Abstract

Sebagian besar masyarakat umum mengenal hak kekayaan intelektual (HKI) berupa hak cipta dan paten. Namun, perlindungan Hak Kekayaan Intelektual juga dapat diberikan pada produk seni budaya tradisional tidak hanya untuk inovasi saja. Guru seni (budaya) merupakan key actor yang terlibat secara langsung dalam memberikan pengajaran, melestarikan, dan mempraktekkan seni budaya. Namun, para guru seperti halnya masyarakat pada umumnya tidak mengetahui bahwa perlindungan Hak Kekayaan Intelektual berkaitan dengan profesi mereka sebagai guru seni. Oleh karena itu, diseminasi Hak Kekayaan Intelektual khususnya berkenaan dengan seni budaya san-gat diperlukan. Sehingga terlaksananya tujuan untuk menyebarluaskan pengetahuan mengenai Hak Kekayaan Intelektual bagi guru seni se-Provinsi Lampung sebagai sasaran kegiatan.

Abstract

Penelitian ini bertujuan untuk memberikan pengetahuan dan pemahaman kepada seniman tari di asosiasi seni mengenai perlindungan hukum terhadap karya cipta dalam rezim hak kekayaan intelektual, serta karya cipta yang dikategorikan sebagai kekayaan intelektual personal dan komunal juga nilai moral dan ekonomis yang muncul dari karya cipta tersebut. Mitra merupakan para seniman tari baru yang masih belum memahami bagaimana perlindungan terhadap karya cipta. Batasan seperti apa yang diperbolehkan atau tidak sebuah karya cipta tersebut diakui sebagai karya cipta intelektual personal maupun komunal. Metode yang digunakan adalah ceramah (penyampaian materi) dan pendampingan dalam mengklasifikasi karya cipta yang bisa diakui dan mendapatkan hak cipta serta menyusun syarat administratif yang harus dipenuhi dalam mengurus dokumen hak cipta. Berdasarkan hal tersebut maka pengabdian dilakukan oleh beberapa orang yang berasal dari berbagai bidang ilmu seperti hukum, pendidikan tari dan ilmu komputer. Mitra adalah “Asosiasi Seni Nuwo Koneng Production”. Asosiasi seni ini merupakan kelompok-kelompok sanggar tari, pencipta tari, penari, pencipta musik dan pemusik yang berada di Bandar Lampung. Berdiri sejak tahun 2019 dan beralamat di Bandar Lampung. Para pekerja seni yang terdiri dari pemusik dan penari yang tergabung dalam asosiasi ini berjumlah 20 sanggar yang terbagi kedalam beberapa kelompok.

Abstract

Protection of communal intellectual property rights is very important in Indonesia. Because communal intellectual property rights are not based on a "first serve" basis, where the first registrant or innovator is the first to acquire intellectual property. However, this method, because it is not always known when or who invented the concept or created a work for the first time. This research uses empirical normative method by examining regulations and field observations. There are 5 (five) regrets that this Communal Intellectual Property needs to be protected, namely in the context of realizing justice, protection (conservation), preservation (preservation), notification from other unauthorized parties who can carry out piracy (biopiracy) and the use of traditional culture. . The concept of protection of communal intellectual property rights with two models of protection that can be provided through defensive protection and positive protection. Defensive legal protection protection is to prevent other parties from taking over intellectual property rights as well as positive protection that is manifested in the form of legislation.

Abstract

Traditional clothing is one of the essential identities in Southeast Asian countries, knowns as ASEAN members; it was once used to showcase individual status in the community. It is still important today and worn on particular occasions to preserve tradition, and now it's emerged as one of the commercial goods. Yet, it becomes a vulnerable commodity when it becomes the object of cultural piracy, dispute of ownership, and disagreement of origin. The problem will continue to be detrimental to indigenous peoples who own it and possibly rift the relationship between ASEAN countries. The protection of traditional clothing in ASEAN is still weak, and there has been no specific legal instrument to regulate it. The intellectual property right (IPR) regime protects traditional clothing as a traditional cultural expression (TCE). TCE protection is part of the international regulation of intellectual property; however, without it well-implemented at the domestic level, TCE can easily be claimed as belonging to other parties who first published and registered them. This research will examine the legal protection of traditional clothes under IPR regimes in ASEAN in their national legal regulations. This research uses a comparative approach that primarily examines the laws and regulations governing the protection of Intellectual Property Rights in ASEAN countries. This research indicates that no single country in ASEAN has a specific law related to traditional cultural expressions (TCE) protection on traditional clothes. The protection for traditional clothes will be embedded in other IPR regimes such as Copyright, trademark, or non-IPR legislation.

Abstract

Indonesian Migrant Workers (PMI) are the country's largest foreign exchange earner. Often dubbed as foreign exchange heroes, it does not make them free from problems while working abroad. Often PMIs are victims of violence and other crimes, especially illegal PMIs. PMI's lack of understanding of the law is one of the factors causing the high number of legal cases experienced by PMI. The form of protection for Indonesian citizens who are abroad should be socialized to PMI Candidates. Kenshusei are basically apprentices stationed in Japan, one of the fields that sends kenshusei a lot is fisheries. For this reason, this activity aims to provide insight to PMIs regarding the rights and obligations as well as protection related to the Rogatory System. The Rogatory System is run by the Ministry of Foreign Affairs and the Supreme Court. The target of this service is PMI/PMI candidates to be able to understand the Rogatory System as a means of protection for PMIs working abroad. The methods used in this service are counseling and focus group discussions (FGD).

