Abstract

Kasus Itar-Tass Russian Agency melawan Russian Kurier Agency yang berkaitan dengan hak cipta, perkara ini dimulai ketika warga negara Rusia menggandakan dan menyebarluaskan karya sastra warga negara Amerika Serikat, penggandaan ini dilakukan di Inggris dan disebarluaskan di Cina. Dalam Perkara ini terdapat 4 negara, yaitu Rusia (negara pelaku pelanggaran), Amerika Serikat (orang yang hak ciptanya dilanggar), Inggris (tempat terjadinya pelanggaran) serta Cina (tempat penyebarluasan). Apabila warga negara Amerika hendak menuntut ganti rugi kepada warga negara Rusia yang telah melakukan pelanggaran terhadap hak ciptanya, maka kemanakah tuntutan tersebut harus diajukan, Hukum apakah yang akan digunakan oleh hakim dalam menyelesaikan sengketa ini, merupakan permasalahan yang hendak ditemukan jawabnya. Berdasarkan kajian teoretis ditemukan jawaban bahwa peradilan yang berhak menangani perkara ini adalah peradilan Amerika Serikat. Sedangkan untuk menentukan hukum yang digunakan menyelesaikan perkara tersebut, hakim menggunakan kualifikasi bertahap, pada tahap pertama hakim Lex Fori mengunakan hukum atas dasar; karya cipta dalam sengketa adalah hasil karya dari warga Negara Rusia, Karya cipta ini pertama kali dipublikasikan di Rusia dan County of Origin-nya adalah Rusia, setelah hakim Lex Fori memutuskan bahwa hukum Rusia yang di gunakan makan hakim melakukan kulifikasi tahap kedua, pada tahap ini hakim melihat bahwa berdasarkan ketentuan perundang-undangan Rusia perkara ini masuk dalam klasifikasi berdasarkan kepemilikan, dan hukum Rusia menunjuk hukum yang belaku bagi kepemilikan adalah hukum pemilik.artinya, hukum Amerikalah yang berwenang untuk itu.Kata kunci : Pelanggaran Hak Cipta, internet dan perdata internasional.

Abstract

The covid-19 case has spread to almost all countries in the world causing harm, so some countries want to hold China accountable as the country suspected of being the origin of the virus. This research aims to know, understand, and analyze the regulatory responsibilities of countries in international law and whether or not the country of origin of the covid-19 outbreak is held accountable for a global covid-19 pandemic. This research is normative legal research with a statutory approach. The results of this study explain that there are characteristics that must be met to hold China accountable for the covid-19 case, but it is not easy for China to be held accountable for this covid-19 case.Kasus covid-19 telah menyebar di hampir semua negara di dunia yang menyebabkan kerugian, sehingga beberapa negara ingin meminta pertanggungjawaban kepada Tiongkok selaku negara yang diduga menjadi asal virus tersebut. Penelitian ini bertujuan untuk mengetahui, memahami dan menganalisis pengaturan tanggung jawab negara dalam hukum internasional dan dapat atau tidak negara asal wabah covid-19 dimintai pertanggungjawaban terhadap suatu pandemi covid-19 yang meluas secara global. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan. Hasil penelitian ini menjelaskan bahwa terdapat karakteristik yang harus dipenuhi untuk meminta pertanggungjawaban kepada Tiongkok atas kasus covid-19, tetapi sangat jelas tidak mudah untuk Tiongkok dimintai pertanggungjawaban atas kasus covid-19 ini.

Abstract

The corporation’s obligation to human rights is not a moral but a legal obligation. Although in international law, the regulation regarding this corporate obligation is at the level of the Resolution (UN Framework Protect, Respect and Remedy on Business and Human Rights/General Assembly Resolution) and not a convention which is one of the sources of law known in international law. Because many countries follow this provision, it can be categorized as a source of customary international law, which is also a source of international law. However, this paper will not discuss the UN resolution on Human Rights and Business in the sources of international law, but rather how the state implements the resolution and respects or follows the corporation. In September 2014, Indonesia launched the draft National Action Plan (NAP) for Business and Human Rights. Until now, the NAP has not been legalized. However, the Indonesian government has made a policy to ensure that business actors (corporations) respect human rights in running their businesses. In 2021, through the Ministry of Law and Human Rights, the Indonesian government launched an application called PRISMA (Business Risk Assessment and Human Rights). This application aims to help corporations analyze the possibility of violating human rights when they carry out their business activities. This article aims to study and analyze whether the application of PRISMA from a due diligence principal point of view can be an effective tool to measure state duty to protect and corporate compliance with human rights.

