Abstract

The World Bank has launched a maritime economic-environmental strategy referred to as the blue economy. This strategic initiative places a strong emphasis on sustainability in marine economic endeavors, aiming to generate both economic and social benefits while protecting the lasting integrity of marine ecosystems amidst the challenges of climate change. The core objective of the blue economy is to notably improve human welfare and social equity while simultaneously reducing environmental risks and ecological scarcities. The relevance of the blue economy concept is especially pronounced in countries with extensive water bodies, such as Indonesia. As an archipelagic state, Indonesia holds significant promise for the development and utilization of marine resources. Leveraging this economic potential holds the potential to create new job opportunities, enhance food security, and support the sustainability of global marine ecosystems. In this regard, adopting a blue economy strategy emerges as a compelling approach to achieve these objectives, especially given that a significant portion of Indonesia's population relies on traditional fishing for their livelihoods. The upcoming research aims to explore two fundamental aspects: firstly, the regulatory framework of the blue economy in relation to climate change, adhering to international legal standards; and secondly, the practical implementation of the blue economy in addressing climate change challenges specific to Indonesia. This research employs a normative research methodology, characterized by a problem-solving approach structured across a series of defined stages.

Abstract

There are 3 (three) conditions that must be met in order to become an heir as regulated in Article 171 letter c of the Compilation of Islamic Law (KHI) namely that an heir is a person who at the time of death, he was related by blood or marriage to the testator, was a Muslim and was not prevented by law from becoming an heir. As in case number 0554/Pdt.P/2023/Pa .Sby. In this decision the Panel of Judges granted the applicant's request and determined the applicant to be a mandatory testator. This research method is  normative legal research, conceptual approach and case approach. The result states that the judge granted the Petitioner to be the Legal Heir as a Testament Wajibah even though he had a different religion from the Muslim heir due to consideration of justice. Judges are not mouthpieces of the law, so for the sake of 'justice' judges carry out legal inroads (contra legem) into the provisions contained in the Compilation of Islam.

Abstract

This study examines the delicate balance between the principle of non-refoulement and national security in protecting refugee rights, focusing on Australia’s approach to handling refugees. Non-refoulement, a fundamental principle of international refugee law, prohibits the forced return of individuals to countries where they may face persecution. However, ensuring national security while upholding refugee rights poses challenges, particularly in the face of global migration crises and security concerns. Through a case study of Australia’s refugee policies and practices, this research explores the complexities of navigating between these principles, considering legal frameworks, policy implications, humanitarian considerations, and the impact on refugee lives. The findings contribute to understanding the intricate dynamics of balancing humanitarian obligations with national security imperatives in refugee protection efforts. The findings of this research suggest that no balancing act can be justified by international law. Turn-back measures cannot be used to balance Australia’s international obligations to protect refugees. This will lead to violations of the human rights of asylum seekers who will be returned. The act of turning back is hazardous and has the potential to bring threats and persecution to asylum seekers who are returned to their country of arrival, country of origin, or third countries.

Abstract

This study aims to determine the extent of state protection towards rape victims in the litigation process under existing laws. However, the phenomenon of gender bias by the surrounding society and law enforcers mostly leads to victim-blaming, which prevents them from reporting the case. Moreover, the study argues that it is necessary to provide a victim's companion at the trial, particularly in the victim-witness examination process, to support them contribute detailed information in a comfortable and secure condition. This study uses a normative-empirical legal approach with primary and secondary data sources. The study discusses the extent of rape victims' protection and the need for companion in litigation process. The results showed that the State had made its efforts to protect women of rape victims by enforcing a sequence of laws beyond the Criminal Code such as Law No. 11 of 2012 concerning the Juvenile Criminal Justice System and Supreme Court Regulation No. 3 of 2017 concerning Guidelines in Adjudicating Women's Cases Against the Law. However, these efforts are deemed insufficient to provide proper protection for rape victims, as evidenced by the significant development of rape cases due to legal enforces' insensibility dealing with women as victims in the litigation process.

Abstract

The Third World Approach to International Law (TWAIL) emerges as a critical perspective on the current international legal system, providing a robust framework to aid Indonesia in safeguarding its communal intellectual property rights. This research seeks to emphasize the urgency of adopting TWAIL and elucidates how its application can play a pivotal role in advancing both economic prosperity and social identity in Indonesia. Positioned within a normative juridical framework, this study delves into the TWAIL perspective and its relevance to the protection of Communal Intellectual Property Rights (CIPR). It demonstrates how embracing the TWAIL approach for communal intellectual property rights can establish a legal framework that is more just, inclusive, and respectful of the rights of indigenous communities. By securing strong legal protections at both international and national levels, communities gain the ability to manage their traditional knowledge for commercial use, identifying potential global markets. Consequently, this approach fosters improvement and underscores the potential positive impacts on economic development, particularly in expanding markets and accessing goods.

