-sharing, improving facilities, and public education to support humanitarian principles and compliance with international law.

Abstract

This research is based on the increase in trafficking cases in the city of Samarinda involving children as victims. Restitution is one of the rights that must be obtained by child victims of sexual violence. Meanwhile, in reality, out of the 20 cases that occurred in the city of Samarinda, there was not a single case that applied Restisui. legal protection for children victims of trafficking in Samarinda still needs a lot of improvement, especially in terms of the implementation of restitution. This study aims to identify and analyze obstacles in the implementation of restitution for children of trafficking victims in Samarinda City. From this case, the problem was formulated, namely, how to implement restitution for child victims of trafficking in the city of Samarinda, and what are the obstacles faced in the implementation of restitution for child victims of trafficking in the city of Samarinda. This research is of the Socio Legal type which was carried out using the statue approach and the case approach. The results of this study reveal that the implementation of restitution for child victims of trafficking in Samarinda City is still far from optimal. Although Law No. 21 of 2007 concerning the Eradication of Trafficking has regulated the right of restitution for victims, as well as the lack of clarity in procedures and the lack of standards in determining the amount of restitution are factors that hinder the implementation of restitution.
