Abstract

The existence of contract furtherly sharia economic contract can’t avoid from dispute’s risk. According of Act Number 3 of 2006 about Islamic Court, legal dispute resolution of sharia economic dispute is being Islamic Court’s authority. One of Islamic Court in Indonesia is Malang City Islamic Court which is must obey the principle of simple justice, quick, and low cost including SEMA Number 3 of 2014. From the beginning of observation, Malang City Islamic Court disobeying the principle of simple justice, quick, and low cost which implemented in SEMA Number 3 of 2014. The focus of this research is (1) what is the concept of the principle of simple justice, quick, and low cost in Indonesian’s act? And (2) what is legal view of the principle of simple justice, quick, and low cost about sharia economic verdict at Malang City Islamic Court in 2019? This research using library research and statue approach, also using legal material in the form of primary legal material, secondary legal material, and tertiary legal material for the example books, journals, acts, legal dictionary, etc. And then all of those legal material will be adjusted within the object of this research. The result of this research is the concept of the principle of simple justice, quick, and low cost can called principle is just because fulfill the meaning of legal principle and the function of legal principle. The principle of simple justice, quick, and low cost have been implemented in various judicial procedural law at Indonesia. Sharia economic verdict at Malang City Islamic Court in 2019 from legal view still can’t obey the principle of simple justice, quick, and low cost and also SEMA number 2 of 2014.

Abstract

The aim of this service is to improve the economic level of the Cement Village community through product photo training and online marketing. The method used is participatory action research (PAR), which actively involves the community in every stage of its implementation. Based on the data collected, the development of MSMEs in Cement Village has not been stable due to the lack of adequate forums and support for MSME actors. Therefore, the training provided covers various important aspects, such as creating logos, product photos, business identity numbers (NIB), halal certification, and online marketing. The results of the questionnaire show that online marketing and product photos are the topics most interesting to MSMEs. After attending training, MSME players succeeded in having a logo and product photo, which is the first step before proceeding to online marketing. The media used in online marketing training are popular platforms such as Facebook, Instagram, and WA Business. With this program, it is hoped that the people of Cement Village can be more advanced in marketing their products effectively so that they can improve the local economy significantly.

Abstract

The article was written to understanding of the factor that influence muslims in Tulungagung registering worship hajj. Research in this article begins fidgetiness some muslim will be the waiting list worship hajj. Income the people in Tulungagung relatively increased every year, and activity religion relatively high greatly effect some muslims to registering wohship hajj. Coupled with the ease of facility credit for worship hajj for the poor. This all lead to decision making, especially nasabah credit to register worship hajj. The result reveals that the factor influenced nasabah decided to departure are credit worship hajj is and religiousity.

Abstract

This article aims to examine the transformation of fatwas of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) regarding brokerage services in the perspective of living fatwa. The main issue raised is the weak binding power of religious fatwas in the realm of positive law, which often causes fatwas to be ignored in the public policy-making process. However, DSN-MUI fatwas related to brokerage services have proven to make a significant contribution in inspiring the formation of legal norms contained in legislation in the banking sector and financial transactions in Indonesia. Therefore, the focus of this article is directed at the study of fatwas on brokerage services as a representation of normative-religious norms in banking practices and financial transactions. Thus, it complements other studies on living fatwas. This article examines how fatwas on brokerage services have been transformed into a living norm in the Indonesian regulatory context, and identifies the main characteristics underlying this transformation. This research is a literature review with a living fatwa approach. The results show that the transformation of Islamic norms in the form of fatwas on brokerage services has a strategic role in influencing the birth of regulations that integrate sharia principles into the national legal system, especially in the field of transactions and finance. The laws and regulations governing brokerage services in Indonesia can be understood as a form of “institutionalization” of the norms previously formulated through the DSN-MUI fatwa. This article argues that these fatwas perform two main functions: first, as a reinforcement of state policy for the public good (ta'yidi); and second, as a normative source in the formulation and making of public policy (insya'i). Furthermore, DSN-MUI fatwas that have undergone transformation into the national legal system in a living perspective display characteristics that are implementative, visionary, scientific, and responsive to social dynamics (dynamic movement).

Abstract

Abstrak: Penelitian ini menitikberatkan pada kajian yang berkaitan dengan peran perempuan khususnya istri eks narapidana terorisme binaan Yayasan Lingkar Perdamaian Lamongan sehingga mereka dapat survive, bertahan hidup serta mampu menguatkan ekonomi keluarga meski dengan stereotip dan stigma negatif yang membatasi ruang geraknya di masyarakat. Relasi suami istri yang terbentuk menjadi faktor penting dalam penguatan keluarga karena tantangan yang dihadapi jauh berbeda seperti tekanan sosial dan ekonomi. Dengan menggunakan pendekatan kualitatif, penelitian ini mengambil data melalui teknik wawancara mendalam, observasi dan dokumentasi kemudian dianalisis menggunakan teori gender dan ketahanan ekonomi. Hasil penelitian ini antara lain: Pertama, relasi keluarga yang terbangun mengalami pergeseran, artinya meskipun konstruksi patriarki melalui paradigma religius masih mengakar namun karena tuntutan agar kondisi ekonomi keluarga menjadi stabil, maka relasi tersebut lebih terbuka dengan keikutsertaan perempuan berkecimpung dalam ranah publik. Kedua, eksistensi jaringan terorisme ternyata tidak hanya karena faktor ideologi dan konsepsi mengenai negara-bangsa-agama, tetapi juga faktor ekonomi keluarga. Di bawah Yayasan Lingkar Perdamaian, para istri dan keluarga eks narapidana terorisme mendapatkan beberapa program penguatan seperti bidang pendidikan, psikologi keluarga, sosial dan ekonomi sehingga dapat mendukung program deradikalisasi dan rehabilitasi bagi mereka yang pernah terinfiltrasi jaringan terorisme. Kata Kunci: Penguatan Ekonomi, Radikalisme, Istri Eks Narapidana Terorisme, Yayasan Lingkar Perdamaian Lamongan