Abstract

Indonesia does not have a specific legislation that regulates traditional culture (Traditional Cultural Expression) issues until right now. Lampung Province has a TCE heritage in the form of tapis, which if not maintained properly will be vulnerable to recognition by other countries that take advantage of its existence. Currently, regulations in Indonesia regulate cloth’s Protection in the copyright regime. However, the copyright regime has limitations in protecting it, for example, the limited time of protection provided. In addition, Tapis handicrafts have Intellectual Property Rights (IPR) potential, not only in copyright protected motifs but also other IPR potentials such as original materials and crafts that can be protected by Geographical Indications. So this can maintain the existence as well as the work of art and culture itself. In this study, the method used is the empirical normative legal method that examines and interviews the cloth weaver group through historical and historical approaches. Protection for Tapis Lampung can be achieved using two means, namely preventive legal protection, by implementing an integrated cultural data collection system that carries out cultural recording and documentation efforts with the aim of preventing claims of intellectual property rights protection against culture. In repressive legal protection, rules are made that can provide a legal basis for parties who will take action against outside parties who are considered to have taken or recognized the rights to cultural property in a clear and systematic manner.

Abstract

The Radio Frequency Spectrum is a limited Natural Resource, which in terms of its management has a strategic and economic impact on the community. These limitations require the government to make quite strict regulations in the utilization of these resources. Indonesia is one of the countries that uses frequency as the consumption of daily life. This is illustrated using communication tools for the telephone network. To avoid using license frequencies, Indonesia must adjust without national and international frequency rules, considering that Indonesia is already a member of the ITU. This situation has been realized through Law no. 24 of 2015 concerning the Table of Allocation of the Indonesian Radio Frequency Spectrum, which states that the frequency allocation in Indonesia refers to the ITU-Radio Regulations. Indonesia is currently in a state of urgency for cyber security or cyber security because of the level of cybercrime or cybercrime in Indonesia. Policy handling cybercrime is different from other crime prevention. However, unlike other crime prevention, cybersecurity requires a comprehensive thought to deal with it. Therefore, the study found two problems: (1) What are the provisions for the use of frequencies in Indonesia, (2) What are the provisions regarding the existence of cyberwarfare, and (3) How are the impacts of cyberwarfare on the frequencies of Indonesian cellular operators based on international information technology law?.

Abstract

Dalam era globalisasi, kerja sama antar negara dan antar warga negara dalam bidang bisnis, pendidikan, maupun diplomasi, dan kepentingan untuk menjalin hubungan yang baik dengan negara-negara lain semakin menjadi prioritas. Namun, dalam menjalin kerja sama tersebut, hal-hal administratif seperti legalisasi dokumen publik asing menjadi salah satu kendala yang sering dihadapi. Proses yang rumit dan biaya yang tinggi menjadi hambatan bagi banyak orang untuk mendapatkan pengesahan dokumen publik yang diperlukan untuk berbagai keperluan. Belum lagi, dokumen publik yang telah dilegalisasi oleh lembaga atau kementerian di Indonesia tidak secara otomatis dapat diterima di negara yang dituju. Seperti akta notaris, surat kuasa, dan dokumen-dokumen lainnya harus dilegalisasi terlebih dahulu sebelum dapat diakui oleh negara tujuan. Hal ini membuat banyak orang merasa kesulitan dalam menggunakan dokumen publik di luar negeri. Untuk mengatasi permasalahan tersebut, Indonesia mengaksesi Konvensi Apostille, dengan demikian proses legalisasi dokumen asing publik di Indonesia menjadi lebih mudah, cepat, dan efisien. Notaris sebagai pejabat publik memiliki peran penting dalam proses legalisasi dokumen tersebut, baik dalam memberikan legalisasi dokumen asing publik yang diperlukan, maupun dalam pengesahan tanda tangan atau legalisir pada dokumen-dokumen yang diterbitkan oleh pihak asing.. Dalam kenotariatan, Kehadiran Konvensi Apostille diharapkan memudahkan akses bagi warga negara Indonesia untuk menggunakan dokumen publik di luar negeri dan notaris dapat memberikan legalisasi dengan menyertakan Apostille pada dokumen publik yang diterbitkan oleh notaris. Keanggotaan Indonesia di dalam Konvensi Apostille memiliki urgensi yang sangat penting untuk mempercepat proses administratif dalam hubungan antarnegara dan antarwarga negara dan membantu dalam mempercepat proses administratif dalam hubungan antarnegara dan antarwarga negara serta meningkatkan kemudahan dalam melakukan kegiatan bisnis dan administrasi di luar negeri.

Abstract

Geographical Indications (GIs) are collective intellectual property rights that protect place names or designations used to identify goods with unique qualities, properties, or reputations from specific geographic areas. GIs were adapted from the provisions of the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement, which provides national and international legal protection to registered GI products. GIs are particularly important for developing countries like Indonesia, as they help maintain the authenticity of local products, often known by other regions, especially agricultural products. However, conflicts between trademark regulations and GIs have hindered the growth of GIs in Indonesia. In response to this issue, the Indonesian government enacted Law No. 20 of 2016 on Trademark and Geographical Indications, granting GIs equal status to trademarks. Despite this, it has become evident through discussions with relevant agencies that the Trademark Law and GIs are not widely known by the community, including the Family Welfare Movement Organization (PKK) in Tanggamus Regency. Ironically, Tanggamus, one of the regencies in Lampung Province, holds GI certification for its Robusta coffee. The PKK, with its strategic role, can play a vital part in disseminating information about GIs to the community, including remote villages where coffee farmers reside. Therefore, this community service program aims to provide information about GI regulations to PKK members, hoping that they will help reach a wider audience in Tanggamus Regency.