Abstract

Salah satu bentuk perlindungan terhadap hak asasi manusia (HAM) yang menjadi tanggung jawab negara adalah perlindungan terhadap pembela hak asasi manusia (Pembela HAM). Namun, gerakan yang kritis dan sering kali tidak sejalan dengan pemerintah membuat pembela HAM terancam, salah satu kasusnya terjadi pada 13 aktivis yang dihilangkan secara paksa pada tahun 1998. Oleh karena itu, penelitian ini akan berfokus pada permasalahan pengaturan perlindungan pembela HAM menurut hukum internasional dan hukum nasional Indonesia, serta tanggung jawab negara dalama memberikan kepastian hukum terhadap 13 aktivis yang dihilangkan secara paksa pada tahun 1998. Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan perundang-undangan. Hasil penelitian menunjukan bahwa, Pertama, hukum internasional maupun hukum nasional Indonesia mengakui dan mengatur secara jelas perlindungan terhadap pembela HAM. Kedua, berdasarkan pengaturan yang ada maka negara bertanggung jawab untuk melindungi pembela HAM termasuk 13 aktivis dari tindakan penghilangan paksa dengan mencari dan menemukan para korban tersebut termasuk mengadili dan menghukum pelaku yang bertanggung jawab

Abstract

The objective of this study is to expound on the discourse surrounding the categorization of intellectual property rights (IPR) under public and private international law, which has been a topic of contention among legal experts. Through an in-depth analysis of the IPR debate, including public and private case examples, and the contrast between traditional and communal IPR, this study intends to explore Indonesia's perspective towards IPR and communal rights. Indonesia acknowledges communal rights within IPR and has implemented various legal and policy instruments to safeguard them. It is envisaged that the research findings will advance the ongoing discourse on the classification of IPR under public or private international law, and enhance the comprehension of the legal framework governing IPR in Indonesia. This study will also bring into focus the recognition and protection of communal rights in IPR, which is a crucial subject in modern international law.

Abstract

Courts that accommodate dispute resolution are still not optimal in implementing fair decisions for the parties. Not only has it not created justice, but it has not been able to resolve the dispute quickly. In the end, there was a backlog of cases, so the simple, fast, low-cost justice principle was difficult to realize. Alternative Dispute Resolution is one of the efforts that can be implemented to assist the court in reducing the number of cases piling up, one of which is in the form of negotiations as regulated in Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. In principle, negotiations are concerned with implementing the Principle of Deliberation and Consensus as implied in the Preamble to the 1945 Constitution as stipulated in the Alternative Dispute Resolution Act. The problematic legal issues in its implementation are compiled in this article, analyzing the weaknesses of Negotiation as an Alternative for Resolving Business Law Disputes in Indonesia as well as the context for the Implementation of Pancasila Values. The type of research used is normative juridical with descriptive research type. The results that will be discussed explain the technical weaknesses of Alternative Dispute Resolution through Negotiations, which are generally linked to business law events in Indonesia in applying Pancasila values, especially the values of Humanity and Deliberation to Consensus. This writing concludes that Alternative Dispute Resolution must continue to be pursued in resolving disputes and in minimizing the weaknesses of the process, including opinions are submitted systematically, politely, and creatively, looking for common ground wisely, viewing the other party as family to create a family atmosphere, and accommodating Pancasila values as a guide to implementing written law.

Abstract

Pentingnya dalam pemberdayaan ekonomi di wilayah operasional desa menjadikan Pemerintah Provinsi Lampung membentuk salah satu visi dan misi yakni Membangun kekuatan ekonomi masyarakat berbasis pertanian dan wilayah pedesaan yang seimbang dengan wilayah perkotaan. Untuk itu, diperlukannya kemandirian dari pihak desa itu sendiri bertujuan guna mendorong tata kelola baik itu segi pembangunan maupun pertumbuhan ekonomi pada desa terkhusus Desa Bandar Sakti. Tujuan dari kegiatan PKM Unggulan ini adalah untuk meningkatkan pemahaman masyarakat Desa Bandar Sakti terkait hak yang dimiliki masyarakat terhadap pendirian BUMDes sesuai tupoksi dan tugasnya berdasarkan regulasi hukum nasional, serta mengedukasi pemahaman tentang pengelolaan BUMDes kepada masyarakat. Abstract

This article discusses the role of legal governance in marriage as a means of supporting the achievement of the Sustainable Development Goals (SDGs) in the field of family life. SDGs aim to realize sustainable development, including aspects of quality, healthy, and prosperous family life. It contains targets that are directly related to the protection of human rights, gender equality, and improving family welfare. Legal governance in marriage, such as regulations regarding the rights and obligations of married couples, prevention of domestic violence, and child protection, plays an important role in realizing this. The method used in this study is a normative method with a statutory regulatory approach and literature analysis related to family law and SDGs. The results of the analysis show that effective legal governance in the context of marriage can contribute positively to the achievement of SDGs goals, especially in improving the quality of family life, reducing poverty, and creating gender equality. With good legal governance, the state can provide comprehensive and sustainable legal protection for families, which ultimately supports the achievement of SDGs in the field of family life.