Abstract

The cases of IUU Fishing often occurred in Indonesia. This is due to the lack of supervision by the Indonesian government towards foreign vessels that are still fishing in Indonesian territorial and EEZ.  IUU fishing caused huge losses to the country. One of the perpetrators of this illegal act was the Thai Silver Sea 2 ship. The ship entered Indonesian territorial waters precisely in Sabang waters, by flying the Indonesian flag to trick the Indonesian government patrolling around Sabang waters. However, gradually the Indonesian government became aware of the existence of foreign vessels which had been suspected by Indonesia for a long time because it often turned off VMS so that its existence could not be detected by the Indonesian government. This study will examine more deeply related to whether the action conducted by Silver Sea 2 Vessels violate Indonesian regulation and UNCLOS 1982? And is the legal enforcement of Illegal Unreported and Unregulated Fishing taken by Indonesian government compatible with UNCLOS 1982?. This research is a normative legal research with a statute approach, and a conceptual approach. Legal material collection techniques are carried out by examining the relevant literature, analyzing various legal references relevant to the problem related to the study to be analyzed further qualitatively and descriptively. The results showed that the actions of SS2 ships violated Indonesian legislation and UNCLOS 1982 and were appropriate when this case was handled by the Sabang district court.

Abstract

One of the perpetrators engaged in this illegal act was the Thai Silver Sea 2 ship. The ship entered Indonesian territorial waters specifically in Sabang waters, by flying the Indonesian flag to trick the Indonesian government patrolling around the area. However, gradually the Indonesian government became aware of the existence of foreign vessels which had been suspected by Indonesia for a long time because it often turned off VMS so that its existence could not be detected by the Indonesian government. This study delves deeper into whether the actions conducted by Silver Sea 2 Vessels violate Indonesian regulations and UNCLOS 1982. Additionally, it examines the compatibility of the Indonesian government’s legal enforcement of IUU Fishing with UNCLOS 1982. The results indicate that the actions of SS2 ships violated Indonesian legislation and UNCLOS 1982. Furthermore, the handling of this case by the Sabang District Court was deemed appropriate.

Abstract

Salah satu bentuk perlindungan terhadap hak asasi manusia (HAM) yang menjadi tanggung jawab negara adalah perlindungan terhadap pembela hak asasi manusia (Pembela HAM). Namun, gerakan yang kritis dan sering kali tidak sejalan dengan pemerintah membuat pembela HAM terancam, salah satu kasusnya terjadi pada 13 aktivis yang dihilangkan secara paksa pada tahun 1998. Oleh karena itu, penelitian ini akan berfokus pada permasalahan pengaturan perlindungan pembela HAM menurut hukum internasional dan hukum nasional Indonesia, serta tanggung jawab negara dalama memberikan kepastian hukum terhadap 13 aktivis yang dihilangkan secara paksa pada tahun 1998. Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan perundang-undangan. Hasil penelitian menunjukan bahwa, Pertama, hukum internasional maupun hukum nasional Indonesia mengakui dan mengatur secara jelas perlindungan terhadap pembela HAM. Kedua, berdasarkan pengaturan yang ada maka negara bertanggung jawab untuk melindungi pembela HAM termasuk 13 aktivis dari tindakan penghilangan paksa dengan mencari dan menemukan para korban tersebut termasuk mengadili dan menghukum pelaku yang bertanggung jawab

