Abstract

Education is one of the most important instruments for forming character and personality. In higher education, especially Islamic law education, curricula serve not only as a means of transferring science but also as a medium for character and moral formation. The study examines the application of hidden curriculum in Islamic law education and its implications for students' character at State Islamic Religious Institute (IAIN)  Kendari. Research methods are qualitatively descriptive. Data is obtained through observations, interviews, and documentation. The collected data is processed through data reduction, presentation, and verification, with data validity testing using source triangulation, techniques, and time. The research results show the application of hidden curriculum in Islamic legal education is known through the interaction of faculty-students, Islamic law practice, observance of order and discipline, academic cultural awareness, and extracurricular activities. The values and norms that are indirectly taught in the educational environment have a considerable role in shaping the personality and character of students. The hidden implications of the curriculum for student character formation are manifested in student integrity and ethics, leadership and responsibility, empathy and justice, and the practice of the principles and values of Islamic law in everyday life. Therefore, institutions must integrate hidden curricula into Islamic law education to achieve comprehensive and sustainable educational goals.

Abstract

This study examines the dynamics of the Mombolosuako (elopement) tradition among the Tolaki ethnic group in Southeast Sulawesi, Indonesia, focusing on its practice in religiously diverse communities. This research specifically compares the implementation and acceptance of this tradition between the Muslim-majority Anggaberi District and Catholic-majority Puasana Village in Konawe Regency. Using a qualitative approach with a comparative case study design, data were collected through in-depth interviews with 16 key informants, field observations, and document analysis analyzed through Interpretative Phenomenological Analysis (IPA). The findings reveal that in Anggaberi, where Muslims and Tolaki are the majority, Mombolosuako is practiced as a non-normal marriage from cultural identity although some consider it contrary to Islamic teachings. This practice is supported by Regional Regulation No. 1 of 2018 concerning the Implementation of Sara Merapu Customary Law of the Tolaki Tribe. Conversely, in Puasana, where Muslims and Tolaki are minorities, this tradition is neither known nor practiced. This indicates that diversity can reduce the role of customs in social structures. This research emphasizes the importance of adaptive and contextual regulatory approaches in multicultural societies, so that customary policies can balance between preserving traditions and dynamic social needs. These findings provide insights for policymakers and academics in designing more inclusive customary policies and add to the literature on the interaction between customary law, religion, and formal regulations in plural societies.

Abstract

ABSTRAK Penelitian ini bertujuan mendeskripsikan implementasi Peraturan Daerah Nomor 17 tahun 2005 dan menganalisisnya dalam Perspektif Maqashid Syariah. Proses penelitian menggunakan metode deskriptif kualitatif yang sumber datanya diperoleh dari proses pengumpulan dokumen yang relevan terutama lembaran Peraturan Daerah Nomor 17 tahun 2005, Pengamatan langsung dan wawancara mendalam (depth interview) baik secara perseorangan maupun kelompok (FGD) dengan informan yang dipilih secara purposive.  Kesimpulan umum penelitian adalah Peraturan Daerah (PERDA) Nomor 17 Tahun 2005 Tentang Bebas Buta Aksara Al-Qur’an Pada Usia Sekolah dan bagi Masyarakat Islam Kota Kendari belum optimal diimpelentasikan. Dari Hasil penelitian ditemukan bahwa terdapat beberapa kelemahan dalam muatan materi Peraturan Daerah sehingga menimbulkan multi tafsir dalam penerapannya. Kenyataan di lapangan mengindisikasikan bahwa Program Bebas Buta Aksara Al-Qur’an sebagai wujud implementasi Peraturan Daerah yang diselenggarakan di sekolah-sekolah maupun pada masyarakat Islam diperhadapkan pada berbagai masalah. Hal ini disebabkan karena belum adanya indikator untuk mengukur keberhasilan pencapaian program, minimnya sosialisasi dan pengawasan serta belum adanya  transparansi anggaran program. Selanjutnya, dari hasil analisis perspektif maqashid syariah, Peraturan Daerah Nomor 17 Tahun 2005 sangat penting dan harus diterapkan karena pembelajaran baca tulis al-Qur’an sebagaimana kandungan materinya merupakan kunci mendasar dalam memahami dan menerapkan isi kandungan kitab suci al-Qur’an sebagai sumber dari segala sumber hukum Islam. Pembuat hukum (syar’i) dalam hal ini pemerintah dan DPRD kota Kendari serta pemangku kepentingan lainnya harus bekerjasama dan terlibat aktif agar Peraturan Daerah memberikan dampak bagi kemaslahatan umat manusia, khususnya umat muslim di Kota Kendari.