Abstract

The existence of international sexual crimes in international court jurisprudence and the international law instruments have evolve as an extensive crime from the abundance crime of outrages upon personal dignity, yet still have to front some challenges to attain triumph in its enforcement. This article aims to observe the sexual crimes as international crime in some aspect, namely, its development and the contribution of feminism, the challenges on the law enforcement against international criminal law and the position of feminism in addressing those challenges. In every stage of sexual crimes evolution as international crimes, feminism hold important contribution. Their impact made up in building international community opinion, sounding and criticizing, and engage in making court decisions through judges with a feminism paradigm. The success in ICTY and ICTR landmark decision and the determination of extensive sexual crimes in Rome Statue, renounce some obstacle which might eliminated by feminism ideas and movement. Once again through pressures and criticisms, awareness of sexual crimes shall increase so that come the incriminating in the completion of sexual crimes cases before international court. The role of feminism is also vital through the presence of prosecutors and judges with a feminism paradigm so that, as before, landmark decisions as produced in the ICTY and ICTR can be issued at the ICC.

Abstract

Lampung Province has a Traditional Cultural Expressions (TCE) heritage in the form of cloth “Tapis"; if it is not appropriately maintained, it will be vulnerable to being recognized by other countries that can take advantage of its existence. Currently, Indonesia regulates cloth protection in the copyright regime. However, the copyright regime has limitations in protecting it, for example, the limited time of protection provided. In addition, Tapis has Intellectual Property Rights (IPR) potential, not only in copyright-protected motifs but also in original materials and crafts that Geographical Indications can protect. So it can maintain the existence and the work of art and culture itself. In addition, the community can get economic benefits and cultural developments in Indonesia as a developing country. Based on the background above, this research will analyze the development of IPR and the construction initiative to protect Tapis Lampung. In this study, the empirical normative legal method examines and interviews the cloth weaver group through historical approaches. The data used are from laws, regulations, and interviews. Protection for Tapis Lampung can be achieved by using two measures: preventive legal protection by implementing an integrated cultural data collection system that carries out cultural recording and documentation efforts to prevent claims of intellectual property rights protection against culture. Furthermore, in repressive legal protection, rules can provide a legal basis for parties who will take action against outside parties that are considered to have taken or recognized the rights to cultural property clearly and systematically.

Abstract

Restorative Justice (RJ) has increasingly been institutionalized within Indonesia’s criminal justice system, including in cases of domestic violence (Kekerasan Dalam Rumah Tangga / KDRT). However, its implementation continues to generate serious criticism because it often prioritizes procedural settlement over substantive victim protection. Existing studies largely focus on the effectiveness or normative legality of RJ, while insufficiently addressing the intersection between gender justice, victim vulnerability, and contextual Islamic legal principles. This study fills that gap by reconstructing a gender-responsive RJ framework grounded in contextual Islamic law and maqāṣid al-syarī‘ah. This research employs a normative-empirical socio-legal approach that integrates doctrinal legal analysis with qualitative empirical findings from domestic violence cases in Lampung Province, Indonesia. Data were collected through analysis of legislation, institutional policies, Komnas Perempuan reports, and in-depth interviews with law enforcement officials and related stakeholders. The data were analyzed using a gender-responsive restorative justice framework and contextual Islamic legal interpretation. The findings reveal that the current implementation of RJ in KDRT cases remains predominantly procedural-formalistic. Approximately 72% of victims accepted restorative settlements due to structural pressures, including economic dependence, family coercion, and fear of social stigma, rather than genuine psychological recovery. Furthermore, the absence of mandatory trauma assessment and post-settlement supervision contributed to repeated violence in 40% of the observed cases. This study argues that prevailing interpretations of iṣlāḥ (reconciliation) have been reduced to symbolic peace-making that neglects substantive justice and victim safety. As its principal contribution, this study formulates a three-stage gender-responsive RJ reconstruction model based on contextual Islamic law: (1) a precondition stage requiring psychological assessment and perpetrator accountability; (2) a mediation stage involving gender-sensitive counselors and progressive Islamic law experts; and (3) a post-process stage based on continuous state monitoring and victim protection. The study further demonstrates that integrating contextual Islamic legal values into national law strengthens restorative justice by aligning it with the principles of ḥifẓ al-nafs (protection of life), human dignity (karāmah insāniyyah), and substantive gender justice. This research contributes theoretically to the development of gender-responsive restorative justice discourse within Muslim-majority legal systems and offers a practical policy framework for reforming restorative justice mechanisms in Indonesia and other plural legal societies
